A Petition signed by a number of Inhabitants of the Borough of Bristol, praying a redress of a grievous insult offered to that Bo- rough by a certain Capt. Sims, was presented & read.


Ordered to lie on the Table.


Caleb Davis, Esq'r, Prothonotary of the County of Chester, com- plained that Henry Hale Graham, Esq'r, late Prothonotary, had un- der divers pretences, neglected to deliver up to him, the said Davis, the Books, Records, Papers & Seals belonging to the said Office; Whereupon the Council, taking into consideration the great danger to which the same are exposed, by reason of the approach of the Enemy,


Ordered, That a Warrant be made out & directed to the said Ca- leb Davis, Esq'r, authorizing & empowering him to enter, in day time, with proper assistants, the dwelling House & Out Houses of the said Henry Hale Graham, Esq'r, & search for & take possession of, & secure in some safe place the Books, Records, Papers & Seals belonging to the said Office, & requiring him to make returns of what he may do herein to the Council.


On motion, Agreed, That Tho's Mckean, Esq'r, be appointed Chief Justice of the Commonwealth of Pennsylvania, and was or- dered to be Commissioned Accordingly.


On motion, Agreed, That Jonathan Dickinson Sergeant, Esq'r, be appointed Attorney General of the Commonwealth of Pennsyl- vania.


The Hon'ble Congress, by their Resolve of this date, wherein it is recommended in the following manner, Viz :


" United States in Congress Assembled, Monday July 28, 1777.


"Resolved, That it be recommended to the Executive Council of the State of Pennsylvania to call out Four thousand of the Militia, in addition to those already called forth, & as their service is imme- diately wanted, that they call forth such as can be soouest collected.


On motion, Agreed, That the City of Philadelphia furnish One Class of the Militia, Philadelphia County Two Classes, Bucks County One Class, Chester County One Class, Lancaster County One Class, York County One Class, Cumberland County One Class, & Northampton County One Class, & that orders be immedi- ately issued to the Lieutenants to bring out the said Militia with all possible expedition. Also, that a detachment of the Artillery of the City of Philadelphia, equal to three-eighths parts of the whole, be called into service.

On motion, Agreed, That John Pearson, Nicholas Deihl, Isaac Hendrickson, Isaac Serril, Harvey Lewis, & Ja'c Richards, be ad- ded to the Committee for driving off the Stock on the Enemies' approach.

" The State Navy Board informed the Council that " the Congress has empowered the Continental Navy Board to purchase twelve Vessels, to be fitted out as Fire Ships, & that the Continental . Navy Board had applied to them to fit out those Vessels," & ask the Council to signify their approbation of the measure, and at the same time informing them that there is combustibles for Four Fire Ships now ready.

Ordered, 'That the Lieutenant of the City & Liberties of Phila- delphia furnish Colo. Nichola with One Hundred and Fifty Men of the Militia, to assist the City Guards in the charge of their impor- tant duty.

An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Sam'l Smith, Esq'r, Sub Lieutenant of the County of Bucks, for the Sum of Nine hundred Pounds, to be charged to Colo. Jos. Kirkbride, Lieutenant of the said County, for the purpose of Paying Substitutes, purchasing Blankets, &ca., for which sum he is to account.


The Petition of upwards of Twenty of the Freeholders of the Town & Township of Easton, and of Forks Township in the County of Northampton, setting forth that Rob't Traill & Henry Fullert, Esq'rs, had declined, & still continue to decline to take the Oaths necessary to qualify them to act in the Office of Magistrate, & that great inconveniences unavoidably & daily arise from there being no Magistrate resident in the said Town of Easton, & also setting forth that it is necessary that one or more Magistrates should be seated in the said Town of Easton, &ca., &ca., was read, & the same be- ing considered ; thereupon,


On motion, Agreed, That Rob't Levers and Abraham Berlin be appointed & Commissioned as Justices of the Peace for the said County of Northampton, & that they be Commissioned accordingly, in the room of the said Rob't Traill & Henry Fullert. '


An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Ja's Loughead, Paymaster of the City Mili- tia, for the Sum of Two Thousand Dollars, for which he is to ac- count.


Francis Hopkinson, Esq'r, from the Continental Navy Board, ap- plied to Council & requested that a Pilot may be put on Board each of Two Ships intended to be ordered down the Bay by the said Navy Board ; thereupon,


Ordered, That the States Navy Board be directed to furnish the Continental Navy Board with Two Pilots, either from among the Chevaux-de-Frize Pilots now in the Pay of this State, or any other Pilots which they may be able to obtain for the said Purpose.


The Council taking into consideration that there does not re- main any great necessity of continuing the board of War, & that strict attention ought to be given to the saving the public money ; thereupon,

Ordered, That the thanks of the Council be given to the Gen- tlemen of the Board of War, for their services to the State, & that they be discharged from further service as a board of War.


Dr. Witherspoon, by a Card, presented his Compliments to the Vice President, & request that Ja's Scott, David Walker, & John Carson, (who were committed to gaol some time ago, as suspicious persons,) may be delivered to his Custody ; thereupon,


Ordered, That they be delivered to Doc't Witherspoon's care, to be retured when called for.


Ordered, That a writ be issued for imprisoning Lewis Gordon, Esq'r, late Prothonotary of the County of Northampton, under the late Government.

