AN ACT ESTABLISHING IN THE TOWN OF SOUTH- BRIDGE REPRESENTATIVE TOWN GOVERNMENT BY REPRESENTATIVE TOWN MEETINGS.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:
SECTION 1. There is hereby established in the town of Southbridge the form of representative town government by representative town meetings hereinafter set forth.
SECTION 2. The by-laws of the town shall determine the number of voting precincts or a minimum and maximum number into which the town shall be divided for the election of members of the representative town meeting.
SECTION 3. The membership of the representative town meeting elected in each precinct shall consist of one town meet- ing member for each one hundred voters or major fraction thereof as nearly as may be.
SECTION 4. The membership of the representative town meeting also shall include the following members at large: the moderator, town clerk, the selectmen, chairman of the finance committee, and chairman of the advisory board of review.
SECTION 5. Meetings of the registered voters of the several precincts for elections and primaries or for voting upon a question to be submitted to all the voters of the town shall be held at the same time and at such place or places as the selectmen shall direct in the warrant for the meeting.
SECTION 6. The nomination of candidates for repre- sentative town meeting members shall be made by nomination papers which shall bear no political designation. Such papers shall be signed by not less than ten registered voters of the precinct in which the candidate resides and shall be filed with the town clerk not later than the last day on which the nomi- nation papers of candidates for other town officers must be

filed. They shall be submitted to the registrars of voters and shall be certified in the manner provided by law for the certifi- cation of the nomination papers of candidates for town offices. Nomination papers shall not be valid for any candidate whose written acceptance is not endorsed thereon or attached thereto when filed.
SECTION 7. A town meeting member may become a candidate for re-election by giving written notice to the town clerk not later than the last day on which the nomination pa- pers of candidates for other town offices must be filed. If a town meeting member is a candidate for re-election, there may be added to his name as it appears on the ballot for the election of town officers the words "candidate for re-election".
SECTION 8. The registered voters in each precinct, at the first annual town election held after the establishment of the precinct, and those in any precinct affected by a revision of precincts at the first annual town election following such re- vision, shall elect by ballot the number of registered voters in the precinct, determined as herein provided, to be representa- tive town meeting members of the town.
SECTION 9. At the first election of members by the voters of each precinct, each precinct shall elect the total num- ber of members to which it is entitled by virtue of the provi- sions of section three above. Of the total number of members elected, the first half in order of votes received shall serve for two years, the second half in order of votes received shall serve for one year from the date of the annual town election. In the event that the total number of members to which a precinct is entitled is an odd number, then one half of the largest even number that is one less than the actual number, plus one, of those elected shall serve for two years and the balance of those elected shall serve for one year from the date of the annual town election.
SECTION 10. Thereafter, except as otherwise provided herein, the registered voters of each precinct at each annual town election shall elect for the term of two years in like manner one half of the number to which the precinct is en- titled.
SECTION 11. If two or more candidates for representa-

tive town meeting member receive an equal number of votes other than for the division into halves, for deciding their term of office, the remaining members elected in such precinct at the same election shall determine by ballot which of the can- didates shall serve as a representative town meeting member. The terms of office of the representative town meeting members from any precinct whose boundaries are revised shall cease upon the election of their successors. The town clerk, after every election of representative town meeting members, shall notify each member by mail of his election. The provisions of this section shall be subject to the provisions of the General Laws pertaining to elections and the procedure for recount.
SECTION 12. If the boundaries of any precinct are re- vised or any new precinct established, there shall be a new election of representative town meeting members in such pre- cinct at the first annual town election following such a revision.
SECTION 13. The representative town meeting mem- bers shall be elected in conformity with the laws relative to elections, and the provisions of law relating to precinct voting at elections shall apply to all elections and primaries in the town so far as such laws are not inconsistent herewith. The provisions of this act pertaining to the establishment of pre- cincts shall not authorize any action contrary to the provisions of any law relative to the use of precincts in the formation of representative districts.
SECTION 14. A representative town meeting member may resign by filing a written resignation with the town clerk, effective upon the date of filing. A member who removes from the town shall cease to be a member forwith upon removal, and a member who removes from one precinct to another may serve only until the next annual town meeting as a member from the precinct from which he has moved.
SECTION 15. A vacancy in the number of representa- tive town meeting members shall be filled by the unsuccessful candidate receiving the highest number of votes at the preced- ing election in the precinct and who consents to accept the office. Such candidate shall be deemed to be elected and the town clerk shall give notice of his election upon the filing of his written acceptance. If there be no such candidate willing to

accept, then the vacancy shall be filled by the remaining mem- bers from the precinct as hereinafter provided.
SECTION 16. Upon petition signed by not less than one third of the remaining representative town meeting members from the precinct, the town clerk shall call a meeting of the remaining members from the precinct for the purpose of filling the vacancy, notice of which shall be mailed to such members not less than seven days before the time of the meeting.
SECTION 17. At such a meeting a majority of the mem- bers from the precinct shall constitute a quorum and shall elect one of their number as chairman and one as clerk. The vote shall be by ballot and a plurality of votes cast shall be neces- sary for a choice. The chairman and clerk shall count the bal- lots, and the chairman shall make a certificate of the choice which shall be filed with the town clerk together with a written acceptance of the person so chosen, who thereupon shall be deemed to be elected as a representative town meeting member.
