Cities and towns are not empowered to act with respect to general elections, taxation, pledges of credit, dispositions of park land, general civil relationships, the punishment of felon- ies, or the imposition of imprisonment except as the Gen- eral Court may lawfully confer such powers upon them.

SUMMARY


The Act imposes a temporary tax upon all retail sales of tangible personal property at the rate of three per cent of the selling price. Sales of certain items are exempted from the tax, including but not limited to sales of food products for human use, articles of clothing, prescription medicines, agricultural machinery and certain publications. The statute contains specific provisions relating to the registration of vendors, the filing of returns and the payment of the amounts collected by such vendors. Vendors may apply to the State Commission for abatements of the amounts owed where they believe such amounts to be excessive, and decisions of the Commission on such applications may be reviewed by the Appellate Tax Board. The Commissioner of Corporations and Taxation shall have the usual powers and remedies pro- vided for tax collection for the collection of the taxes im- posed by this section. The State Tax Commission shall issue regulations necessary for proper administration and enforcement of the section.


The Act further imposes a temporary excise upon the storage, use or other consumption in Massachusetts of tangible per- sonal property at the rate of three per cent of the sales price of such property. Sales upon which the retail sales tax described above has been imposed, or which are exempt from the retail sales tax, shall be exempt from the use tax. Sales upon which a tax has been paid in another jurisdiction shall also be exempt. Assessment, abatement and collection of the use tax shall be governed by the provisions which re- late to the tax upon retail sales. The tax upon retail sales and the excise upon storage, use or other consumption shall be effective during the period from April 1, 1966 to Decem- ber 31, 1967.


Each qualified taxpayer shall be entitled to a credit of four dollars for himself, four dollars for his spouse and eight dollars for each qualified dependent, but such credit shall not be allowed if the taxable income of such individual and his spouse exceeds five thousand dollars for the year. In addition to the taxes described above, the Act provides for new excises upon certain banks; new taxes upon the income of certain corporations; new taxes upon cigarettes; a room occupancy excise upon rent paid for the use of hotel rooms and other lodging places; and excises upon sales of certain

alcoholic beverages.


The Act creates the Local Aid Fund for the purpose of pro- viding educational assistance, and authorizes the periodic distribution of amounts from such Fund to the cities and towns. In addition, the Act contains a variety of provis- ions relating to the program of State aid to public schools, and to its administration.

GREETINGS:


In the name of the Commonwealth of Massachusetts, you are hereby required to notify and warn the inhabitants of the town of Southbridge, qualified to vote in town affairs, to meet at the Town Hall, in said Southbridge, on Monday, December 5, 1966 at 7:30 P.M., then and there to act on the following articles:


Article 1. To see if the Town will vote to hear , act on, and accept the report of the Board of Selectmen as to the laying out of a public way a certain street to be known as Surrey Lane from the Easterly sideline of the 1940 accept- ance of Lebanon Hill, Easterly for a distance of about 451 feet, or act anything thereon.


Article 2. To see if the Town will vote to raise and


appropriate, borrow or transfer emergency funds for the Highway Department of $ 6, 000. 00 for Snow and Ice, $1,500.00 for Gasoline and Oil, and $1,000.00 for Road Machinery Maintenance, or act anything thereon.


Article 3. Shall the Town accept the provisions of Sec- tions sixteen to sixteenI, inclusive, of Chapter Seventy- One of the General Laws, providing for the establishment of a regional school district, together with the towns of Charlton, Dudley, Oxford and Webster, and the construction, maintenance and operation of a regional school by the said district in accordance with the provisions of a proposed agreement filed with the Selectmen ?

To see if the Town will vote in accordance with Section 3 and 7 of Chapter 40 of the General Laws of Massachusetts to authorize the Board of Selectmen to lease until March 31, 1967 property known as the Big Pond area to the rear of the West Street School owned by William A. To see if the Town will vote to create a special unpaid committee to be known as the Southbridge School Building Needs Committee,to consist of ten mem- bers, five of which are to be appointed by the Board of Select- men and five of which are to be appointed by the School Com- mittee for the purpose of studying, assessing and recom- mending to the citizens of the Town of Southbridge the pres- ent and future building needs of the Southbridge Public School System, or act anything thereon.


