Article 10. To see if the Town will vote to hear, act on, and accept, the report of the Selectmen as to the laying out of a public way a certain street known as Crestview Drive, com- mencing at the terminus of the 1961 Layout of said Crestview Drive, thence southeasterly for a distance of three hundred forty (340.0) feet more or less, in accordance with Plan dated July 24, 1961, altered September 27, 1962, on file in the Town Engineer's Office, or act anything thereon.

Article 11. To see if the Town will vote to raise and ap- propriate, borrow or transfer, the sum of One Thousand Nine Hundred Seventy-Five Dollars and Twenty Cents ($1,975.20) for the Non-Contributory Retirement System, or act anything thereon.


VOTED: That the sum of $1,975.20 be transferred from the Excess and Deficiency Account to the Non-Contributory Retirement System Account.


Article 12. To see if the Town will vote to raise and ap-

propriate, borrow or transfer, the sum of Eighteen Thousand ($18,000.00) to the Veterans' Benefits Account, or act anything thereon.


VOTED: That the sum of $18,000.00 be appropriated for the Veterans' Benefit Account, said sum of $18,000.00 to be raised from the 1963 Tax Levy.


Article 13. To see if the Town will vote to transfer the sum of One Thousand Forty-Five Dollars and Five Cents ($1,045.05) from the Road Machinery New Equipment (New Truck) Account, and the sum of Nine Hundred Forty-Two Dollars and Fifty-Six Cents ($942.56) from the Hartwell Street Reconstruction Account, a total of One Thousand Nine Hun- dred Eighty-Seven Dollars and Sixty-One Cents ($1,987.61) to the Other Expense Account, or act anything thereon.


VOTED: That the sum of $1,045.05 be transferred from the Road Machinery New Equipment (New Truck) Account and that the sum of $942.56 be transferred from the Hartwell Street Reconstruction Account, a total of $1,987.61, to the Other Expense Account.


Article 14. To see if the Town will vote to transfer the sum of Six Hundred Seventy-Two Dollars and Seventy-Six Cents ($672.76) from the Central Street Bridge Repairs Ac- count to the Gasoline and Oil Account, or act anything thereon.


VOTED: Indefinite postponement.

Article 16. To see if the Town will vote to raise and ap- propriate, borrow or transfer, the sum of $1,500.00 to pay Bo- lak Szumilas and Dorothy Szumilas, in full settlement of any and all claims arising out of the taking of land owned by them by the Worcester County Commissioners for the re-location and re-construction of Pleasant Street, or act anything thereon.


VOTED: That the sum of $1,500.00 be transferred from the Excess and Deficiency Account to pay Bolak Szumilas and Dorothy Szumilas in full settlement of any and all claims arising out of taking of land owned by them by the Worcester County Commissioners for the re-location and re-construction of Pleasant Street.


Article 17. To see if the Town will vote to hear, act on, and accept, the report of the Board of Selectmen as to the lay-

To see if the Town will vote to amend the wording of the vote on Article 50 of the annual meeting of March 12, 1962 from, "Voted in the affirmative for $2,500.00 for the repair of present iron fence on the westerly side and the the pointing and reinforcing of the retaining wall on the east- erly side with new beam type guard rail at the Central Street. bridge, said work to be done by contract," to "Voted in the af- firmative for $2,500.00 for the repair of present iron fence on the westerly side and the pointing and reinforcing of the re- taining wall on the easterly side with new beam type guard rail at the Central Street bridge, said work to be done by the Highway Department," and also to approve the expenditure of said funds by the Highway Department.

The proposed amendment imposes no new taxes but gives the General Court the power to pass an income tax at gradu- ated or proportioned rates and is a change in the constitu- tional limitations now in effect on the power of the General Court to pass tax measures. The proposed amendment would add a new Article to the Constitution of the Commonwealth by which full power and authority is granted to the General Court, in the alternative to the power and authority to tax in- comes in the manner provided in Article XLIV of the Amend- ments to the Constitution, to impose a tax on incomes at rates which are proportioned or graduated according to the amount of income received, irrespective of the source from which it may be derived, and to grant reasonable exemptions, deduc- tions and abatements. It further provides that any property the income of which is taxed under the provisions of the pro- posed Article may be exempted from the imposition and levy- ing of proportional and reasonable assessments, rates and taxes as at present authorized by the Constitution, and that the

Article shall not be construed to limit the power of the General Court to impose and levy reasonable duties and excises.

This act increases the compensation each member of the General Court shall receive for each regular annual session from fifty-two hundred dollars to sixty-seven hundred dollars and increases the additional compensation the President of the Senate and the Speaker of the House of Representatives shall receive from fifty-two hundred dollars to sixty-seven hundred dollars. The act also increases the additional compensation the floor leaders of the major political parties in the Senate and House of Representatives, the Chairman of the Senate Commit- tee of Ways and Means and the Chairman and Vice-Chairman of the House Committee on Ways and Means shall receive from twenty-six hundred dollars to thirty-three hundred and fifty dollars, and provides that a member of the General Court chosen to fill a vacancy, or who resigns his seat during a regular annual session, shall receive a per diem compensation at the increased rate of compensation for each regular annual ses- sion.

The following is the statement appearing on the petition for recount filed with this office in the interest of John A. Volpe, candidate for Governor:


"TO THE SECRETARY OF THE COMMONWEALTH:

"We, the undersigned registered voters of


County, represent that we have reason to believe and do believe that the returns of the Election Officers and the records or copies made by the Elec- tion Officers of the Commonwealth of the votes cast at the ELECTION on Tuesday, November 6, 1962, for JOHN A. VOLPE of Winchester and ENDICOTT PEABODY of Cam- bridge, and all other candidates for Governor of the Common- wealth are erroneous, in that JOHN A. VOLPE of Winchester, Republican Candidate for said office, was credited with fewer votes than he was entitled to, and ENDICOTT PEABODY of Cambridge, Democratic Candidate for said office was credited with more votes than he was entitled to, and in particular with- out restricting the generality of the foregoing, that votes were counted for ENDICOTT PEABODY which should have been counted for JOHN A. VOLPE, that votes were counted as blanks which should have been counted for JOHN A. VOLPE, that votes were counted for ENDICOTT PEABODY which
