Ordered, That the Secretary call on Will'm Sykes for the Secu- rity which he is ordered to give for his good behaviour.


Ordered, That the Sum of One Thousand Pounds be sent by Rob't Galbraith, Esq'r, to John Hubley, Esq'r, of Lancaster, to be by him forwarded to Bartram Galbraith, Esq'r, Lieut. of the County of Lancaster, for the purpose of purchasing Muskets, for which Sum he is to account.


An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of the Secretary, for the Sum of One Thousand Pounds, to be forwarded as aforesaid.

An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Will'm Henry, Esq'r, Lieut. of Philadelphia, for the Sum of One thousand pounds, for the purpose of paying Substitutes, & purchasing Blankets, &ca, for which Sum he is to account.


Gen'l Roberdeau informed the Council that Congress had or- dered the Virginia & South Carolina Troops now in the City, to march to Billingsport, to assist in completeing the works to be erected there ..

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of John Smith, for the Sum of Twelve Pounds, for riding express.

Ordered, That the following Proclamation be inserted in the several Newspapers of this City :


" By the Supreme Executive Council.


" A PROCLAMATION.


"' Whereas, great inconveniences hath happened to many persons in this State by the Continental Officers mistaking a recommenda- tion of the Hon'ble Congress, addressed to the several States, that they would permit Servants to be enlisted into the Continental Service, for an authoritative direction in the premises; And Where- as, many of the said Officers are also Officers in the Pay of this State, have thereupon proceeded to enlist bought Servants, under indenture, to the great damage of their masters.


." And Whereas, the Legislature of the Commonwealth having had opportunity of perceiving that such inlistments, though dis- tressing to the Masters, had not promoted the General Service to any proportionable degree, have declined giving their concurrence in said measure :


" And. Whereas, some persons, pretending ignorance, may still inlist Servants; these are therefore, strictly to forbid all Recruit- ing Officers in the Continental Service, and all others, from enlist- ing Servants or Apprentices within this State, on pain of being prosecuted with the utmost rigour of the Law.

for the Sum of Five hundred Pounds, for the purpose of Paying Substitutes & purchasing Blankets, &ca.


Caleb Davis, Esq'r, Prothonotary of the County of Chester, ap- peared, & took the Affirmation required by Law to Qualify him for that Office, and offered Thomas Cheney, Esq'r, as surety, with giv- ing One Thousand Five Pounds security ; And he having been ap- pointed Clerk of the Orphans' Court of the said County of Ches- ter, took the Affirmation required by the Constitution to Qualify him to act in the said Office.


Will'm Lyon, Esq'r, having informed the Council (by Letter) that Mr. Agnew, the late acting Prothonotary of the County of Cumberland, had refused to deliver up the Seals & papers belong- ing to the said Office, and requesting the direction of Council there- on,


Ordered, That the Secretary write to Mr. Lyon, & let him know the mode of obtaining the Seals & Papers belonging to said Office, as the Law directs, and that if Mr. Agnew persists, so as to make the interposition of Council necessary, on receiving attested Copies of the proceedings thereon, Council will take further order thereon.


The Committee for driving off Cattle for the City and County of Philadelphia having represented to the Board that they thought their number too few, & recommended that the City & County of Philad'a be divided into five Classes, & that the Gentlemen named in each Class be appointed to the said duty, Vizt :


First Class. For Oxford, Lower Dublin, Moreland, & Byberry Townships, which comprehends all between Frankford & Poques- ton Creeks ; Jacob Zible, Sam'l Potts, Rudolph Neff, James Dun- gan, Sam'l Neaswinger, John Keen, Sen'r, & Sam'l Swift, Sam'l Erwin, Casper Fetters, Will'm Tilyer, John Britain, and Benjamin Watson.


Second Class. This District includes from Frankford to the bounds of the City; Conrad Baker, John Stillwagon, John Hall, Isaac Coates, & Jacob Hill.


