eldest son, Beriah; granddaughter Sarah Brown, a minor who had a legacy left her by son Gershom Brown, deceased; sons William, John, Samuel, Ebenezer, Nathaniel, and Joseph who is under age. Sons John, Nathaniel and Ebenezer named executors (Essex Probate, 302 : 172). The inventory of his estate was taken 12 Mar., 1687-8 (Essex Probate, 302: 173). He may have married before 1647, and his first wife may have been daughter of Francis Lambert (112) and the mother of his children Gershom and Mary, who were probably born before he came to Rowley. He owned land in Rowley, Newbury, and Bradford (Essex Probate, 331 : 171). His widow, Mehitable, m. (3) (int. 23 June, 1733) Lieut. Jacob Perley of Boxford.

30-3. BERIAH2 BROWNE (Charles 30), born 8: 5 mo. (July), 1648; married 6 Jan., 1673-4, Sarah, daughter of John Harris (79). In the will of his father, Charles Browne, 1687, he is mentioned in words following: "I give to my eldest son Briah Browne twenty-four pounds in some good pay." In the same will his brothers are given land. No after mention of him nor of his wife is found of record in Essex Co., save only in the will of his grandfather Acy as given below. He moved to Kingston, R. I., and there married (2) 1685, Abigail, daughter of Alexander and Abigail (Sewall) Phenix of Kingston. He married (3) Eleanor ,He died in Kingston and was buried 20 Feb., 1717, during a snow storm. Administration granted to his oldest son, Alexander Brown.

In the will of her uncle, Gershom Browne, 1683, she is mentioned as follows: "I doe give unto my Cousen Sarah ten pounds of that pay that is in Thomas Pallmers hand, and my will is that the saide ten pounds shall be in my mothers hand for the bringing of her up, and that at the age of twenty and one years or at the Day of her marriage which shall first happen the said ten pounds be payd her."


In a deed of her grandfather John Harris (79), to his son Timothy, dated 27 July, 1682, Timothy is required to pay or cause to be paid "Ten pounds in cattle unto my Grandchild Sarah Browne in Rowley, to be payd at the age of twenty years, she giving seasonable warning, Provided she be not married before, wch if she be shall be payd within one yeare after her marriage, if she demand it" (Essex Deeds, 4 Ips. : 459).


In the will of her grandfather Charles Browne (30), 1687, she is mentioned as follows: "I give to my granddaughter Sarah Browne a legacy given by my son Gershom to her & left in my hands my will is that my executors pay it to her in one half corne & the other half cattle when she comes to ye age of twenty- one years or do marry."


In the will of her great grandfather William Acy (2), 1689, she is mentioned as follows : "I give to my grandchild, Beriah Brown's daughter Sarah Brown fourty shillings in Money." No after mention of her is found of record in Rowley. It is probable she joined her father in Rhode Island.

By deed, dated 6 July, 1722, Samuel Browne of Rowley bought all the right his sister, Hannah Browne of Rowley, had in the real estate of their father, John Browne, late of Rowley, deceased ( Essex Deeds, 41: 63). Samuel also bought the right of his brother, Joseph Brown of Boston, "joiner," in the real estate of their father, John Browne, deceased, 15 Sept., 1722. Johanna, wife of Joseph, signs the deed (Essex Deeds, 41: 64).

He made his will 5 Apr., 1681, "being aged & decreped"; it was proved 10 Apr., 1683; mention is made of wife, Jemima; son Caleb; son John; and John's son Timothy, "my grandchild who liveth with Capt. Saltinstale"; daughter Lydia and her husband unnamed (Essex Probate, on file, and Essex Deeds, 4 Ips. : 514). Widow Jemima died 24 Mar., 1692-3.

31-4. CALEB2 BURBANK (John 31), born 19: 3 mo. 1646; married 6 May, 1669, Martha, daughter of Hugh Smith (181). They joined Rowley Church, 21 Feb., 1685. The Rev. Samuel Phillips entered in the Rowley Church Record, 10 Nov., 1689, that he had long considered Caleb Burbank "crazed in his understanding wch I am ye more con- firmed in by what his mother lately related to me."


His will, dated 15 Feb., 1688-9, proved 25 Mar., 1690, mentions "honored & Aged Mother"; wife (unnamed), who is executrix; oldest son, and other children, all unnamed (Essex Probate, 304: 255).


His widow, Martha, married (2) John Hardy (76-3). "Or sister, ye Widow Burbank, now wife to John Hardy, dismissed to ye church at Bradford June 13, 1698" (Ch. R.).


By deed, dated 23 Nov., 1701, Caleb Burbank's widow, Martha, then Hardy, sold to her son, Caleb Burbank, all the homestead of her late husband, Caleb Burbank, in Rowley, bounded "by ye Town Street ye Westerly end ye other end by Dickinsons land ye South side by Samuel Cooper's land, ye north side by Samuel Palmer . . . Also all her Right Interest & claim in ye household stuff Bedding & Utensells yt ye said Caleb's Mother Burbank Carried away unto her son & daughter Fos- ters when she went to live with them" (Essex Deeds, 14: 161).

John Acy (2-4). In 1703 he was of Bradford, he was soon after of Boxford, where he died 1 Feb., 1749-50.


His will, dated 14 Dec., 1744, mentions wife, Hannah; sons John, Timothy, Asa, David; daughters Hannah Hardy, Lydia Foster, Mary Wallingford, Ruth Hardy, Elizabeth Bailey, Margaret Hopkinson, and Martha Burbank who "is not capable of taking care of herself"; sons- in-law William Hardy, Jr., and Edward Hardy (Essex Probate, 320: 287).


His widow, Hannah, died 8 Jan., 1762. By deed, dated 6 Mar., 1733-4, Eleazer Burbank and Daniel Gage, both of Bradford, Joseph Hardy and Mary, his wife, Samuel Burbank and Ebenezer Burbank convey to their brother, Caleb Burbank of Boxford, all their rights in the estate of "our Hond. father Caleb Burbank late of Rowley dec'd," in the town of Rowley or elsewhere (Essex Deeds, 66: 220).

BURPEE BURKBY BIRTBY


32. THOMAS1 BURKBY (Burpee) was keeper before the Court in Boston, 1635 (Mass. Col. R.). He was of Boston, 3 Sept., 1639 (Pope) ; was in Rowley about 1651. See John Hill (88).


He brought with him his wife, Martha. She was the daughter of John Cheney of Newbury, and widow of Anthony Sadler of Salisbury, who was drowned 23: 2 mo. 1650 (Salisbury R.). She married Burpee between 12: 2 mo. 1651 and 14: 4 mo. 1653 (Norfolk Deeds, Salem, 1: 65). She was buried 24 June, 1658. He married (2) 15 Apr., 1659, Sarah, daughter of John Kelley of Newbury, where she was born 12 Feb., 1641. He died 1 June, 1701. His widow, Sarah, died 25 Dec., 1713.
