On motion, Agreed, That as it does not suit the conveniency of Colo. Hunter to continue Paymaster of the County of Berks, Mr. Henry Spyker be appointed Paymaster of the Militia of the County of Berks.

MINUTES OF THE


Colo. Ayres & Capt. Brown, of the Artillery of this City & Lib- erties, laid before the Council some inconveniences which will arise from ordering out three-eighths parts of the Artillery Militia in the City, & proposed that instead thereof, two complete Companys of Militia Artillery Men now go into service.


Application was now made by Colonel Flower, in the name of Gen. Knox, to borrow the two brass twelve Pounders Field Pieces belonging to this State, and he offers to leave in exchange for the present, two brass six Pounders for the use of the Militia; and Congress, by their resolve of this date, having recommended it to Council "to lend the Commander-in-Chief" the said two brass twelve Pounders ; thereupon,


Ordered, That the Council will lend to the Commander-in-Chief the Two brass 'Twelve Pounders belonging to this State, & that they be delivered to Colo. Flower, on condition that two good brass six pounders be left in their stead, for the use of the Militia.


On motion, Agreed, That Jas. Irwin, Esq'r, be appointed a Brig- adier Gen'l of this State.


Ordered, Than an express be sent to French Creek, with orders to Mr. Dehaven to send down immediately all the Arms in his pos- session which are fit for service, & an account of the Lead in his possession.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Colo. John Weitzel, Lieut. of the County of Northampton, for the Sum of One Thousand and Five hundred Pounds, which he is to account for.


Ordered, That application be made to the Board of War, for an order to their Commissary of Stores to supply the Militia of this States, thro' Mr. Robert Towers, our Commissary, with such Stores as they may have occasion for & which he cannot furnish them with.


An order was drawn on Dav'd Rittenhouse, Esquire, Treasurer of this State, in favor of Mr. James Sutter, for the Sum of Five Hundred Pounds, to be by him delivered to Mr. Tho's Savage, & charged to said Savage as director of Salt-works.

The Congress by a Resolve of yesterday, having recommended to this Council that " the leaden Spouts in Philadelphia be taken

down for the use of the Laboratory," & it appearing to this Coun- cil to be a Salutary & necessary measure ; therefore,


Resolved, That Evan Evans, Robert Allison, & James Worrell, be appointed to take down all such Spouts accordingly, & make a just valuation thereof.


And in conformity with another Resolve of the same date, found- ed on evident necessity & sound Policy,


Resolved, That the Colonel or Commanding officer of each Re- giment of the City Militia, do appoint one or more Officers & & sufficient number of men in each ward, who shall search the Houses of all such of the "inhabitants of the City of Philadelphia, who have not manifested their attachment to the American cause, for Fire Arms, Swords & Bayonets; That the owners of the Arms so found be paid for them at an appraised Value, & that they be de- livered to such of the Militia of the State of Pennsylvania who are at present unarmed & have been called into the field," and that a Constable attend each party during the said search, in order to keep the Peace.


And another Resolve of Congress of the same date, "requesting this State to cause all persons within the same notoriously disaf- fected, forthwith to be apprehended, disarmed, and secured, till such time as the State shall think they may be released without injury to the common cause ;" the same was referred to further consideration.


N. B. The above mentioned Arms are to be put into the hands of the Lieut. of the City, for the aforesaid purpose. 1


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Michael Boyer, for the Sum of Fourteen pounds & fourteen Shillings, for riding express on Public Business.


Mr. Robt. McGee petitioned the Council, praying to receive in Exchange, One large Copper bottom, one small raised ditto, and four parts proposed for large still heads for Copper, of equal quality. in substance.


On consideration,


Ordered, That the said Petition be granted, & that the Commis- sary in whose hands the above mentioned Copper is, do exchange it accordingly.


Mr. Anthony Butler, agent for the Quarter Master General, ap- plied to Council & requested to be supplied with forty Waggons & Twenty-four Artillery Horses.


