An order was drawn on the Treasurer, in favor of Capt. James Carnahan, of the 13th Pennsylvania Reg't, for the Sum of Eighty- eight Dollars, to be charged to Colo. Walker Stewart.

The Council took into Consideration the great necessity of open- ing the Courts of Justice in this County.


Ordered, That a Commission be immediately issued, appointing Jonathan Bayard Smith, Esq'r, to be Prothonotary of the County of Philadelphia, and also a Commission appointing him to be one of the Justices of the Court of Common Pleas for the said County.


Capt. Montgomery attended the Council & informed that he had brought down from Trenton one of the Galleys, & asked to be in- formed whether she should be immediately repaired.


On consideration,


Ordered, Capt. Montgomery do apply to one of Mr. Ayres's, & have the necessary repairs done to the Armed Galley under his command.


On application,


An order was drawn on the Treasurer in favor of Capt. John Bankson, of the 2nd Pennsylvania Regiment, for the Sum of Four hundred & fifty Dollars, for the recruiting Service, for which sum he is to account.


The Rev'd Mr. Thomas Coombe, Jun'r, attended in Council, & informed that he declines to take the Oath of Allegiance to the State, and he now requests that he may be permitted to pass out of this State on his way to New York, there to take passage for Europe ; thereupon,


Ordered, That a Pass under the less Seal be granted to the Rev'd Thomas Coombe, jun'r, to leave this State.

Ordered, That a Copy of the deposition of Mr. Alexander Pat- terson be made out & sent to Congress.


A Letter from Samuel Hunter, Esq'r, of the 4th instant, also relating to the ravages of the Indians.


The Council took into consideration the return of an Election of Justices for Augusta Township, in the County of Northumberland, including the Town of Sunbury.


Ordered, That Thomond Ball, & David McKinney, & Wilton Atkinson, be appointed & Commissioned to be Justices of the Peace for the County of Northumberland.


Capt. Williams Alexander, of the 7th Pennsylvania Regiment, laid before the Council a sketch of his account in the Recruiting Service ; and thereupon,


An order was drawn on the Treasurer in favor of Capt. William Alexander, of the 7th Pennsylvania Regimn't, for the Sum of Five hundred & twenty Dollars, for the Recruiting Service, for which sum he is to account.


An order was drawn on the Treasurer in favor of William Pol- lord & Company, for the sum of Two thousand eight hundred and Thirty-seven Pounds & Ten Shillings, balance of an account for Spirits seized for the use of the State Fleet. The said sum to be charged to William Crispin, Commissary of the State Fleet ..

Ordered, That the Secretary write to the Commissioners ap- pointed under the Ordonance of the Council of Safety, to seize the personal Estate of Persons who have gone over to the Enemy, di- recting them to make complete returns to the Secretary's Office of all the effects seized by them, & an account of sales where they have been sold, & that this be done without delay.


The following orders were drawn on the Treasurer for the Re- cruiting Service, Vizt : In favor of Lieut. Miller, of the 7th Penn- sylvania Reg't, for the Sum of One hundred Dollars, to be charged to him ; and in favor of Lieut. Abraham Lewis, of the 4th Pennsyl- vania Reg't, for the sum of One hundred Dollars, to be charged to him.


Robert Mackey, a Mariner, represented to Council, that he had brought off from the Vigilant an armed Boat, which now in the Possession of the State Navy Board.


Ordered, That Major Benjamin Eyre, taking one other Judicious person to his assistance, do Value the said Boat & make return to this Council.


Mr. Blewer, Mr. Eyre & Commodore Hazlewood attended the Council, & informed that the Armed Boats belonging to the State are now afloat & getting ready for service.


Ordered, That the Convention Brig be fitted out as soon as possible, & go down into the Bay, and as many of the Armed Boats as can be manned, be also repaired with all expedition & put into service.

Ordered, That a representation of the situation of our distressed frontiers be now made to Congress, & their attention to the relief of them solicited & earnestly pressed for.

The following draught of a Circular letter was read in Council and agreed to, Vizt. :


" In Council, Philad'a, July 14th, 1778.


" Sir,


"The attack which has been made by the Indians and others, on the Frontiers of this State, having been laid before the Congress, and a consultation held between the Board of War and Council, they have agreed upon the following arrangements for defence, to wit :


" A detachment of Col. Hartley's Regiment to march from New Jersey to Easton, there to join Col. Kowatz, who has under his command a small number of horse. The remainder of Col. Hart- ley's Reg't, now in Philad'a, to march immediately to Sunbury and join the Two Companies lately raised at Wioming. Col. Broad- head's Regiment, now on their march to Pittsburgh, to be ordered to the Standing Stone, But it is necessary to add to these Conti-

nental troops a considerable body of Militia. Council have therefore determined to order to Sunbury three hundred Militia from the County of Northumberland, four hundred from the County of Lan- caster & one hundred and fifty from the County of Berks; to the Standing Stone, three hundred from the County of Cumberland, and two hundred from the County of York; to Easton, from the County of Northampton three hundred men, & from the County of Berks one hundred and fifty men.


