" By His Excell'y Joseph Reed, Esq'r, President, & the Su- preme Executive Council of the Common-Wealth of Pennsylva- nia :
" Whereas, Frederick Kesselman, late an inhabitant of this State, Trader, hath adhered to & knowingly & Willingly aided & assisted the Enemies of this State & of the United States of America, by having joined their Armies at the City of New York;
We, the Supreme Executive Council aforesaid, by virtue of cer- tain powers & authorities to us given, by An Act of General As- sembly entitled
' An Act for the attainder of divers Traitors, if they render not themselves by a certain day, & for vesting their Estates in this Commonwealth, & for more effectually discovering the same, & for ascertaining & satisfying the lawful Debts & claims thereupon,' do hereby strictly charge & require the said Frederick Kessel- man To render himself to some or one of the Justices of the Peace, Supreme Court, or of the Justices of the Peace of one of the Counties within this State, on or before the Twentieth day of June next ensuing, & also abide his legal trial for such his Treason, on pain that he, the said Frederick Kesselman, not rendering him- self as aforesaid, & abiding his trial aforesaid, shall from and after the said Twentieth day of June next, Stand & be attainted of High Treason, to all intents and purposes, & shall suffer such pains & penalties, & undergo all such forfeitures, as persons attainted of High Treason ought to do; And all the faithful Subjects of this State are to take notice of this Proclamation, and govern themselves accordingly.

Capt. Rob't French & Mr. Benja. Loxley, jun, were brought be- fore the Council, & Mr. Loxley being examined, it appeared that he had been in search of several Seamen who had deserted his ser- vice after having entered on board a Vessel in which he was in- terested :
And Capt. French being heard, & it appearing that he had been endeavouring to Spirit away the Seamen, & having pledged his Honor not to attempt to engage any Seamen in this State until after the Ship Gen'l Green shall have Sailed ;
Ordered, That Captain French do give Security to the State, him- self in the Sum of One thousand Pounds, & one sufficient Surety in the like Sum of One thousand Pounds, that he will not directly or indirectly entice away any Seamen from this State until after the Ship General Green shall have Sailed.
A Letter from Lieu. Col. Adam Hubley, dated Mill-Stone Camp, May 4, 1779, inclosing a Certificate Signed by Ar. St. Clair, Maj. Gen'l, that Col. Hubley is elected Lieu. Col. in the Troops of the State of Pennsylvania, &ca.
The Council took into consideration the return of Justices elect for Mulberry Ward, by which it appears that William Rush, Esq'r, & Will'm Colliday, were duly elected ; & thereupon,
Ordered, That Will'm Rush, Esq'r, be appointed & Commissioned to be a Justice of the Peace for the City of Philadelphia.
Mr Matt'w Stony, proposing to the State that he will Sweep the River in search of Anchors, &ca., & allow to the State one-fourth part of what he may recover,
Ordered, That the said Matt'w Strong have permission to sweep the River in search of Anchors, &ca., he allowing to the State one- fourth part of what he shall procure in so doing.
The following Petitioners praying permission to go into New York, were read, Viz :
Sarah Smith permitted to go, on giving Security £1500, not to return without permission from the State.
Peter Taylor permitted to go, on giving like security in the Sum of £500.
Mary Carr & her Daughter permitted to go, in she having given Security not to return without permission from the State.
Mary Hamilton permitted to go without giving security, her ease being singular & distressing, & she without Friends.
The Petition of Mrs. Rebecca Shoemaker being again read & considered, the Council were unanimously of opinion That she cannot, consistent with the Interest of the State, be permitted at present to go into the City of New York.

