on plans referred to in the Orders of Layout and on file with the Town Clerk's Office and to authorize the Board of Selectmen to acquire by eminent domain or otherwise such rights, titles and easements, includ- ing drainage easement, as may be necessary to accomplish such purpose.


Article 40. Voted to raise and appropriate the sum of $327.11 for the purpose of paying land damages arising from the relocation of Bridge Street.

Voted that the Committee appointed to study the North Street School for use other than School Purposes be discharged.


Voted that the committee to study Land Acquisition for School Purposes be discharged.


A resolution was unanimously made to give the School Land Acqui- sition Committee a sincere vote of thanks for their extensive work.


Article 42. Voted that this article be dismissed wherein a sum of money was sought for extraordinary repairs to the former North Street School to convert the same for use as a municipal office building. NOTE : The following Resolution was submitted to the meeting at this time:


Resolved, that the Park and Recreation Commission be instructed to study the North Street School for the purposes of a Community Recreation and Youth Center and that the Medfield Youth Center Committee be asked to help in this study and report back at the next Special Town Meeting.


Article 43. Voted to raise and appropriate the sum of $300.00 for the use of the Town Common and Parking Area Committee appointed under Article 16 of the Special Town Meeting of November 22, 1965.


Article 44. Voted to dismiss this article wherein authorization to purchase a lot of land for school purposes from Mr. Byng was sought.

Article 45. Voted to dismiss this article wherein authorization to purchase a lot of land for school purposes from Mrs. Frances M. Cun- ning was sought.


Article 46. Voted to dismiss this article wherein authorization to purchase a lot of land for school purposes from the Beckwith Post No. 110, Inc., American Legion was sought.


Article 47. Voted to dimiss this article wherein the Park and Recreation Commission sought a sum of money for the purchase of land adjacent to the Swimming Pond land.


Article 48. Voted to dismiss this article wherein a sum of money for surfacing the Swimming Pond Parking Area was sought.


Article 49. Voted to dismiss this article wherein a sum of money was sought for capital improvements to the Town Swimming Facility off Green Street.


Article 50. Voted to raise and appropriate the sum of $500.00 for the purpose of improving the Baker's Pond area.


Article 51. Voted to authorize the Board of Park Commissioners to disburse from its annual appropriation miscellaneous sums of money for entry fees, the purchase of prizes and awards, and the like in con- nection with the participation of groups sponsored by the Commission in meets, contests, and competitions both within and without the confines of the Town of Medfield.


Article 52. Voted to amend the Town By-Law of 1926, as amended by the vote taken under Article 8 of the Special Town Meeting of April 4, 1955 and as amended by the action taken under Article 1 of the Spe- cial Town Meeting of November 26, 1956 by revoking the amendments thereby enacted and by substituting therefor the following Article 1. After Section 3, a new section which shall read as follows:


"(4) In the event that the Annual Adjourned Town Meeting or any Special Town Meeting shall not have been completed by 10:45 P.M. it shall be adjourned to a place and time determined by a majority of the voters then present; however, the Moderator shall be authorized to keep any such Annual or Special Town Meeting in session for an additional half hour period, if, in his opinion, the meeting will thereby be enabled to complete the remaining business."


NOTE: The vote on this article was nearly unanimous. (2 dissenting)


Article 53. Voted to raise and appropriate the sum of $300.00 for the purpose of repairing a section of Cemetery wall on Main Street.

Article 57. Voted to amend the Zoning By-Law of the Town of Medfield adopted April 21, 1938, as amended by making the following alterations and additions thereto, viz :


By deleting in its entirety the paragraph numbered 1. of Section III. "B" RESIDENCE DISTRICT USES and by substituting therefor the following:


1. Any use permitted in an "AA", "A" and "C" Residence District unless specifically prohibited by this Zoning By-Law.

By adding the following new Section :


SECTION VI. APARTMENTS


An apartment or apartment house is herewith defined as a building intended and designed to be occupied by more than two families living independently in separate dwelling units. Each dwelling unit shall be separated by sound proof partition walls and/or floors from each other, with each apartment having individual living, sleeping, kitchen and toilet facilities. Each apartment building shall occupy one lot in single owner- ship throughout. Professional offices and home occupations are specific- ally excluded from apartment house units.


Apartments or apartment houses may be constructed in "B" Resi- dence District only, subject to the following rules and regulations :


Height and Bulk Regulations 1.


(a) Maximum height shall be limited to thirty-five (35) feet above the average elevation of the finished grades of the building lot. Height shall be measured to the highest point on the roof of the building.


(b) Maximum number of stories shall be limited to three, includ- ing the basement level. A story is defined as that part of a building between any floor and the floor or roof next above. For the purpose of this Zoning By-Law, where a building is not divided into stories, a story shall be considered fifteen (15) feet in height. Steeples, cup- olas, stage lofts, and the like shall not be considered as additional stories. A basement, or cellar, to be inhabited, must have the ceiling not less than five (5) feet above the average elevation of the land immediately surrounding the building foundation wall.


(c) Floor-area ratio shall not exceed 0.40. The floor-area ratio is defined as the ratio of the net floor area of the apartment building to the total lot area. Net floor area is the sum of the areas used for living, sleeping, kitchen and toilet use only, of the several floors of a building, measured from the exterior faces of the walls but shall not include areas used for hallways, closets and the like.


(d) The minimum usable green space shall not be less than 25% of the area of the lot. Green space is defined as space in a yard or within a setback area on a lot that is unoccupied by buildings, un- obstructed to the sky, not devoted to service driveways or off-street loading or parking spaces and available to all occupants of the building on the lot.

