Article 4. Voted to authorize the Treasurer with the approval of the Selectmen to borrow money from time to time in anticipation of the revenue of the financial year beginning January 1, 1962, and to issue a note or notes therefor, payable within one year and to renew any note or notes as may be given for a period of less than one year, in accordance with Chapter 44, Section 17, General Laws.
Article 5. Voted to authorize the Collector to use all means in the collection of taxes as the Treasurer might if elected to that office.
Article 6. Voted to raise and appropriate the sum of $6,900.00 for the reconstruction of a section of High, South and Spring Streets (Route 27), and Main Street (Route 109), said money to be used with funds allotted by the County and State.
Article 7. Voted that the sum of $55,000.00 be raised and appro- priated for the reconstruction of Pound Street and to meet said appro- priation the sum of $5,000.00 be transferred from the Stabilization Fund and that the Town Treasurer, with the approval of the Selectmen be and hereby is authorized to borrow the sum of $50,000.00 and to issue bonds or notes of the Town therefor, in accordance with Section 7, Chapter 44 of the General Laws, providing that the whole loan shall be paid in not more than ten years from the date of issue of the first bond or note.

Article 8. Voted to raise and appropriate the sum of $15,000.00 for the Street Improvement Account, said funds to be expended for the

reconstruction of Cross Street, and to meet said appropriation the sum of $4,968.09 be transferred from the unexpended balance of an appro- priation made under Article 29 of the Annual Town Meeting of March 14, 1960 and the sum of $10,031.91 be raised and appropriated from the 1962 tax levy.
Article 9. Voted to raise and appropriate the sum of $1,000.00 for the purpose of installing Guard Rail Posts and Cable Fence on the easterly side of the overhead railroad crossing on Curve Street, a dis- tance of approximately 150 feet.
Article 10. Voted to amend Article 19 of the Annual Town Meet- ing of 1961 by deleting the words "on Route 109 and Route 27" from the vote which reads as follows:
"Voted to raise and appropriate the sum of $1,500.00 for the pur- pose of painting the white lines on Route 109 and Route 27."
and substitute the words "public ways" so that it shall read as follows:
"Voted to raise and appropriate the sum of $1,500.00 for the pur- pose of painting the white lines on public ways."
Article 11. Voted to raise and appropriate the sum of $3,200.00 for the purchase of a Sidewalk Tractor and Plow for the use of the Highway Department.
Article 12. Voted unanimously to raise and appropriate the sum of $17,000.00 for the purchase of a Front-End Loader for the Highway Department and to meet said appropriation, the sum of $5,000.00 be transferred from the Stabilization Fund and that the Town Treasurer, with the approval of the Selectmen be and hereby is authorized to bor- row the sum of $12,000.00 and to issue bonds or notes of the Town therefor, in accordance with the provisions of Section 7, Chapter 44 of the General Laws, providing that the whole loan shall be paid in not more than five years from the date of issue of the first bond or note.
Article 13. Voted to accept two drainage easements, the first being a grant of easement by William S. Blanchard and Gertrude C. Blanchard to the inhabitants of the Town of Medfield by instrument dated October 15, 1959, and recorded with Norfolk Deeds in Book 3774 at page 248, the second being a grant of easement by Herbert P. Crump and Dorothy C. Crump to the inhabitants of the Town of Med- field by instrument dated October 16, 1959, and recorded with said Deeds in Book 3774, Page 247.
Article 14. Voted to raise and appropriate the sum of $1,300.00 for the purpose of extending the drainage in an easement off Bridge Street for a distance of 350 feet.

