An order was drawn on the Treasurer in favor of John Conrad & John Marks, for the Sum of One hundred & One Pounds & four Pence, balance due to them for 'Thirty days Stage Waggon hire in conducting the Prisoners to Virginia, at Four Pounds Ten Shillings day, they having received of George Ross, Esq'r, the Sum of Thirty-three Pounds Nineteen Shillings & Eight Pence, in part ; And,


An order was drawn on the Treasurer in favor of George Ross, jun'r, for the Sum of Thirty three Pounds Nineteen Shillings & Eight Pence, advanced by him as aforesaid; this last order being interwoven in the former one.


Mr. Benja. Rittenhouse, Superintendent of the Gun Lock Facto- ry, having represented to the Council that the Pay allowed him is insufficient for the maintainance of his Family, & prayed that his Salary may be increased,


On consideration,


Ordered, That Mr. Benja. Rittenhouse be allowed, for Superin- tending the Gun Lock Factory, the Sum of Five hundred Pounds Anp., to Commence from the 15th Feb'ry last.


Petitions of divers Volunteers who went from Antrim & Peters Township into service in November last, setting forth,


That in consequence of the invitation of the President & Gen'l Armstrong, & that they have served at Camp in expectation that it would have been considered as a tour of duty done by them, but that the Lieutenant of the County is now about to order them to be fined for not turning out in their Classes respectively, being read ; on consideration,


Ordered, That agreeable to the order of Council to the Lieuten- ants of the several Counties dated the. 23d day of October last, all persons who had not gone out in their turn in the Classes called before that time, & who turned out & served two months according to the said order, such service shall be considered as a full compen-

sation for their former neglect, & that all persons whose turn it was not then to go into the field, & who notwithstanding, went out vol- untarily & served a tour out of their turn, be exempted from their then next tour of duty ; But Council hath not any legal authority to extend this exemption to those who refused to go in their turn under the Officers which had been duly chosen by the People, & Commissioned accordingly.


An order was drawn on the Treasurer in favor of Colo. Dan'l Broadhead, for the Sum of Three Thousand Seven hundred & Six & One-third Dollars, to be by him delivered to sundry Officers of Colo. Stewart's Batt'n, who have been recruiting, to be charged to Col. Walter Stewart.

Mr. John Brown attended the Council, agreeable to the order of the first instant, & was discharged from the Parole under which, for some time past, he has been enlarged, And the surety of good behaviour given by him is not to extend to his conduct from this date.

A Resolve of Congress of the 19th March last, being now read in Council, as follows :

MINUTES OF THE


" In Congress, March 19th, 1778.


" Resolved, That it be recommended to each State to appoint some suitable person or persons to get made, with all possible dis- patch, as many complete sets of accoutrements & spare bayonet. Sheaths as shall be sufficient for their respective quota of Troops ; The Cartridge Boxes to be made to hold at least Twenty nine rounds of Cartridges, when made up with ounce Balls, & the cover of good substantial leather, with a small cover or flap under it, that . the Ammunition may be most effectually guarded against rain; & to prevent impositions from the workmen, that proper inspectors be appointed to examine & receive the accoutrements, with orders to reject such as are bad & insufficient ; & that the accoutrements so provided be sent forward with the Troops, or as soon after as possi- ble ; That in case in any State they have quantities of Tin, instead of the Cartouch Boxes, an equal number of Tin Cartridge Cannis- ters be furnished, agreeable to a pattern or description to be sent by the board of War."


Ordered, That William Henry, Esq'r, be appointed to procure the accoutrements to be made agreeable to the foregoing Resolve of Congress.


The Resolve of Congress of the 16th March last, "That the board of War be directed to deliver over to the order of the Presi- dent & Council of Pennsylvania, the Prisoners sent from this State to Virginia," being now read, & the law for the further security of the Government taken into consideration, as far as the same may affect the said Prisoners; thereupon,


Ordered, That the said Prisoners, to Wit: Israel Pember- ton, John Hunt, James Pemberton, John Pemberton, Thomas Wharton, Edward Pennington, Henry Drinker, Thomas Gilpin, Charles Jervis, Thomas Fisher, Samuel Pleasants, Thomas Af- flick, Elijah Brown, Owen Jones, jun'r, Samuel Fisher, Wil- liam Smith, Miers Fisher, Charles Eddy, & William Drewitt Smith, be brought to Shippensburgh in this State, & there en- larged ; That they be informed of the Law passed for the fur- ther security of the Government, by giving to Mr. Israel Pem- berton, or some one of the said Prisoners a printed Copy of the said Law for the inspection of the whole ; That Mr. Francis Bailey & Capt. Lang be appointed to apply to the Board of War for, & receive from them an order for the delivery of the Prisoners sent from this State to Virginia, & that the Board of War be requested to give orders for such assistance in procuring Waggons to bring the Prisoners into this State as may be necessary ; That the said Francis Bailey & Capt. Lang receive & conduct the said Prisoners to Shippensburgh in this State, & there set them at liberty; and that on their journey they be treated with the respect due to their Characters.

