Upon representation of Mr. Adam Kimmel, that one of the Wag- gons which he had impressed by virtue of a Warrant from this Council, has been rescued from him by Jacob Keller, George Adam France, Dav'd Menser, Sam'l,Bowman & Henry Brental, in defiance of the said Warrant; thereupon,


Ordered, That the Sheriff apprehend the said persons, & bring them before this Council, and that a warrant issue for that purpose.


On motion,


Ordered, That a Circular Letter be written to the Lieutenants of the several Counties, to exert themselves in Collecting the Fines due from Delinquents, & remit the same to the Treasurer, and likewise to send forward returns of all the Militia in the several Counties, who have from time to time turned out in the several Classes.


The Council took into consideration the Memorial of Benja. Wallace, setting forth that his brother, Mich'l Wallace, had been put under Guard, by order of Col. Boyd, of Pequea, & had been threatened to be Marched to Camp for this reason, that he, Mich'l Wallace had obtained a warrant for a substitute, in the said Colo. Boyd's Battalion, for abuse.


Ordered, That the said Mich'l Wallace be discharged from his confinement.

one of them recommending it to the Legislatures of the several States to enact Laws for the Calling in the Old Bills of Credit, struck under the authority and sanction of the King of Great Bri- tain, & the other recommending to the Legislatures of this State to repeal the clause in the Militia Law which permits the hireing of substitutes.'


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Capt. Ja's Francis Moore, for One hundred Pounds, in part of his Account, to be charged to Jacob S. Howell, to be by him charged to the Commanding Officer of the Regiment late of this State, and now Commanded by Colonel Stewart.

Ordered, That Jacob Keller be now brought before the Coun- . cil, and it appearing by his own confession that he had, in contempt of the Warrant of this Council, taken several Horses from Adam Kimmel, which had been impressed by order of Council for Public Service, and George Adam France, Dav'd Menser, Sam'! Bowman & Henry Brental being now brought in, and it appearing by their own confession that the said George Adam France, Dav'd Menser, Sam'l Bowman & Henry Brental, were concerned with Jacob Kel- ler, in taking several Horses from Adam Kimmel, in contempt of a Warrant issued by this Council ; thereupon,


Ordered, That the said Jacob Keller, George Adam France, Dav'd Menser, Sam'l Bowman & Henry Brental be committed to the common Goal of this County.


Several letters from the County of Bedford, relating to the incursions made by the Indians, being now read and considered,


Ordered, That the Lieutenants of the County of Bedford, & of the County of Westmorland, be authorized and directed to call out from time to time, such parts of the Militia of the said Counties as may be necessary for the immediate defence of the Inhabitants against the Indians, & to take such measures as may most effectu- ally cover the inhabitants while they are securing their grain, and

Ordered, That Mr. John Tyler send what Rifles he has by him fit for service, immediately forward to this Borough, to the Council. The General Assembly of Representatives of the Freemen of Pennsylvania, sent into Council the following Certificate, vizt :


" In General Assembly of the Commonwealth of Pennsylvania, Wednesday Dec'r 10, 1777, P. M.


" On motion, Resolved, That this House will now proceed, agrea- ble to the order of the day, to the Election of Delegates to serve this State in Congress for the ensuing year, every one of whom shall have forty Shillings for each days' service.

The Petition of Jacob Keller & Peter Miller, on behalf of Ja- cob Keller, jun'r, Sam'l Bowman, Jacob Brindle, Dav'd Meinzer, George Adam Frantz, now prisoners in the Goal of this County, being read, & the Petitioners heard ; thereupon,


Ordered, That Sam'l Bowman, David Meinzer, & George Adam Frantz, who appear to have been drawn in to aid & abet Jacob VOL. XI .- 25.

Keller in forcibly taking away two Horses from Adam Kimmel, which were in the service of Council, thro' a deception, be dis- charged on taking & Subscribing the Oath or Affirmation of Alle- giance to the State, and that Jacob Keller, jun'r, & Jacob Brindle, on their taking & subscribing the Oath or Affirmation of Allegiance to the State, and giving Security for their good behaviour for one year, themselves each in the Sum of Four hundred Pounds, & one Sufficent Freeholder in the Sum of Two hundred Pounds, be en- larged.


Colo. Bayard & Colo. Coats attended the Council in the name of the Hon'ble House of Assembly, requested a conference with Council, (either in the Assembly Room or in the Council Cham- ber, as the Council think fit,) on the situation of the State, with respect to the Continental Army going into Winter Quarters; thereupon, -


Agreed, That this Council will attend the House in the Assembly Room.


The Conference with the Hon'ble House of General Assembly having been had, & it being unanimously agreed to remonstrate to Congress against the Army going into Cantonments,


Ordered, That the Hon'ble Vice President & Mr. Scott be ap- pointed to join with a Committee of the Hon'ble House of Gen- eral Assembly to draw up the said Remonstrance, to be laid before the Council & the House to-morrow morning.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Peter Dehaven, for the Sum of Two hundred Pounds, for which he is to account.


