To see if the Town will vote to amend the Zoning By- Law and Zoning Map of the Town of Medfield by removing the premises hereinafter described from the provisions of Section II, "AA" Residence District Uses and placing the same under the provisions of Section IV, Business District Uses, that certain parcel of land situated on the northerly side of Harding Street in Medfield, Norfolk County, Massa- chusetts and bounded and described as follows:


SOUTHERLY-by Harding Street 196 feet;


EASTERLY-by land now or formerly of Clayton W. Adams. et ux, 196 feet;


NORTHEASTERLY-by land now or formerly of Clayton W. Adams et ux, 154 feet; and


,WESTERLY-by land owned by James F. Ours, 268 feet.


Said premises are shown as Parcel "A" on a "Plan of Land in Medfield, Mass." dated July 30, 1964 and drawn by Colburn Engineering, Natick, Mass., and said premises contain 0.9 acres of land.

By virtue of this warrant I have notified and warned the inhabi- tants of the Town of Medfield, qualified to vote in elections to meet at the time and for the purpose named by posting attested copies of said warrant in not less than five public places in the Town at least seven days before the time of holding the meeting.

SPECIAL TOWN MEETING


November 30, 1964


Pursuant to the foregoing warrant, the meeting was called to order by the Moderator at 7:30 P.M. and after reading the warrant notice and Constables' return, the following action was taken on the articles:


Article 1. Voted unanimously to accept as public ways the following named streets, or parts thereof, viz:


Heatherstone Drive and Arnold Drive


as laid out by the Board of Selectmen on November 10, 1964 and as shown on plans referred to in several Orders of Layout and on file with the Town Clerk's Office and to authorize the Board of Selectmen to acquire by eminent domain or otherwise such rights, titles and easements, including drainage easements, as may be necessary to accomplish such purpose.


Article 2. Voted to transfer from available funds in the Town Treasury the sum of $244.27 for the purpose of paying land damages arising from the relocation of Hospital Road.

Article 3. Voted to transfer from available funds in the Town Treasury the sum of $1,500.00 for Aid to Families with Dependent Children.


Article 4. Voted that the sum of $1,000.00 be appropriated for the purchase of a second hand Pickup Truck for the Highway Department, and to meet said appropriation that the sum of $1,000.00 be transfered from the unexpended balance of the item "Materials and Supplies- Machinery" in the Highway Account and that in addition to said sum of money the Board of Selectmen be authorized to trade in the 1955 Ford Pickup Truck as part of the purchase price.


Article 5. Voted to transfer the sum of $762.00 from the Road Machinery Fund to the Highway Operating Account.


Article 6. Voted to transfer the sum of $1,500.00 from the item "Payroll" in the Highway Account to the item "Materials and Supplies- Machinery" in the Highway Account.


Note-Action was taken on Article 6 prior to action on Article 4 in order to have funds available for Article 4 if voted.


Article 7. Voted to transfer the sum of $278.00 from available funds in the Town Treasury to the "Town Dump Payroll Account" and to transfer the sum of $675.60 from available funds in the Town Treasury, to transfer the sum of $465.40 from the unexpended balance of an ap- propriation made under Article 10 of the Special Town Meeting of December 2, 1963, for a total of $1,141.00 to the "Town Dump-Other Expenses Account."


Article 8. Voted to transfer the sum of $240.00 from available funds in the Town Treasury to the "Care of Trees Account" to defray the cost of operations for the remainder of the year.


Article 9. Voted that a committee of eight citizens appointed by the Board of Selectmen shall be and constitute a Land Acquisition committee for School Building Needs, said committee to study into and investigate the desirability of acquiring land for school building pur- poses and to report and make recommendations to the Town from time to time.


Article 10. Voted to transfer the sum of $1,000.00 from available funds in the Town Treasury to the Land Acquisition Committee appointed under Article 9 for expenses incurred relative to preliminary survey of proposed school sites.

Article 11. Voted that a committee of nine citizens appointed by the Board of Selectmen shall be and constitute a "Committee to Study the North Street School for Use Other Than School Purposes", said Com- mittee to study and investigate the use of said North Street School for municipal purposes other than school purposes, and to report and make recommendations to the Town thereon from time to time.


Article 12. Voted that the sum of $300.00 be transferred from avail- able funds in the Town Treasury to the North Street School Study Committee appointed under Article 11 for expenses incurred by said Committee relative to their investigations.


Article 13. Voted that the Board of Selectmen be instructed to petition the Boston Edison Company to install street lights on the fol- lowing named streets:

Article 14. Article 16. Voted that this article be dismissed wherein the Fire Department sought the purchase of a new Emergency Fire Truck.