Capt. Martin, of the armed boat Lyon, attended in Council, & represented that divers of the Seamen belonging to the State Fleet had disappeared, & that it was apprehended they were gone to Bal- timore by persuasion of Capt. Robert French, & Duncan Mc- Kenzie also appeared, & deposed that he saw two of the Men be- longing to the said armed boat Lyon, in Company with Capt. French's people, and that he believes they are gone off to Balti- more with Captain French.
Ordered, That Capt. Martin do immediately proceed to Balti- more, in Maryland, & use his utmost endeavours to secure & return to their duty such of the Men belonging to the State fleet as he can find.
Ordered, That application be made to the Quarter Master's de- partment for a Horse for Capt. Martin, of the armed boat Lyon, to go to Baltimore on Public business.
The Council being informed That there is not a supply of Ammunition at Mud Island,
Ordered, That Col. Flower be requested to send down to Mud Island, as soon as possible, a supply of ammunition for Two Twenty-four Pounders & One Thirty-Two Pounder.
.A Letter from Henry Haller, Esq'r, dated Reading, May 4, 1779.
Ordered, That the Secretary do write to Col. Haller, & desire him to send down a list of the Justices of the Peace for the Coun- ty of Berks, who have taken the oath of Office, & also of those who have neglected or declined to do so, with their reasons, so far as has come to his knowledge.

Return of officers of Militia from John Carothers, Esq'r, Lieu- tenant of the County of Cumberland, dated May 1, 1779, by which it appears that the following Gentlemen were elected, Viz :

Ordered, That Commissions be accordingly issued.
Application was made by Col. Morgan Connor, for Cloathing for the Eleventh Pennsylvania Reg't.
And application was also made for Cloathing for the fourth Penn- sylvania Battalion.
Ordered, That the Receiver General of Cloathing, do immedi- ately deliver to Lieu. Jeremiah Jackson, of the 11th Pennsylvania Regt, Two Hundred Shirts & Cloth and Trimmings, for eight suits of Cloaths ; And also One Hundred Shirts and Cloth and Trim- mings for four suits of Cloaths, for the fourth Pennsylvania Regt., to be put up in a parcel, separate from the Cloathing ordered for the 11th Regt.
The following Petitions for permission to pass into New York, was read, Viz :- Elizabeth Holdsworth, wife of James Holdsworth, & Mary Ann Goreley.
Ordered, That recommendations be given to the said Eliza. Holdsworth & Mary Ann Goreley, to be permitted to pass into New York, they giving surety in the Sum of £500, not to return again without permission first had from the State.
Ordered, That the 67 Stand of Arms belonging to the State, & lately arrived from Cape Francois, now in the hands of Rob't Mor- ris, Esq'r, be delivered to Capt. Joseph Stiles, Commissary of Mili- tary Stores.ª
An order was drawn on the Treasurer in favor of Mr. Robert Al- lison, or his order, for the Sum of One Thousand Pounds, to be charged to his account.
On application,
Ordered, That the Sloop Betsey and Alithea, Joseph Basden Commander, late from the Island of Bermuda, in quest of Provi- sions to relieve the inhabitants of that Island from extreme neces- sity, be permitted to pass the Fortifications on Delaware ; And also the Sloop Betsy, William Popham Commander; Also, the Sloop Little Bernard, Capt. Leonard Albony; the last mentioned, with 3 bbls. Flour, 3 bbls. Bread & 3 bbls. Beef or Pork, & the follow- ing passengers, Viz :- Capt. John Osbourne, Capt. Erasmus Mo- ritzen, Capt. Henry Fishorst, Mr. Frederick Dashong & Mr. John Potts, agreeable to Petition.
Col. Grono, Sub-Lieutenant of Chester County, attended in con- sequence of a Letter wrote him of the 28th April, And it appearing

that the Election referred to in the said Letter, was conducted without a proper attention to the Test Law, & that the said Elec- tion on that account is informal,
Ordered, That the same be vacated, & that Col. Grono be direc- ted to hold a new Election as soon as convenient, & report to this Board, that Commissions may issue without farther delay.
Application was made to Council in behalf of Edward Tew, Rookloff Albertson, John Huddle, Joseph Best, James Craft, & John Knox, requesting they may have permission to Sweep the Delaware in search of Cannon & Anchors, they restoring to the State one-fourth part of all they shall obtain, & giving to the State a preference in the purchase thereof.
On consideration,
Ordered, That the said request be complied with, & the said Edw'd Tew, Rookloff Alberston, John Huddle, Joseph Best, James Craft, & John Knox, be authorized to Sweep the Delaware on the terms proposed by them.

