Petition of Capt. B. Van Hier, praying that his Troop of Horse may be allowed to draw enumerated Articles, was read & rejected.


WHEREAS, it hath been heretofore represented by His Excellency the Commander-in-Chief to this Board, that the intercourse which has been maintained by the passing of so many Persons to New York, is exceedingly prejudicial to the Interests of America general- ly, & the safety of the Army in particular; & it being also appa- rent that some persons who have been recommended to go within the Enemies line on condition of not returning, have nevertheless returned, & are now residing in this State.


Resolved, That this Board will not in future give any recom- mendation but in cases of a particular & extraordinary nature, & then only to such as shall be recommended to the Board by per- sons of known good Character: And that in all cases where a re- commendation is given upon condition of not returning without the permission of, Public Authority, & two good Securities be given for the performance, or the application be rejected.


Ordered, That the following Pay be allowed to the Captain do other Sea Officers on board the Ship General Green, Viz:

Ordered, That Mr Thomas Cuthbert be appointed to said Office, & that the Secretary give him notice thereof.


A Petition from Mr. Hunter, to Pass to New York, rejected ; A like Petition from Wary & Middleton Braddock, in order to go to. Europe, to their Friends, granted upon condition of not returning, and sureties given in £500 for the performance of the condition.


A Letter wrote to the Agents desiring them to recommend a second Lieutenant & Master to the Ship General Green, & that preference be given to the Old Supernumary Officers of the state, if of abilities. At the same time inclosed recruiting instructions, to Capt Caldwell, of the Marines; Also, enclosed Mr. Henry's list of the Stores under his care, & directed the Agents to take as much as they could from thence, to save expence.


A Letter received from the Board of War, informing that Raw- lins Reg't would soon begin their March to Fort Pitt.

Major Armstrong, superintendant of the workmen at the Forti- fications on Delaware, applied for the use of a pair of Timber Wheels.


Ordered, That the Secretary be directed to request of Col. Mitchell, A. Q. M. G. to supply Maj. Armstrong with the use of a pair of Timber Wheels, on his application for it.


Petition of A. Kleir, Colonel, praying allowance of enumerated Articles, was read & rejected.


A return of an Election for chusing Justices of the Peace for the District of West Fallowfield, Sadsbury & West Cales, in the County of Chester, was read ; by which it appears that William Cloughan, Esq'r, & Joseph Parker, were chosen ; thereupon,


Ordered, That Will'm Cloughan, Esq'r, be appointed & Com- missioned to be a Justice of the Peace for the County of Chester.


The following Two orders were drawn on the Treasurer, Viz :


In favour of Thomas Nevil, or his order, for the Sum of One Hundred Pounds, to be charged to his account ; &


In favor of Robt. Lollar, Esq'r, Paymaster of Militia of the County of Philadelphia, or his order, for the Sum of One Thou- sand & five Hundred Pounds, to be charged to his account.


Application for a recommendation of Mrs. Duche to pass into the City of New York with her children, being now read,


Ordered, That a recommendation be given to Mrs .. Duche, wife of the Rev'd Jacob Duche, to pass into New York with her chil- / dren, she giving security not to return again without permission from the Authority of the State, in the Sum of £1500.

An order was drawn on the Treasurer in favor of Capt. Jos. Stiles, Commissary of Military Stores, or his order, for the Sum of Five Hundred Pounds, to be charged to his acco't.


A Letter to the Secretary from Matt'w Clarkson, was read. On consideration,


Ordered, That Matt'w Clarkson, Esq'r, be appointed & Commis- sioned to be Marshall of the Admiralty. Matt'w Clarkson offers as sureties Mich'l Hillegas, Esq r, & Dr. Ger. Clarkson, & they are approved.


A Letter from Patrick Anderson of 27th ins , representing that Elections of Officers in the Militia have been held in Chester County, & voters admitted who have not taken the test, & returns of the said Election by Col. Gronow.


Ordered, That the Secretary do write Col. Gronow, & enquire into the aforesaid charge.


The Secretary represented to Council, that he had not been able to determine whether the Fees on Marriage Licences were to be raised, as well as the Fee Payable to the State, as on his own fees, & requested their direction therein. On consideration of the Law, it was the Opinion of Council that tho' Assembly probably intended to have raised the Fee due to the State, yet the words did not fully authorize the Secretary to raise it.


Petition of Rob't McNeil, a Prisoner in the Goal of the County of Lancaster, convicted of stealing a Mare, the property of John Harris, was read ; And it appearing that having suffered the Cor- poral Punishment adjudged, he had agreed to bind himself a Ser- vant to Pay his Fees.