Article 17. Voted that the sum of $17,500.00 be raised and appropriated on the 1965 Tax Levy for the purchase of a New Tank Truck for the Fire Department and to authorize the trade in of the present 1949 Tank Truck -Engine 3 as part of the purchase price.


Article 18. Voted that the sum of $12,500.00 be raised and appropri- ated on the 1965 Tax Levy for the purpose of extending the water main from its present terminus on Adams Street for a distance of approximately five hundred (500) feet to land of Varney Bros. Sand and Gravel Co., Inc. on West Mill Street, said water extension to be under the provisions of the Water Betterment Act.

Voted that the sum of $19,500.00 be raised and appropri- ated on the 1965 Tax Levy for the purpose of extending the water main in West Mill Street from Adams Street to Harding Street, a distance of approximately fifteen hundred (1,500) feet, said water extension to be under the provisions of the Water Betterment Act.

Article 22. Voted to dismiss this article wherein a sum of money was sought for the installation of about 1,150 feet of drainage in and off Spring Street.


Article 23. Voted that the sum of $4,500.00 be raised and appropri- ated on the 1965 Tax Levy for the purchase of a parcel of land on Spring Street as shown on the Assessors' Map, Lot No. 277 for drainage pur- poses and the Board of Selectmen be authorized to purchase the same or to take by eminent domain.

PERSONNEL ADMINISTRATION PLAN TOWN OF MEDFIELD


TITLE


1. The classification of Positions and the Pay Schedules appended hereto, and the provisions of the By-Law shall be personnel Administra- tion Plan (hereto after referred to as THE PLAN) for the Town of Medfield.


APPLICATION


2. The Plan shall apply to all officers and employees in the service of the Town (whether full time, or part time, seasonal, casual, special, Civil Service or other) other than those positions filled by popular elec- tion and those under the direction and control of the School Committee. Nothing herein, however, shall bar using the Plan or its provisions or facilities or Committees in determining the compensation of such other- wise exempted employees or officials.


TITLE OF POSITIONS


3. No person shall be employed or paid as an employee in any position subject to the provisions of the Plan under any title other than those in the Schedules or under any title other than that of the job, the duties of which are actually performed. The job title in the Plan shall be the official title of the position and shall be used in all administrative and employment records, and in every other connection involving per- sonnel or fiscal processes.


PERSONNEL BOARD


4. Under the Plan, there shall be a Personnel Board consisting of three members who shall be appointed by the Moderator acting in con- junction with the Chairman of the Board of Selectmen and the Chairman of the Finance Committee. The term of office of members of the Per- sonnel Board shall be three years; initial appointments to the Personnel Board shall be for the periods of one year, two years and three years respectively. No elected or appointed officer of the Town of Medfield and no person employed by the Town of Medfield shall be eligible for service upon the Personnel Board.


The Personnel Board shall serve without pay.

DUTIES OF THE PERSONNEL BOARD


5.


a. The Personnel Board shall administer the Plan and establish such policies, procedures and regulations consistent with the Plan as it deems necessary.


b. The Board shall maintain written descriptions of the job titles in the Plan describing the essential characteristics, requirements and the general duties. The descriptions shall not be interpreted as complete or limiting definitions and employees shall continue to perform any duties assigned by their superiors.


c. The Town Accountant and department heads shall keep such records of the employees of the Town as the Board may require. The Board shall keep such records of its own as it considers appropriate. All records of the Town by whomever kept pertaining to the Town's employees shall be open to inspection by the Board, or any of its mem- bers, at all reasonable times.


d. The Personnel Board, from time to time, shall review the work of all positions subject to the Plan. Such reviews shall be so scheduled as to cover all such positions at intervals of not more than three years. In case of urgent necessity, the Personnel Board may tentatively add a new position to the Plan or re-classify an existing position, subject to the subsequent ratification of its action by a formal amendment of the Plan at the next town meeting. No such action may be taken in connection with positions subject to Civil Service Laws.


e. The Personnel Board shall from time to time review the Pay Schedules. It shall keep informed as to pay rates and policies outside the services of the Town and shall recommend to the Town any action deemed desirable to maintain a fair and equitable pay level.


f. Upon recommendation of a Department Head, supported by evidence in writing of special reasons and exceptional circumstances satisfactory to the Personnel Board, said Board may authorize an entrance rate higher than the minimum rate for a position, and such other variances in the Plan as it may deem necessary for the proper functioning of the services of the Town.