On consideration,


Ordered, That the Justices of the County of Philadelphia be required to send down immediately Twenty-five Waggons, & that the Justices of the County of Chester be required to send down Twenty-five Waggons, to be Subject to the orders of the Quarter Master General or his Agents.


On motion, Agreed, That Philip Boehm be appointed .Paymas- ter of the Militia of the County of Northampton.

Mr. McGee acquainted the Council that Mr. Watkins, in whose bands the Copper ordered to be exchanged yesterday, has refused to be at the trouble of exchanging it ; therefore,


Ordered, That Capt. Watkins deliver the Copper in hands be- longing to this State, to Mr. Robert Towers, Commissary.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Will'm Crispin, Esq'r, for the sum of Three Thousand Pounds, for which he is to Account.


Mr. Joshua Williams having represented to the Council that the late Council of Safety had encouraged him to enlist a Company of Men, & had engaged to give him a Captain's Commission, on condition that he should do so, and that he has in consequence thereof, enlisted about Thirty Men to serve during the War, who are now ready to be marched to Camp; whereupon,


Resolved, That Mr. Joshua Williams be entitled to receive a Captain's Commission, on his marching to Camp any number of effective Men not less than Twenty-five, enlisted to serve three Years, or during the War; and that a Captain's Commission be lodged in the hands of Major Gen'l Armstrong, to be delivered to Mr. Williams, on his producing a Certificate from a Gen'l Officer, that he has complied with the above condition.

An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Benj'a. Brannon, Esq'r, for the Sum of One thousand Dollars, to be charged to Rob't Smith, Esq'r, Lieut. of the County of Chester, for the purpose of Paying Substitutes & Purchasing Blankets, &ca., for which he is to account.


An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of Robert Dorsey, Esq'r, Paymaster, for the Sum of Four Thousand Pounds, to be applied in Paying the Militia of this State, for which he is to account.


An order was drawn on Jacob S. Howell, in favor of Mr. Joshua Williams, for the Sum of Seven Hundred dollars, for the purpose of Paying Recruits inlisted by him to serve in the Pennsylvania line, for which Sum he is to account.


The Petition of Stephen Jos. Rouget, praying to obtain " a War Commission for his Brigatine James, of the Burthen of Eighty 'Tons, mounting Ten Carriage Guns of Four Pounders & Eighteen Swivels, navigated by Eighty Men, now lying in this river, Com- manded by himself, was read, & Martin Jugiez offering himself as Surety, &ca .; thereupon,


Ordered, That the said Commission be issued by the Secretary.


The following orders were drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, for riding Express, in favor of John Bird, for the Sum of Two Pounds Ten Shillings ; in favor of Jonathan Grey, for the Sum of Two Pounds Five Shillings; in favor of Lesher, for the Sum of Two Pounds Five Shillings.


Alexander Ramsey having had incouragement from the Council of Safety to raise a Company of Men for the Continental Army, and exerted himself in the attempt, but that he has only raised twelve Men, now prays that he may be indulged Six weeks longer to complete his Company, & in the mean time, that he will deliver over the twelve Men to some Continental officer in Service, who shall be accountable to Mr. Ramsey for them when demanded; to which the Council agreed.


Mr. Ramsey proposes Robert Brackenridge as Second Lieuten- ant.

Mr. Rittenhouse, Colo. Bradford, Colo. Delany & Capt. Peel, attended, in consequence of an invitation from Council, and the resolutions of Congress of the Twenty-eighth instant was commu- nicated to them in confidence, & their assistance asked in forming out a List of persons dangerous to the State, & who ought to be arrested ; and also in forming a list of Gentlemen proper to be au- thorized to arrest such dangerous persons; and the several Gentle- men expressed the utmost readiness in complying with the request of Council, & the following resolution was thereupon made, Viz't :


