The Inhabitants of Braintree being Lawfully assembled then chose Captain John Mills Moderator for yt day.


£70. It was then voted, that seventy Pounds money be raised forthwith for the Defreying the Towns charges for this present year.


It was then propounded by the moderator whether or no they would chuse a committee to Treat & Agree with the Honoured Edmund Quinsey Esqr. or any other Person (in this Town) about

Then voted that ye Present select men be a committee for said purpose.


It was then voted that Captain John Mills & Lt John Cleverly be added to the Committee of said Selectmen for ye end aforesaid


It was also then voted, that any three of said Committee be impowered to Defend the Town at Court, against any Person or Persons in case of their non agreement.


Voted, That the matter Relating to the 6000 acres of Land be continued to the next Marchi General Town Meeting


Braintree December, the 28th. 1719


The Inhabitants of Braintree Lawfully assembled, Then chose ye Honourable Edmund Quincey Esqr. Moderator for that day.


December the 28th. 1719.


the committee chosen the last Town meeting being August ye 7th. 1719, to Treat & Agree with the Honourable Edmund Quincey Esqr. or any other Person (in this Town) about any demands that they had to make about high wayes. They made their Report as followeth. That they were of opinion [139] That the Records on the Towns Book Relating to an highway or Town drift way, through the Lands of the said Quincey &c as may appear on Record, baring Date February ye 15th. 1714/15 be erased made void, and be as tho it had never been.


And it was then voted that the report of said Committee should be accepted with ye Town.


Braintree December ye 28th. 1719.


It was then moved by the moderator whether or no the Town would allow Mr. Samuel White any pay or no, for a way laid out by the select men may the 21st. in ye year 1690, (as appears on Record) it passed in ye negative.


Then propounded by the moderator whether or no the Town would take into their consideration until the next March meeting : what Mr. Thomas White and some others desired as to pay for ways laid through their Lands it passed in ye affirmative.


Then voted that whereas the accounts of ye Committee chosen to look after the Towns' wood was then imperfect, the further consideration thereof was deferred, till next march meeting.


Then voted that the writing & Reading school granted formerly to be kept, at the South end of the Town, may be removed into more than one place.


Then voted that the Selectmen should have the management of that matter


Then voted, That the Selectmen make up Accounts with Cap- tain John Mills as to what is due from him to ye Town And from ye Town to him and make Report thereof next March General Town Meeting.

The Inhabitants of Braintree Lawfully Assembled then chose the Honourable Edmund Quincy Esqr. Moderator for that day.


The Selectmen chosen for the ensuing year were


Mr. Benjamin Webb.


Mr. Samuel Allen.


Mr. Samuel White


Mr. Joseph Crosbie. Mr. Benjamin Neall.


Constables were Samuel Savell, & Joseph White but said White hired Mr Ephraim Jones and said Jones was accepted by the Town in said White's stead.


Town Treasurer was Mr. Moses Payne.


Then voted that he should have for his service for ye year ensuing 35 shillings.


Surveyers, were Lt. Joseph Neal Mr. Joseph Adams, John Thayer son of John Thayer and John Holbrook.


Fence Viewers, Joseph Nightingal, Moses Curtis, Wm. Hunt Elkanah Wales.


The Act Relating to swine, were John Bass, son of John Bass, Thomas Crosby John Wild, Junior, Joseph Spear, Thomas Wales


Sealer of Leather was John Beall.


Sealer of Weights & measures John Bass.


Tithingmen were Samuel Tompson, John Baxter, Ephraim Jones Jonathan Hayward.


£3-0-0 Clerk, was Joseph Parmenter, then voted that he should have three pounds for his serving the Town in that office for the Two last years and if he continue in said office the year ensuing


It was then propounded by the Moderator whether or no they would chuse a Committee to Joyn with the Committee of the Purchasers to run and settle bounds between the Common Lands and the Land of the Purchasers (if they se good) and to make report thereof the next Town meeting, it passed in the affirmative.


Then voted, that Major John Quincey Esqr. Mr. Benjamin Webb, Mr. John Marshall, Deacon Peter Hobart, and Mr. Moses Belcher, be a Committee for said service.


The Meeting was then adjourned till nine of the clock next morning.


[141] March the 8th. 1719/20.


Upon an ajournment the Inhabitants of Braintree being assembled.


Then voted that the orders last year Relating to Bulls be re- vived and continued, with this addion that every such Bull be kept for the use of the Town in a good pasture conveniently dis- tant in ye judgment of one or more of ye Selectmen, and the Clerk to give an account of every Bull so entred (in March) instant) at the next meeting of the Town to chuse a Representa- tive.

BRAINTREE RECORDS, 1720.


Voted, that the order last year relating to boars be revived and continued only with this Addition that their be ten shillings allowed for every such sufficient boar.


Voted, That ye Present Selectmen draw up an order or by-law for the restraining of Rams from the first of August to the first of November yearly, the penalty of every breach of said order not to exceed five shillings, to be recovered, as the Provence Law Relat- ing to impounding cattle, sheep &c directs, the said sum to be to the use of him or them, that take up such Rams.


It was propounded by ye moderator whether they would accept of the returne made by the Committee who were chosen to give in their opinion who were the Proprietors of the 6000 Acres of Land granted by ye honoured Court And it passed in the negative.


It was then propounded by ye Moderator whether the Town would sell said Land and it passed in ye negative.


Upon a motion made it was propounded by the Moderator whether They would Lease said Lands, it passed on ye negative.