Resolved That an order be drawn on the Treasurer in favor of the said Francis Hopkinson, Esq'r, for the Sum of One Thousand & five hundred Pounds, & that the same be delivered to him on his giving Bond with sureties, that if any claims or demands shall here- after be made on the Estate of the Rev'd Mr. Jacob Duche, which shall be allowed, so as to lessen the present apparent value thereof to the State, that then the said Francis Hopkinson shall refund the said One Thousand & five Hundred Pounds, or such part thereof as the Justices of the Supreme Court shall decree, so as that the said allowance may be made proportionate to the real Value of the Interest accruing to the Common-Wealth from the said forfeiture, any former allowance or decree notwithstanding.
The following three orders were drawn on the Treasurer, Viz .:
In favor of Col. Lewis Farmer, Commissary, &ca., or his order, for the Sum of Twenty Thousand Pounds, to be charged to his ac- count.
In favor of Capt. Joseph Stiles, Commissary of Naval Stores, or his order, for the Sum of Three Thousand Dollars, to be charged to his account.
In favor of his Excell'y Joseph Reed, Esq'r, President, or his order, for the sum of One Thousand Pounds, to be charged to his account, as part of his salary.
The return of Justices elect for Tyronne Township, in the county of Westmoreland, being read, it appears that John Allen, & James Paterson were elected ; thereupon.
Ordered, That Allen, Esq'r, be appointed & Commis- sioned to be a Justice of the Peace for the County of Westmore- land.
Ordered, That a Copy of the Letter from Gen'l McIntosh to Col. Lochry, be transmitted to the Board of War.
Maj. John Brown, of the fifth Battalion of Militia of the County of Philadelphia, having sent in his Commission & expressed his in- tention to resign the same, & it appearing that he stands charged with misbehaviour.
Ordered, That the resignation of the said Maj. John Brown be .not now accepted.
Petition of Serjeant Cline, praying to be appointed Ensign, was read, & dismissed ; no Serjeant being to be promoted but upon special recommendation of the Officers of the Regiment to which he belongs.
The Petition of Shewbart Armitage, praying to be appointed an Officer in the Reg't of Artillery commanded by Col. Proctor, be- ing read ; & his recommendation by Col. Proctor considered,
Ordered, That Shewbart Armitage be appointed third Lieu. in Col. Proctor's Reg't of Artillery.
A Certificate of an Election of Justices of the Peace for Barre Township, in the County of Bedford, being read ; & it appearing upon the face of it that there was some controversy about it,

Application was made by Mr. Blair McLenaghan, for the follow- ing Stores for the Ship Gen'l Green, Viz .:
800 round Shot, 600 d'ble- headed Shot, 200 round Shot for 3 Pounders, 100 d'ble-headed do., 50 round of Shot for Six Pounders, 50 d'ble-headed do., 5 Sheets Copper, 300 lbs. of Sheat lead. & 2 Drums & Fifes.
Ordered, That Capt. Stiles make immediate enquiry whether the above articles, or any of them, can be had from the Continental Commissary of Military Stores, & if so, to apply to the Hon'ble Board of War for an order, it being to replace Articles of the same kind lent to the Continent to go to South Carolina two Months since.

The President having laid before the Board a very complete & elegant draught of the proposed Fortifications for the defence of the River Delaware & the City, made by the General De Portail & his Assistants, at the joint instance of Gen'l Washington & this Board,
Resolved, That the thanks of this Council be given to General De Portail, for his important services in this respect; & that, as is customary on such occasions,
An order was drawn on the Treasurer in favor of the said Gen- eral De Portail, for Two Thousand Dollars, which he be desired to accept, as an additional acknowledgement, for his time & labor spent in the service of the State.
Resolved, also, That an order be drawn in favor of Col. La Ra- dine, assistant Engineer to Gen'l De Portland, for One Thousand Dollars, & for Six Hundred Dollars in favor of Ville- panche, to be delivered in like manner, for their services in the same business.
A Petition from the Officers & Men of Col. Eyre's Battalion of Militia Artillery, now in Garrison at the Posts on the River, was read & considered ; Whereupon,
Resolved, That the Board is fully convinced of the Justice & Truth of the facts set forth, & the sentiments therein expressed ; & that they will recommend the said application to the Hon'ble House of Assembly, at the next Sessions for proper attention & re- lief ; & that in the meantime, from a desire to do equal Justice, &