Ordered, That the further consideration of the case of Geo. Hardy, now under sentence of Death, be referred to to-morrow.


A return of Justices elect for the district of lower Saucon Town- ship, in the County of Northampton, was read, by which it appears that John Biles & Anthony Lirch the elder, were elected ; & there- upon,


Ordered, That John Biles be appointed & Commissioned to be a Justice of the Peace for the County of Northampton.

A Letter from Col. Rich'd Humpton, of the Tenth Pennsylvania Reg't, respecting the settlement of his accounts, & a Note to him from the Auditors of the Public Accounts; Thereupon,


A Letter was written to the Auditors on that Subject.


Andrew Boyd, Esq'r, County Waggon Master of Chester County, & his Deputies, having applied to this Board for their Pay in said Offices,


Resolved, That is the opinion of this Board, that the same being a regular charge to the United States, founded upon Law, & Calcu- lated for their advantage, & which has been found beneficial to the Quarter Master's department, it will promote the service & be most regular that they should be paid by the Quarter Masters in the first instance. County Waggon Masters is by Law entitled to Major's Pay & Rations when in actual service, Deputy Waggon Masters, Captain's Pay & Rations during actual service ; And that the Pres- ent Petitioners be recommended to the Quarter Master General or his Assistants, therefor,


The Board taking into consideration the great difficulty attend- ing the attempt to Man the State Ship General Green, & that di- vers of the Seamen which had entered themselves on board her, have been induced to go on board Merchantmen, after having re- ceived a great part of their bounty Money,


Ordered, That an Embargo be laid on all Ships & other Vessels for & during the space of fifteen days, & that the Oficers Com- manding at Billingsport & Mud Island be directed to stop all out- ward bound Vessels until further orders from this Council.


The Council resumed the consideration of the unhappy case of George Harding, & the two several Petitions of divers inhabitants, The Petition of his Wife, The Petition of the Jurymen who convicted him, & the representation of the Judges of the Supreme Court, be- ing read, & some considerable time being spent in deliberation ; thereupon,


Ordered, That this Council do dismiss the said Petition's.

A Letter from Gen'l St. Clair, requesting the Accounts against Recruiting Officers to be sent to Camp, as many Soldiers Complain they have not been paid their bounty,


Ordered, That a Transcript of said accounts be forwarded to Camp, & that Gen'l St. Clair be informed that the Congress has not furnished this Board with any Money for the Recruiting Ser- vice.


Ordered, That the Secretary write to Thomas Hewitt, Esq'r, & his Brother, the Justices of Northumberland, that the discharge of a Soldier by a Court of Sessions is irregular and improper, the Sessions not having such a power, and that Joseph McHarg, of the 12th Pennsylvania Reg't, who has been lately discharged upon his own Affidavit, ought to be delivered up to his proper Officer, & procure his discharge in the usual form.


A Letter from Mr. Wilercks, in behalf of himself & others, Owners of the Scho. Liberty & Brig Achilles, setting forth that the same is bound to Statia, laden with Tobacco, and the other to Martinico, laden with Flour, for the use of the French Fleet; that both are cleared, & requesting permits to pass the Forts, & engages that no Seaman in the Service of the State on board either.


Resolved, That a Pass be given to the Achilles, on the Master giving good Security in £2000, not to carry off any Seaman or Ma- riner in the service of the State, or any Seaman belonging to the Vessels of the Subjects of His most Christian Majesty, without leave obtained from the Consul in Writing.

Ordered, That a Certificate be granted to Mrs. Duche, Wife of Jacob Duche, late of this City, of her having obtained leave to depart this State with her family & Children, on her Voyage to Great Bri- tain, & a recommendation to such of the Citizens of the United States into whose hands she may fall, to treat her with kindness & humanity.


An application being now made by John Wharton, Esq'r, in be- half of the Navy Board middle department of the United States, for permission for the Sloop Polly, Sanford Monroe, Master, laden with 189 bbls. Flour, 11 bbls. of Middlings, & 100 bbls. of Ship

Stuff, for the use of the Navy at Boston, to clear out for the said Port.


Ordered, That the Naval Officer be directed to clear out the said Sloop Polly for Boston.


Ordered, That the Officer commanding at Billingsport & Mud Island, be directed to permit the Sloop Polly, Capt. Sanford Mon- roe, to pass on her Voyage to Boston, any orders' to the contrary from this Council notwithstanding.


The following Proclamation, laying an Embargo on Vessels Out- ward bound, being read & considered, was ordered to be issued, Viz :


" Pennsylvania, ss :


" A PROCLAMATION.