Article 15. Voted to increase the term of office of the Town Treasurer from one (1) year to three (3) years, said three-year term of office to commence in the year 1963.
Article 16. Voted that this article be dismissed wherein a sum of money was sought for the purpose of renovating the Town Hall.
Article 17. Voted that this article be dismissed, wherein adoption of the provisions of General Laws, Chapter 41, Section 97, relating to the operation of the Police Department was suggested.
Article 18. Voted that this article be dismissed, wherein adoption of the provisions of General Laws, Chapter 41, Section 97A, relating to the operation of the Police Department was suggested.
Article 19. Voted that this article be dismissed, wherein accept- ance of the provisions of Chapter 41, Section 108E of the General Laws as amended pertaining to the minimum annual compensation of Police Officers was petitioned.
Article 20. Voted to dismiss this article wherein a sum of money for the purchase of a 75 foot Aerial Ladder Truck for the Fire Depart- ment was sought.
Article 21. Voted to raise and appropriate the sum of $750.00 for the purchase of 500 feet of 21/2" hose for the Fire Department.
Article 22. Voted to raise and appropriate the sum of $1,735.00 for the purpose of changing the radios of the Fire Department with the Base Station.
Article 23. Voted unanimously to transfer the sum of $5,500.00 from the Stabilization Fund for the purchase of a new truck for the Tree and Moth Departments and authorize the Tree Warden to trade or sell the existing tree truck as part of the purchase price.
Article 24. Voted to authorize the Water and Sewerage Board to appoint one of its members as Water Superintendent.
Article 25. Voted that the sum of $4,300.00 be raised and appro- 'priated for the purchase of a truck chassis and a utility body to be mounted on the same for the use of the Water and Sewerage Depart- ment, and to meet said appropriation the sum of $4,300.00 be trans- ferred from the unexpended balance of an appropriation made under Article 29 of the Annual Town Meeting of March 14, 1960 and that the Water and Sewerage Board be authorized to sell or trade as part of the purchase price, the present 1951 truck.
Article 26. Voted that this article be dismissed wherein an engineering survey for the possible extension and improvement of the Town Water System was suggested.

Article 27. Voted to raise and appropriate the sum of $321.82 for retirement under the provisions of Chapter 708, Acts of 1941, as amended and Chapter 419, Acts of 1943, as amended, relative to teach- ers entering Military Service.
Article 28. Voted unanimously to transfer the sum of $14,000.00 from the Stabilization Fund for the purpose of renovating various areas in the Dale Street School and to equip four (4) classrooms and the cafeteria.
Article 29. Voted to establish a Permanent School Planning and Building Committee to be composed of five members to be appointed by the Town Moderator. Such a committee to consist of one member of the School Committee and four members at large. Term of member- ship shall be for three years except that the initial appointments shall be made as follows: One member for a term of one year, two members for a term of two years and two members for a term of three years, and to raise and appropriate the sum of $1,000.00 for the purpose of this committee and to authorize said committee from time to time to make application to the United States of America for a financial advance and assistance under the provisions of Public Law 560 of the 83rd Congress for securing an option on an appropriate site, preliminary and final plans, specifications and construction bids for the construction of addi- tional school building facilities, and any vacancies in said committee to be filled by the Moderator.

Article 30. Voted to authorize the Board of Assessors to appoint one of its members as Clerk.
Article 31. Voted to authorize the Board of Health to appoint one of its members as agent for the Board of Health.
Article 32. Voted to authorize the Cemetery Commissioners to appoint one of its members as Superintendent.
Article 33. Voted to raise and appropriate the sum of $150.00 to pay for trucking approximately 1500 yards of peat from the Route 27 reconstruction project to the Vine Lake Cemetery.
Article 34. Voted that this article be dismissed wherein a sum of money was asked for the surfacing of drives in Vine Lake Cemetery.

