The meeting was called to order at 7:30 P.M. by Moderator, Willard R. Stark.


The following motion made, seconded and carried:


VOTED: That this meeting be recessed for ten (10) min- utes.


The recess requested by the Finance Committee.


At 7:40 P.M. the moderator announced that the recess had terminated.


The moderator made the following announcements: "No standing in the rear of the hall." "That as usual the recom- mendations of the Finance Committee be considered as mo- tions and said motions duly seconded. However, substitute motions may be presented from the floor." "You will please refrain from personalities."

Article 1. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $700.00 to the Damages to Persons and Property Account, or act anything thereon.

Article 2. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the purchase and installation of a Chain-link type fence on the east and west side of the Police Station driveway, a total distance of approximately 300 feet, or act anything thereon.

That $550.00 be transferred from the Excess and Deficiency Account to the Police Department Chain-link Fence Account. Substitute motion presented and not seconded.

To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $3,000.00 pursuant to the provisions of General Laws Chapter 40, section 5 (47) for the purpose of establishing and maintaining a business and industrial commission to promote business and industry in Southbridge, or act anything thereon.

the Excess and Deficiency Account for the purpose of estab- lishing and maintaining a business and industrial commission to promote business and industry in Southbridge; said com- mission to be established and funds expended under the direc- tion of the Board of Selectmen.


Article 4. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $10,700.00 to the Pleasant Street Land Damage Account to pay for the settle- ment of certain land damage claims caused by takings made for the reconstruction and relocation of Pleasant Street, or act anything thereon.

That the sum of $7,000.00 be transferred to Pleasant Street Land Damage Account from the Excess and Deficiency Ac- count.


The following substitute motion presented, seconded and carried:


VOTED: That the sum of $10,700.00 be transferred from the Excess and Deficiency Account to the Pleasant Street Land Damage Account to pay for the settlement of certain land damage claims caused by takings made for the reconstruction and relocation of Pleasant Street.


Article 5. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for connecting abandoned sewer lines from Veterans Housing Project to drainage system on Armory Lane, or act anything thereon.

VOTED: In the affirmative $1,500.00 to be transferred from the Excess and Deficiency Account, work to be done by the Highway Department.


Article 6. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the con- struction of a storm drain on Warren Street from the existing drain southerly for a distance of about four hundred and forty (440) feet, or act anything thereon.

Article 7. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the con- struction of a sanitary sewer on Morris Street from the exist- ing sewer southerly to the end of the 1961 layout, a distance of about four hundred seventy-five (475) feet, or act anything thereon.

To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the con- struction of a sanitary sewer on Fort Sumpter Road from the existing sewer at North Woodstock Road, thence southwest- erly for a distance of about three hundred and fifty (350) feet, or act anything thereon.

Article 9. To see if the Town will vote to raise and ap- propriate, borrow or transfer a sum of money for the relaying of six hundred thirty (630) feet of sewer on Highland Street, or act anything thereon.

Article 10. To see if the Town will vote to raise and appropriate, borrow or transfer a sum of money for the con- struction of a storm drain on Woodycrest Avenue from prop- erty of Donald Marino easterly along Highridge Avenue for a distance of about two hundred (200) feet, thence northerly along property of Warren McGrath and Victor Salviuolo for a distance of about two hundred and twenty-five (225) feet to Woodycrest Avenue, thence easterly along Woodycrest Ave- nue for a distance of about forty-five (45) feet to existing drain, or act anything thereon.

appropriate, borrow or transfer a sum of money for grading of gutter on westerly side of Roger Street for a distance of about one hundred eighty-five (185) feet, said grading to con- sist of excavation, gravel fill, and Type I surface, or act any- thing thereon.

Article 12. To see if the Town will vote to raise and appropriate, borrow or transfer a sum of money for the con- struction of a stone rubble masonry wall along the easterly line of Roumanian Avenue opposite land owned by George and Anastasi Andrea with necessary supporting walls along the northerly line of Cisco Street and the northerly line of land owned by said Andrea, or act anything thereon.

VOTED: That the sum of $7,800.00 be taken from the Excess and Deficiency Account for the construction of a stone rubble masonry wall along the easterly line of Roumanian Avenue opposite land owned by George and Anastasi Andrea with necessary supporting walls along the northerly line of Cisco Street and the northerly line of land owned by said Andrea, work to be done by contract.


