An order was also drawn on the Treasurer in favor of Col. Robert Lollar, or his order, for the Sum of Three hundred and fifty Pounds, to be by him advanced to such of the Militia now under orders to March, as stand in need of it.


Ordered, That the Lieutenants of the County of Philadelphia & Bucks, be authorized to pay the 'Tavern-keepers seven Shillings & six Pence Per day for Victualling the Militia on their March from their Homes to Sherrard's Ferry ; And also be authrized to provide Waggons to carry the baggage of the escort to Sherrard's Ferry, there to be discharged.


Ordered, That two hundred stand of Arms & fifty Camp Ket- tles be immediately forwarded to Sherrard's Ferry, for the use of the Philadelphia & Bucks County Militia, under the care of Fred- erick Hagner, & proper Receipts taken of the Captains to whom they shall be delivered.


Ordered, That it be recommended to Colo. Henry to forward about four hundred Dozen Musket Cartridges, for the use of the Pennsylvania escort.


Ordered, That the Muster master be directed to proceed to Wright's Ferry, or such other Ferry on Susquehanna which the Troops may cross, & there muster the Militia ordered into service to escort the Convention Troops thro' this State.

Heysham, John Barnhill, & Peter Ozeas, attended the Council, in consequence of notice to the Petitioners against fore- stallers to attend in Council, And the resolve of the Hon'ble House of General Assembly of the 5th instant, recommending to the se- rious attention of Council the Petition of sundry inhabitants of the City of Philadelphia, presented to the House, & praying in effect their interposition to prevent forestalling, was read. The said Pe- tition was also read. On Consideration,


Ordered, That Willam Heysham, George Schlosser, & Will'm. Hollingshead, be appointed & requested to make inquiry in all that part of the City from Market Street Northward, including the North Side of Market Street, concerning the engrossing of Flour & other necessaries of Life, & make report as soon as may be, to this Council, of such facts as have come or shall come to their know- ledge, concerning the same ; And that Nathan Boys, Jediah Snow- den, & Robert Bridges, be appointed to the same, from Market Street Southward, including the South Side of Market Street; & Colo. William Coats, Frederick Kull, & Emanuel Eyre, for the North- ern Liberties.


On motion,


Ordered, That the unanimous thanks of the Council be given to Col. Thomas Hartly, for the brave & prudent Conduct in cover- ing the North Western frontiers of this State, & repelling the- Savages & other Enemies ; And that he be requested to inform the Officers & Men who have been under his command, that this Coun- cil is highly sensible of the difficulties & hardships of the duty which they have performed, & the courage & zeal which they have shown during the last Campaign.

Ordered, That Mr. George Henry be appointed to superintend & Conduct the Sales of the Vessels, Gallies & Gun Boats, with their apparrel & furniture, (Guns excepted,) he to be accountable for the Nett proceeds of the sales, and that he be allowed the same Commissions as the Marshall of the Admiralty in like cases.


Petition of Peter Dehaven, Benj. Rittenhouse & Hugh Dehaven, respecting the Gun Factory, was read.


Ordered, That Mr. Dehaven be directed to make out & deliver an Inventory of the Factory.


Petition of Richard Footman, in behalf of James Warren, Brew- er, was read & ordered to lie on the Table.


Report of Dr. Hutchinson, of the Stateof the Navy Hospital, was was read ; and thereupon,


Ordered, That Dr. Hutchinson be directed to make out, & dc- liver to the Secretary, an estimate of a Medicine Chest for the Navy.


William Streaker, late of the Island of Barbadoes, but now an inhabitant of the State, having presented a Memorial setting forth that he had taken the Oath of Allegiance to this State, and cou- siders himself a Subject & resident thereof; but that having property in the Island of Barbadoes, he proposes to go to the West Indies in order to secure & transport the same to this Country, of which he thought it his duty to acquaint the Board, to prevent any future questions or disputes on his return :


Ordered, That the said Memorial be filed among the Papers of the Board, & that the Secretary give him a copy of this Minute, if requested.