WHEREAS, the Congress of the Thirteen United States of North America have by their Resolves of the 21st inst., recommended to the Executive Powers of the several States to apprehend & secure all persons who have in their General conduct & conversation evi- denced a disposition inimical to the Cause of America, particularly Joshua Fisher, Abel James, Jas. Pemberton, Henry Drinker; Israel Pemberton, John Pemberton, John James, Sam'l Pleasants, Thos. Wharton, Sen'r, Thomas Fisher, (Son of Joshua,) & Sam'l Fisher (Son of Joshua,) together with all such papers in their possession as may be of a Political nature, and that the persons so seized be confined in such places, & treated in such manner as shall be con- sistant with their respective Characters, & the security of their Per- sons ; and that the Records & Papers of the Meeting of Sufferings of the Society of People called Quakers, in the several States, be forthwith secured, & that such parts of them as may be of a politi- cal nature, be forthwith transmitted to Congress :


And whereas, it is necessary for the Public safety of this time, when a British Army is landed in Maryland, with a professed de- sign of enslaveing this free Country, & is now advanceing towards this City, as a principal object of hostility, that such dangerous persons be accordingly secured ; therefore,


Resolved, That a suitable number of the friends to the Public cause be authorized forthwith to seize & Secure the Persons of the said xJoshua Fisher, xAbel James, xJames Pemberton, xHenry Drinker, xIsrael Pemberton, John James, xSam'l Pleasant, xTho's Wharton, sen'r, xTho's Fisher & Sam'l Fisher, (both Sons of Joshua,) and also xMyers Fisher, Elijah Brown, xHugh Roberts, zGeo. Ordered, That the following instructions be also given :- Early attention should be given to John Hunt, who lives on the German- town Road, about five Miles off the City, & to John Pemberton, Sam'l Emlen & others, leaders in the Society of Quakers, concern- ing Books & Papers. As to the rest, your own prudence must direct. Congress recommend it, & we wish to treat Men of reputation with as much tenderness as the Security of their Persons & Papers will admit. We desire, therefore, that if the persons whose names in the list are marked with a Cross x thus, offer to you, by promise in writing, to remain in their Dwellings, ready to appear on the demand of Council, & meanwhile to refrain from doing any thing injurious to the United Free States of North America, by Speak- ing, Writing or otherwise, & from giving intelligence to the Com- mander in Chief of the British Forces, or any other Person what- ever, concerning public Affairs, you dismiss from further confine- ment of their Persons; but if such engagement, or a promise equivalent thereto, cannot be obtained, we desire that in such a case you confine the refusers, together with the others to whose names the said mark is not prefixed, in some convenient place under a Guard, with which the Town Major, Colo. Nichola, will supply you. The Free Masons' Lodge may be perhaps procured. It would serve as well as any other place for this purpose. You may perceive that Council would not without necessity commit many of the persons to the Common Goal, nor even to the State Prison.


Lieut. Colo. Clarke, of Cumberland County, representing to Council by direction of Gen'l Armstrong, the unfurnished condi- tion of great numbers of the Militia of this State under the Com- mand of Gen'l Armstrong, in respect of warm Cloathing & Blank- ets, without a supply whereof the Men must in the approaching Season Suffer & Sicken ; The Council, to relieve in some measure those who are called out in the defence of their Country, & consid- ering the repeated collections of Blankets made in this City, & the impossibility of purchasing such goods from Traders at this time,


Resolve, That Gen'l Armstrong employ proper persons to pur- chase Blankets of all persons disposed to sell, for the use of the Militia ; they also


Resolve and authorize Gen'l Armstrong, if such purchases seem impracticable, to make as equal & moderate a levy of Blankets as circumstances will permit, upon the inhabitants of the County of Chester in this State, for the use of the Militia, confineing the same

to persons who refuse to bear Arms or take an active part in the defence of their bleeding Country, now invaded by a cruel Enemy : And that Gen'l Armstrong do name & employ proper & discreet persons to levy & collect the same, first having the Blankets which may be taken from each person appraised, & a certificate of the numbers & value delivered to the Owner, and that a List of the names of persons levied on their townships, number of Blankets & the valuation, be sent in due time to this Board, so that satisfaction may be made to all concerned. And Council recommend to Gen'l Armstrong & his Officers, to keep accounts of the Blankets collect- ed & purchased as aforesaid, distributed to the Militia, in order that they may be transferred to succeeding Corps called into service.

