The Council having received information that Henry Sckiles, who &ca., and Tho's Boyd, James Wilson, John Hastings & Cha's Caldwell, who, &ca., have not yet been taken, &ca. ; thereupon,


Ordered, That a reward of Two hundred Dollars be offered by Proclamation, for each & every of the said Henry Skeles, &ca.


The following being approved was ordered to be Published in due form :


" By the Supreme Executive Council of the Commonwealth of Pennsylvania:


"A PROCLAMATION:


"WHEREAS, A certain Benjamin Hammon was lately most cruelly & barbarously murdered, in the County of Chester, in this Commonwealth :


" And Whereas, an inquisition taken on the body of the said Benjamin Hammon, & by depositions taken before sundry Justices of the said Commonwealth, there is great reason to believe that a certain Henry Skyles, late of the County of Lancaster, in the said Commonwealth, Yeoman, did feloniously kill and murder the said Benjamin Hammon, & that Thomas Boyd, Jas Willson, John Hastings, -, and Charles Caldwell, of the said County of Lancaster, Yeomen, together with others who have surrendered themselves, were feloniously 'present, comforting, abetting & aid- ing the said Henry Skyles, to do & commit the said murder :


" And Whereas, it is at all times, but more especially in the present situation of our affairs, of the utmost consequence to the peace of the Commonwealth, that the perpetrators of such attrocious offences should be brought to condign & exemplary punishment, and the endeavours hitherto used for apprehending & securing the said offenders have proved ineffectual :


" We have therefore thought fit to issue this Proclamation, hereby offering & promising a Reward of Two hundred Dollars, to be paid out of the Public Treasury of this Commonwealth, to such person

or persons who shall apprehend the said Henry Skyles, & deliver him into the Custody of the Keeper of the Goal of either of the Counties of Lancaster, Berks or York, in this Commonwealth; And also, hereby offering & promising a like reward of Two hundred Dollars, for each & every of them the said Thomas Boyd, James Wilson, John Hastings, , & Charles Caldwell, to be paid as aforesaid, to such person or persons who shall apprehend & secure them, or any of them, in either or any of the gaols aforesaid.


" And we do hereby strictly charge & command all Judges, Jus- tices, Sheriffs, Constables & other Officers, & all other the Citizens of this Commonwealth, to make diligent search & pursuit after the said Henry Skyles, Thomas Boyd, James Wilson, John Has-


tings, , & Charles Caldwell, & to use their utmost endeavours to apprehend & secure them, that they may be pro- ceeded against according to Law.

The Council taking into consideration the State of the Militia now in the Field,


Ordered, That the Seventh & Eighth Classes of the Militia of Cumberland, the first Class of Philadelphia County, be called into service immediately, & sent to Gen'l Lacy's Camp.


An order was drawn on the Treasurer in favor of Col. Clarke, for the Sum of Two thousand Pounds, to be charged to Capt. Tho. Dorsey, Paymaster of the Militia.


Mr. Adam Reigart informed the Council that he had begun to purchase Horses, agreeable to his orders, & desired to know where they were to be sent to for the present.,


Ordered, That Mr. Reigart be directed to apply to Mr. Ross, deputy Q'r M'r, for an apartment of the Continental stables in this Borough, & forage for the Horses which he shall procure ; And that Mr. Reigart appoint a Trusty person to take care of them.

Ordered, That Colo. Rob't Lollar be appointed Paymaster of the Militia of Philadelphia County.


An order was drawn on the Treasurer in favor of Colo. John Shields, for the Sum of Thirty five Pounds, for the Carriage of 72 Riffles from Shippensburgh to Westmorland.

The Hon'ble John Hambright, Esq'r, being now about to go into the County of Northumberland, & its being doubtful whether Mr. Wm. Gray & Mr. John Little, Commissioners for the pur- chasing of Provisions in that County, have been able or will be able to lay out any considerable Sum of the Four thousand Dollars sent to them for that purpose ; therefore,


Ordered, That the Hon'ble John Hambright, Esq'r, be requested to call on the said Will'm Gray & John Little, & enquired what they have done in said business ; & he is hereby authorized to receive from them, & each of them, what Monies may remain in their hands.


An order was drawn on the Treasurer in favor of Philip Mars- teller, Esq'r, for the Sum of Four thousand Pounds, for paying the Militia with, for which he is to account.


An order was drawn on the Treasurer in favor of Will'm C. Bradford, for the Sum of Three thousand Pounds, to be by him delivered to Will'm Crispin, Commissary of the State Fleet, and to be charged to the said William Crispin.

An order was drawn on the Treasurer in favor of James Young, Esq'r, Waggon Master of the State, for the Sum of Seven hundred & fifty Pounds, for which he is to account.


