The Council took into consideration the representation of Robit Smith, County Lieutenant, & Andrew Boyd, Sub-Lieutenant of the County of. Chester, respecting the Commissioners & Assessors of the County of Chester, not legally elected, continuing to set, not- withstanding the determination of the Hon'ble House of General Assembly respecting the election of the said County; & there- upon,


Ordered, That the Secretary be directed to write to the Com- missioners & Assessors of the County of Chester, elected according to Law, to take their seats at the board, & proceed to the duties of their office.

The President laid before the Board a Letter from the Hon'ble the President of Congress, inclosing sundry resolutions of Con- gress.


" First-To enact Laws for detecting persons employed in making Counterfeit Money, or passing it knowingly, dated 1 Jan'ry, 1779. " Secondly-In calling in 15 Millions of Dollars the ensuing Year, & 6 Millions annually for 18 Years to come.


"Thirdly-In calling in the Emissions of May 11, 20, 1777, and April 11, 1778, both dated Jan'ry 2, 1779.


"Fourthly-In fixing the several Quotas of the said 15 Millions upon the respective States in the Union, Dated Jan'ry 5, 1779."


Ordered, That the same be filed, in order to be laid before the Hon'ble House of Assembly at the next meeting.


Ordered, That the Fine upon John Smallwood be remitted, & his offence pardoned.

Petition of John Smallwood, now confined in the Goal of thir City, setting forth that he had been fined by the Court of Quarter Sessions of the Peace of the County of Philadelphia, for the Sum of Fifty Pounds, & praying the said fine may be remitted and he enlarged from imprisonment, was read ; And a Certificate signed by Dr. Fred'k Phile, being also read, that the said John Smallwood was very ill with the Rheumatism all over his body, &ca .; & there- upon,


Ordered, That the fine & imprisonment of John Smallwood, now confined in the Goal of the City of Philadelphia, be remitted, in consideration of his great indisposition of body.


David Caldwell laid before the Council a draft of the late State Navy board on Will'm Webb, Pay-master, for the Sum of £141 10 11, " to be charged to the Continental Navy board," and it appear- ing by Certificate that the same remains unpaid ; and thereupon,

Ordered, That the Secretary give notice in the Papers that the House & bridge at the Middle Ferry is to be Rented, and the Sec- retary will receive proposals from any person disposed to Rent the same.


An order was drawn on the Treasurer in favor of John Parker, Bricklayer, for the Sum of One hundred & fifty Pounds, to be charged to his account.

Also, David Rittenhouse, Esq'r, Treasurer; Daniel Roberdeau & William Shippen, Esquires, Delegates of this State in Con- gress.


And the Council conferred with the said Gentlemen on the situa- tion of the State Treasury, & the probable effects which the Re- solves of Congress for calling in the Bills of credit emitted by them of 11th of April & of the 20th May, will produce thereon.


Capt. 'Joseph Dean, William Pringle, Mr. Purviance, & other's, attended the Council, & represented, That a considerable number of sailors had assembled together under pretence of raising their Wages, & had committed several unwarrantable acts of a danger- ous tendency, unrigging Vessels, & taking away by force the Workmen employed on board them.

The Council thereupon recommended, by Letter to Plunkett Fleeson & Benja. Paschall, Esq'rs, & others, the Justices, to exert themselves in suppressing the said Riot, & bringing the offenders to Justice ; And there appearing an order of the Board of War to Gen'l Arnold, to give such Military assistance as this Council shall apply for,


Ordered, That Maj. Gen'l Arnold be requested to give such aid to the Justices of the Peace of this city as they shall apply for, to suppress a Riot among the sailors.


James Claypoole, Esq'r, made returns of an Election chusing a Representative for the City of Philadelphia, to serve in General Assembly, held on the 5th instant, and the same was read ; whereby it appears that Will'm Hollingshead was duly elected a Represen- tative in General Assembly for the said City.

The Memorial of David Brown & Edw'd Randolph, Lieuts. of the fourth Pennsylvania Reg't, setting forth that they had been stationed on the Frontiers of the State, & were in great distress for want of cloathing, was read ; and thereupon,


Ordered, That Lieuts. David Brown & Edw'd Randolph, of the 4th Pennsylvania Reg't, be furnished by Jacob S. Howell, State Clothier, with each one suit of cloaths, 2 shirts and 2 pair of stockings.