EFFECTIVE DATE


6. The Plan shall become effective upon adoption by the Town.

INSTALLING PLAN


7.


a. All present employees included in the Plan shall be eligible to receive pay based upon their job classifications as provided by the schedules adopted herewith. All adjustments shall be subjected to the approval of the Department Head and the Personnel Board.


b. No pay shall be reduced as a result of the installation of the Plan. Any existing rates above the maximum shall become personal rates and apply only to the present incumbent. When his employment ends, no successor shall advance beyond the maximum for the job.


STEP INCREASES


8. Progression through the rate ranges is not automatic and shall be on the basis of step increases because of merit, on recommendation of the Department Head and the Personnel Board.


PROMOTIONS AND TRANSFERS


9. When an employee is promoted to a higher rated job, he shall enter at the minimum of the job range or at his own rate, whichever is the higher. He may also receive a step increase at the time, if the Department Head feels that qualifications and prformance warrant it, and the Personnel Board recommends it.


If an employee should be transfered and reclassified to a lower rated job he shall enter it at his own rate or at the maximum of the job, whichever is lower.


10. When rate ranges are affected by a wage increase voted by the Town, either fixed percentage or a fixed amount, all employees covered by the Plan and in the classifications specified, except those holding personal rates, shall benefit. Those holding personal rates shall not receive increases until the maximum for the classification exceeds the personal rate.


No pay shall be reduced as a result of rate range revision of the Plan. When an employee receives a pay rate above the maximum for the job, this rate becomes a personal rate and applies only to the present incumbent. When his employment ends no successor shall advance beyond the maximum for the job.

NEW PERSONNEL


11. The hiring rate shall be the minimum of the rate range for the job unless otherwise authorized by the Department Head and Personnel Board. If such authorization is given, it shall be supported by the Department Head's written statement of the reasons.


VACATIONS


12. The following annual vacations with pay will be granted to all permanent full time employees and to regular part time employees who are on an hourly paid basis, after the following periods of continuous employment.

For the purpose of this by-law, a regular part time employee is one who is regularly scheduled to and works no less than twenty (20) hours weekly. The weekly vacation pay of such regular part time employee shall be the average of his weekly pay for the last twenty-six (26) weeks worked immediately preceding his vacation.


Vacations with pay shall not be granted temporary employees.


Should a holiday fall during the vacation period on a regularly scheduled work day, an additional day of vacation will be allowed for full time employees.


Vacations shall not be cumulative from year to year.


Employees terminating their employment with the Town will receive payment in lieu of any earned vacation not yet taken in the calendar year of their employment termination.


LEAVE OF ABSENCE


13. Except for reasons to the extent herein after provided, all leaves of absence shall be without compensation.

SICK LEAVE


14. No sick leave with pay shall be granted during the first three months of employment.


Starting with the fourth month of continuous employment a per- manent full time employee shall be entitled to sick leave with pay for personal illness and exposure to contagious diseases at the rate of 11/4 days for each full month employed subject to a maximum accumulation of forty-five (45) days.


Loss of time directly attributed to injury incurred while performing duties shall not be charged to sick leave.


HOLIDAYS


15. Permanent full time employees shall be paid for each of the following holidays which falls on or is observed on a regularly scheduled work day:


New Year's Day Memorial Day Veteran's Day


Washington's Birthday


Independence Day


Patriot's Day


Labor Day Columbus Day


Thanksgiving Day Christmas Day


Permanent full time employees of the various town departments, other than Department Heads, required to work on any of the above specified holidays shall be paid on the basis of straight time in addition to the regular holiday pay for that day, or, at the discretion of the Department Head may be given equivalent time off at regular pay.


Police Department employees will be paid at straight time for time worked on a holiday in addition to holiday pay. Police Department employees working on a scheduled day off which is a holiday may be given equivalent time off at straight time.


OVERTIME


16.


a. No overtime shall be paid to the following in the normal course of their duties, even though the positions may be referred to below:


Department Heads Professional Employees Fire Department Employees Others by agreement when hired.

b. Hourly-paid employees.


Time worked prior to or after the regularly scheduled eight hour work day, Monday through Friday, inclusive, shall be paid at the rate of straight time. Time worked Saturdays and Sundays even if forty hours have been worked during the week, shall be paid at the rate of straight time.


c. POLICE DEPARTMENT


Straight time shall be paid for all time required in excess of eight hours in any one day. Work performed on a scheduled day off or during vacation shall be paid on the basis of straight time, in addition to any regular pay applicable to that day, or at the discretion of the Chief, the employee may be given equivalent time off.


JURY DUTY


17. A permanent full time employee called for jury duty shall be paid by the Town an amount equal to the difference between the com- pensation paid for a normal working period and the amount paid by the Court excluding allowance for travel.