Article 13. To see if the Town will vote to raise and appropriate, borrow or transfer a sum of money for the re- construction of a sidewalk and installation of drainage on Dresser Street; said construction to consist of rebuilding one hundred (100) feet of sidewalk, grading driveway and lawn at Southbridge Nursing Home; said installation of drainage to consist of installing a drain at Franklin Terrace and at South- bridge Nursing Home, or act anything thereon.

Article 14. To see if the Town will vote to sell for Five Hundred ($500.00) Dollars to Massachusetts Electric Company, a Massachusetts corporation, the perpetual right and easement

to construct, maintain and operate line of towers or poles or both, and wires together with the necessary fittings and ap- purtenances thereto, for the transmission of high and low volt- age electric current and for telephone use, over, across and upon a strip of land in Southbridge, Worcester County, Massa- chusetts, owned by said Town, extending from land now or formerly of Raymond L. Mckinstry in a westerly direction to other land now or formerly of said Massachusetts Electric Company, said strip of land being generally bounded and described as follows:


Beginning at the southwest corner thereof at a point sit- uated North 19º 18' E., a distance of one hundred two and forty-eight hundredths (102.48) feet, more or less, from a drill hole in wall at the southwesterly corner of land conveyed to the Town of Southbridge by Worcester County Electric Com- pany by deed dated August 30, 1955 and recorded with Wor- cester District Deeds, Book 3743, Page 431, said drill hole be- ing also at the northeasterly corner of land described in the grant of an easement by the Town of Southbridge to Worces- ter County Electric Company be deed dated November 21, 1955 and recorded with Worcester District Deeds, Book 3745, Page 481;


Thence North 19º 18' E., by land of Massachusetts Electric Company, a distance of two hundred (200) feet to a point at other land of the Town of Southbridge;


Thence South 56° 21' E. by land of the Town of South- bridge, a distance of two hundred twenty-seven and sixty-five hundredths (233.62) feet to the westerly line of a brook and land now or formerly of Raymnod L. Mckinstry;


Thence southerly by the westerly line of brook and land now or formerly of Raymond L. Mckinstry a distance of eighty (80) feet, more or less, to a point at land of the Town of South- bridge;


Thence North 86° 28' W. by land of the Town of South- bridge, a distance of two hundred twenty-seven and sixty-five hundredths (227.65) feet to the point of beginning.


Also, the perpetual right and easement to use, for all pur- poses for which streets or ways are used in the Town of South- bridge, a portion of the hereinabove described strip of land forty (40) feet in width, together with the right to fill, drain, pave and otherwise improve said portion of said strip as may be necessary in order to use the same for said purposes;


And to authorize the Selectmen to execute and deliver to said Massachusetts Electric Company such deeds or other instruments as may be necessary to accomplish the same, such deeds or other instruments to be in such form as the Select- men may approve; or act anything thereon.


VOTED: (unanimously) To waiver reading of strip of land by moderator.

Article 15. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $500.00 for the purchase and installation of a monument in honor of Gold Star Parents on Gold Star Circle, or act anything thereon.

Article 16. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $1,000.00 to Law Expense Account to be used for expenses in the prosecution of suit against T. J. Brodeur and others, or act anything there- on.

Note: The moderator informed the Town Clerk during the meeting that 134 were present.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Southbridge, qualified to vote in town affairs, to meet at the Southbridge Town Hall, in said Southbridge, on Monday, December 9, 1963 at 7:30 P.M., then and there to act on the following articles:


Article 1. To see if the Town will vote to transfer the sum of $260.00 from the Assessors' S-2 Clerk Salary Account to the Assessors' Expense Account to purchase fifty (50) ring binders at $5.20 each for binding deed abstracts, or act any- thing thereon.


Article 2, To see if the Town will vote to transfer the sum of $100.00 from the Treasurer's Other Expenses Account to the Treasurer's Extra Clerical Account, or act anything thereon.


Article 3. To see if the Town will vote to transfer the sum of $491.00 from the Town Hall Lighting Account (offices) to the Town Hall Legion Rooms Lighting Account, or act any- thing thereon.


Article 4. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $126.40 to reimburse Skarbros Realty, Inc. for the construction of a concrete side- walk on North Street or act anything thereon.


Article 5. To see if the Town will vote to transfer the sum of two hundred fifty ($250.00) dollars from the Engineer- ing Salary Account to the Engineering Other Expense Account or act anything thereon.

