This letter is to advise you of the filing with this office of a second petition for state-wide recount in the interest of Endi- cott Peabody, on Wednesday.


Inasmuch as a state-wide recount for the office of Gover- nor of the Commonwealth has already been ordered and re- count procedures are now in progress throughout the state, this is not in the nature of a second formal order for such a recount, but rather to apprise all clerks and election commis- sioners of the filing of the second petition. The one recount will, of course, serve both petitions.


In order that you may know the content of the statement on the petition for Endicott Peabody, a mimeographed copy is enclosed.

GREETING:


In the name of the Commonwealth of Massachusetts, you. are hereby required to notify and warn the inhabitants of the Town of Southbridge, qualified to vote in town affairs, to meet at the Southbridge High School, in said Southbridge, on Monday, December 10, 1962 at 7:30 P.M., then and there to act on the following articles:


Article 1. To see if the Town will vote to hear, act on, and accept the report of the Board of Selectmen as to the lay- ing out of a public way, a certain Street known as High Street, commencing at the southerly terminus of the 1961 Acceptance of said Street, thence southerly for a distance of about three hundred seventy (370.0) feet, or act anything thereon.


Article 2. To see if the Town will vote to transfer the sum of $46.12 from the Veterans' Services extra clerk hire ac- count to the Veterans' Services Director's salary account, or act anything thereon.


Article 3. To see if the Town will vote to raise and ap- propriate, borrow or transfer the sum of $180.00 to pay for removal of two dead elm trees located on a town sewer line easement off South Street, or act anything thereon.

To see if the Town will vote to hear, act on, and accept the report of the Board of Selectmen as to the lay- ing out of a public way, a certain street known as Pinedale Street, commencing at the southerly terminus of the 1961 Lay- out of High Street, thence southwesterly for a distance of about six hundred ten (610) feet, or act anything thereon.


Article 9, To see if the Town will vote to transfer the sum of $349.50 from Communications 1 Gonset Communicator 144 MC Account to Communications New Equipment Account, or act anything thereon.


Article 10. To see if the Town will vote to transfer the sum of $109.50 from the Civil Defense Warden Account to the Civil Defense Administration Miscellaneous Account, or act anything thereon.


Article 11. To see if the Town will vote to transfer the sum of $150.00 from the Civil Defense Administration Surplus Property Account to the Civil Defense Welfare Account, or act anything thereon.


Article 12. To see if the Town will vote to authorize the Board of Selectmen to appoint a committee to investigate a proposed change in the manner in which the Town Meetings are conducted so as to provide for a Representative Town Meeting form in which to conduct Town Meetings in the future and to investigate the advisability of any other changes in the form of government of the Town, said committee to be known as Representative Town Meeting Committee and said committee to report to the next Annual Town Meeting its findings and recommendations and to raise and appropriate, borrow or transfer the sum of Two Hundred ($200.00) dollars

You are directed to serve this warrant by posting attested copies in six (6) conspicuous places within the Town at least. seven (7) days before holding said meeting.

tee to be known as Representative Town Meeting Committee and said committee to report to the next Annual Town Meeting its findings and recommendations, and that the sum of $200.00 be transferred from the Excess and Deficiency Account to the Representative Town Meeting Committee Expense Account and that the Representative Town Meeting Committee be com- prised of the following:


Three (3) persons recommended by the Democratic Town Committee;


Three (3) persons recommended by the Southbridge Women's Democratic Club;


Three (3) persons recommended by the Republican Town Com- mittee;


Three (3) persons recommended by the Southbridge Women's Republican Club;


Three (3) persons recommended by the Chamber of Commerce; Three (3) persons recommended by the Veterans' Council, and Seven (7) persons to be chosen at large by the Selectmen.

During the pros and cons on above substitute motion and at the suggestion of Selectman S. A. Caprera, Willard R. Stark, moderator, ruled that in the event the committee does not reach full appointed strength, because of the failure of any group to name or approve three of its members serving on the committee, he will consider it legal for the committee to proceed with less than twenty-five (25) members.


It was moved and seconded to dissolve the warrant.

I submit herewith my report of an audit of the books and accounts of the town of Southbridge for the fiscal year 1961, made in accordance with the provisions of Chapter 44, Gen- eral Laws. Sir:


In accordance with your instructions, I have made an au- dit of the books and accounts of the town of Southbridge for the fiscal year 1961, and submit the following report thereon:


The financial transactions, as recorded on the books of the several departments receiving or disbursing money for the town or committing bills for collection, were examined, checked, and verified by comparison with the books and rec- ords of the town treasurer and the town accountant.


The town accountant's ledger was analyzed, the appropria- tion accounts being checked with the town clerk's record of appropriations and transfers voted by the town meetings, and with the finance committee's authorizations of transfers from the reserve fund. The necessary adjustments were made, and a balance sheet, a copy of which is appended to this report, was prepared showing the financial condition of the town on December 31, 1961.


The books and accounts of the town treasurer were exam- ined and checked in detail. The recorded receipts were ana- lyzed and compared with the town accountant's books, with the departmental records of payments to the treasurer, and with other sources from which money was paid into the town treasury, while the payments were checked with the select- men's warrants and with the accountant's records.


The cash book additions were verified, and the cash bal- ance on January 25, 1962, was compared with the amount of cash in the office and in the banks, as shown by a reconcilia- tion of the bank balances with statements furnished by the banks of deposit.


The reconciliation of the treasurer's cash on January 25, 1962, which is appended to this report, shows a discrepancy of $9,609.00, due to the fact that three checks presented as part of the cash in the office could not be accepted as cash and credited to the treasurer, since, in checking with the bank on which they were drawn, it was found that there were not sufficient funds in the accounts to cover any one of the checks.


Of these three checks, two were issued by an individual payable to the treasurer personally in the amounts of $4,550.00 and $3,450.00, respectively. The third check in the amount of $1,609.00 was payable to the town and covered a period of three years' fees for alcoholic beverage and other licenses for a local establishment.


In checking further, it was noted that the town treasurer had, over a two-year period, drawn twenty-six checks totaling $9,075.00 payable to the town of Southbridge and four checks totaling $900.00 payable to himself, none of which appeared

on an approved warrant. These checks were all endorsed by the treasurer and cashed at local banks.


Funds to cover the three checks previously mentioned, were subsequently deposited in the individual accounts, and on January 31, 1962 these checks were deposited and credited to the town treasurer's account.


The audit of the treasurer's accounts was extended to February 12, 1962, and a reconciliation of the treasurer's cash as of that date shows that the balances in the banks were in agreement with the cash book balance.


The maturing debt and interest payments were compared with the amounts falling due and were checked with the can- celled securities on file. The outstanding bonds and coupons were listed and reconciled with the balances in the bond and coupon accounts, as shown by statements received from the banks of deposit.


The records of payroll deductions for Federal and State taxes and for group insurance premiums were examined and the payments to the proper agencies were verified.


The records of tax titles and tax possessions held by the town were examined, and all transactions were compared with the books of the town collector and the town accountant.


The securities and savings bank books representing the investments of the several trust and retirement funds in the custody of the town treasurer and the trustees were examined and listed, the income being proved and the withdrawals being verified.


The records of collections from parking meters were ex- amined, footed, and compared with the treasurer's recorded receipts.


The books and accounts of the town collector were exam- ined and checked. The tax, excise, assessment, and depart- mental accounts outstanding at the time of the previous audit, as well as all subsequent commitments, were audited and proved.