The Account of Lieu. Jacob Mosser, of the 6th Pennsylvania Reg't, for Money advanced to Recruits, & for his service therein, was inspected ; and thereupon,

Joseph Ledree & Sam'l Oliver, presented to Council a return of a Warrant for the holding an Election for chusing, by the freeholders of South Ward, two fit persons to be returned to this Council for - the purpose of one of them to be appointed a Justice of the Peace for the County of Philadelphia, from which it appears that no Vo-' ters had appeared at the time and place appointed for holding the said Elections.


Ordered, That the Delegates of this State in Congress, be direc- ted to apply to Congress for an advance of Sixty Thousand Pounds,

Ordered, That Jacob S. Howell, the State Clothier, be directed to furnish Capt. Christ'r Getting, of the 12th Pennsylvania Regi- ment, with a suit of Officer's Regimental Cloathing.


The application of Capt. Will'm Mackey, of the - Pennsyl- vania Regiment, who was wounded at the Battle of Brandywine, taken Prisoner & now on Parole, praying for a suit of Cloaths, was read ; & thereupon,


Ordered, That Capt. Will'm Mackey be furnished by Jacob S. Howell, State Cloathier, with a suit of Cloaths & two Shirts.


On consideration,


Ordered, That Benjamin Paschal, Esq'r, be appointed & Com- missioned to be one of the Justices of the City Court of Phila- delphia.


The Petition of Mess. Purviance, Dean & Harbeson, praying to be supplied with divers Stores, was read ; and thereupon,


Ordered, That Capt. Stiles, Commissary of Military Stores, be directed to furnish Mess. Purviance, Dean & Harbeson, with 2501bs Gunpowder, 50 Ibs Match Rope & 200 31b & 41bs Bunches of Grape Shot, if they can be spared from the Public Stock, they paying a reasonable Price for the same.

Mrs. Parrock, Wife of John Parrock, late of the City of Phila- delphia, attended in Council in consequence of the order of yester- day. (she was attended by Mr. John Drinker & his Wife. ) Mrs. Parrock being informed that the Council had received intelligence of her having been lately in the City of New York, She replied that she had really not been there, nor out of this State; And upon being informed of the complaint of George Becktel against her, re- specting her demand of Rent, & that the Council conceived the Rent was not payable to her, it being forfeited to the State by her Husband ; To which she replied, That the Estate was her own, be- ing conveyed in trust by her Father to her use, & that she was ready to shew her Title; & thereupon,


Ordered, That it be recommended to Jonathan D. Sergeant, Esq'r, Attorney General, to inspect the Title of Mrs. Mary Par- rock to a House & Lot of ground in Spring Garden, in the possess- ion of George Becktel, which she claims to hold independent of her Husband, John Parrock, & of such other Estate as she may claim to hold in her own right, if she shall lay the same before him, & report to this Council his opinion thereon.


Frederick Snyder's account of sundry small expences paid by him, & for his attendance on Council from the 12th of October to the 12th instant inclusive, being examined & allowed,


An order was drawn on the Treasurer in favor of Frederick Sny- der, Door-keeper, for the sum of Two Hundred & Two pounds four Shillings & Seven pence, the Amount of his account.

Ordered, That Frederick Hagner, Esq'r, be appointed to go to Northampton & receive from John Tyler all the public property in his hands, & transmit such of them as may properly be moved, to Capt. Joseph Stiles, Commissary of Military Stores in this City, And to sell such buildings and other property in that Town which may belong to the State.


Ordered, That Mr. George Henry deliver to Captain Joseph Stiles, Commissary of Military Stores, or his order, such Stores now in his hands as he may have occasion for from time to time.


The Petition of Robert Shewell, praying in effect that the Coun- cil order Mr. Isaac Wikoff to pay him for certain effects detained by him from the Petitioner, was read & dismissed, The Council having no power over Mr. Wikoff, & not being disposed to relin- quish the claim of the State, without further consideration.