Article 7. To see if the Town will vote to amend the following Classification as contained in Exhibit A of the Classification Plan of Article MCX of the Town By-Laws, as amended from time to time, so as to read as follows:

Article 9. To see if the Town will vote to transfer the sum of Seventy-Five Dollars ($75.00) from the Board of Health Travel Expense Account to the Office Expense Account , or act anything thereon.


Article 10. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of Ten Thousand Dollars ($10,000.00) for the Veterans' Benefits Account, or act anything thereon.

Article 13. To see if the Town will vote to authorize the transfer of One Hundred and Fifteen Dollars and Fifty Cents ($115.50) from the Police Division, Special Police, Matrons, etc. Account to the Police Division, Police Chief Salary Account, or act anything thereon.

To see if the Town will vote to authorize the transfer of One Thousand Five Hundred Dollars ($1, 500.00) from the Police Division, Officers' Training School Account to the Police Division, Special Officers, Matrons. etc. Salary Account: said monies to be used to compensate members of the local Police Department for ex- tra duty time incurred during the Sesquicentennial Celebra- tion held in May of 1966, and for members of out of town police requisitioned as per Authority of Chapter 41, Section 99, as amended, by Chapter 382, Acts of 1965 of the Gen- eral Laws, or act anything thereon.


Article 15. To see if the Town will vote to hear, act on, and accept the report of the Board of Selectmen as to the laying out of a public way a certain street to be known as Brentwood Drive from the Southwesterly sideline of the 1966 layout of Morris St. Southwesterly for a distance of about 909 feet, or act anything thereon.


Article 16. To see if the Town will vote to raise and appropriate, borrow or transfer the sum of One Thousand Four Hundred Dollars ($1,400.00) for the demolition of the

Mill Street houses at 164 and 168 Mill Street, or act any- thing thereon.

SPECIAL TOWN MEETING DECEMBER 5, 1966


At 7:30 P. M. the Town Clerk called the meeting to order and entertained a motion for a recess because the voters coming into the auditorium to attend the meeting were being checked- off the voting lists.


On motion of R. Brousseau, duly seconded, it was VOTED: That a recess be taken at this time.


At 7:55 P.M. Selectman Caprera declared that the recess was over and the meeting resumed.


"Our town moderator is still indisposed and we must nom- inate a moderator for this meeting. There are so many legal ramifications pertaining to this meeting that we, the select- men, felt that W. Snyder, Esq. should serve as the moder- ator for this meeting. I now nominate Walter Snyder to act as moderator for this evening." Nomination seconded. Mr. E. Ryan addressed the meeting and stated: "I would prefer that we nominate another person than the Town Counsel. Possibly, some of us here present might desire a ruling from our Town Counsel during this meeting. I nominate Ray- mond Pervier as moderator for this evening." Nomination seconded. Atty. Walter Snyder withdrew. Nominations closed.


VOTED: That Raymond Pervier act as the moderator for this meeting.


VOTED: That the reading of the warrant by the Town Clerk be dispensed with.


The Officer's return of warrant was being read by the Town Clerk when Mr. E. Ryan questioned me, "Did you ever see a warrant presented like this one this evening?" (said warrant also contained recommendations of Finance Commit- tee) I replied, "No." He further stated, "That Article 1 should be read before it was voted that the reading of the warrant by the Town Clerk be dispensed with. " Article 1 was read. Motion by E. Ryan, duly seconded it was VOTED: That the reading of the remaining articles appearing in warrant by the Town Clerk be dispensed with.


The moderator announced: "Per our usual custom the recom- mendations of the Finance Committee are accepted as motions and duly seconded. Substitute motions may be pre- sented from the floor. "


Article 1. To see if the Town will vote to hear, act on, and accept the report of the Board of Selectmen as to the laying out of a public way a certain street to be known as Surrey Lane from the Easterly sideline of the 1940 accept- ance of Lebanon Hill, Easterly for a distance of about 451 feet, or act anything thereon.


Recommendation of Finance Committee. To refer to the Town Meeting.


On motion of Selectman A. Bellerive, duly seconded, it was VOTED: (Unanimously) To accept the report of the Board of Selectmen as to the laying out of a public way a certain street to be known as Surrey Lane from the Easterly side- line of the 1940 acceptance of Lebanon Hill, Easterly for a distance of about 451 feet.
