On motion of R. A. Pontbriand, duly seconded, it was VOTED: (Unanimously) To amend the zoning by-laws, to establish a uniform Heavy Industry District on both sides of Dresser Hill Road.
Beginning at the terminus of the existing Heavy Industry District on the westerly side of Dresser Hill Road; Thence running north westerly for a distance of four hundred feet (400) Then turning and running easterly to the Town of Charlton town line; Then beginning on the easterly side of Dresser Hill Road at the Charlton town line and going east- erly for a distance of four hundred feet (400); Thence turn- ing and going southerly on the entire easterly side of Dres- ser Hill Road to the beginning of Dudley Hill Road at the southern end of Dresser Hill Road as shown on the 1958 zoning map of the town. The purpose being to have a zone 400 feet deep of Heavy Industry on each side of Dresser Hill Road.
The foregoing amendment to zoning by-laws adopted under Article 44 is hereby approved.

To see if the Town will vote to raise and appropriate, borrow or transfer , a sum of money to purchase from Eva and Desanges Chamberland lot #15 as shown on plan of "Pleasant Street Heights," dated October 1, 1922 to be used as a Town Street, or act anything thereon. On motion of Finance Committee, duly seconded, it was VOTED: Indefinite postponement.
Article 46. To see if the Town will vote to transfer the the sum of $150.00 from the E & D Account to an account to be known as the Special Counsel Account to pay Attorney Harry Zarrow, for his services rendered to the town, or act anything thereon.
The Finance Committee corrected their motion to read In- definite postponement. Reason for correction: The Town Counsel advised the Committee that the article was illegal. The moderator ruled that there was no Article 46, inasmuch as this was illegal and that he was not accepting it as an article. He Stated: "That the Town Counsel had so in- formed him that even if the Town were allowed to vote, and did vote in the affirmative, that under the existing laws of the Commonwealth this bill could not be legally paid. " Mr. Ryan of the Southbridge Planning Board through which this

bill was incurred tried to argue that because a judge had ruled that the litigation resulted in a decision of the Plan- ning Board made this request for payment legitimate. The moderator in conclusion, pointed out, that the result of the litigation was of no consequence, in as far as without auth- ority and against the general statutes, that this bill had been incurred. He also refused Mr. Ryan's request that we vote on the matter, and then send the results to the Dept. of Corps. and Taxation in Boston and then ask them to decide upon the legality of our action. The moderator explained his refusal of this request, on the fact that he would not knowingly ask the townspeople to vote on any matter that the Town Counsel ruled would be against any of the laws of the Commonwealth.
Article 47. To see if the Town will vote to transfer the sum of One Thousand Ten Dollars ($1,010.00) from the Sale of Lots and Graves Account to the Cemetery Improvement Account, or act anything thereon.
On motion of Finance Committee, duly seconded, it was VOTED: In the affirmative for $1,010.00 from the Sale of Lots and Graves.
Article 48. To see if the Town will vote to abandon that section of Old South Road from the westerly line of the 1961 Re-location of South Street as shown on Plans Decree 2028, Plan H3805R, dated March 9, 1961; Thence northwesterly to the southerly line of South Street as relocated in 1904 by the County Commissioners, for a distance of approximately six hundred eighty (680) feet, or act anything thereon. On motion of Finance Committee, duly seconded, it was VOTED: Indefinite postponement.
Article 50. To see if the Town will vote to abandon that section Breakneck Road from the Southerly line of the 1904 re-location of South Street, southwesterly to the northerly line of the 1961 relocation of Breakneck Road for a distance of approximately two hundred twenty (220) feet, or act any- thing thereon.
On motion of Finance Committee, duly seconded, it was VOTED: Indefinite postponement.
Article 51. To see if the Town will vote upon the recom- mendation of the Board of Selectmen to raise and appropriate or transfer the sum of Two Thousand ($2,000.00) Dollars in order to grant a yearly Annuity to Mr. Leon A. Caron, former Town Accountant, under the provisions of Chapter
32, Section 95, General Laws of Massachusetts, or act anything thereon. On motion of Finance Committee, duly seconded .... Indefinite postponement.

Caron, former Town Accountant , under the provisions of Chapter 32, Section 95 of the Gen- eral Laws and in accordance with the recommendation of the Board of Selectmen.