Ordered, That the Lieutenants of the Counties through which the aforesaid Prisoners may pass, do give the necessary assist- ance to Mr. Bayley & Capt. Lang, by furnishing Waggons, or other assistance which they may stand in need of.


Ordered, That the whole expence of arresting & confining the Prisoners sent to Virginia, the expences of their journey, & all other incidental charges, be paid by the said Prisoners.


An order was drawn on the Treasurer in favor of Francis Bailey, & Capt. James Lang, for the Sum of One hundred and fifty Pounds, for which they are to account.


The Hon'ble Jonathan B. Smith, Esq'r, Delegate of this State in Congress, having inclosed to this Council a. draft in the follow- .ing words, Vizt :

" YORKTOWN, Mar. 30, 1778. " Sir :


" Pay to the Hon'ble the President & Council of the State of Penn- sylvania, or order, the Sum of Fifty Thousand Dollars, it being to be by them put into the hands of proper persons, for the purpose of purchasing Horses in said State for the use of the Army of the United States, & to be paid out of such Money as you have or may receive in consequence of issues of Loan Office Certificates, the said State to be accountable.

The recommendation by four of the Justices & the Sheriff of the County of Northampton, of Robert Clarke, convicted of Felouy in the said County, as a fit object of Mercy, & interceding for the remission of his fine and corporal punishment, was read, & the rea- sons whereon the same is founded being considered ; whereupon,


Ordered, That the fine & corporal punishment adjudged by the Court of the County of Northampton, to be inflicted on a certain Robert Clarke, be remitted.


An order was drawn on the Treasurer in favor of Mr. Joseph Carson, for the Sum of Nine thousand & forty-three Pounds and Ten Shillings, the balance due to him for a quantity of Woollens seized by this Council in the Great Swamp in the County of Bucks, & applied to the Cloathing of the Continental Troops, agreeable to a resolve of Congress for that purpose ; the said Sum, together with the Sum of Seven Thousand Pounds drawn in favor of the said Carson of the 7th January last, be charged to James Meas, Esq'r, Clothier General of the United States.


Mr. James Futhy having delivered into the Continental Stable, Eleven Horses purchased by him,


Ordered, That the Secretary give Mr. Futhy a Certificate of the same.


An Address from the Wives & near friends of the Prisoners in Virginia being read & considered ; thereupon,


Ordered, That the Prisoners now in Virginia be brought to this Borough, instead of being enlarged at Shippensburgh.


The board of War having sent to Council an order to Jos. Holmes. Esq'r, to deliver over to the order of the President & Council of this State all Prisoners of this State now under his care; thereupon,


Ordered, That an order be endorsed thereon for the delivery of the said Prisoners to Mr. Francis & Capt. Lang.


An order was drawn on the 'Treasurer in favor of David Watson, Esq'r, for the Sum of One thousand & five hundred Dollars, for the purpose of purchasing Horses in the County of York, for the Con- tinental Cavalry.


An order was drawn on the Treasurer in favor of Mr. Sam. Fu- thy, for the Sum of One thousand & five hundred Dollars, to be paid in Loan Office Certificates, for the like purpose, in the County of Chester.

Lieut. McClellan, of the 1st Pennsylvania Battalion.


Capt. Miller of the 7th Pennsylvania Battalion, sent into the County of Cumberland, with orders on the Lieutenant of the said County.


The following orders were drawn on the Treasurer, Viz :

Capt. Tho's Gourly, of the 9th Pennsylvania Regiment, having requested by Colo. Butler to undertake the Recruiting Service, attended the Council & received Recruiting orders for the County of York, with the general instructions to call on the Lieut. of the said County for Money.


Major Gen'l Green havingrepresented to the Council, on the 13th instant, that there may probably be cases of great necessity for Waggons for the Army, which cannot be supplied by the mode di- rected by the Waggon Law; and that great difficulties have arisen in procuring Waggon Masters & Teamsters, in consequence of the demands made upon them for their services in the Militia, or Pay- ment Substitution Money, in lieu of such Service ; and the same being taken into consideration, this Council are of opinion, That whenever, &ca. (See the 18th instant.)