Third Class. For the City ; William Carson, Dean Timmons, Nathan'l Donnell, Andrew Carson.


Fourth Class. For Southwark, Moyamensing, and Passyunk ; Edw'd Tew, Rich'd Dennis, James Whitton, Henry Maag, Samuel Penrose, George Young, & Jacob Whitman.


Fifth Class. For Kinsess. & Blockley ; Philip Price, Adam Guyer, & Joshua Ash, jun'r.


On motion, agreed that the said plan be adopted, & the Gentle- men therein recommended for the respective Districts be appointed for the said purpose, and have full power to remove all kinds of live Stock, whenever the approach of the Enemy shall make it neces- sary so to do.

Gen'l Du Coudray laid before the Council a " definite project to correct the fort of Billingsport," with a plan of the Construction of it."i

Colo. Coxe informed the Council that he had, by direction of the Field Officers, applied to Mr. Butler for Tents for the Militia now at Billingsport, and was informed by Mr. Butler that he not sup- ply them.


The Council being informed that there is not any Money in the Treasury, nor likely to be any until Friday next, & as there is Money due Col. Proctor's Regiment, now under Marching orders, & the demand for other purposes being very considerable & pressing,


Agreed, That application be made to Congress for Sixty Thou- sand Dollars, to be accounted for to Congress.

Mr. Roberdeau, Mr. Morris, & Mr. Wilson, Delegates of this State, having attended in Congress, attending the Council, Gen'l du Coudray's " definite project to correct the fortifications at Bil- lingsport" was laid before them, & they were requested to lay it before Congress for consideration.

1 Agreed, That Col. Bull, Adjutant Gen'l of the Militia of this State, is requested to procure the number of Carts & the Timber and other materials which may be necessary for carrying on the fortifications at Billingsport.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Col. Will'm Coats, Lieut. of the County of Philadelphia, for the Sum of One thousand four hundred Pounds, for the purpose of paying the Militia, & for which Sum he is to account.


On motion, Agreed, That John Morris, jun'r, Esq'r, be & he is hereby authorized to appear in the City Court & prosecute in the name of the Commonwealth of Pennsylvania.


The Hon'ble Congress having ordered the Sum of Sixty Thousand Dollars, to be paid to the President & Council of this State,


Ordered, That the same be made Payable to Dav'd Rittenhouse, Esq'r, Treasurer, & it was indorsed by the Vice President accord- ingly.


As order was drawn in favor of John M. Nesbitt, Esq'r, (as the Treasurer,) for the Sum of Thirty thousand Dollars, of which Sum Twenty thousand is intended for the payment of Drafts by the Board of War, & Ten thousand Dollars for the Payment of the drafts of the Navy Board.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Col. Will'm Henry, Lieut. of the City of Philadelphia, · for the sum of Five hundred Pounds, for the purpose of Paying Substitutes, purchasing Blankets, &ca., for which Sum he is to ac- count.


The Council being informed by the Hon'ble Navy Board, that application has been made to them by the Hon'ble Continental Board of War for Two Fire Ships, to act in conjunction with a Fleet intended to be sent down the Cape May Channel, and the Navy Bord requested our advice and direction of therein,


On consideration that the Fire Ships were intended to annoy the Enemy in the narrow part of the River, & is considered as a res- pectable part of the defence of this City, the Council cannot con- sent to part with them but on the strongest assurance of others being immediately prepared to supply their place with all possible expedition.


The Council taking into consideration the probability of a de- mand of Waggons being made in the County of Northampton, there- upon,


Ordered, That where Waggons are necessary for the use of the Continental zrmy, that the Waggon master of the said County of Northampton,on application to him for that purpose, do furnish with all possib, expedition the number of Waggons which may be necessary, any irection which he may have received from this Council to the catrary in anywise notwithstanding.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, for the Sum of Seven Pounds, in favor of Henry Emhard, for riding express for and by order of Major Gen'l Armstrong.