"You are, therefore, to exert yourself to get into the field three hundred men of the militia of your county, and march them im- mediately to For this purpose you are to order out the first, second, third, & even fourth class, if it be necessary to make up this number-the men must be had. It is expected that there are guns sufficient in you hands to arm them. Ammuni- tion and provisions will be supplied to you by order of the Board of War.


"The arrival of a powerful fleet from France, having a considera- ble number of troops on board, with orders to act in conjunction with the Continental army, & now actually blocking up the British fleet in the harbor of New York, has induced the Congress to de- . termine to make a vigorous effort to destroy the whole British fleet now in that City, & there appears to be a reasonable ground to hope for success in the attempt. This determination makes it highly improper to detach any part of the main army for the defence of the frontiers. If the attempt to reduce the whole British force should be crowned with success, it will undoubtedly be attended with the most salutary effects in removing the Enemy from the frontiers, as it cannot be doubted but that they must see the im- possibility of their continuing, with any hope of success, their attack on us, when we shall be able to employ our whole force against them, and we are confident that the blow given by the In- dians will be severely revenged before the War with them is closed."


Council being now informed that Congress had issued an order on their Treasurer in favor of this State, for the sum of One Hun- dred Thousand Dollars, on account of the cloathing purchased by this State,


Ordered, That the Sum of One Hundred Thousand Dollars, lately ordered by Congress to be paid to this Council, or their Council be paid to David Rittenhouse, Esq'r, Treasurer of the State.

Ordered, That the Money in the hands of Sharp Delany, arising from the sale of Drugs put into his hands by the Council of Safety, be paid by him to David Rittenhouse, Esq'r, the State Treasurer.


Colo. Hartley having applied to Council for a further sum of Money, for the Recruiting service, & on his leaving the City, re- quested in Writing, that the order for the same be delivered to Capt. Stoddard ; thereupon,


An order was drawn on the Treasurer in favor of Capt. Benja- min Stoddard, for the Sum of Three Thousand Dollars, for the re- cruiting service, to be charged to Colo. Thomas Hartley.


An order was drawn on the Treasurer in favor of the Hon'ble John Hambright, Esq'r, for the Sum of five hundred Dollars, to be charged to his account.

"The board of Treasury having considered a Letter of the 5th inst., from George Bryan, Esq'r, Vice President of the State of Pennsylvania, to the Delegates of that State, referred to them by Congress,


" Resolved, That One hundred Thousand Dollars of the War- rant for Three hundred Thousand Dollars, issued the 12th day of February last, in favor of the Delegates of Pennsylvania, to be by them transmitted to the President of the said State, for the purchase of Flour, &ca, be applied for the purpose of Paying for the Cloath- ing mentioned in the Vice President's Letter aforesaid.

Ordered, That Mr. Robert Allison be directed to secure the plank, scantling, &ca., left by the Enemy on the lines & in the Redoubts, & remove them to places of Safety ; And that he pro- vide suitable materials for repairing the Court Room in the State House, & draw a plan of the necessary repairs.

Ordered, That the Secretary procure eighteen Windsor Chairs for the Council Room.


The Hon'ble Joseph Reed, Esq'r, returned by the Sheriff of the County of Philadelphia as having been duly elected Councellor for the said County, attended the Council & represented, That he is now one of a Committee of Congress for arranging the Army, which Committee has sat for several Months past, & have gone far into business, which appears to be of great importance, and that as

a considerable part of it has necessarily fallen on him, it will be improper for him at present to retire from the Committee, & there- fore, begs the Council may not consider him as inattentive to his duty to the Public, if he shall not attend the Council until the said arrangement is completed ; At the same time declaring his readi- ness to accept such Post as his County may think proper to call him to, for the service of the Public, as soon as it is in his power so to do.


It appearing that John Williams, of the Northern Liberty Town- ship, & Jacob Bright, of the City of Philadelphia, Merchant, two of the Commissioners for Taxes & Levies for the County of Phila- delphia, who should have continued in office, for want of a new choice in October last, have been made Prisoners by the British Army, lately possessed of the said City ; that the said John Wil- liams was carried away by the said Army; that the said Jacob Bright is now at his place of abode, but is considered as a Prisoner under Parole ; & that both of these Commissioners are disqualified from acting : Council considering that Isaac Snowden, the third Commissioner, cannot alone, in the present case, if in any, with the Assessors, (who also continue for want of an Election as aforesaid, ) nominate & fill up the vacancy caused as aforesaid, do thereupon, by virtue of the power vested in them by the Twentieth section of the Constitution, supply the vacancy caused by the disqualification of John Williams & Jacob Bright, as aforesaid, by appointing Ed- ward Bartholomew & William Antis of said County to the office . of Commissioners of the County of Philadelphia, until the said office can be filled in the time and manner directed by Law & the Constitution.