Article 52. To see if the Town will authorize the Board of Assessors to use a certain sum of Free Cash in the Treas- ury in computing the rate for 1966, or act anything thereon. On motion of Finance Committee, duly seconded, it was VOTED: That the Board of Assessors use $180, 000.00 from the Free Cash in the Treasury in computing the tax rate for 1966. (Unanimous vote.)
Article 53. To see if the Town will vote to rescind its action in acceptance of an article at a previous town meet- ing establishing the elected term of office of the Tree Warden as a one year term, and elect a Tree Warden as provided for in Chapter 41, Section 1, of the General Laws, to serve for three (3) year terms; said term of office to be effective at the next Annual Town Meeting.

VOTED: (Unanimously) That the Town rescind its action in acceptance of an Article at a previous town meeting establishing the elected term of the office of Tree Warden as a one (1) year term and elect a Tree Warden as provided for in Chapter 41, Section 1 of the General Laws, to serve for three (3) year terms; said term of office to be effective at the next annual town meeting.
Article 54. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of Nine Thousand Two Hundred Twenty-eight Dollars and Thirteen cents ($9,628.13) for the Non-Contributory Retirement System for the pension allowance payable to Mr. Raymond L. Ben- oit, $3,209.38 for the period July 1 thru Dec. 31, 1965

and $6,418.75 for the entire year 1966, who retired June 30, 1965 under Chapter 490 Section 1, 2 & 3 of the Acts of 1961, or act anything thereon.

Resolutions Congratulating the Town of Southbridge on the Occasion of the One Hundred and Fiftieth Anniversary of Its Incorporation
Whereas, On February 15, 1816 parts of the town of Charlton, Dudley and Sturbridge were incorporated as the Town of Southbridge; and
Whereas, The inhabitants of the Town of Southbridge have contributed immeasurably to the growth and develop- ment of the Commonwealth's economy; and
Whereas, Many of its citizens have distinguished them- selves in the field of public service in the town, the Com- monwealth and the nation; now, therefore, be it
Resolved, That the Massachusetts Senate hereby ex- tends to the town of Southbridge its heartiest congratulations and best wishes for a prosperous future on the occasion of the one hundred and fiftieth anniversary of its incorporation; and be it further
Resolved, That a copy of these resolutions be forwarded by the Clerk of the Senate to the Town Clerk of the town of Southbridge to be filed with the records of said town.

