In the name of the Commonwealth you are hereby required to notify and warn the inhabitants of the Town of Southbridge who are qualified to vote in the State Election to meet at the several polling places in said Southbridge designated by the Selectmen, to wit: Precinct #1, Mary E. Wells Junior High School; in Precinct #2, West Street School; in Precinct #3, Sacred Heart Parish Hall; in Precinct #4, Eastford Road School; in the Central Counting Place, Memorial Hall, Town Hall; on Tuesday, November 3, 1964, for the following purposes :

Do you approve of the adoption of an amendment to the consitution summarized below which was approved by the General Court in a joint session of the two branches held March 29, 1961, received 219 votes in the affirmative and 26 in the negative, and in a joint session of the two branches held May 8, 1963, received 244 votes in the affirmative and 14 in the negative?

SUMMARY


The proposed amendment provides that the terms of office of the Governor, Lieutenant Governor Secretary of the Common- wealth, Treasurer and Receiver General, Attorney General and Auditor shall be four years. Executive Councillors, Senators and Representatives shall continue to serve for two years. The four- vear term for constitutional officers would become effective at the time of the November election in the year 1966.

In the event that any public office, whether elective or appointive, shall become vacant as a result of enemy attack, the proposed amendment would enable the General Court to provide for prompt and temporary succession to the powers and duties of such offices, and to take steps to insure continuity of government of the Commonwealth and its political subdivisions.

The proposed amendment provides that the credit of the Commonwealth may be given, loaned or pledged only by a two- thirds vote of each branch of the Legislature. In no event shall the credit of the Commonwealth be given or loaned to or for any individual, private association or corporation privately owned or managed.

The proposed amendment authorizes both the Governor and the Executive Council to require opinions of the Justices of the Supreme Judical Court on questions of law. The present require- ment that the Governor and Council agree before a question may be submitted would be annulled.

SUMMARY


The proposed measure provides that henceforth appointments in the executive branch of the government shall not require the advice and consent of the Governor's Council. Exceptions to this provision include appointments to the Youth Service Board, Industrial Accident Board, Commission of the Department of Public Utilities, Parole Board and Appellate Tax Board, which appointments shall continue to require Council action. However, should the Council fail to act upon appointments within thirty calendar days, then the person involved shall be deemed to have been lawfully appointed. Any appointment in the executive branch by an officer other than the Governor which heretofore required council approval shall henceforth require approval by the Go- vernor.

Removals from office shall no longer require the advise and consent of the Council, except in the case of the Youth Service Board, which removals must still receive Council approval. As in the case of appointments still requiring Council approval, such recommended removal from the Youth Service Board must be acted upon the Council within thirty calendar days; otherwise the pro- posed removal shall become effective as if approval had been given. In the case of any appointment which heretofore required Council approval the Governor may, within fifteen days of the making of the appointment, remove the person appointed without cause.


The Council shall no longer be required to approve the fixing of any compensation for services rendered in the executive depart- ment. And henceforth there need be no approval by the Council of actions or agreements by executive officers, including but not limited to borrowings and loans, investments, leases, licenses, pur- chases and conveyances, and contracts, and also including the promulgation of rules and regulations.


Notwithstanding the foregoing, the Governor shall at all times remain free to seek the advice and consent of the Council upon any matter.

Under the Act, effective as of January 1, 1964, each member of the General Court shall receive seventy-eight hundred dollars for each regular annual session, the President of the Senate and Speaker of the House of Representatives shall each receive the same amount as additional compensation, and the floor leaders of each of the major political parties in the Senate and House, the Chair- man of the Senate Committee on Ways and Means and the Chair-

man and Vice-Chairman of that committee of the House, shall each receive thirty-nine hundred dollars as additional compensa- tion, to be paid as provided in the Act. After the same date the annual expense allowance is to be six hundred dollars for each member and the travel allowance is to be eight cents per mile with a stated minimum and an alternative, and a member chosen to fill a vacancy or who resigns during a session is to be entitled to per diem compensation at the rate for each regular annual session and to the allowances for travel and other expenses for the time of his membership.