Article 8. To see if the Town will vote to transfer the sum of One Thousand Six Hundred and Sixteen ($1,616.00) Dollars from the Road Machinery New Equipment Account (balance from purchase of New Truck) to an account for the purchase of a New Snow Plow, or act anything thereon.


Article 9. To see if the Town will vote to transfer the sum of One Thousand Two Hundred and Nine ($1,209.00) from the Road Machinery New Equipment Account. ($574.80 bal- ance from purchase of Grader Plow and $634.20 balance from purchase of a 21/2 Ton Roller, total of $1,209.00) to the Gasoline and Oil Account or act anything thereon.


Article 10. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $500.00 for the Dog Officer Expense Account, or act anything thereon.


Article 11. To see if the Town will vote to authorize the transfer of $400.00 from the Police New Cruiser Purchase Ac- count to the Police Cruiser Gas, Oil and Car Expenses Ac- count, or act anything thereon.


Article 12. To see if the Town will vote to amend Classi- fication P-2 and P-3 of Exhibit B-3 as contained in the Com- pensation Plan of Article MCX of the Town By-Laws, as amended from time to time, so as to read as follows :

Article 15. To see if the Town will vote to transfer the sum of one hundred forty-five ($145.00) dollars from the World War I Memorial Park Special Repair Account to the general account of World War I Memorial Park.

Article 16. To see if the Town will vote to hear, act on and accept the progress report of the By-Law Study Commit- tee in accordance with Article 46 of the Annual Town Meet- ing held March 11, 1963, or act anything thereon.


Article 17. To see if the Town will vote to change the Zoning Map and Zoning By-Laws of the Town of Southbridge to extend the General Business District as it presently appears on the northerly side of North Street to include the following described tract of land:


Beginning at a point on the northerly line of said North Street at the southwest corner of the presently zoned retail business district, said point being one hundred sixty- one and thirty-three hundredths (161.33) feet westerly of the junction of the northerly line of said North Street and the westerly line of said Mechanic Street;


Thence N 68° 28' W by the northerly line of said North Street, for a distance of seventy-nine and forty-seven hundredths (79.47) feet, to a stone bound at land of Uni- versal Blank Co., Inc .;


Thence N 19° 23' W by land of said Universal Blank Co., Inc. and land of George A. Gamache and Marie Anne Ga- mache, a distance of one hundred thirty-five and ninety- five hundredths (135.95) feet, to a stone bound at land of said Universal Blank Co., Inc .;


Thence N 31° 34' E by land of said Universal Blank Co., Inc., a distance of ninety-six and sixty-nine hundredths (96.69) feet, to a stone bound at land formerly of F. X. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of two thousand five hundred ($2,500) dollars to be used in the preparation of plans for Nuisance Brook Improvements, said money to be used un- der Chapter 91 of the General Laws in conjunction with money which may be alloted by the State and/or County, or both, for this purpose or act anything thereon.


Article 19. To see if the Town will vote to revise the Chapter 90 Pleasant Street assignment of funds voted under Article 34 of the Annual Town Meeting held March 11, 1963, to include construction work on South Street, or act anything thereon.

Article 20. To see if the Town will vote the following resolution:


Resolution authorizing filing applications with the United States of America for an advance to provide for the planning of public works under the terms of Public Law 560, 83d Con- gress of the United States, as amended.


Whereas, the Town of Southbridge, after thorough con- sideration of the various aspects of the problem and study of available data, has hereby determined that the construction of certain public works, generally described as construction of intercepting sewer on east Main Street, is desirable and, in the public interest and to that end, it is necessary that action preliminary to the construction of said works be taken imme- diately; and


Whereas, under the terms of Public Law 560, 83d Con- gress, as amended, the United States has authorized the mak- ing of advances to public bodies to aid in financing the cost of engineering and architectural surveys, designs, plans, work- ing drawings, specifications or other action preliminary to and in preparation for the construction of public works; and


Whereas, the town has examined and duly considered such act and the Town considers it to be in the public interest and to its benefit to file an application under said act and to authorize other action in connection therewith;


Now, therefore, be it resolved, by the Town Meeting as- sembled of the Town of Southbridge, as follows:


1. That the construction of said public works is essential to and is to the best interests of the Town, and to the end that such public works may be provided as promptly as practicable, it is desirable that action preliminary to the construction there- of be undertaken immediately;
