The shooting is believed to have resulted from a factional feud of long standing in Thayer, and it to known that there had been ill feel- ing between Gaw and the constable for several months.

EARLIER GUNPLAY

On Thursday night, it was re- ported to the constable's office that there was considerable drinking in Thayer. McCourtney and W. A. Penne, city marshal, attempted to discourage it. Peane Invaded the White Kitchen, where there neemed a disturbance of some kind. As MrCourtney followed him In, Gaw Is said to have drawn a gun, point- ed it at him and ordered him out. Pease whipped out a revolver, cov- ered Gaw and forced him to put up the pistol.

. Early Friday morning, McCourt-

-

ney drove to the business district and parked his automobile near the White Kitchen. Gew strode across the street to meet him.

-

"TO SETTLE IT"

McCourtney declares Gaw patted the handle of a pistol aticking in the front of his shirt as he walked toward him, and announced he had come "to settle it." Gaw. McCourt- ney maya, had been drinking, and he ordered him back to the cate.

Gaw responded by slapping the constable in/ the face. Both men drew revolvere and started firing. McCourtney sprang in one side of his car, and most of the bulleta ' were burled in his aedan. The men fired until both their guns were ' empty. Gaw turned and walked back to the cafe. He had been hit In the left breast. and another bul- let had struck hin wrist. McCourt - ney was unhurt. The cafe owner died five hours later in an Impro- : vised hospital room in hla cafe.