Gen'l Potter having applied to Council for Boats to bring the Militia now at Chester from thence to Billingsport; thereupon,


Ordered, That the Navy Board be requested to supply Ger'l Potter with as many Boats as may be necessary for the purpose, when he shall demand them.


Gen'l Armstrong & Gen'l Potter attended the Council on the general situation of our Military affairs.


The Council taking into consideration the return of Jistices for the Township of Little Britain, & there appearing some objections to the appointment of one of the Gentlemen returned,


Ordered That Tuesday the 12th day of August next, be ap- pointed for the hearing of the parties, at Ten O'Clock in the fore- noon, in this Chamber, and that notice thereof be given to the In- spector & Judges who made the return.


An order was drawn on Dav'd Rittenhouse, Esq'r, Trasurer, in favor of Edw'd Stroud, for the Sum of Ten Pounds, forriding Ex- press.


Agreed, That Capt. Downy be ordered up from Bilingsport.

The Council being informed that Mr. Thomas Barclay had im- ported a small Cargo of Salt in Tom's River, in New Jersey, & that Mr. Barclay had been offered Ten Dollars # Bushel for it, at which price he is willing to sell it to the Council for the use of the People of this State,


On motion, agreed, That the Secretary be ordered to purchase the said Cargo. of Salt at the said price, on condition that it remain at the risque of the present Owner for eight days from this time.


An order was drawn on David Rittenhouse, Esq'r, Treasurer, in favor of John M. Nesbitt, Esq'r, for the Sum of Three thousand Pounds, for which Mr. Nesbitt is to account.

John Thompson, Esq'r, Sheriff of the County of Bucks, made return of an Election for the choosing a Councellor for the said County, by which it appears that Joseph Hart, Esq'r, was duly elected Councellor for the said County of Bucks; And Jos. Hart, Esq'r, attended, took the Oath required by the Constitution to Qualify him to act as Councellor, and thereupon took his seat in Council.


Ordered, That Mr. Benjamin Davis be requested to assist Capt. Downy in Surveying the Ground near the River Delaware, as far downward as they may find practicable and advantageous.


Joseph Reed, Esq'r, attended the Council & gave (in writing) bis reasons for declining to accept the office of Chief Justice.

The Petition of Catherine Murphy & Mary Green, setting forth, That at the City Court holden the Twenty-third instant, they were sentenced to receive fifteen lashes a piece, on Saturday next, at the Public Whipping Post, on a Conviction for two several felonies, and praying for their reasons therein mentioned, that the Council will free them from the Punishment that is ordered to be imposed on them, & the Judges of the said Court having recommended the Petitioners to the Clemency of the Council; thereupon,


Ordered, That Catherine Murphy & Mary Green be pardoned, so far as relates to the inflicting of the Corporal Punishment ordered by the City Court.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of John M. Nesbitt, Esq'r, for the Sum of Ten thousand Dollars, (intended to be subject to the draft of the Board of War.)


The Board of War having informed the Council that the last De- tachment of Col. Proctor's Regiment was to march this day, in consequence of which Fort Island would be left without a Guard; thereupon,


Ordered, That Gen. Potter be requested to send a proper guard to take care of the Artillery Stores, &ca., on the said Island.


The Council taking into consideration a letter from Gen'l Washington, dated 9th instant, requesting that a survey may be made of such parts of the River Delaware, & land adjacent, as may be of Military use, in case the enemy should bend their force this way; And thereupon,


Ordered, That Mr. Nathan Sellers be directed to make a Sur- vey of the River Delaware, for the purpose aforesaid, from Schuyl- kill to Christiana Creek.


That Colo. Lalor be directed to make a like survey from Chris- tiana Creek downward.


That on the East side of the River, Capt. J. Downey be author- ized to make a like Survey, beginning at Cooper's Ferry & extending downward to Salem; And, That Mr. Benja. Davis be appointed to make a like Survey, beginning at Salem & extending downward; and that proper instructions be drawn aud delivered to each of them.