To either of the constables of the Town of Southbridge, in said County , GREETINGS:
In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Southbridge, qualified to vote in town affairs, to meet at the Town Hall, in said Southbridge, on Monday, June 6th, 1966 at 7:30 P. M., then and there to act on the following articles:
Article 1. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $5,000.00 to the Damages to persons and property Account, or act anything thereon.
Article 2. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of $60.00 to the Cady Brook Land Damage Account to pay Rita E. Dragon formerly known as Rita E. Lefebvre in full satisfaction for all the claims arising as the result of takings by the Town of Southbridge for improvements to Cady Brook, viz., Par- cel #6 by Land Taking, dated August 1, 1960, or act any- thing thereon.
Article 3. To see if the Town will vote to permit the Southbridge Airport Committee to enter into a lease with one Raymond Leo of a portion of the Southbridge Airport lo- cated on the Easterly side of the Northwest Runway and more specifically referred to as the future Industrial Area on the Southbridge Master Plan for the purpose of operating a fixed base operation consisting of gas sales, aircraft sales, charters, rentals, and incidental uses thereto, up- on such terms and conditions as the Southbridge Airport Committee deems for the best interests of the Town of South- bridge, or act anything thereon.
Article 4. To see if the Town will vote to transfer the sum of Thirty Five Hundred and Twenty One Dollars ($3,521.00) from the New Equipment Account to the Snow and Ice Account or act anything thereon.
Article 5. To see if the Town will vote to authorize the transfer of Nine Hundred and Ninety-five dollars ($995.00) from the General Parking Meter Fund for the purchase of a new Coin Sorting and Counting Machine to replace the machine now disabled, or act anything thereon.
Article 6. To see if the Town will vote to transfer any funds received or to be received from the County of Worcester , as a grant, under the provisions of Chapter 132 of the Gen- eral Laws as amended by Chapter 657, Section 26D of the Acts of 1956, to the Dutch Elm Disease Account or act in any manner thereto.
Article 7. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of Three Hundred Dollars ($300.00) to the Park Commissioners for the main- tenance and upkeep of the Gold Star Memorial, or act any- thing thereon.
Article 8. To see if the Town will vote to authorize the Board of Selectmen to enter into a lease with the South- bridge Finishing Company for the use for a period of five years of the premises conveyed by said Southbridge Finish- ing Company to the inhabitants of the Town of Southbridge by deed dated August 10, 1956 and recorded with Worcester District Registry of Deeds, Book 3795, Page 552, as cor- rected. Said lease to be executed in accordance with the provisions of Section 3 of Chapter 40 of the General Laws of the Commonwealth. Consideration for said lease to be in an amount not greater than one dollar ($1.00) per year, or act anything thereon.
Article 9. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of Two Hundred Forty One Dollars and Twenty Eight Cents ($241.28) from the Gen- eral Civil Defense Account to an account entitled Pay Re- imbursement Account, or act anything thereon.
Article 10. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of Four Thousand Four Hundred Seventy Dollars, ($4,470.00) for equipment, alterations and repairs for the Welfare quarters, or act any- thing thereon.
Article 11. To see if the Town will vote to appropriate, borrow or transfer the sum of One Thousand Four Hundred and Fifty Six Dollars ($1, 456.00) to increase the wages one step on the wage scale for the Highway Dept. employees that did not receive an increase at the annual Town meeting in March. Increase to be retro-active to January 1st.
Article 12. To see if the Town will vote to hear, act on and accept the report of the Board of Selectmen as to laying out of a public way, a certain street to be known as Brent- wood Drive from the easterly line of Lebanon Hill easterly and northerly to the land now or formerly owned by Adelina Peck a distance of about 2160 feet, or act anything thereon.
Article 13. To see if the Town will vote to raise and appropriate, borrow or transfer, the sum of One Hundred Fifty Dollars ($150.00) to an account to be known as the
Regional Vocational School Planning Committee, Administra- tive Expense Account, pursuant to Chapter 71 of the Gen- eral Laws of Massachusetts, Section 14 to 161 inclusive, or act anything thereon.
Article 14. To see if the Town will vote in accordance with Section 22 of Chapter 40 of the General Laws to auth- orize the Board of Selectmen to lease until March 31, 1967, property located at the corner of Main and Goddard Streets , owned by Martin Realty Co., of Auburn, Inc., to be used for off- street parking upon such terms and conditions as the Board of Selectmen might determine and to raise and appro- priate, borrow or transfer a sufficient sum of money to cov- er the cost of such lease, public liability insurance and the cost of policing and maintaining said area, or act anything thereon.
Article 15. To see if the Town will vote to amend Sec- tion 3 of Article MCX of the Town By-Laws, as amended from time to time so that it will read as follows:
Section 3. The Compensation Plan . The Compensation plan, when established by vote of the Town, shall consist of the minimum and maximum salaries and wages to be paid all employees of the Town in any position subject to the Class- ification Plan, and the Compensation Plan may be amended from time to time by vote of the Annual Town meeting or by vote of a Special Town meeting, or act anything thereon.
Article 16. To see if the Town will vote to amend the following Classifications as contained in Exhibit A of the Classification Plan of Article MCX of the Town By-Laws, as amended from time to time, so as to read as follows:

JUNE 6, 1966
Meeting was called to order by Moderator, Willard R. Stark at 7:30 P.M.
VOTED: That the reading of the warrant by the Town Clerk be dispensed with.
Officer's return of warrant was read by Town Clerk, Clare P. Boyer.
The moderator stated: "It is our usual custom to recognize the recommendations of the Finance Committee as motions and that said motions are duly seconded. Substitute motions may be presented from the floor." He then continued stat- ing the duties of a moderator. In conclusion he said: "I represent you and not anybody else at these meetings. "
Article 1. To see if the Town will vote to raise and appro- priate , borrow or transfer the sum of $5,000.00 to the Damages To Persons and Property Account, or act anything thereon.
On motion of Finance Committee, duly seconded, it was VOTED: (Overwhelmingly) To transfer $5,000.00 from the Excess and Deficiency Account to the Damages to Persons and Property Account.

To transfer the sum of One Thousand Five Hundred Twenty- One Dollars ($1, 521.00) from the Road Machinery New Equip- ment Account to increase the wages one step on the wage scale for the employees of the Highway Department that did not receive an increase at the annual town meeting in March. Increase to be retro-active to January 1st, and to become effective immediately.