" By His Excell'y JOSEPH REED, Esq'r, President, & the Su- preme Executive Council of the Commonwealth of Pennsylvania :


"WHEREAS, the Hon'ble the General Assembly of this State, at the earnest solicitations & instance of the Merchants & Traders of this City, did resolve, that a Ship of War should be fitted out with all Possible dispatch, for the protection & security of the Trade & Commerce of this State :


" And this Board having accordingly procured and equipped a Vessel for the said purposes, at a very great Public expence, it is now represented that notwithstanding the great encouragement given, a sufficient number of Seamen & Mariners have not yet en- tered on board said Ship, & also that many Masters of outward bound Vessels have received & carried off seamen belonging to said Ship, who had taken the Public bounty, whereby there is just cause to fear that the said Ship may be delayed on her Cruize, & our in- veterate Enemies continue their depredations & insults without any Check :


" In order therefore, the more effectually to execute the benefi- cial intentions of the Legislature, & answer the reasonable expecta- tions of the Merchants and other Traders, by affording them imme- diate relief & protection : (all other measures to remedy said evil having been found ineffectual :)


"We do hereby lay an embargo on all outward bound Vessels whatsoever, for & during the space of Fifteen days, and for that purpose do forbid the clearing out & dispatch, & the sailing of any Ship or other Vessel, of which the Naval Officer, the Commanding Officers of the Gallies & of the Forts on the Delaware, & the said State Ship, & all other Officers in the service of this State, are to take notice & govern themselves accordingly.


"And Whereas, it hath been represented to this Board that some persons, preferring their own private gain to the benefit & service

of their Country, have clandestinely Shipped & exported Flour & other Provisions, contrary to the Law of this State; We do, there- fore, hereby strictly enjoin & require all Merchants, Traders, Mas- ters of Vessels, & others, to Pay a due regard to the said Law, declaring that the most effectual measures will be taken to detect & punish such parties in future, & the Law enforced in its fullest extent.


" Given by order of the Council, under the hand of his Excell'y. the President, & the Seal of the State, at Philadelphia, this thirtieth day of April, in the Year of our Lord One Thousand Seven Hundred & Seventy-Nine.

The Council again resumed the consideration of the case of George Harding, now under sentence of Death, & ordered to be executed this day ; & after a full consideration of his case,


Ordered, That the said George Harding be reprieved until the end of the next Session of General Assembly, the word Session being understood to mean sitting.


John Wilcox attended & represented that the Schooner Liberty, Henry Hawkins, Master, had cleared out before the embargo was laid, & that she has passed the Fortifications at Billingsport and Mud Island ; & on Consideration,


Ordered, That the Scho. Liberty, Henry Hawkins, Master, be permitted to pass on her voyage, any order of this Council hereto- fore given to the contrary notwithstanding.


A Petition of Jacob Deisher, Supervisor of the Highways from Maxetawney Township, in Bucks County, praying that the Records may be searched for the return of a certain Road in the said Town- . ship was read ; and thereupon,


Ordered, That the Secretary do apply to Joseph Shippeu, Esq'r, late Secretary or Clerk of the Council, & obtain from him the Public Records belonging to his said Office.

Letters from Col. Hunter, of Sunbury, Dr. Allison, & others, relating to the depredations of the Indians.


Ordered, That Dr. Hutchinson be directed to procure a Box of Medicines sufficient for a Regiment for four Months, & a case of Instruments, to be forwarded immediately to Northumberland County, to the care of Samuel Hunter, Lieutenant of the said County.


An order was drawn on the Treasurer in favor of the Hon'ble Jos. Hart, Esq'r, or his order, for the Sum of Ten Thousand Dol- lars, to be by him forwarded to Col. Samuel Hunter, Lieutenant of the County of Northumberland, & charged to the said Hunter.


Ordered, That Dr. Andrew Todd be appointed Surgeon of the State Ship General Green.


The following were drawn on the Treasurer for Work done on board the Gallies, Viz :


In favor of Hill & Marriott for the Sum of Two Hundred & Sixty Pounds Two Shillings & Seven pence, & in favor of Hale & Lawton, for the Sum of One Hundred & Thirty Eight Pounds Ten Shillings & Three Pence.


Application of Samuel Dewees, Esq'r, Sub-Lieutenant of the County of Philadelphia for 150 Stand of Arms, for the use of Two Classes of the 7th Battalion of the said County.


Ordered, That Capt. Stiles do deliver to Samuel Dewees, Esq'r, . Sub-Lieutenant of the County of Philadelphia, One Hundred & Ffty Stand of Arms, for the use of the Militia, for which Mr. De- wees is to be accountable.


Ordered, That the Treasurer do exchange for James Hepburne, a Sum of the Emissions of Continental Bills called out of circu- lation, for Bills now Current, not exceeding Three hundred Dollars, the same having been received by him of the Treasurer.