Article 35. Voted to hear the report of any committee appointed at any previous Town Meeting. The report of the Personnel Board Advisory Committee was read and accepted and the following resolu- tion was voted:
That a suitable article be prepared and submitted to the Town at the next Special or Annual Town Meeting and that the present Per- sonnel Board Advisory Committee continue in power and prepare said article.
Article 36. Voted that the Moderator appoint a committee of (5) five members and authorize it to make arrangements and to spend money appropriated under Article 3 for the observance of Memorial Day. The committee thus appointed by the Moderator was Joseph Roberts, Vincent Palumbo, Donald Mailing, Millard Owen and Ralph Baker.
Article 37. Voted to raise and appropriate the sum of $7,300.00 for the purpose of completing the swimming pond and its appur- tenances located at Green and Brook Streets and to authorize the Park Commission to spend said sum of money.
Article 38. Voted to raise and appropriate the sum of $4,800.00 for the purpose of operating and maintaining the swimming pond located at Green and Brook Streets.
Article 39. Voted to raise and appropriate the sum of $500.00 for the purpose of development and maintenance of the Little League play- ing area.
Article 40. Voted not to amend the Zoning By-Law and Zoning Map of the Town of Medfield for a certain parcel of land situated on the southerly side of Main Street as described in this article.

Voted unanimously to reconsider Item 121 (Stabilization Fund) of Article 3 and also Articles 7 and 12.
Voted to rescind the action taken on Item 121 (Stabilization Fund) of Article 3 and to raise and appropriate the sum of $5,000.00 instead of the $15,000.00 previously voted for this fund.
Article 7. Voted to rescind the previous action taken on Article 7 at the Annual Town Meeting held March 12, 1962.
Voted unanimously to raise and appropriate the sum of $55,000.00 for the purpose of reconstructing Pound Street, and to meet appro- priation the sum of $5,000.00 be raised and appropriated and the Town Treasurer, with the approval of the Selectmen be and hereby is author- ized to borrow the sum of $50,000.00 and to issue bonds or notes there- for, in accordance with Section 7 of Chapter 44 of the General Laws, providing that the whole loan shall be paid in not more than 10 years from the date of issue of the first bond or note.

Article 43. Voted to adopt the following as a By-Law:
"Rules and Regulations Governing the Removal of Earth and Rock in the Town of Medfield", said Rules and Regulations being on file in the Office of the Town Clerk, and that all previous earth, rock and gravel removal By-Laws of the Town of Medfield are hereby rescinded.
Rules and Regulations Governing the Removal of Earth in the Town of Medfield
The removal of earth from all zoning districts of the Town of Medfield shall be deemed a non-conforming use of premises. Such uses shall be permitted only after special permission of the Board of Selectmen and under these rules and regulations. The Board of Select- men shall grant no such permit as would in their opinion adversely affect the scheme of growth laid down in the Zoning By-Law or else- where, or the economic status of the town, or tend to impair the beauty of the town, or of the district most immediately affected, or develop health or other hazards.
All applications for approval or endorsement for the removal of earth in the Town of Medfield shall be made in accordance with the rules and regulations hereinafter set forth.
Before an applicant can obtain a permit for the purpose of remov- ing earth in the Town of Medfield, he shall present to the Board of Selectmen an original and five copies of a plan made by a Registered Engineer or Registered Land Surveyor, which shall show in detail the following information:
(1) All the property where earth is to be removed with the boundaries shown in detail.
(2) All buildings on said property and buildings within one hundred feet of said property lines.
(3) All adjacent roads, their elevations, and established grades.
(4) All adjacent waterways, brooks, swamps and their elevations.
(5) Contour lines for the entire property at two-foot intervals showing existing and proposed elevations.
(6) Any and all easements existing and proposed, public or private.
(7) Any and all bench marks.
(8) All land shall be divided into five-acre grids.
The plan shall be drawn to a scale of 1" equals 40'. All profiles shall be drawn to a scale of 1" equals 8'.