Mr. Young & Mr. Bailey, the Waggon Master of Lancaster County, having now represented to Council that the Pay of the Officers in the Waggon department is so low that they are not able to procure suitable persons to execute the law, & that many of those who have acted hitherto are under the necessity of resigning ; thereupon,


Ordered, That this Council will represent to the Hon'ble House of General Assembly the low Pay allowed to the Officers under the Waggon Law, & will use their influence with the House to induce them to make the same more adequate to the duty.


An order was drawn on the Treasurer in favor of Shriver, Sum- mers, & Lasky, for the Sum of Eight hundred & fourteen Pounds five Shillings & one Penny, for Provisions furnished to the Fleet, & charge the same to Will'm Crispin, Commissary of the Fleet.

For the Sum of Ninety-Seven Pounds & ten Shillings for the Carriage of 164 Riffles from this place to Bedford, to be charged to John Piper, Esq'r, Lieut. of the County of Bedford.


For the Sum of Eight Pounds fifteen Shillings & Six Pence, for his extra expences on thirteen days journey on Public Service by order of Council. And also,

An order was drawn on the Treasurer in favor of Mr. Adam Reigart, for the Sum of Two Thousand Pounds to purchase Horses with, agreeable to the request of the Committee of Congress at Camp, for which he is to account.

" A Letter from Tho's Hartley, Esq'r, Colonel of one of the Congress Regiments, to the Speaker, desiring leave to inlist for his Regiment within this State, & to be furnished with the bounty granted by this State for Recruits, & inclosing a resolve of Con- gress, that the men so inlisted should be considered as part of the quota of this State, was read, & it was thereupon


" Resolved, That the said Col. Hartley be permitted to enlist with- in this State, & that the men so by him recruited, be entitled to the bounty lately granted by this State for Soldiers inlisted for the Regiments of this State."


An order was drawn on the Treasurer in favor of Tho's Hartley, Esq'r, Colo. of the Congress Reg't, for the Sum of Five Thousand Dollars, for the Recruiting Service, for which he is to account.

M., has lately sent to Boston a Brigade of Waggons, which it is suspected were Public Waggons, drawing Public Forage, & that they have been employed in bring- , ing Merchandize from Boston on some private account ; whereupon,


Ordered, Tho's Silliman, Sam'l Rea, Esq'rs, of the County of Northampton, be required to Summons such persons as may be probably acquainted with the said transaction, & fully examine them on Oath concerning it, & to take the necessary measures for securing all persons which may be concerned in carrying on this or any other public fraud, and make Report of their proceedings here- in, as well to do justice to the United States as to the Character of Mr. Backhouse, if the report shall appear to have been without - foundation.

MINUTES OF THE


The Hon'ble House of General Assembly having entered into the three following Resolves :


" In General Assembly, April 1, 1778, A. M.


" WHEREAS, It is absolutely necessary that the quota of this State towards the Continental Army should be raised with the ut- most expedition, And that all means should be used for attaining that important end,


1. " Resolved, That the Sum of Sixteen Dollars, lately resolved by this House to be paid to the recruiting Officer for each Soldier he shall inlist, shall also be paid to any person within this State, who shall procure an able-bodied recruit to inlist in any regiment belong- ing to this State, which said Sum shall be paid to the said person by the Lieutenant or nearest Sub- Lieutenant of the County, upon his delivering the said Recruit to him, together with an attestation of such inlistment, under the hand & Seal of some Justice of the County.


2d. " Resolved, That it be recommended to the Supreme Execu- tive Council to call upon the Lieutenants & Sub-Lieutenants of the several Counties of this State, for fair & exact lists, distinguishing battalions & Companies, of all the Officers & Soldiers within this State, which shall be delivered in, on or before the first day of May next.


3d. " Resolved, That it be recommended to the said Supreme Executive Council, to endeavour to procure the most exact & accu- rate accounts of what will be the deficiency of the quota of this State on the said first day of May next ; and that thereupon, & as soon as the said deficiency shall be known, theCouncil will fix, ascer- tain & allot to each of the said battalions the quota, proportion, or- number of men required of it for completing the Troops of this State; and as soon as the said requisition and allotment are made known to the Commanding Officer of the Battalion, the Field Offi- cers thereof shall meet together & allot, fix & ascertain the number of men required of each Company of the said battalion , and the same being notified to the Commanding Officer of each Company, the Officers thereof shall procure by draught, lot, or any other means whatsoever, the number of Men required of the said Com- pany ; And the said men shall be delivered by the Commanding Officers of the Companies respectively, to the Lieutenant or nearest Sub-Lieutenant of the County, within ten days after such requisition made to the Company, who shall give a Certificate of their being received ; and the said Lieutenant or Sub-Lieutenant shall deliver the same men to the nearest recruiting Officer, who shall also give a Certificate of their receipt. And the said men so draughted or otherwise procured, shall serve as Soldiers in the Continental Army for the space of nine months, or during the Campaign, unless sooner discharged.

