FILED FIRST WILL IN 1856

..

Early . Probate Records of Greene County Date Back To 1833.

- --

The first will on record In Greene county filed in probate court MAY 2. 1856. and was that of Barah Trentham. Although the first to be found on the records, It was not the firat will . filed.

The first record of any probated . willa was in 1833, but the names are not available an at that thine the ; . county court handled all probate work and only the minutes were pre- served. In 1847 the Greene county probate' court was established. ' but the court records from 1847 to 1856 are unaccounted for.

--

The Trentham will was admitted to probate May 3, 1856. and evidently waa made ou a deathbed. The ad-

- dress of the testator was given only as Greene county and the will WAR accepted by 8. H Boyd, who eigned

clerk before his name.

The first. record book. which 18 marked "edition A." evidently

had the best of care, as every page !! well preserved, and the writing in

--

most of the entries la exocedinly lexible. The volume has been re- bound several times. All of the en- tries were made in longhand. and show that several of. the clerks were excellent penmen.

Forma Nearly Aimllar.

.The form of the - wills entered at That time and those entered at the prosent. time are nearly almllar. The greatest difference is seen in the spelling. an some of the spelling of the early Inhabitants of Greene county does not conform with the present day sivle. For Instance the old timers spelled "right" in several . places "rite." and In all instances liscd "bet wix" in place of "between"., or "among."

Who the judges of the probate : court were between 1847 and 1865 ! cannot be ascertained. as all of the calries In the recorits were simply. signed by the clerk with his title. The legal phraseology of the early ' " !Ils was entirely disregarded. all be- '! very brief and to the point In rome Instances The wills wern signed by h "mark." the writer making his . mark.

The name of the truster and of : vibeke always Appeared attached .o the wills

O'her rarly will filed in this coun- . " were those of Nathan Boone, who' st: las residence n: St. Louis, Mo . i !. d way admitted to probate October . 10. 1856. and the will of William Mc- Doacil, which was adinited, April 13.

THE WASTE BASKET

. Death notlow as will & Bathbug naturally mention ' his father. Col. George 8. Rathbun. The Rathbun nuthe which has so long . beenin part of Springfield, seems to be close to the vanishing point. Thus dose dosth work. Col. George D. Rathbun, it is stated, was one of Gen. Jo Bbelby's men and he took an sotive part in the Civil war. He was at Lone Jack. near Kansas City. a bloody engage- ment in which Col. Rathbun die- tinguished himself.

As & lawyer. Col. Rathbun, who for years was a partner of Will A. Rathbun, was also of the vigorous. fighting character. Probably bla most celebrated caso was that of Oors E. Lee; charged with being an accemory in the murder of Mrs. George E. Graham. Mr. and Mrs. Graham, Cora E. Leo and Mra. Emma Mallory came to Springfield from Peoria and were reformera of some kind. They located on a farm near Brookline and one day the body of Mrs. Orabam was found in & well on the farm. There was a terrible up- ronr. This was in 1886, and the ex- cllement didn't abate for over a yoar.