A Transcript of the Conviction before the Court of Oyer and Terminer & General Goal delivery, held at Philadelphia on the 9th day of November last, of James O'Bryan & John Beard, alias dictus James Beard, of Felony & Robbery, was read & considered; and thereupon,


Ordered, That the sentence of the Court of Oyer & Terminer, & General Goal delivery, against James O'Bryan & John Beard, alias dictus James Beard, be executed upon them, the said James VOL. XI .- 41.

Ordered, That Joseph Stiles, Commissary of Military Stores, be directed to supply James Ash & Comp'y, with One hundred weight of Gunpowder, for the Letter-of-Marque schooner Rebecca, they paying him the Value thereof.


Petition of Marlon Carvel, convicted of having gone into the city of Philadelphia, & praying to have his fine remitted was read, & a Certificate in his favor, signed by John Vandergrift, Esq'r, was read ; &


On Consideration,


Ordered, That the fine adjudged to be paid to the State by Mar- lon Carvel, for his having gone into the City of Philadelphia while in the possession of the Enemy, be remitted.


On motion,


Ordered, That a Pass into New York be granted to Mary Wil- son, not to return again.


Ordered, That the execution of the Sentence of the Court against Mary Miller, so far as relates to the Corporal punishment, be re- spited for ten days, & until further orders from this Council.

Ordered, That all the Guns under Six Pounders be Sold, to be put up in pairs ; And in case the Sales cannot be conducted agreeable to this direction, they are to be bought in for the State, & a further day appointed for the Sale.


A Letter from Capt. Tho's Hazlewood, requesting a Furlow, to make a voyage to the West Indies ;

Ordered, That Capt. Tho's Hazlewood be allowed to make & Voyage to the West Indies, on his own private Business, & to re- tain his Rank in the service of the State; but he is not to receive Pay or draw Rations until he shall again enter into actual service.

Ordered, That the Secretary acquaint Messrs. Alexa. Wilcocks & William McMurtrie, that it having been suggested to the Board that they are possessed of property belonging to British subjects, or otherwise liable to the just claim of the State, The Public offi- cers of the State will be ordered to take the proper steps for secu- ring the same for the benefit of the State, unless the parties con- cerned can shew the Board sufficient reason to the contrary.

Ordered, That Capt. James Lang do deliver over to Jacob S. Howell, as soon as may be, all the Cloathing belonging to the State now in his hands, the said Lang's possesion, taking a Receipt for the same; And that the said Lang do immediately lay before the Council his Accounts, prepared for a final Settlement.


An order was drawn on the Treasurer in favor of Captain James Lang, for the Sum of Three Thousand Pounds, for the Cloathing department, for which Sum the said Lang is to account. 1

Ordered, That the Execution of the Sentence of the Court of Oyer & Terminer & General Goal delivery, upon the body of James Bryan, be respitted for fifteen days, & that a Warrant under the less Seal, be issued for the purpose accordingly.


Thomas Fitzsimmons laid before the Council a Certificate signed by the Hon'ble the Sieur Gerard, Minister Plenipotentiary of His most Christian Majesty, that the Ship Mary & Elizabeth, belong- ing to Mr. Fitzsimmons & Company, was laden with biscuit & Flour for the use of the Fleet of His most Christian Majesty, and prayed that the said Ship may be cleared out at the Naval Office.

Ordered, That a Proclamation, under the Seal of the State, be issued agreeable to an Act of General Assembly entitled “ An Act to prohibit the exportation of Provisions from the State of Penn- sylvania for a limited time," to suspend the operation thereof so far as to admit the exportation of any of the Articles within the description of the said Act, for the use of the Fleet of his most Chris- tian Majesty.


A letter from Robert Galbraith, Esq'r, resigning his Offices of Prothonotary, Clerk of the Peace, Clerk of the Orphans' Court, Recorder of Deeds, & Register for the Probate of Wills, and also the Commission of the Peace for the County of Bedford.


Ordered, That David Espy be appointed & Commissioned to be Prothonotary, Recorder of Deeds & Register for the Probate of Wills, for the County of Bedford, & one of the Justices of the Court of Common Pleas for the said County,

The Plan of defence of the North Western frontiers of this Place, laid down by Col. Hartley, was now read & considered ; and thereupon,


Ordered, That the plan & Arrangement for the defence of the North Western frontiers of this State, laid down by Col. Hartley, & dated December 1st, 1778, is approved by this Council ; And that Col. Sam'l Hunter, Licut. of the County of Northumberland, be directed to supply the Post at General Potter's, in Penn's Val- ley, with two Officers & Twenty Men, until further orders; And in case any other Officer should succeed Colo. Hartley in command, it is recommended that Col. Hartley's plan be pursued, as far as cir- cumstances will admit.


