WISCONSIN COLLECTION AND ASSIGNMENT LAWS, ETC.
Acknowledgments-Deeds executed within this state- of lands or any in- terest in lands therein-must be exe- cuted in the presence of two witnesses, who shall subscribe their names to the same as such and the persons execut- ing must acknowledge the execution before any judge or clerk of a court of record, court commissioner, U. S. commissioner, county clerk, register of deeds, notary public or justice of the peace; and the officer taking the acknowledgment must indorse a cer- tificate of the acknowledgment and the true date of making it under his hand. A scroll answers for a seal ex- cept in the case of a notary public, who must attach his official seal and date of expiration of his commission. Deeds conveying land or any interest in land situated in the State if exe- cuted in any other State, Territory or District of the United States may be executed according to the laws of such place and the acknowledgment may be before any judge or clerk of a court of record, notary public (with seal and expiration of commission), justice of the peace, master in chancery, or other officer there authorized by law to take the acknowledgment of deeds therein, or before a commissioner ap- pointed by the Governor of this state for such purpose; and if executed with- in any jurisdiction of any military post of the United States not within this state, before the commanding officer thereof. If such deed be executed in any foreign country, it may be exe- cuted according to its laws, and acknowledged before any notary pub- lic-with seal affixed-or other officer authorized by law there to take such acknowledgments or any minister, charge d'affaires, commissioner, or consul of the United States appointed to reside therein, and certified by him; and, if executed according to the laws of such foreign country the certificate of acknowledgment shall certify that fact.
Arrest .- Defendant may be arrested and held to bail at the time of issuing the summons or at any time before judgment in an action for damages not arising on contract, when a non-resi- dent or about to remove from the state
or in an action for injury to person, property or character; or for injury or wrongfully taking, detaining or con- verting property; for a fine or penalty; for money embezzled or fraudulently misapplied by a public officer, attorney, agent or an officer of a corporation, or by any person in a fiduciary capacity, or for any misconduct or neglect in office or in a professional employment; in actions to recover damages for prop- erty obtained by false pretenses; in ac- tions of replevin when property has been concealed.
Assignments. - Voluntary assign- ments may be made by debtor for benefit of general creditors under statutory formalities. Preferences are not allowed. Release not granted. Any preference made by debtor by the sale of property, mortgage or other security, within sixty days prior to date of assignment shall be void and. of no effect, provided the party bene- fitted had reasonable cause to believe such debtor insolvent, and by confes- sion of judgment within the same per- iod, void absolutely. When any debtor, being insolvent, shall confess judgment or do any act by which one or more of his creditors shall obtain a preference over others, or shall omit to do any act which he might do to prevent such preference; or if he shall not within ten days after any levy by attachment, execution or garnishment, make a vol- untary assignment or institute proceed- ings in good faith to vacate such pref- erence, then, or within thirty days thereafter any two creditors having claims aggregating two hundred dol- lars or more, may procure the appoint- ment of a receiver who shall convert into money all the property of the debtor not by law exempt, and distri- bute the same, free from any liens or preferences obtained contrary to the intent of these provisions, pro rata among all the creditors who shall prove their claims within such time and in such manner as the court shall direct.
Attachment .- May be issued at any time before judgment in all actions on contract, express or implied, where plaintiff shows by affidavit that fact,

and that the debt exceeds $50, and that the affiant has good reason to believe one of the following cases to exist: That defendant has absconded or is about to abscond from the state or is concealed therein to the injury of his creditors; that he has assigned, dis- posed of or concealed, or is about to conceal any of his property, with in- tent to defraud his creditors; that he has removed or is about to remove any of his property out of the State, with like intent; that he fraudulently con- tracted the debt or incurred the obliga- tion for which this action is brought; that he is a non-resident or it is a for- eign corporation; that he has fraudu- lently conveyed or disposed of his property, or part of it, to defraud his creditors. Attachment may also be made for debt to become due on filing similar affidavit, and giving undertak- ing for three times amount of claim. Aattachment may issue in Justice Court, upon grounds nearly identical where debt exceeds $5.
Bills of Exchange and Promissory Notes .- No person within this State to be charged as acceptor on a bill of exchange unless his acceptance shall be in writing signed by himself or his lawful agent. Days of grace are abol- ished from and after. April 5, 1894. Notes falling due on Sunday or holi- day are payable next secular day.
Chattel Mortgages .- Are valid be- tween the parties .thereto, but void as against any other persons, un- less the possession of the mort- gaged property be delivered to and retained by the mortgagee, or unless the mortgage, or сору thereof, be filed with the clerk of the village, town, or city, where the mort- gagee resides, or if he is a non-resi- dent, where the property is situated at the time of making the mortgage. Such chattel mortgage ceases to be valid, except as between the parties, at the expiration of two years, unless within 30 days next preceding the ex- piration of the two years, the mort- gagee or his agent make and annex to the mortgage, or a copy thereof, on file, an affidavit setting forth the inter- est of the mortgagee in the property mortgaged. The effect of such affi- davit renews the force of the mortgage for two years. Similar renewals may be made at the end of each two years. It is a misdemeanor to sell or dispose
of chattels mortgaged, with intent to defraud. No specified time in which mortgaged property must be sold to pay debts. Chattel mortgage upon household furniture or exempt chattels of married man invalid without signa- ture of wife witnessed by two wit- nesses.