4th. " Resolved, That every Militia Man who shall voluntarily inlist himself without draughting or lot, in pursuance of these Re- solves, shall be exempted from all Taxes for one Year after his time of Service elapsed ;" Thereupon,


Ordered, 'That the Lieutenants of the several Counties be re- quired immediately to make the returns to this Council as ordered by the above 2nd Resolve, & that he take care to have them made on or before the said first day of May.


An order was drawn on the Treasurer, in favor of Colo. John Bird, for the Sum of One Thousand & five hundred Pounds, to be by him forwarded to Mr. James Ramsay, of Bedford County, to Purchase Horses, agreeable to the request of the Committee of Congress.


An order was drawn on the Treasurer in favor of Colo. Rob't Culbertson, of Cumberland County, for the Sum of Two Thousand Pounds, to purchase Horses with to mount the Cavalry, agreeable to the request of the Committee of Congress at Camp.


The Hon'ble House of Assembly having nominated Thomas Levis, Esq'r, to be a Sub-Lieutenant of the County of Chester,


Ordered, That he be commissioned accordingly.


An order was drawn on the Tresurer in favor of Stephen Coch- ran, Esq'r, for the Sum of Two thousand Pounds, to be by him paid to Mr. Sam'l Futhey, of the County of Chester, to purchase Horses with to mount the Cavalry, agreeable to the request of the Committee of Congress, lately at Camp.


The Hon'ble House of Assembly having appointed George Read- ing, Esq'r, to be a Sub-Lieutenant of the County of Westmorland, in the room and stead of James Pollock, who is superceeded be- cause he hath not taken the Oath of Allegiance to this State,


Ordered, That he be Commissioned accordingly.

" Resolved, That the Hon'ble Mr. Speaker, Colo. Knox, Doct. Gardner, Colo. Clark & Mr. McLene, be a Committee to confer with

the Council on the best means of reducing three Reg'ts belonging · to the quota of this State, & also to resolve & determine in conjunc- tion with Council, which Regiments and what officers shall be so reduced; & that they make report of their proceedings to this House, at their next Sitting."


The Hon'ble the Speaker of the House, Colo. King, Col. Clark, & Mr. McLene, of the Committee mentioned in the foregoing Re- solve of the Hon'ble House, & also the Hon'ble Joseph Reed, Esq'r, one of a Committee of Congress lately at Camp, attended in Council.


The present State of the Thirteen Battalions belonging to this Commonwealth, now being read before the Council & Gentlemen in conference & in the Continental Service, the circumstances at- tending them respectively, carefully attended to by them ; and after a full discussion of the difficulties arising from the various modes proposed for reducing the three Regiments, agreeable to the Reso- lution of Congress,


Ordered, That the 13th, 12th & 11th be joined with some other of the Regiments.


That as the State of the Second & third Battalions require con- siderable alterations to be made, the 13th Battalion be incorpora- ted with the Second, & that Colo. Walter Stewart take the Com- mand in the room of Colo. Becker.


That the Twelfth Battalion be incorporated with the third Bat -- talion.


That the Eleventh Battalion be incorporated with the tenth, be- ing the next youngest Battalion; and that Colo. Humphreys take the Command in the room of Colo. Nagle.


That the arrangement of the other Officers be submitted to the direction of the Committee of the Hon'ble Congress, lately sent to Camp, as they will be possessed of the best information whereon to found a judgment herein. At the same time, it is recommended to them to regard the date of Commissions where there is equal merit; but as the reason on which the rule adopted in such cases in older Countries is founded, does not fully extend to a service so new as that of the United States of America is, where there are de- ficiencies in the conduct of any Officer, and it appears to be for the interest of the Service to remove him & to advance others in con- sideration of merit, that the interest of the service be allowed its dne weight.

Colo. Broadhead attended the Council & represented the neces- sity of Bayonets in his Battalion, & the great difficulty of pro- curing workmen to make them ; On consideration,


Ordered, That if it shall happen to be the Tour of duty in the Militia, of any Workman which shall be employed in making Bayo- nets & Belts for Colonel Broadhead's Brigade, he shall continue in that employment, & be allowed Rations & Pay as if actually in the field, & that it be considered as a performance of his Tour of duty for such time as he shall be actually employed in making such Bayonets & Belts ; and that the Lieutenants & Sub-Lieutenants of the County are hereby directed to take care that this Resolve be faithfully executed, without abuses of any kind.


An order was drawn on the Treasurer in favor of Jacob S. Howell, for the Sum of Five Hundred Pounds, for which he is to account.

The Hon'ble Jacob Morgan, Esq'r, having resigned his Seat in Council; thereupon,


Ordered, That a Writ be issued to the Sheriff of the County of Berks, commanding him to hold an Election for chusing a Coun- cellor for the said County, agreeable to the Constitution, & make return thereof on or before Tuesday the 6th of May next.


A Letter from His Excell'y Gen'l Washington, inclosing one from Mrs. Mary Pemberton to him, requesting a Protection for one or more Waggons, & for the persons who may be employed to go with them to Winchester, to carry necessaries for the Prisoners. sent there from this State ; On consideration,
