By virtue of this warrant I have notified and warned the inhabi- tants of the Town of Medfield, qualified to vote in elections to meet at the time and for the purpose named by posting attested copies of said warrant in not less than five public places in the town at least seven days before the time of holding the meeting.

SPECIAL TOWN MEETING


June 12, 1961


Pursuant to the foregoing warrant the meeting was called to order by the Moderator at 7:30 P.M. and the following action was taken on the articles therein:


Article 1. Voted to transfer the sum of $175.00 from Free Cash in the Treasury for the purpose of defraying the expenses of the Legal Department for the balance of the current year.


Article 2. Voted to authorize the Board of Selectmen to rescind and abandon that portion of the Order of Layout and Order of Taking of Cross Street which pertains and relates to the imposition of better- ment assessments, the remainder of said Order of Layout and Order of Taking to remain in full force and effect, said Orders being recorded with Norfolk Deeds in Book 3397, Pages 153 to 157, both inclusive.


Article 3. Voted unanimously to amend the Building By-Law of Medfield, as amended, by adding to Section 1 of Article 11 thereof, the following paragraph:


(c) There shall be an Inspector of Gas Piping and Gas Appli- ances and an Assistant Inspector of Gas Piping and Gas Appli-

ances, each of whom shall be appointed by the Board of Select- men for a term of five years with the same conditions appli- cable as stated in the foregoing Section 1.


Article 4. Voted to transfer the sum of $300.00 from Free Cash in the Treasury for the use of the Gas Inspector to defray the operating expenses for the balance of the current year.


Article 5. Voted unanimously to amend the By-Law adopted by the Town under Article 3 of a Special Town Meeting held May 19, 1952, as amended, by deleting Section 1 thereof and substituting there- for the following:


Section 1. There shall be a Wiring Inspector and an Assistant Wiring Inspector, each of whom shall be appointed by the Board of Selectmen for the term of five years. Their respec- tive appointments shall continue during good behavior and satisfactory service. The Board of Selectmen shall have the power to discharge either or both the Wiring Inspector and the Assistant Wiring Inspector for failure to perform his duties, and to fill any vacancies in his office. Neither of them shall be removed from office except for cause shown after full opportunity has been given them to be publicly heard on specific charges. They shall keep a record of the business of their department and submit to the Selectmen in time for publication in the Annual Town Report a yearly report of such business.


Article 6. Voted to transfer the sum of $379.50 from the Road Machinery Account to the Highway Operating Account to defray the expenses of the operation and maintenance of Highway Machinery.


Article 7. Voted to authorize the Moderator to appoint a com- mittee of five (5) members, one of whom shall be a member of the Board of Selectmen and one of whom shall be a member of the Finance Committee to study the need for a Personnel Board in the Town of Medfield to be established under the provisions of Sections 108A and 108C of the General Laws of the Commonwealth of Massachusetts and to report at a future Town Meeting.


Article 8. Voted to adopt the following By-Law establishing minimum and maximum salaries to be paid members of the Police Department under the provisions of General Laws, Chapter 41, Section 108A as amended:


Section 1. Chief of Police


Minimum $5200.00 per year or $100.00 per week


Maximum $6200.00 per year or $119.23 per week

To be increased at the rate of $333.33 per year or approxi- mately $6.40 per week until maximum has been reached.


Section 2. Sergeant


Minimum $5100.00 per year or $98.07 per week Maximum $5500.00 per year or $105.77 per week To be increased at the rate of $200.00 per year or approxi- mately $3.84 per week until maximum has been reached.


Section 3. Patrolmen


Minimum $3880.00 per year or $74.61 per week


Maximum $4800.00 per year or $92.30 per week


Annual pay raises of $230.00 per year shall be granted to each employed patrolman on the anniversary date of his employ- ment until maximum pay rate is reached; provided however that no patrolman presently employed shall receive a salary which is less than the salary he is receiving on the date of the passage of this By-Law.


Article 9. Voted to accept the provisions of Chapter 571 of the Acts of 1961 authorizing the Town of Medfield to furnish water to the Dover-Sherborn Regional School District and to authorize the Water and Sewerage Board to enter into a contract pursuant thereto substan- tially in the form of contract which is on file in the Office of the Board of Selectmen.


