Article 6. To see if the Town will vote to raise and ap- propriate, borrow or transfer, a sum of money for loam and seeding Alumni Field, or act anything thereon.

VOTED: That the sum of Eight Hundred Fifty ($850.00) Dollars be transferred from the Excess and Deficiency Account to the balance open in the Grading and Seeding Account of Alumni Field, with gross fund to be used in grading and seed- ing. Said work to be done by contract.


Article 7. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $465.00 to remove seven dead elm trees to stop the spread of Dutch Elm Disease, work to be done under the supervision of the Tree Warden, or act anything thereon.

Article 9. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $300.00 for additional. budget needed to finish the 1962 season at Henry Street Field, or act anything thereon.

GREETINGS:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Southbridge, qualified to vote in town affairs, to meet at the Town Hall, in said Southbridge, on Monday, Octo- ber 22, 1962 A.D. at 7:30 P.M. then and there to act on the fol- lowing articles:


Article 1. To see if the Town will vote to raise and appropriate, borrow or transfer, the sum of $300.00 to be used by the Urban Renewal Committee for office equipment and supplies, or act anything thereon.


Article 2. To see if the Town will vote to transfer the sum of $1,400.00 from the Road Machinery New Equipment- Sweeper Account, to Road Machinery New Equipment-Snow Plow Account , or act anything thereon.


Article 3. To see if the Town will vote to raise and appropriate, borrow or transfer $1,387.00 for payment on ma- turing debt-High School, or act anything thereon.

Article 9. To see if the Town will vote to hear, act on, and accept the report of the Selectmen as to the Laying out of a public way a certain street known as High Ridge Avenue,

from the Westerly line of Cole Avenue to the Easterly line of High Street for a distance of seven hundred forty (740.0) feet in accordance with Plan dated September 25, 1962 on file in the office of the Town Engineer, or act anything thereon.


Article 10. To see if the Town will vote to hear, act on, and accept, the report of the Selectmen as to the laying out of a public way a certain street known as Crestview Drive, Commencing at the terminus of the 1961 Layout of said Crest- view Drive, thence southeasterly for a distance of three hun- dred forty (340.0) feet more or less in accordance with Plan dated July 24, 1961, altered September 27, 1962, on file in the Town Engineer's Office, or act anything thereon.


Article 11. To see if the Town will vote to raise and appropriate, borrow or transfer, the sum of one thousand nine hundred seventy-five dollars and twenty cents ($1,975.20) for the Non-Contributory Retirement System, or act anything thereon.


Article 12. To see if the Town will vote to raise and appropriate, borrow or transfer, the sum of eighteen thousand ($18,000.00) dollars to the Veterans Benefits Account, or act anything thereon.


Article 13. To see if the Town will vote to transfer the sum of one thousand forty-five dollars and five cents ($1,045.05) from the Road Machinery New Equipment (New Truck) Ac- count, and the sum of nine hundred forty-two dollars and fifty- six cents ($942.56) from the Hartwell Street Reconstruction Account a total of one thousand nine hundred eighty-seven dollars and sixty-one cents ($1,987.61) to the Other Expense Account, or act anything thereon.


Article 14. To see if the Town will vote to transfer the sum of six hundred seventy-two dollars and seventy-six cents ($672.76) from the Central Street Bridge Repairs Account to the Gasoline and Oil Account, or act anything thereon.


Article 15. To see if the Town will vote to amend the wording of the vote on Article 50 of the annual meeting of March 12, 1962 from, "Voted in the affirmative for $2500 for the repair of present iron fence on the westerly side and the pointing and reinforcing of the retaining wall on the easterly side with new beam type guard rail at the Central Street bridge, said work to be done by contract," to "Voted in the affirmative for $2500 for the repair of present iron fence on the westerly side and the pointing and reinforcing of the re- taining wall on the easterly side with new beam type guard rail at the Central Street bridge, said work to be done by

the Highway Department," and also to approve the expendi- ture of said funds by the Highway Department.


Article 16. To see if the Town will vote to raise and appropriate, borrow or transfer, the sum of $1,500.00 to pay Bolak Szumilas and Dorothy Szumilas, in full settlement of any and all claims arising out of the taking of land owned by them by the Worcester County Commissioners for the re- location and reconstruction of Pleasant Street, or act any- thing thereon.


Article 17. To see if the Town will vote to hear, act on, and accept the report of the Board of Selectmen as to the laying out of a public way, a certain street known as Pinedale Street, commencing at the southerly terminus of the 1961 Lay- out of High Street, thence southwesterly for a distance of about seven hundred fifty (750) feet, or act anything thereon.