A Letter from the Marine Committee read, enclosing an engage- ment on the part of the Minister of France, to Pay Twelve Thou- sand Dollars as a reward to any Vessel capturing or destroying any Vessel of the Enemy laden with Masts or Spars, & bound for New York, Halifax, or Newport.


Ordered, That the same be filed.

Ordered, That in addition to the News Papers now taken of Dunlap of this city & of Mr. Collins of Burlington, the following News Papers be taken, Viz :- Mr. Purdy's, of Williamsburg, in Virginia ; Miss Goddard's, of Baltimore, in Maryland ; Mr. Lou- don's, at Fishkill, in the State of New York ; -, at New Haven, at Providence ; Miss. Edes & Gills, & Powers, & Willis's of Boston ; and that the Sec- retary do write to the said Printers respectively, & request them to send their Papers Weekly.


Ordered, That there be printed Three Hundred Copies of the Passports which are to be given to Ships & Barques, according to the 27th Article of the Treaty of Amity & Commerce, done at Paris, the sixth day of February, One Thousand Seven Hundred & seventy-eight ; And that the same be issued under the less Seal uf the Commonwealth of Pennsylvania, and signed by the Presi- dent or Vice President, and countersigned by the Secretary.


The Secretary reports, That there are now no Commissions for private ships of War in his hands, & laid before the Council Twen- ty-two Bonds, taken on the issuing a like number of Commissions. Two Commissions filled up on applications & not called for, which completed the Twenty-four Commissions received on the 31st Au- gust, 1778, from the Hon'ble Henry Laurens, Esq'r, late President of Congress; and also two Bonds, taken on the issuing of a like number of Commissions, part of a former mumber received by Council, & that there had been One Commission sent to the State Navy Board, which that Board had not accounted for; And there- upon,


Ordered, That the same be sent to the Hon'ble Jobn Jay, Esq'r, President of Congress.

Passes to New York ordered for Sarah Williamson, Wife of Jesse Williamson, to return again. James, a Lad of 14 Years of Age, belonging to that City. Mary Ginn, Wife of Capt. Ginn, com- manding a Merchant Ship in the Enemy's Service, not to return.


Ordered, That Mr. George Henry be and he is hereby appoint- ed Commissary of Naval Stores of this State, & that he be autho- rized to take into his care and Custody the Vessels of every kind not in Commission, Guns, Arms & other Naval Stores, the whole to be collected together as much as Possible, & all the Offiers of the State & others, are hereby required to deliver up to the said Commissary the several articles herein mentioned, as they will answer the contrary at their Peril ; And for his trouble herein, this board so agree to allow him eight Dollars per day, exclusive of the necessary expences attending the safe keeping and preservation of the Stores.

The two following orders were drawn on the Treasurer, Viz :


In favor of Ebenezer Cowell, or his order, for the Sum of Five hundred Pounds, to be charged to his account.


In favor of John Parker, or his order, for the Sum of Fifty Pounds, to be charged to his account.


Ordered, That the Secretary prepare a Circular Letter to each of the absent Delegates in Congress, acquainting them that since the late appointment the State has seldom been represented by more than two, & frequently only by one, which is attended with great inconvenience to the Continent in General & prejudice of this State in particular, & to desire they would with all convenient dispatch to repair to Congress and agree among themselves, so that in future a certain day not less than three, may always attend.

MINUTES OF THE


A Letter from His Excell'y Gen'l Washington, dated Middle- brook, December 17, 1778, was read, stating sundry inconvenien- cies arising from the intercourse as at present carried on with the City of New York, & proposing that Flag boats shall go only at stated periods, (unless in extraordinary Cases,) & desiring the con- currence of this board thereon.


Resolved, That the President do acquaint the General that the board approve the said proposition, & as soon as he has fixed on the stated time of permission, will grant passes conformably.