to encourage all those brave Men & true Patriots who turn out to defend & protect the Country in time of danger, Mr. Crispin, the Commissary of the State, be directed to supply them with Rum, Tea, Sugar, Soap & other Articles furnished the Continental Troops, agreeable to a Resolve of Assembly of the 5th of December, in the same proportion & at the same Rates as the same are fur- nished to any Troops in the service of the State; The same to be issued at the respective Posts, and to such only as are on actual duty
Resolved, That Col. Bull do proceed to execute the Plan of For- tification delivered in by Gen'l D. Portail, with all expedition, & that the same be not in any respect departed from, without the concurrence of this Board.
That the Refugee line at Billingsport, be repaired, at the least expensive mode of completeing that Work.
Ordered, That the Commissaries of Stores, supply Col. Bull with such Tools & other Articles as they may have, & he may want from time to time, in carrying on said Works, taking his Receipt therefor.
Resolved, That Col. Bull do confer with Capt. Boys, & other Captains of the Gallies, on the proper places to sink the new Che- vaux-de-Frize, & determine the numbers necessary.
Resolved, That Col. Bull be allowed at the Rate of Twenty-four Dollars $ day, for his trouble & service for Superintending & di- ' recting said Work, & that the same do commence from the time the said Col. Bull was engaged by this Board to attend said Work, & collect materials, under a former Resolve ; to Wit : the 27th Feb- ruary last.
Whereas, the purposes intended to be answered by the embargo on all Ships, &ca., has not yet been fully answered,
Resolved, That the Embargo on all Shipping be further contin- ued for fifteen days, or until otherwise ordered by this Council.

Resolved, That the same be complied with, & the Waggon Mas- ters of Lancaster, York & Cumberland, (in which Counties the said Provisions are) do furnish the number required with all expe- dition, & that the same be as follows, Viz :- from Lancaster 40, York county 30, Cumberland 25.
Gen'l St. Clair, Commanding officer of the Pennsylvania line, having certified that Adam Hubley, Esq'r, Lieu. Colonel of the Reg't of the Troops raised by this State, is the oldest Lieu. Colo- nel in the line, & therefore entitled to succeed to the vacancy made by the resignation of Col. Hartley, in the 11th Reg't.
Ordered, That the said Lieu. Colonel Hubley be recommended to the Hon'ble Board of War for the Commission of Lieu. Colo- nel Commandant of the Eleventh Regiment.

SUPREME EXECUTIVE COUNCIL.
. A certificate signed by Holker, certifying that the Schooner Swan, Capt. James Robinson, is freighted to transport Three Hun- dred barrels of Flour to St. Pierre of Martinique, for the use of the Fleet Commanded by His Excell'y, the Count d'Estaing; & ap- plication by George Meade, &ca, Owners of the said Schooner, for permission to clear out for St. Pierre accordingly.
Ordered, That the Naval Officer do clear out for St. Pierre, Martinique, The Scho. Swan, Capt. Ja's Robinson, freighted with Three hundred barrels Flour, for the use of the Fleet commanded by His Excell'y, the Count d'Estaing.
Ordered, That the State Treasurer be requested to furnish the Council with an account of the Monies paid by him upon orders drawn by Auditors of accounts.
The Petition of John Taylor, a disabled soldier of the Flying Camp, was read ; thereupon,
Ordered, That it be recommended to the Justices of the County of Northampton, to enquire whether the Petitioner has been wound- ed in an engagement, or whether he has been disabled by natural sickness ; if the former be the case, the said Justices will provide for him, according to the Act of Assembly for the relief of disa- bled soldiers & seamen, passed 18th September, 1777; if disabled by natural sickness, it is recommended to the Overseers .of the Poor to make provision for the Petitioner, according to his circum- stances & necessity. .