You are directed to serve this warrant by posting attested copies in six (6) conspicuous places within the Town at least seven (7) days before holding said meeting.


Hereof fail not and make due return of this warrant with your doings thereon to the Town Clerk at the same time and place mentioned before.

PROCEEDINGS OF SPECIAL TOWN MEETING OCTOBER 22, 1962


The meeting was called to order at 7:30 P. M. by Moderator Willard R. Stark.


The moderator made the following announcements: "As usual the recommendations of the Finance Committee to be considered as motions and said motions duly seconded. How- ever, substitute motions may be presented from the floor."


"Refrain from personalities, please."


He also stated: "Mr. Harold Peterson, our Town Counsel, will not be present this evening because he had a previous legal appointment in Barnstable."


VOTED: That the reading of the warrant by the Town Clerk be dispensed with.


Article 1 To see if the Town will vote to raise and ap- propriate, borrow or transfer, the sum of $300.00 to be used by the Urban Renewal Committee for office equipment and supplies, or act anything thereon.

(Finance Committee's recommendation: That action be referred to the Town Meeting.) The moderator announced: "A two-thirds vote necessary to carry."


The following motion presented, seconded and carried:


VOTED: (unanimous) That the Town do not amend the Zoning By-Laws as requested in Article 7.


During the pros and cons on this article Atty. J. J. O'Shaughnessy, legal counsel for some residents of Coombs Street, said the article is "a deliberate attempt to circumvent the laws, and should be fought."

Dr. R. Dresser of Main Street, started to give what he ·called a "chronological order" of a dealing which the Desautels sisters of 71 Main Street, had experienced with a contractor, who would stand to gain by rezoning, according to Dresser. Moderator Stark ruled that the reading of the chronological order would have no bearing on the question at hand.


Mr. E. Ryan read the first paragraph of the zoning laws: "By-Laws establishing a zone plan for the purpose of promot- ing the public health, safety, convenience, morals and the general welfare; dividing the town of Southbridge into districts and etc." Mr. Ryan argued that only one person would stand to benefit by a zoning change . . . the landlord.


Mr. E. Ryan explained the term "multi-family." He also informed the inhabitants that if this zone change was voted it would be detrimental to the promotion of public health, safety, convenience, morals and the general welfare.


On October 18, 1962 at 10:09 A. M., I received a copy of the minutes of the hearing conducted by the Planning Board on October 15, 1962, concerning a proposed amendment to the Zoning By-Laws to extend the Multiple-Family District on Coombs Street from the northerly line of that district, norther- ly to Main Street and to extend easterly to the present ter- minus of the General Business District, and southerly to the terminus of the Multiple-Family District.


The notice of the hearing was read by the secretary. No one rose to speak in favor of the proposed change. Many resi- dents of the area and other interested citizens spoke in opposi- tion and pointed out that the suggested change would bring more traffic, decrease play area for children, devaluate prop- erty and hurt the financial interests of those in the area. Chair- man Arsenault announced that the Board would make its rec- ommendation at the Town Meeting on October 22, 1962. The hearing was closed at 8:45 P. M.

Recommendation of the Planning Board on Article 7.


Due to the result of the Planning Board's investigation, and the public hearing held October 15, 1962, this Board, meet- ing in executive session on October 15, VOTED not to recom- mend this proposed zone change. We find insufficient evidence to support a zoning change in the area at this time.

Mrs. Anna D'Alessandro 13 Coombs Street Southbridge, Massachusetts Dear Mrs. D'Alessandro:


A Hearing was held on October 8, 1962, at the Town Hall, Room 14 and adjourned to the Memorial Hall in the Town Hall, wherein abuttors were represented by John J. O'Shaugh- nessy. The unanimous decision of the Board is as follows:


"That a variance be granted for a Multiple-Family Dwell- ing (5 apartments) in the Two-Family Residence District on the property located on the easterly side of Coombs Street bounded and described as follows:


Beginning at an iron pin in the ground at the easterly line of said Street at the southwesterly corner of land formerly of George Desautels and now of Alice Desautels seventy-nine and eighty-five hundredths (79.85) feet, more or less, to an iron pin in the ground at land now or formerly of one Robert; thence S. 16° 15' W. along the westerly line of said Robert land about fifty-seven and nine-tenths (57.9) feet to a stone bound; thence N. 70° 20'W. along land formerly of Hormidas Trem- blay eighty (80) feet to a drill hole in the easterly line of Coombs Street; thence N. 16° 15' E. fifty-two and forty-five hundredths (52.45) feet along the easterly line of said Coombs Street back to the iron pin at the point of beginning."