An order was drawn on the Treasurer in favor of Elias Boyce, for the Sum of Six hundred & five Pounds, to be charged to Will'm Crispin, Commissary.

An order was drawn on Colo. Jacob Morgan, Lieutenant of the County of Berks, in favor of Henry Spyker, for the Sum of Six Thousand Pounds to Pay the Militia, for which he is to account.


An order was drawn on the Treasurer in favor of Mr. Christ'n Lower, one of the Commissioners for purchasing of Horses in the . County of Northampton, for the Sum of Two thousand Five hun- dred Pounds to pay the Militia, for which he is to account.

sundry small expences paid by him, and for his attendance 123 days, ending the 16th instant.


An order was drawn on the Treasurer in favor of Robert Craig, one of the Commissioners of Lancaster County, for purchasing Cloathing, for the Sum of Two thousand Pounds, for which the said Craig is to account.


It having been represented to this Council that a considerable number of the Militia of the County of Chester, heretofore called in their respective Classes, from various circumstances have not performed their Tour of duty, nor as yet paid their Substitution Money, & the same being now considered ; thereupon,


Ordered, That such of the Militia of the County of Chester as have not performed their Tour of duty, or paid their Substitution Money, be now called into service, & that the serving two Months under the present call, shall be accepted in lieu of their former service.


Major Gen'l Green having on the 13th instant represented to the Council that there may probably be cases of great & immediate necessity for Waggons for the use of the Army, which cannot be supplied in the mode pointed out by the Waggon Law, so as to an- swer such emergency; & he expressing an earnest desire of acting in the discharge of his duty as Quarter Master Gen'l in perfect harmony with this State, & of conforming to the Laws of it, pro- posed that some further authority be given by Law to him & his deputies in extra cases. The Subject being duly considered, this Council are of opinion, That whenever a Sudden & extraordinary emergency shall make the impressing of Waggons by a Military force absolutely necessary, that necessity must, from the nature of things, justify the impressing by force of Arms, but that it would be improper to trust such powers in the Military by Law: And Maj. Gen'l Green having represented to Council That great diffi- culties had arisen in the procuring of Waggon Masters & Team- sters, in consequence of the demands made on them for their ser- vice in the Militia, or for Payment of Substitution Money in lieu of such Service ; On consideration the Council are of opinion, That Waggon Masters & Waggon drivers, actually enlisted in the Conti- nental service for a reasonable time, are not liable to serve in the Militia during the time of their continuing in such service, nor sub- ject to the Payment of Substitution Money : And that an enlist- ment in either of these services for Six Months, or longer time, ought to be considered by the Lieutenants & Sub-Lieutenants of the respective Counties of this State, as a good and sufficient cause to forbear levying the Substitution Money in such cases.

Joseph Irwin & Lieu't Vanleer, of the 9th Pennsylvania Battalion, were appointed also to the re- cruiting service, & that Colo. Butler had sent out other Officers to recruit, requesting they may be supplied by Council with Money for that purpose.


Ordered, That these Gentlemen be furnished with recruiting or- ders & drafts for such Monies as shall be necessary.

Peter Sommers laid before the Council an order drawn by Will'm C. Bradford, in favor of Henry Shriver, for the Sum of One hun- dred & Sixty-seven Pounds & five Shillings, to be charged to the said Will'm C. Bradford.


And an order was drawn by William Crispin, Commissary of the State Fleet, in favor of Lasky & Shriver, for the Sum of Eleven hundred & twenty-eight Pounds Seventeen Shillings & Six Pence,

MINUTES OF THE


for sundry Cattle delivered for the use of the Fleet, the said Sum to be charged to the said Will'm Crispin. These orders not being endorsed to Mr. Sommers, & therefore not payable to him, the Council found a difficulty in granting an order on the Treasury ; but Capt. Joseph Blewer having represented that the Money had been long due, & that Sommers was in Partnership with Lasky & Shriver ; on consideration,


An order was drawn on the Treasurer in favor of Captain Joseph Blewer, for the Sum of One hundred & Sixty-Seven Pounds five Shillings, to be charged to Will'm C. Bradford, Paymaster of the Fleet.


Also an order was drawn on the Treasurer in favor of Capt. Joseph Blewer, for the Sum of of One Thousand One hundred & Twenty Eight Pounds, Seventeen Shillings & Six Pence, the same to be charged to Will'm Crispin, Commissary.


Petition of John Young, (convicted in the County of Bedford, of having stolen 2 lbs. of lead, & sentenced to receive Seven lashes,) Praying that his Punishment may be remitted, & the recommen- dation of him as an object of mercy .by several Justices of the said County, (and offering himself a Soldier in the Continental Army,) was read; Thereupon,