N. B. Edw'd Bartholomew & William Antis were highest in vote as Commissioners at the Election for chusing a Councellor for the County of Philadelphia.


Ordered, 'That the Bridge laid by the Navy board over the River Schuylkill at the middle ferry, be immediately repaired & removed to its place again, & that the bridge now there be removed to Gray's ferry.


Ordered, That Major Casdrop be appointed to superintend & direct the removal of the said bridge.

The Petition of the Hon'ble George Taylor, Esq'r, setting forth his claim to the lands & works known by the name of Durham fur- nace, & that the same had been seized by Mr. George Wall, one of the Agents appointed for seizing forfeited Estates, & put under the care of a certain James Morgan, was read. A notification signed by the said George Wall, & directed to Mr. Moses Yeaman, a Ten- ant under the said George Taylor, forbiding him to take & carry away any more Stamped metal from the said Furnace, & the writ- ten agreement signed by the said Joseph Galloway, under which he claims the possession of the said Furnace, were also read ; And the same being considered,


Ordered, That Mr. George Wall be directed to pay due respect to the written agreement between Joseph Galloway, Esq'r, & the Hon'ble George Taylor, Esq'r, for the lands & works known by the name of Durham furnace, & that he do not disturb Mr. Taylor in the peaceable possession & enjoyment thereof, agreeable to the terms of the said agreement. And as the said George Taylor has represented that he has a quantity of Wood cut, & ore raised, at a considerable expence, it appears to the Council to be just & equita- ble that he should have a Lease of the Premises for so long as the Council or their Agents are authorized by Law to let the same in preference to any other, on such reasonable terms as may appear to be just. The Council, therefore, recommend it to Mr. Wall to treat with the said George Taylor, relating to the Premises, & agree with him on equitable & reasonable terms ; Such lease not to ex- tend beyond the 1st day of April, 1780.

The Council taking into consideration the necessity of appoint- ing Wardens of the Port of Philadelphia,


Ordered, That Luke Morris, Esq'r, Samuel Mifflin, Esq'r, Sam'l Howell, Esq'r, Capt. Joseph Stiles, Capt. Will'm Heysham, Com- modore And'w Caldwell, Esq'r, & Capt. Nathaniel Falconer, be appointed Wardens of the Port of Philadelphia.


Council considering an application from Colo. Nicola, Town Ma- jor, to have the value of his retained Rations determined,


Ordered, that the retained Rations of Col. Nicola, as Town Ma- jor, be estimated at Two Shillings & Six Pence + Ration, accord- ing to the regulation of Rations ordered by Congress.


The Board of War having given an order on their Commissary General of Military Stores for a supply of Lead, Powder, & flints, to the order of Council.


Ordered, That the Ammunition for the Militia sent to Standing Stone, at the Rate of Thirty rounds Per Man, & half a Ton of Powder & a proportion of Lead, & a reasonable quantity of Flints, be delivered to Colo. John Carothers, Lieut. of the county of Cum- berland ; That the Ammunition for the Militia sent to Sunbury, & one-third of the Ton of Gunpowder & a proportion of Lead, with a proper number of flints, be delivered to Colo. Bartram Galbraith, Lieu. of the County of Lancaster; That the other Two-thirds of the said Ton of Gunpowder & proportion of Lead, be delivered to the Lieutenants of the Counties of Berks & Northampton, an equal quantity to each; That the Ammunition for the Militia order to Easton, be delivered to Colo. John Weitzel, Lieutenant of the County of Northampton.

The Council met.


PHILADELPHIA, Friday July 24, 1778. PRESENT :

Ordered, That two or three of the Barges or Guard Boats, pro- perly equipped & manned, be immediately sent into Delaware bay to watch the Cruisers of the Enemy, procure & transmit intelli- gence, & seize upon any of their Merchant Vessels which may be found there ; And that as many of the Gallys be furnished with Cannon, & fitted out as can be manned, sent down the River, & em- ployed in watching & guarding the same against the Enemy, or any disorderly persons disturbing the Navigation ; That the Galley rigged as a Brig be repaired & fitted out with all expedition, under the Command of a proper Officer, & employed in defending & pro- tecting the Navigation of Delaware Bay.