The Board of Selectmen, hereinafter called the Board, after study, may make such corrections and revisions as it deems advisable in the public interest.
Section I. General Requirements
In approving the plan the Board will require that the land shall be suitable for the removal of earth without danger to health and life and that proper steps are taken so as not to hinder or danger traffic on public ways. The Board may require, at its discretion that police con- trol of the traffic be provided by the applicant at his expense. Only under special circumstances will the Board approve a plan for the removal of earth where intentions are shown for excavation below an already existing public way.
Section II. Procedure
The Board will act upon application for approval of earth removal only when proper plans have been submited with all information that is required clearly shown.
Before approval is granted, a public hearing shall be held by the Board, notices of which shall be sent by certified or registered mail with return receipt to mortgagees, if any, of the applicant's property and to all owners of property as appearing on the most recent tax list, any part of which lies within one hundred feet of the property of the applicant.
The applicant shall arrange and pay for such publications and notices and shall deliver a list of said mortgagees, property owners, return receipts, and a copy of the paper containing the notice of the hearing to the clerk of the Board at least twenty-four hours prior to the hearing.
The notice shall appear in a paper of general circulation within the Town, at least seven days prior to the hearing.
The word "applicant" as used in these rules and regulations shall mean the owner of the property or his legal representative or persons authorized by owner.
Corporations shall file with the Board a list of their officers and designate their authority to sign legal documents.
Before approval of any plan, and in order to insure the fulfillment of the following requirements, the Board will require a proper bond, deposits of money, or negotiable securities on a scale of not less than five hundred dollars per acre, the exact amount to be set by the board.
Said bond or security to be held by the Town of Medfield until all requirements of the Specifications have been complied with. The

Board shall be the agent to enforce compliance with these rules and regulations, and upon satisfactory completion will release the security.
Only under exceptional circumstances will any applicant be allowed to work more than one five-acre grid at any one time.
Section III. Specifications
All work shall be done in accordance with the following speci- fications:
(1) Trees to be cut (not bull-dozed).
(2) All trees, brush and stumps to be burned or chipped on the site, unless removed for commercial purposes.
Note: Before any burning is done, a fire-burning permit must be obtained from the Fire Chief of the Town of Medfield.
(3) All loam and subsoil must be bulldozed into piles for future re- spreading. No loam or subsoil may be removed from the property.
(4) Earth may be removed only to contours as specified by the Board. In earth removal areas, ledge shall not be left exposed above the approved grade and boulders, when encountered, shall be buried at least such that their tops are six feet below the approved grade and in the event that ledge is encountered, prior to reaching the approved grade, a revision of the approved grade plan must be immediately obtained.
(5) After the earth has been removed from the first five-acre grid, and before proceeding to the next five-acre grid, excavation shall be graded to the approved grade and all loam and subsoil shall then be respread over the excavation, except in such areas as are re- quired in subsequent operations.
(6) Rye grass shall be seeded on this reloamed area at the rate of two hundred pounds per acre.
(7) Fingerling fir or other approved trees shall be planted over the entire area, five or six feet on centers.
(8) Upon completion and approval by the Board of a five-acre grid, the security may be released in part or in whole or it may be advanced to the next grid.
Removal of earth which is not intended as a business, but for the improvement of a person's property and does not include large acreage, will be allowed on a weekly permit upon such conditions and terms as specified by the Board. This type of permit must be renewed every seven days at a time and place set by the Board.

In every case, whether it be a large or small earth removal operation, if any violation occurs, the permit shall be revoked forth- with and will not be renewed until the violation has been corrected to the satisfaction of the Board.
These rules and regulations governing the removal of earth in the Town of Medfield shall not apply to operations that were in progress and operated on land owned by the applicant prior to April 9, 1938, except that the final grade of the land shall be approved by the Board immediately upon the approval of this by-law.
The Board shall designate authority to inspect the earth removal operations under these rules and regulations.
The Board shall reserve the right to limit the days and hours of operation and may require antidust treatment in those areas that in the Board's opinion require such treatment.
The Board may also require additional surety to cover the cost of drainage to existing town roadways or clean-up requirements caused by the earth removal operation.