Petition of Henry Van Vleck was read, praying recommenda- tion to pass into New York, &ca.


Ordered, That a Pass be granted to Henry Van Vleck to go into New York & to return, bringing with him his Negroes.


On application by Col. Humpton,


Ordered, That the Fine adjudged by the Court of Quarter, Ses- sions of the Peace for the County of Philadelphia, to be paid by John Allen, now confined in Goal, be remitted; & that he be dis- charged, on Payment of his Fees; Doct. John Sparhawk, from whom the Goods were Stolen, having had the same returned to him,


An order was drawn on the Treasurer in favor of Dav'd Ken- nedy, Commissioner for purchasing of Cloathing for the Continen- tal Army, in York County, or his order, for the Sum of Four Hun- dred & Fifty Pounds, the same to be charged to account of the said Kennedy.

A Letter from Mess. McClenaghan & Irwin ; whereupon,


Ordered, That Mr. D. Hart be appointed Second Lieutenant, & Mr. Hollingshead Master, of the Ship General Green.


Application from Robt. Knox & Comp'y, setting forth that a Brig belonging to them was cleared, and the Papers signed before the Embargo took place, May 3d, 1779, & praying a Permit to pass the Forts.


On consideration,


Resolved, That it is not consistent with the public Interest to permit any Vessel to depart until the State Ship is sailed. 1

A Letter from the Hon'ble John Jay, Esq'r, President of Cone gress, of this date, enclosing a Resolve of Congress, dated the 3d ins., requesting such of the Militia of this State to take Post at Fort Mifflin & Billingsport, in the room of Colonel Proctor's Men, as shall be judged by the said President & Council sufficient ; the said Militia to be allowed Continental Pay & subsistance, was read ; And Council having ordered Two Companies of Militia Artillery to go down to the said Forts, Council conceived that those two Companies will answer the intention of Congress, & be entitled to the Continental Pay & Rations under the said Resolve.


It being represented to Council that Robert French, Cornelius Ifillman, & Benjamin Loxley, jun., are at this time endeavouring to entice away the seamen now in this Port, and induce them into service in the neighbouring States, while an embargo is in force to enable the Council to Man the Ship General Green, State Ship,


Ordered, That a Warrant be issued to the Sheriff of the City & County, to. take the said Robert French, Cornelius Hillman, & Benja. Loxley, jun., and bring them forthwith before this Council,

On application by Doct. Jennings, who is stationed at Sunbury, & under peculiar difficulties in this respect,


Ordered, That the Receiver General of Cloathing do furnish to Doct. Jennings, Cloth of any Colour other than blue, & trim- mings for a Coat & Jacket, Linnen for two Shirts, & two pair of Thread Stockings.


Ordered, That Thomas Hale be appointed an Agent for seizing of forfeited Estates in the County of Philadelphia, in the room of Thomas Cuthbert, who has resigned.


The Council resumed the consideration of the abuses by Vendues being held contrary to Law.


Ordered, That the Secretary be directed to write to & request Edward Pole, Thomas Hale & Edward Evans, to pay attention to this abuse, & that the Council will give them effectual support in every legal measure which shall be taken for suppressing this grow- ing evil, & order prosecutions to be instituted against offenders.


Resolved, That Maj. William Armstrong be appointed Paymas- ter of the Workmen & others employed at Mud Island & Billings- port, or other public works on the Delaware, & that he settle the accounts of Money already advanced to Col. Bull, so as to take up the same from the beginning.

An order was drawn on the Treasurer in favor of Major William Armstrong, Paymaster of the Workmen at Billingsport, &ca., or his order, for the Sum of Five Thousand Pounds, & to be charged to his account.


Mr. John Chaloner, one of the Commissarys of Purchases, repre- sented to the Council, that an Agent acting under authority of a Law of the State of Maryland, had purchased of Mr. Levi Hollings- worth a quantity of Flour, & thereby raised the Price of Flour near five Pounds P cent,


Ordered, That the Secretary do write to Mr. Hollingsworth & desire him not to deliver the Flour until this matter is enquired into, and his attendance in Council immediately.

The Council having received information that Frederick Kessel- man, late of this City, Trader, hath gone over to & joined the Ene- my at New York,


Ordered, That a Proclamation be now issued requiring the said Fred'k Kesselman to render himself on or before the 20th day of June next, & abide the Judgment of the Court, according to the Law of the State, entitled " An act for the attainder of divers Traitors, &ca, if they render not themselves by a certain day, & for vesting their Estates in this Common wealth, & for more effectually discov- ering the same, & for ascertaining & satisfying the lawful Debts & claims thereupon.
