Arch'd Lochry, Lieut. of the said County; and also an order was drawn on William Henry of this borough, for all the Riffles in his possession, to be delivered to Colo. Archi- bald Lochry, Lieut. of the said County.
Ordered, That the Board of War be requested to furnish Her- man Husband, Esq'r, with Two hundred Pounds of Powder & Six hundred Pounds of Lead, for the use of the Militia of Westmore- land County, in defending themselves against the Indians, and the like quantity for the use of the Militia of Bedford, for the said purpose.

Hart; where- upon, Colo. Hart, with the concurrence of Council, delivered the Keys to the said Mr. Anderson, Colo. Dill & Colo. Clarke.
An order was drawn on the Treasurer in favor of Mr. Tolbert, for the Sum of Seven Pounds & ten Shillings, for riding express for General Armstrong.

Ordered, That Congress be informed that the Prisoners now at Winchester, are considered by this Council as the Prisoners of the United States, & that a considerable expence hath been paid by this State removeing them to Winchester.

Complaint being made that several Waggons had been impressed contrary to the assurance given by Council to the Farmers sending in Wood, Hay, &ca. to this Borough,

Ordered, That Colo. Hartley, the Commanding Officer now here, be directed to attend the Council this Afternoon ; & Colo. Hartley attended, & being informed of the Complaint, assured the Council that he had not ordered the impressing of the Waggons above mentioned, & that he would immediately order them to be dis- charged.
Capt. Blewer laid before the Council a Receipt signed by Sam'l Smith, Lieut. Colo. & Commander of Fort Mifflin, for Two hun- dred & Twenty-four pair of Stockings, One hundred & Twelve pair of Shoes, One hundred & Ninety Shirts, & Twenty Coats, for the use of the Party under his Command in the said Garrison.
Ordered, That the same be communicated to the Clothier Gene- ral, that he may charge the said Cloathing to the said Colo. Smith, & credit this State therewith.
The Petition of Lambartus Scheline, Setting forth that he has been confined in the Goal of Berks County, on the common allow- ance, upwards of Two Years & Three Months, under sentence of Death for passing of false counterfeit Bills, in the form & simili- tude of the true genuine Bills, the Currency of Pennsylvania; that he is upwards of Seventy Years of Age, & that shortly after his confinement, thro' sickness and distress he has entirely lost his Eye- sight, & praying a discharge, &ca., now laid before the Council & read ; And after mature deliberation on his case, it was
Ordered, That the said Lambertus Scheline be Pardoned & dis- charged from his confinement, on paying the costs of prosecution & Prison Fees.
Mr. Joseph Carson, to whom the Goods lately brought from Bucks County belong, requested that he may be supplied with the Sum of Seven thousand Pounds in Loan Office Certificates, in part of the Amount of the said Goods; & it appearing that there is a considerable sum of Money yet due on the last order of Congress on the Treasury in favor of this Council, & that the Sum required by Mr. Carson may be had at the Loan Office in Certificates, toward the Payment of the said order of Congress ; whereupon,

Bull be informed, in the most respectful terms, that the Council are of opinion that his Services as Adju- tant General will not be any longer necessary ; & lest he should consider it as intended as a dismission of him from the service in consequence of some disapprobation of his conduct, that he be in- formed that it is not intended to appoint another Person in his room.

Capt. John Dav'd Wolper, of the German Battalion in Conti- nental Service, laid before the Council an Account of Four Pounds & Ten Shillings, paid by him for taking up four deserters, agreeable to the direction of an Act of General Assembly of this State, pas- sed Feb'ry 20, 1777 ; On consideration,
The Council ordered the same to be paid by the State Treasurer, & informed Capt. Wolper that they have granted this order from a desire of avoiding the discouragement of the taking up of Deser- ters, rather than from the justice of the claim, as they apprehend he ought to have reimbursed himself out of the pay of the Soldiers so taken up.
Rob't Levers, Esq'r, of the County of Northampton, having had orders to send forward a quantity of Indigo to Boston to be sold there, & the Money laid out in Clothing for the Troops, & he now representing that it will be necessary to send a number of Wag- gons to bring the said Clothing back, more than will be necessary to carry the indigo there,
Ordered That three hundred & Fifty Pounds be put into his hands to purchase Iron, & send by the said Waggons for the like purpose, &
An order was drawn on the Treasurer in his favour for the said Sum of Three hundred & Fifty Pounds, for which he is to ac- count.
Council having repeatedly had under their consideration the re- commendation of the Hon'ble House of General Assembly of the 2d inst., respecting the Recruiting Men to complete one Quota of the Continental Army, & being fully satisfied that men qualified & willing to perform this business cannot be found, And that an at- tempt to carry into execution the plan therein recommended, would be attended with great inconvenience & loss of time, if not with fatal Consequences ; therefore,
Resolved, That this Council will write to His Excell'y Gen'l Washington, lay before him the said recommendation, & request him to nominate two Officers, who he may think best qualified, in each Battalion of this State, to Recruit Men for the said Battalions, who shall repair to the different Counties of this State & attend immediately to this important duty, and acquaint His Excell'y that Council will deposit in the hands of the Lieutenant of the respec- tive Counties a Sum of Money to Pay the bounty ordered by the Honorable House of Assembly, to whom the said Officers may apply from time to time for the same, as they shall inlist men.