Commencement of Suit .- Suits are commenced by service of summons. The defendant in cases ir Justice Courts, in ordinary cases, has six days in which to appear in Circuit Courts, twenty days after service within the State; and if not so served and sum- mons is published, six weeks and twenty days.
Consignments .- If the consignee fraudulently converts the consigned property to his own use he is guilty of embezzlement. Six years will bar a criminal prosecution, as well as the consignor's civil action.
Exemptions-Library, household fur- niture, etc., $200; firearms, $50; neces- sary team, cattle and utensils; 1 year's provisions; tools or stock in trade of mechanic, miner or other person, $200; library and implements of professional man, $200; printing material, presses, etc., $1,500; homestead in country, 40 acres, or in town plat, one-fourth of an acre. The earnings of all married per- sons having a family dependent upon them for support, for three months next preceding the issue of any pro- cess, to the amount of $60, only for each month in which such earnings are made or secured. No personal property is exempt as against any debt remaining of its purchase price.
Garnishment .- Money or property of the defendant in the hands of another, except a municipal corporation, or debts due him, may be garnisheed either at the time of the bringing of the action or while it is pending, or upon execution after judgment is ob- tained thereon. In such cases the gar- nishee debtors are liable for the amount of property in their hands or the amount of indebtedness due from them to the principal debtor, over and above exemptions, from the time gar- nishee summons is served upon them. Garnishment may also be had in any cause of action in which a writ of at- tachment may issue. The lien ob- tained by garnishment is dissolved if the debtor, being insolvent, within ten days after the service of process make

a voluntary assignment, or if within the same time or thirty days there- after, a receiver is appointed.
Interest .- Legal, 6 per cent; by con- tract in writing, 10. Usury (except in bottomry and respondentia bonds) for- feits all interest if not yet paid; if paid, treble the unlawful excess may be recovered by suit within a year.
Judgments .- Judgments of the Cir- cuit Court become a lien on all real es- tate of the judgment debtor within the county, and from the date of its being docketed in the clerk's office; this lien holds for ten years. A transcript of the judgment of a justice of the peace may be docketed in the circuit court clerk's office, and becomes then a lien on real estate, and is regarded as a circuit court judgment for its enforce- ment and collection. A transcript of the docket of the judgment in any cir- cuit court clerk's office may be filed and docketed in any other county, and becomes a lien on all real estate of the judgment debtor in any county where docketed, from that date, and is en- forced by execution issued from the county where judgment was rendered.
Justice's Jurisdiction .- $200, may en- ter judgment by confession to $300.
Limitation of Actions .- On contracts not under seal, 6 years; judgments of courts within the State and on sealed instrumnts, cause accruing within the State, 20 years; foreign judgments and specialties, cause accruing without the State, 10 years; recovery of bonds, 20 years.
Married women retain all property for their exclusive use and benefit, which is acquired from any source ex- cept their husband, and may convey it and do business as if unmarried. Widow is entitled to dower of one- third in all lands owned by husband
at any time during marriage, unless lawfully barred.
Mortgages are executed precisely as deeds, except the wife need not join in a purchase money mortgage to bar dower. Any conveyance, however, in whatever form, will be held a mort- gage on familiar equity principles, if in reality a security for debt. If a power of sale be inserted, they may be foreclosed by advertisement. One year's redemption is allowed after sale in such cases, but the common and bet- ter practice is to foreclose by suit in circuit court, and after sale, which cannot take place until after one year's redemption; after judgment no re- demption is allowed. Redemption be- fore sale must include 10 per cent in- terest from date of judgment. A rea- sonable solicitor's fee is allowed in ad- dition to taxed costs. No strict fore- closures allowed of mortgages. No mortgages or sale of a homestead valid unless the wife joins.
Proof of Claimis Sent for Collection. -It being necessary to sue in the name of the real party in interest, creditors sending claims for collection should give their names in full. In case of a firm, full name of the indi- viduals composing the firm should be given, and if creditor is a corporation, that fact should be stated.
Redemption .- Of lands sold under execution, one year, or by subsequent creditor, 15 months; mortgage, one year; taxes, three years.
Revivor .- Part payment or new promise in writing, if by one joint debtor, revives the debt only as to him.
Stay of Execution .- Only on justice's judgments, $10 to over $50, exclusive of costs, one to four months.
Witness .- Party in interest may be unless opponent is dead.