Ordered, That David Rittenhouse, Esq'r, Treasurer, do supply Messrs. Sellers, Lollar, Downy & Davis, with what Money shall be necessary, from time to time, for completeing the Surveys ordered to be made on the Delaware.


Mr. John Adams, Mr. Sam'l Adams, Colo. Lee, and Colonel Har- rison, of the Continental Board of War, attended in Council to consult with them on the means of procuring the earliest intelli- gence of the approach of the Enemies' Fleet on our Coast, should they come this way, and laid before them a Letter from His Excell'y Gen'l Washington, dated - instant, recommending this measure ; thereupon,


Ordered, That Capt. Hunn, Benja. Jones, & James Martin, go immediately down to the Capes for the said purpose, and that in- structions be given them for their conduct therein ; & An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favour of Capt. Hunn, for the Sum of One Hundred Pounds, to hire expres- ses & Pay such Expenses as may accrue, and for which Sum he is to account to the Board.

Agreed that Rob't Patterson, John Vandergrist, Tho's Long, & Martin Shipe, be appointed Justices of the Peace for the County of Bucks ; & That Will'm McMullen be appointed a Justice of Peace for the County of Philadelphia ; And That Thomas Levis, Tho's Boyd, Rob't Ralston, John Hart, and Rich'd Reiley, be ap- pointed Justices of the Peace for the County of Chester; And That Cha's Shoemaker, Giddy Myer, & Jac'b Morgan, be appointed Justices of the Peace for the County of Berks, & were Commis- sioned accordingly ; And That John Read, David Jenkin, & George Reed be appointed Justices of the Peace for the County of Lan- caster, & were Commissioned accordingly ; James Whitesides & Patrick Ewing, appointed August 12th, and the Commission in- cluding these bears that date ; ditto John Hubley, Esq'r.

Gen. Du Coudray attended the Council, & enquired what Ordi- nances had been provided for the Fortifications at Billingsport; and thereupon, after enquiry made on this subject,


Ordered, That the Secretary be directed to inform Gen. Du- Coudray of the number of Pieces of Ordnance in the State House Yard, as returned by Capt. Stiles.


The Council being informed on Oath, that the Public Records of the County of Westmoreland had been in an unlawful & Clan- destine manner, removed & Secreted, and that there is reason to suspect that they are removed to, and secreted in the Borough of Lancaster, and that Mich'l Hoofnagle, late Deputy Prothonotary of the said County, had removed & Secreted the said Records, &ca .; thereupon,


Ordered, That John Hubly, Esq'r, of the Borough of Lancaster, be authorized & empowered to search for, demand, take, & receive the said Books, Records, Papers, & Seals, or such of them as may be found : And for the more effectual recovery of the same, that he be directed to apply to, and demand of Mich'l Hubley, Esq'r, & Will'm Henry, Esq'r, Justices of the Peace for the County of Lan- caster, for their Special Warrant, enabling the Sheriff of the said County, or any Peace Officer, to enter, in the day time, into any dwelling, or other House, within the said County of Lancaster, and there to make diligent search for the said Records, Books, Papers, & Seals, and if the same, or any of them be there found, to bring them before the said Justices, in order that they may be delivered

into the Custody of the said John Hubley ; And That Mich'l Hub- ley & Will'm Henry, Esq'r, be commanded & empowered to grant the search Warrant before mentioned, to search any particulrr House or Houses, as aforesaid, due cause to suspect that the said Records, Books, Papers, & Seals, or any of them, be concealed therein, be to you shewn; And That, as the said Mich'l Hoofnagle is now at Camp, His Excell'y Gen. Washington be requested to send the said Mich'l Hoofnagle to this City immediately, to answer his conduct herein.

Ordered, That John Vandegrift, Arthur Watts, James Wallace, Joshua Anderson, & Joseph Thomas, be added to the Committee for removing Cattle, in the County of Bucks.