A Letter from Thomas Adams, Francis Lightfoot, and Meri- wether Smith, Esq'rs, Delegates of the State of Virginia in Con- gress, inclosing the Resolves of the House of Delegates of the State of Virginia on the 9th of December, 1778, respecting the line between the two States, was read.


A Letter from Dan'l' Roberdeau, Esq'r, inclosing a Resolve of Congress, in the following words, Vizt :


"In Congress, Jan'ry 16, 1779.


" The Delegates of Pennsylvania laid before the Congress a Let- ter of 14th, from the President of that State in Council, instruct- ing them to apply to Congress for an advance of Sixty Thousand Pounds, for the use of that State; whereupon, on motion,


"Resolved, That the Sum of One Hundred & Sixty Thousand Dollars be advanced to the State of Pennsylvania, the said State to be accountable.

Ordered, That the Sum of One hundred & Sixty Thousand Dol- lars, ordered by Congress on 16th instant to be advanced to this State of Pennsylvania, be paid to David Rittenhouse, Esq'r, Treas- urer of the State.

MONDAY EVENING, Jan'ry 18, 1779.

Ordered, That Mr. George Henry apply to the Attorney General, & state the proceedings respecting the Salt lately seized by order of the Council in Jos. Pritchard's Store, and take his direction far- ther on the matter ; That Mr. Henry also employ an assistant Council, to be recommended by the Attorney General, & advance from the Money in his hands the necessary Fee; & that the Attor- ney General be desired to get the Replevin issued at the suit of Mr. Wilcox, quashed at the next Court, if, upon consideration, he & the assistant Council shall judge it consistant with the rules of Law; & that in the mean time Mr. Henry be directed to see that the seizure extend to all the Salt left in the City by Backham & Ash- ton, British Merchants ; But if it shall be found that the said salt is in the Possession of the Commissioners of the United States, he is. directed to permit them to return it, upon their en- gagement to account to the State for the value, if the property of the Salt shall be finally determined to be in this State; And that Mr. Henry be furnished with a Copy of this order.


Ordered, That Mr. Howell, Commissary of Cloathing, get the Cloth on hand cut out into suits of suitable sizes, & forward it to the Camp; that if there are not trimings on hand sufficient, to pro- cure them & fold them up in each suit.


Petition of Robert Macky, setting forth that a valuation of the armed Boat Viper, made by Emanuel Eyre and Joseph Carson, in pursuance of an order of this Council, was lost, &ca, was read ; & thereupon,


Ordered, That Mr. Benjamin Eyre & Mr. Joseph Carson be re- quested to Certify to the Council their valuation of the armed boat Viper, retaken by Mr. Robert Macky last Summer.


The Council resumed the consideration of the case of the pro- perty in the hands of Mr. Wikoff, imported in the Flora, claimed by Mr. Robert Shewell, & which Mr. Wikoff has engaged to ac- count for to this Council.


Ordered, That Thursday the fourth day of February next, be appointed to hear Mr. Robert Shewell & Mr. Isaac Wikoff, re- specting part of the Cargo of the Flora, which Mr. Wikoff has en- gaged to account for to this Council, and which Mr. Shewell claims as his property ; And that the Secretary give notice hereof to the parties.

The following Proclamation against forestalling being read & approved, was ordered to be published under the State Seal, signed by the President & attested by the Secretary.


" Pennsylvania, ss :


" By the Supreme Executive Council of the Common- Wealth of Pennsylvania :


"A PROCLAMATION.


"WHEREAS, The forestalling the Markets & engrossing great quantities of Articles of usual Consumption, have a manifest ten- dency to enhance the prices, odious & punishable by Law; But when such practices are extended to Bread & the other necessaries of life, they become distressing and ruinous to the industrious poor, & most heinously criminal. In order therefore, to prevent as much as possible the inhabitants of this State from unwaringly falling into such dangerous & illegal practices, We do hereby make it known, that we have caused prosecutions to be commenced against some persons Charged with the above offences, and we do strictly charge the Justices of the Peace, Constables & other civil Officers, to make due enquiry into the above offences; & we do require the faithful inhabitants & Subjects of this State to whose knowledge the same may come, to make discovery thereof to the Officers of Justice, in order that the perpetrators may be brought to speedy & condign punishment.