A Letter from Gen'l Hand, dated Fort Pitt, 24th July, 1777, requesting that orders may be given to the Militia Officers of West- moreland & Bedford, to furnish him with what Men they can spare, for the purpose of penetrating the Indian Country & destroying their settlements, which he apprehends to be necessary to prevent the continuance of the Cruelties which they have lately practised, as appears inclosed in the General's letter,


Ordered, That the Letter from Gen'l Hand, dated Fort Pitt, 24th July, 1777, with paper contained therein, be sent to Congress, for their consideration & direction thereon.

The Continental Board of War having made application to the Council for a guard, in case it shall be found necessary to remove the Prisoners from Lancaster ; thereupon,


Ordered, That on application of the Commissary of Prisoners, or his Deputy, the Lieutenant of the County of Lancaster, do fur- nish the Guard which may be necessary for the said purpose.


Mr. James Dundass applied for Money to pay off several Con- tracts with Workmen, for tools, &ca., and an order was drawn on Jacob S. Howell, in favour of said James Dundass, for the Sum. of One thousand five hundred pounds, for which he is to account.


On motion, agreed, That Mr. John White be appointed paymas- ter of the Militia of the State of Pennsylvania.


Mr. John Sullivan, a Prisoner on Parole, having prayed an en- largement of his Bounds ; thereupon, Agreed, That he be indulged with the liberty of the City & County on the West side of Dela .. ware for Six Miles.

The Petition of Negro Harry, formerly a Slave of Jo'n Humphrey's setting forth, that he was Manumitted in due form by his said Mas- ter, & Ann Humphreys, the Widow of his deceased master, is about to sell him to a person whom, he is apprehensive, will immediately

carry him out of this State to places far remote from his Witness, & where, it is probable, he may be detained during his life, &ca ; & that by reason of the Courts of Justice being shut, he can pro- cure no process whereby his person may be secured till the matter in dispute can be legally determined ; & therefore prays that meas- - ures may be taken, so as to secure his person from injury till the Courts of Justice shall be opened, as to this Council may seem expedient ; and thereupon,


Ordered, That Mrs. Ann Humphreys (Widow of Mr. Jonathan Humphreys, late of this City,) be written to, requesting that she will not proceed in selling the aforesaid Negro Harry, until she shall make it clearly appear that she has a right so to do


Will'm Mollaston, one of the Pilots engaged in the service of this State by the late Council of Safety, applied for his discharge from that duty, in order to go on Board the Delaware Frigate ; thereupon,


Ordered, That the aforesaid Wm. Mollaston be discharged ac- cording to his request.

Mr. Penrose, Mr. Dunlap, Mr. Hall, Mr. Hunter, & other Gen- tlemen of the Light Horse, waited on the Council & informed that Benja. Chew, Esq'r, was, in conformity to the order of Council, made Prisoner, and remained at his own House as a Prisoner ; and that the Hon'ble John Penn, Esq'r, was also made Prisoner, & would, at 12 O'Clock this day, be at the House of Will'm Allen, Esq'r, subject to the orders of the Council ; And the Council there- upon,


Ordered, That information be given to Congress, that the Hon'ble John Penn, Esq'r, late Governor of Pennsylvania, & Benja. Chew, Esq., Chief Justice, Register General of Wills, &ca, & one of the Governor's Council of the same, have been made Prisoners agreeable to the recommendation of Congress ; That both of them refuse to sign a Parole of any kind ; and that Congress be requested immediately to order them to be removed out of the State.

An order was drawn on Jacob S. Howell for the Sum of Five thousand Pounds, in favor of Joseph Blewer, Esq'r, Chairman of the Naval Committee, for which he is to account.


Agreeable to the order of the day, Francis Armstrong of the Township of Little Britain, in the County of Lancaster, Complain- ant against James Whitesides, Justice elect of the said Township, George Ewing of the same place, & John Allison, one of the Judges of the Election for the choosing of Justices for the said Township, appeared and laid before the Council divers depositions and evi- dences said to be respecting the said Complaint, which having been duly examined, do not appear to contain any matter immediately relating either to the disqualification of the said Whitesides to fill the Office of a Justice of the Peace, or tending to prove any unfair proceedings at said Election.

The Continental Board of War having in writing desired that this Council will procure an Officer & Six Gentlemen of the Philadel- phia Light Horse to escort John Penn & Benja. Chew, Esq'rs, as Prisoners to Fredericksburg, in Virginia, and direct them to call at the War Office & receive their instructions as soon as possible, and the resolutions of Congress respecting the removal of the aforesaid Gentlemen being read ; thereupon,


Ordered, That the Officers of Light Horse of this City be re- quested to select from among themselves & their escort an officer & Six Gentlemen to escort John Penn & Benj'a Chew, Esq'rs, as Pri- soners to Fredericksburg, in Virginia, & that the escort call at the Continental War Office & receive their instructions as soon as pos- sible.


Gen'l Du Coudray having applied to Council for a House at Fort Island,

MINUTES OF THE


Ordered, That Gen'l Du Coudray be furnished with the House on Fort Island which may best his conveniency.


A Letter from Gen'l Potter respecting the promise of the Sub- Lieutenants of Bucks County to their people, that they shall be discharged when the time of those that entered first is out,


Ordered, That a Copy of the said Letter be sent to Col. Kirk- bridge, Lieutenant of the County of Bucks.


Mr. White, lately appointed Paymaster of this State, having de- clined to accept that appointment, as he chose to enter the Service in another line,


On motion, Agreed, That Capt. Thos. Dorsey be appointed Pay- master of the Militia of this State.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer, in favor of Will'm Crispin, for the Sum Two Thousand Pounds, for which he is to account.