On motion, Agreed, That John Morris, jun'r, Esq'r, be & he's hereby appointed & authorized to appear at the next Court of Quarter Sessions of the Peace for the County of Philadelphia, there to prosecute in the name of the Commonwealth of Pennsyl- vania.


James Tilghman, Esq'r, having applied to Council & expressed a desire to visit his family in Maryland ; thereupon,


Agreed, That Jas. Tilghman, Esq'r, be permitted, under the Parole lately signed by him, to visit his family in Maryland, to re- turn in one Month, or sooner if called for.

Ordered, That it be recommended to the Navy Board to view the Banks of Fort Island, & order the necessary repairs to be made therein.


The Gentlemen of the Navy Board having some time ago repre- sented the advantages & necessity of having a Floodgate at Fort Island, made so as to admit the Guard Boats, &ca, in the Winter ; thereupon,


Ordered, That the Navy Board do make such a Flood Gate as will answer the aforesaid purpose.


Resolved, That the following persons be appointed and authorized to carry into execution the Resolves of Yesterday, respecting the Arresting such persons as are deemed inimical to the cause of American Liberty, Vizt : Will'm Bradford, Sharp Delany, James Claypoole, Wm. Heysham, John Purviance, Jos. Blewer, Paul Cox, Adam Kimmel, Will'm Graham, Wm. Hardy, Cha's W. Peale, Capt. M. Culloch, Nath. Donnel, Rob't Smith, Wm. Car- son, Lazarus Pine, Capt. Birney, John Downey, John Galloway, Wm. Thorpe, John Lisle, James Loughead, James Cannon, Jas. Carr, Tho's Bradford, together with such other persons as they shall call to their assistance.


NOTE .- That the foregoing Resolution (with those before relating to this Business) was signed by the Hon'ble George Bryan, Esq'r, Vice President.


Resolved, That Colo. Nicola, the Town Mayor, do furnish Colo. Bradford, on application, with a detachment of the City Guards.


The Justices of the County of Chester having recommended Caleb Davis, Wm. Blair, & Rich'd Thomas, in order that one of them may be Commissioned as Clerk of the Peace of the said County ; and Council taking in consideration the same,


Resolved, That Caleb Davis, Esq'r, be appointed Clerk of the Peace for the County of Chester.

Ludwig Hautman, a Militia Man from Westmoreland County, who was badly wounded at Woodbridge, in New Jersey, last February, and now on his way home in a very weak State, solicited some assistance to enable him to reach it; on consideration of his peculiar circumstance,


- An order was drawn on Dav'd Rittenhouse, Esq'r, Treasurer of the State, in favor of the said Ludwig Hautman, for the Sum of Six pounds, to be charged to the State.


Colo. Bradford, Paul Cox, & Capt. Blewer, informed the Council that among a number of other persons mentioned in the Warrant of Council of the 31st Ult'o, Alex'd. Stedman, Chas. Stedman, jun'r, & Dav'd Lenox, were apprehended & confined at the Free Masons' lodge ; on consideration,


Ordered, That the said Alex'd. Stedman, Chas. Stedman, jun'r, & Dav'd Lenox, be committed to the State Prison.

An order was drawn on David Rittenhouse, Esq'r, Treasurer of the State, in favor of Joseph Blewer, Esq'r, Chairman of the State Navy Board, for the Sum of Four thousand Pounds, for which that Board is to account.


John Reed applied to Council for permission to pass into the Delaware State, (near Cantwell's Bridge,) which Council have no objection to, provided that Gen'l Washington has not ordered the Communication with that Country to be cut off.


Jacob Morgan, Esq'r, Councellor for the County of Berks, ap- pear'd, took the Oath required by the Constitution of the Com- monwealth to qualify him to sit in Council, & took his seat accordingly.