" Given by order of the Council, under the hand of his Excel- lency Joseph Reed, Esquire, President, & the Seal of the State, at Philadelphia, this eighteenth day of January, in the year of our Lord One thousand Seven Hundred & Seventy-Nine.

Whereas, The wisest, freest, & bravest nations, in the most vir- tuous times, have endeavoured to perpetuate the memory of those who have rendered their Country distinguished services, by pre- serving their resemblances in Statues & Paintings; This Council, Deeply sensible how much the liberty, safety, & happiness of America in General, & Pennsylvania in particular, is owing to His Excell'y General Washington & the brave men under his Com- mand, do resolve, That His Excell'y Gen'l Washington be request- ed to permit this Council to place his Portrait in the Council Chamber, not only as a mark of the great respect which they bear to His Excellency, but that the contemplation of it may excite others to tread in the same glorious & disinterested Steps which lead to public happiness and private honor, And that the President

A Representation having been made by Colo. Andrew Boyd, Waggon Master of the County of Chester, thro' James Young, Esq'r, W. M. G. S., to this Board, that Jesse Jordan, a deputy Waggon Master, was sent by Col. Boyd with a Brigade of twelve Waggons to Philadelphia, under the Waggon Law of this State, to convey Provisions from thence to New Windsor, in consequence of orders from him, the Waggon Master General, of the 27th Sep- tem. last, & that when the said Jorden returned home, he informed Col. Boyd that when he arrived in Philadelphia with his Brigade, he applied to John Mitchell, Esq'r, Deputy Quarter Master General, for loading, who sent him with his Brigade to Egg harbour without loading, with orders to load Merchandize there of private property, & return with it to Philadelphia, which he did, that the loading was delivered there into private stores ;


On consideration,


Ordered, That Mr. Mitchell be requested to state to Council, in Writing, the transaction relating to Jordan's Brigade of Wag- gons sent by him to Egg harbour, ascertaining the property, or to whom the same was delivered.

The Council having considered the case of John Hays, Allen M'Cultom,


Ordered, That the Paymaster of the State Fleet do pay off Allen M'Cultom & John Hays, the first to the 22d, the other to the 21st of September last, from which time they are to be deemed discharged from the service.


The Council having obtained a state of the claim of Col. Atlee, to an appointment as a Brig'r General in the Continental Army,


Ordered, That the same be transmitted to His Excell'y Gen'l Washington, & his opinion requested thereon, and it was sent ac- cordingly.


A Letter from Gov. Morris & Will'm Whipples, Esquires, dated the 19th inst., was read.


WHEREAS, it is alleged that the Court of Quarter Sessions of the Peace for the City of Philadelphia, had adjourned so early that divers persons said to have been guilty of misprission of Trea- son, remained without trial, and this Council conceiving the speedy trial of persons so charged to be of great importance to the Safety of the State; And Whereas, it is understood that the sitting of the Court of Common Pleas for the County of Philadelphia, will ren- der it necessary for the said City Court to adjourn :


Ordered, That the Secretary be directed to write to the Judges of the Court of Quarter Sessions of the Peace for the City of Philadelphia, & inform them it is the desire of this Council that the said Court be adjourned to a short day, then to meet, attended by the Grand Inquest of the City, in order to afford time for the trial of Persons charged with Misprissions of Treasons.


Robert Macky laid before the Council a Valuation of the Armed boat Viper, retaken by him from the Enemy, signed by Benja. G. Eyre & Joseph Carson, amounting to three hundred & fifteen Pounds ; and thereupon,


An order was drawn on the Treasurer in favor of Mr. Rob't Macky, or his order, for the Sum of One hundred & fifty-seven Pounds & Ten Shillings, his right of Salvage of the armed boat Viper.

An order was drawn on the Treasurer in favor of Major Will'm Armstrong, Pay-master of the Workmen employed at Billings- port, or his order, for the Sum of Two hundred & fifty Pounds, to be charged to account of the said Armstrong.