Council being informed that there is a quantity of Gun powder, Salt Petre, & Sulphur, belonging to either this State or to the Continent, which is at present in the hands of Tho's Himeburg, near the Yellow Springs, which appears to be insecure ; therefore,


An order was given for the delivery of the same to the Hon'ble Tho's Urie, Esq'r, to be by him secured, and an order was also drawn directing Mr. Rob't Towers, to deliver to the said Tho's Urie such Public Stores as are now in his hands belonging either to the Continent or to this State.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Mr. Blaithwaite Jones, for the Sum of Two hundred Pounds, to be charged to Congress, in part Pay for his services in superintending the Works at Billingsport.

" In Council, Lancaster, Decem. 24, 1777.


" To the Representatives of the Freemen of the Commonwealth of Pennsylvania:


"'The Council having found great inconvenience and mischief arise from the want of a Law for regulating Carriages employed in the Service of the Army; That such Laws having been found proper & useful in former times, when Soldiers have been employed & Quar- tered in Pennsylvania, are become more necessary than ever, from the great extent & burden of that duty at present ; That contrary to the Policy of free States, Quarter Masters, Commissaries, & other persons of Character, purely Military, have been left through necessity, to press Waggons & Horses, a practice big with mischief & oppression, such Officers regarding merely their own convenience & ease, & burdening chiefly the neighbourhood where they reside, & forcing into Service Carriages carrying in the Town food & fuel to the immediate distress of the inhabitants; That Council have endeavoured to interpose their influence in extending the burden of this necessary duty to the People generally, but that want of au- thority to enforce their Rules by punishing offenders & restraining the Military Officers aforesaid, have undermined all their efforts, and must continue to do so, whereby the Waggon Service will be- come an intolerable grievance to many worthy Farmers, and will be performed with reluctance & insufficiency; That the need of a better reward than Thirty Shillings P. Diem, for the service of a Team of four Horses & a Waggon, has been fully manifest to Council ; That they have represented to our Delegates in Congress that adequate Wages are essentially necessary to the performance of this important Service, & they have recommended that Forty- five Shillings or Fifty Shillings Per Diem be hereafter allowed; Council therefore, are of opinion that a Law on the Subject of Car- riages & Horses for Continental Service is indispensibly necessary, & if it should be considered as proper, Council will frame heads of a Bill for expediting the same.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of John Proctor, Esq'r, Paymaster of the Militia of the County of Westmoreland, for the Sum of One thousand & five hundred Pounds, to be applied in Paying the said Militia, & to be charged to Thomas Dorsey, Esq'r, Paymaster of the State.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of John Proctor, Esq'r, for the Sum of Five hundred Pounds, to be by him delivered to Colo. Holliday, for the Sum of Four hun- dred Pounds, to Pay for Provisions purchased to supply the Militia of Bedford County, & to continue the Supply, which Sum is to be charged to Colo. On Monday last Mich'l Smith, Waggon Master, delivered to Council Nine Bales of Woollens & five small Bales of Shalloons, which had been Seized by Colo's Smith & Keiklein, of the County of Bucks, & sent forward for the purpose of Cloathing of Troops; . and an order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of the said Mich'l Smith, for the Carriage of the said Goods, for the Sum of Ninety-four Pounds & ten Shillings, to be charged to account of Cloathing the Troops of this State.


Ordered, That Capt. John Harrison be appointed to the Com- mand of the Dickinson Arm'd Boat, and that he be commissioned accordingly.

Joseph Green, of the County of Northumberland, laid before the Council an Account of Expences in supplying the Militia of that County with Provisions, on an expedition up the West branch' of Susquehanna River, to defend the frontiers against the Indians, Amounting to One thousand Four hundred & Sixty Six Pounds Se- ven Shillings & Six Pence, as he has stated it; but Council not having before them the vouchers necessary to support the said ac- count, & it appearing that a considerable Sum of Money will be wanted in that department, this account is ordered to be rendered to the Lieu't of the County; And an order was drawn on the Trea- surer, in favor of Joseph Green, for the Sum of One Thousand & Six hundred Pounds, to be by him paid into the hands of Samuel Hunter, Esq'r, Lieutenant of the said County, & to be charged to the said Hunter.


An order was drawn on the Treasurer, in favor of Jacob S. How- ell, for the Sum of One hundred Pounds, for which he is to ac- count.

MINUTES OF THE


Mr. Sam'l Caldwell rendered an account of the Expences paid by him & Mr. A. Nesbitt, in conducting the Quaker Prisoners to Reading, Amounting to One hundred & Fifty-Nine Pounds Three Shillings & four Pence ; And an order was drawn on the Treasurer, in favor of Mr. Sam'l Caldwell, for the Sum of Fifty-Nine Pounds Three Shillings & four Pence, balance of the aforesaid Account.

Mr. James Read & Colo. Clarke, a Committee of the Hon'ble House of General Assembly, attended in Council & laid before them the Petition of Forty-four respectable Persons of this County, pro- posing the calling out the whole strength of this State against the Enemy, and proposed a conference between the Council & General Assembly.