(e) The minimum residential floor area shall be five hundred (500) square feet of living space per dwelling unit. Living space shall mean the total of the floor area of rooms used or intended to be used as living, sleeping, and kitchen purposes only.


2. Area and Width Regulations


(a) The minimum lot size shall consist of not less than twelve thousand (12,000) square feet for the first two (2) family units, plus an additional three thousand (3,000) square feet for each additional family unit, and not less than one hundred 100) feet wide. (SECTION VII. Par. 5. for lot width requirements).


3. Yards


(a) Rear Yard - minimum depth shall not be less than fifty (50) feet.


Rear yard shall mean a space, unoccupied, extending for the full width of the lot between the rear line of the building wall and the rear lot line.


(b) Side Yard - minimum width shall not be less than twenty (20) feet.


Side yard shall mean an unoccupied space extending for the full length of a building between the nearest building wall and the side lot line.


(c) Front Yard - minimum depth shall not be less than forty (40) feet.


Front yard shall mean a space extending for the full width of the lot between the front line of the nearest building wall and the front lot line.


(d) Corner Lots


Yard requirements for lots located on the corners of two streets shall be considered as two (2) front yards, one (1) side yard, and one (1) rear yard.


(e) Projections into the required yards or other required open spaces shall not exceed four (4) feet.


4. Offstreet Parking


(a) Two. (2) off-street parking spaces shall be provided for each family unit.

(b) The minimum size for each parking space shall be ten (10) feet wide by twenty (20) feet long - two hundred (200) square feet. Access areas and maneuvering space shall be in addition to the required parking space area.


(c) No off-street parking space or accessory off-street parking shall be permitted within the front yard area.


(d) All parking areas containing more than five (5) parking spaces shall be effectively screened on the side that faces the side and/or rear lot line. The screening shall consist of a solid fence or wall not less than four (4) feet nor more than six (6) feet in height, or by use of shrubbery, or by both.


(e) Parking spaces shall be arranged so that no motor vehicle will be parked within ten (10) feet of any side lot line, or within ten (10) feet of any rear lot line.


5. Waste Water Disposal


(a) All waste water shall be disposed of by means of adequate connection to the sewerage system of the Town of Medfield.


6. Site Plans


(a) A Site Plan shall be submitted to the Building Inspector and shall show the following :


(1) Dimensions of the lot.


(2) All proposed buildings.


(3) Structures.


(4) Parking facilities.


(5) Service areas.


(6) Open space


(7) Front, side and rear yard areas.


(8) Any other information as may be necessary to deter- mine that the requirements of the proceeding sections (Section VI. Sub (sections 1 through 5) shall be met.


(b) Upon approval of the Site Plan, the builder of the apartment or apartment house may apply for a Building Permit under the apropriate section of the Building Code, Town of Medfield, Massachusetts.

By adding the following new paragraph to SECTION VIII. AREA REGULATIONS.


9. Corner Lots in All Districts. A corner lot is defined as a lot which has an interior angle of less than 135 degrees at the inter- section of the two street lines. On corner lots, the building lot shall be considered as having two (2) front yards, (one facing each street), one (1) side yard, and one (1) rear yard.

Amendments to the foregoing article which were submitted by the Planning Board were voted and incorporated under the fore- going SECTION VI. APARTMENTS as follows:


(a) Change the word "party" to "partition" so that it will read "sound proof partition walls". (fourth line)


(b) Under paragraph 1, Height and Bulk Regulations, sub- paragraph (b) - Change the last sentence to read: "A basement, or cellar, to be inhabited, must have the ceiling not less than five (5) feet above the average elevation of the land immediately surrounding the building foundation wall."


Article 58. Voted to authorize the Moderator to appoint a com- mittee of five (5) members and authorize it to make arrangements and to spend a sum of money appropriated under Article 3 for the observ- ance of Memorial Day. (Those appointed were William Mann, John J. O'Keefe, Lindsey Ripley, Patrick Walker & E. M. Wheelwright.


Article 59. Voted to transfer the sum of $85,000.00 from Free Cash in the Treasury for the reduction of the 1966 tax rate.


Article 60. Voted to accept the following named sums as Per- petual Trust Funds for the care of lots in the Vine Lake Cemetery, the interest thereof or as may be necessary to be used for said are, viz:

To see if the Town will vote to authorize the Board of Selectmen to acquire on behalf of the Town for public parking and Town Common purposes, by purchase, taking by eminent domain or otherwise, all of the land now owned, or recently owned, by Socony Mobil Oil Co., Inc. lying northerly of Main Street and easterly of North Street and being more particularly bounded and described in a certain deed from the estate of Waldo Fitts to Socony Mobil Oil Co., Inc. dated December 14, 1962 and recorded with Norfolk Deeds in Book 4402, Page 425 and to see what sums of money the Town will vote to raise and appropriate and/or borrow and/or transfer from available funds to defray the cost of such acquisition, or do or act anything in relation thereto.

Prior to voting that a written ballot be used for action on Article 1, Mr. Fred Clarridge gave a very informative description of the cost and advantages of the proposed plan for a Town Common and Parking Area on the northeasterly corner of North and Main Streets.


Article 1. Voted that this article be dismissed wherein authorization to acquire on behalf of the Town for public parking and Town Common purposes, all of the land now owned, or recently owned by the Socony Mobil Oil Company lying northerly of Main Street and easterly of North Street was sought.

Voted that the Town Common and Parking Area Committee be dis- missed and a sincere vote of thanks from the Town be extended to them for their extensive and consciencious work on this project.