It is also provided that in addition to the compensation for the 1963 annual session the President of the Senate and Speaker of the House shall be paid thirty-nine hundred dollars, the floor leaders of each major political party in the Senate and House, the Chairman of the Senate Committee on Ways and Means and Chairman and Vice-Chairman of that committee of the House, shall be paid twenty-nine hundred and twenty-five dollars and each other member shall be paid nineteen hundred and fifty dollars. Each member shall also be entitled to an additional expense allow- ance of two hundred dollars for the calendar year 1963 and the travel allowance shall be at the rate of eight cents per mile with a sated minimum and an alternative for the balance of the calendar year 1963.

In accordance with Chapter 54, Section 112 I transmitted to the state secretary copies of the records of votes cast for candi- dates and on the questions on November 10, 1964. Said records were certified by the selectmen, and attested and sealed by me.

In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the Town of Southbridge, qualified to vote in town affairs, to meet at the Town Hall, in said Southbridge, on Monday, December 7, 1964 at 7:30 P.M., then and there to act on the following articles :


ARTICLE 1. To see if the town will vote to raise and appropriate, borrow or transfer the sum of $434.38 for the Inter- est on Revenue Loan Account, or act anything thereon.


ARTICLE 2. To see if the town will vote to raise and appropriate, borrow or transfer the sum of $2,100.00 for the Pension : Group Insurance Account, or act anything thereon.


ARTICLE 3. To see if the town will vote to hear, act on, and accept the report of the selectmen as to the laying out of a public way a certain street to be known as Woodcliffe Road, commencing at a town bound at the southeasterly terminus of the 1964 layout of Glen Ridge Road, thence northeasterly for a distance of three hundred ninety (390) feet, or act anything thereon.


ARTICLE 4. To see if the town will vote to hear, act on, and accept the report of the selectmen as to the layout, of a public way a certain street to be known as Laurel Hill Road, commencing

at the northerly terminus of the 1945 acceptance of Laurel Hill Road, thence northeasterly for a distance of about seven hundred thirty-four (734) feet to the southerly sideline of Cohasse Street, or act anything thereon.


ARTICLE 5. To see if the town will vote to hear, act on, and accept the report of the selectmen as to the laying out of a public way a certain street to be known as Glen Ridge Road, commencing at the southeasterly line of Eastford Road, thence southeasterly for a distance of three hundred fifty(350) feet, or act anything thereon.


ARTICLE 6. To see if the town will vote to revise the Chapter 90 South Street Assignment of funds voted under Article 22 of the Annual Town Meeting held March 16, 1964, to include construction work on Guelphwood Road, or act anything thereon.


ARTICLE 7. Too see if the town will vote to amend the zoning by-laws map to change the existing Retail Business District to a Light Industry District as follows: Beginning at the north- erly side of Hartwell Street and the westerly side of Elm Street, thence running northerly along Elm Street to a private road : thence running westerly along said private road and extension of it to the easterly side of Chapin Street ; thence southerly along the easterly side of Chapin Street to the northerly side of Hartwell Street ; thence easterly along the northerly side of Hartwell Street to the point of beginning, or act anything thereon.


ARTICLE 8. To see if the town will vote to amend the zoning by-laws map to extend the existing heavy manufacturing district as described: Beginning at the terminus of the existing Heavy Industry Zone on the westerly side of Dresser Hill Road; thence running westerly along the existing Heavy Industry Zone to other land of the Inhabitants of the Town of Southbridge (former Bellerose property) ; thence running northeasterly to include the properties owned by Town of Southbridge (Sewage Treatment Plant land) Stephen Kupiec, Marcel and Estelle Remil- lard, Alfred and Rita Gallipeau, Sidney and Maria Hazzard, to the Town of Charlton town line ; thence running southerly along the Charlton-Southbridge town line to the southeast corner of land of Alfred and Rita Gallipeau; thence southwesterly to include the properties of Aldei, Rosa and Henry Remillard, John Keenan, Edward Hopwood, c/o Ruth Davis, Earl and Pearl Cote, Edgar

and Simone Hudon, Marcel and Estelle Remillard, Milton Weg- larz, Joseph and Rita Macuga ; thence northwesterly along land of Macuga to Dresser Hill Road; thence northeasterly along the easterly side of Dresser Hill Road to the point of beginning. Meaning and intending to include all the properties on Dresser Hill Road from the existing Heavy Industry zone to the Charlton town-line on both sides of the road, or act anything thereon.