Jacob Dingee & Rich'd Strode delivered the body of Charles Dingee, late of the County of Chester, to the order of this Coun- cil, agreeable to the condition of a Bond by them given, with Thos's Meeter, to his Excell'y the President, taken by Elias Bou- dinot, Esquire, Commissioner of Prisoners, when he was attempt- · ing to go into Philadelphia while in the Possession of the Enemy, contrary to law; And being there examined, & it appearing that he hath not taken the Oath or Affirmation of Allegiance directed by the Laws of this State, the same was read & tendered to him, and he being requested to withdraw & take time to consider of the same, withdrew accordingly, & after some time, voluntarily returned & declared he could not take the said Oath or Affirmation ; there- upon,

The Lieutenant of the County of Northumberland having re- presented that several inhabitants of that County had been lately killed by the Indians, and that there was reason to apprehend that a considerable body of them was now meditating a blow against the frontiers of the said County ; thereupon,
Ordered, That the Lieut. of the County of Northumberland use his best discretion with respect to the Class of Militia now called out, & apply such part thereof to the defence of the inhabi- tants as may appear to be necessary ; he giving this Council from time to time intelligence of his proceedings herein.
An order was drawn on the Treasurer in favor of Peter Deha- ven, for the Sum of Five Hundred Pounds, for which he is to ac- count.
James Dunn, a wounded Militia Man, applied to Council for re- lief ; thereupon,

Ordered, That Wm. Henry, Esq'r, Lieut. of Philadelphia, be requested to supply the said Dunn with such Money as appears to be necessary for him in his present Situation.
Gen'l Fulsom & Mr. Danae, Members of Congress, two of the Committee appointed by that Hon'ble Body, to take into conside- ration the proposed attack on the City of Philadelphia, attended in Council & laid before them the following Resolve of Congress, to wit :
" In Congress, January 16, 1778.
" Resolved, That Congress highly applaud the rising spirit of the inhabitants of Pennsylvania to regain the Capital of their State and drive out our cruel invaders ; That Congress are ready & wil- ling, with all their power, to co-operate with them for effecting this Salutary purpose : That to this end the Committee appointed to go to the Camp, be directed to consult with the President & Council of the State of Pennsylvania, & with Gen'l Washington, on the Subject, & if upon consultation the measure shall be deemed prac- ticable, that they be fully empowered to call on the neighboring States for such aids as they shall think necessary, & take every measure which they shall think proper for effecting the end pro- posed.

The Act entitled " An Act for the better Supply of the Armies of the United States of America," was read, so far as it relates to the procuring Provisions, in order to shew the measures taken by this State for the said purpose, & the probability of supplying the Militia if called.
Council taking into their consideration the Act last above men- tion'd, observe that there are no Commissioners appointed therein for the County of Berks, & being fully satisfied of the necessity of having Commissioners in the said County, for collecting & pur- chaseing Provisions & forage therein for the Army ; That the omit- ting to name in the Act Commissioners for the said County, was owing to a mistake in the Clerk; and that very dangerous conse- quences may arise from the delay thereof until the next meeting of the General Assembly ; thereupon, for the Public Safety & from the necessity of so doing,
Ordered, That Colo. Valentine Eckhard & John Lasher, of the County of Berks, be & they are hereby appointed & authorized to act as Commissioners for purchasing Provisions & Forage for the Army in the said County, & to use & exercise like powers & au- thorities as are given by the said Act to any of the Commissioners therein named, until the General Assembly shall otherwise order. herein.

Ordered, That an order be drawn on the Treasurer in favor of Will'm Scott, Paymaster of the Militia of the County of York, for the Sum of Four thousand Pounds, to be charged to Tho's Dorsey, Esq'r, Paymaster of the State ; And that it be recommend- ed to D. Rittenhouse, Esq'r, to endorce on the order a Certificate to Rich'd McCallister, Esq'r, Lieut. of said County ; that the said Will'm Scott's Receipt thereon will be allowed as a Sufficient voucher for the Money paid him in virtue of the said Order.

Mr .. John White Swift attended the Council & informed that he had become bound with surety to the Gov'r of Maryland, for his appearance before this Council, in consequence of his having re- fused to take the Oath of Allegiance required by the Laws of that State, and that he now attends the Council in consequence of the said obligation.