Resolution: Voted that an initial period of five (5) years be written into the aforementioned Dover-Sherborn Regional School District water contract instead of the 10 years origin- ally named.


Article 10. Voted unanimously to purchase, take by eminent do- main and/or accept as a gift from sundry owners for water purposes, 40,000 square feet of land in fee on Mt. Nebo and right of way ease- ments connecting therewith all as shown on a plan entitled "Plan of Proposed Standpipe Lot and Rights of Way to be acquired by the Town of Medfield, Mass., Cheney Engineering Co., Feb. 15, 1957" and to acquire by any of the foregoing methods a right of way easement for water purposes in land of Pliny Jewell et al, as shown on a plan entitled "Plan of Proposed Right of Way to be acquired by the Town of Medfield, Mass., Cheney Engineering Co., Oct. 17, 1958".


Article 11. Voted to accept Section 42A, 42B, 42C, 42D, 42E, and 42F of Chapter 40 of the General Laws of Massachusetts as amended.

Article 12. Voted to transfer the sum of $150.00 from Free Cash in the Town Treasury for the purpose of transferring excess loam from the Junior-Senior High School site to the Vine Lake Cemetery.

In the name of the Commonwealth you are directed to notify and warn the inhabitants of the Town of Medfield, qualified to vote in elections and in town affairs, to meet at the Dale Street School on Monday, the 11th day of December A.D. 1961 at 7:30 P.M. then and there to act on the following articles:


Article 1. To hear and act on the report of any special committee appointed at any previous Special Town Meeting or appointed by the Moderator or the Selectmen as authorized by vote of the Town.


Article 2. To see what sum of money the Town will vote to raise and appropriate and/or transfer from Available Funds in the Treasury for the use of the Town Hall Renovation Committee in connection with securing preliminary architectural plans and cost estimates of renova- tion to the Town Hall, or do or act anything in relation thereto. Article 3. To see if the Town will vote to transfer a sum of money from the Road Machinery Fund to the Highway Operating Account to defray the expenses of the operation and maintenance of Highway Machinery.

Article 10. To see if the Town will vote to name the new Junior- Senior High School the Amos Clark Kingsbury School or do or act anything in relation thereto. (School Building Committee)


Article 11. To see if the Town will vote to transfer from Avail- able Funds in the Town Treasury a sum of money for the Town Clock.


Article 12. To see if the Town will vote to transfer from Avail- able Funds in the Town Treasury a sum of money to defray the cost of the purchase of a new typewriter for the Police Department, or do or act anything in relation thereto. (Police Department)


Article 13. To see if the Town will vote to transfer to the Med- field Memorial Library the sum of $1,264.11 received from the Com- monwealth of Massachusetts under the provisions of Chapter 760, Acts of 1960, an act providing State Aid for public libraries, which monies have been applied for by the Library in accordance with said act. Article. 14. To see if the Town will vote to transfer from Avail- able Funds in the Town Treasury the sum of $1,613.96 to pay an out- standing Boiler Insurance premium.

Article 15. To see if the Town will vote to transfer from Avail- able Funds in the Town Treasury a sum of money to make an engi- neering survey for the possible extension and improvement of the Town Water System.


Article 16. To see if the Town will vote to adopt the following By-Law: "No person shall hunt, fire or discharge any firearms or explosives of any kind within the limits of any highway, park or other public property except with the written permission of the Board of Selectmen; or on any private property except with the written consent of the owner or legal occupant thereof; provided, however, that this By-Law shall not apply to the lawful defense of life or property nor to any law enforcement officer acting in the discharge of his duties. Any person who violates this By-Law shall be punished by a fine of not more than $20.00". (Park Commission)

To see if the Town will vote to accept the following named streets or portions thereof constructed under the provisions of the Sub-Division Control Laws (so-called) as laid out by the Board of Selectmen on November 28, 1961 according to plans filed with the Town Clerk on November 28, 1961 including the taking or acceptance of easements for drainage purposes as shown on said plans:

Article 1. Voted to hear any reports of Special Committees ap- pointed at any previous Town Meeting. The report of the Medfield Town Hall Renovation Committee which was appointed by the Moder- ator under the provisions of Article 40 of the 1961 Annual Town Meet- ing was read and accepted.