Upon a motion (again) made it was Proposed by the Moderator whether they would Reconsider the Former vote about selling the Land aforesaid, it passed in ye affirmative


Voted, then that the said Land should be sold, the produce there- of to be disposed for the use of ye Town for ever, any of ye Inhab- itants of the Town having the refusal, they giving as much as any other, against this vote Ephraim Thayer entred his dissent


Then Voted that Major John Quincey Esq". Captain John Mills & Mr. Joseph Crosbie be a Committee to sell said lands.


Voted, That Captain Mills have fourteen shillings & nine pence allowed him for expenses on ye Committee that sold ye Towns wood.


Voted, That Captain Mills have fifteen shillings more allowed him for time & expences about ye Towns Leasses.


Voted, That ye matter relating to pay, desired by some Persons for ways laid through Their lands be referred to next General Town meeting.


[142] Braintree May ye 2ª. 1720.


The Inhabitants of Braintree Lawfully assembled then chose Major John Quincey Esq. their Representative ye year ensuing.


Then also They chose the said John Quincey Esq". Moderator for that day.


It was then proposed by ye Moderator whether they would Re- consider their former vote about selling ye Towns Land Granted by the Honoured Court, it passed on ye affirmative.


Then moved, by ye Moderator, whether ye Town would make any alteration in ye late vote that had passed, for selling, said land it passed in ye negative.


Then voted that the by law drawn up by ye Selectmen about the Restraint of Rams (there read) be carried to ye Quarter Sessions for their approbation & Confirmation.

Committee to agree with the Whites, about Pay for a way through Their Land, it passed on the negative.


The Committee's Report was then Read which was as followeth,


The Report of ye Committee chosen to settle bounds with the Purchasers &c Wee the subscribers hereunto being a, Committee chosen by ye Town March 7th 1719/20 to Joyne with a Committee of ye Purchasers (so called) to Run & settle bounds between ye Towns Common Lands and ye lands of the Purchasers (if we saw good) did on March 22d. following, meet with ye other Committee & viewed ye Lands with such papers as might give us any light & Direction : and having fully debated ye matter we are of opinion that ye Lands in that place which ye Purchasers lay claim to, be- long to ye Town, but in as much as ye Purchasers pretend a Right thereunto, to prevent troublesome law suits whereby we may soon lose y" value thereof, we (in case ye Town approves thereof) see cause to relinquish ye Towns rights to them, upon conditions that they Pay to ye town, in case they enjoy it quietly without Law suits, Forty Pounds, but if molested so as to be forced to defend themselves in away of law, then Thirty pounds and in case it should be recovered by Mr. Faxson (who also claims it) or any other person from them (ye said Purchasers) then ye Town to re- mitt the sum or sums aforesaid, The said Purchasers in case they enjoy it, to leave out ye cart way leading to ye Captains Plain (so called) along by ye swamp and ye way leading to William Thayers, both coming into one below all the stony [143] ground, i.e. the Land they enjoy not to extend further upon ye common than these ways to all which ye Purchasers Committee agreed.

Then voted that ye return of ye Committee be accepted with this Alteration and addition that the one half of ye Produce of said Pur- chasers Land be to ye use of ye Town and ye charges if any be in ye law to be bore in equal part.


June ye 13th. 1720.


The Inhabitants of Braintree Lawfully Assembled, Then chose Major John Quincey their Representative for ye year ensuing.


They then chose the Honourable Edmund Quincey Esqr. Moder- ator for that day.


Then voted that the matter relating to the keeping a writing & Reading school at ye south end of ye Town ye whole year, be Re- ferred till next Town meeting.


It was then also voted, that the matter relating to the stinting ye common Lands of ye Towns, be continued till next Town Meet- ing.


July the Eleventh 1720.


The Inhabitants of Braintree Lawfully assembled then chose the Honourable Edmund Quincey Esq'. Moderator for that day.

The question was then propounded by the Moderator whether a writ of tresspass, should be brought & Prosecuted against the Per- son or Persons that had lately Fenced in a piece of the Towns com- mon Land it Passed on ye affirmative.


Then voted that Mr. Samuel Allen, Mr. Samuel White, Mr. Benjamin Neall and Mr. Joseph Crosby the Present Selectmen, be a committee impowered to Prosecute in. Law on ye Towns be- half said Trespassers.


Then voted that any three of said Selectmen be a Committee for said Purpose.


Then voted, that all encroachments on Common Lands and highways belonging to the Town be Reformed.


Then voted that the present Selectmen be a Committee to take care of that affair.


Then voted yt ye matters Relating to ye keeping the Schools y' whole year at ye south end of ye Town and about stinting yº common Lands be continued untill next General Town meeting.


[144] Braintree August ye 8th. 1720.


The Inhabitants of Braintree being lawfully assembled, They then chose Mr. Benjamin Webb, Moderator for yt day.


£25-Then voted, that Seventy five Pounds be forthwith Raised for ye Defreying Town charges.


Then voted that ye matters Relating to stinting ye Common Lands & keeping ye school ye whole . year at ye south end of ye Town be continued until next General March meeting.


Then voted that ye matters Relating to ye Lands in controversey between ye Town and Mr. Josiah Faxson be left to Three sworn surveyors to be by them Judged & Determined whose said Land shall bee. The Town to chuse Two of ye said Surveyors and said Faxson one, the charges to be equally born between said Parties and each Partie to enter into Bonds to stand to their determination.


Then voted that the Honourable Edmund Quincey Esqr. Mr. Benjamin Neall Mr Samuel White, Mr Samuel Allen and Mr. Joseph Crosby, bee a Committee, to chuse ye said Two Survey- ors, and to say & do what is needful in ye case on ye Towns behalf, and that the affair depending be issued with all convenient speed.


March the 6th. 1739.


The Inhabitants of Braintree Lawfully Assembled They then chose John Quincey Esqr. Moderator for that Day.


They then chose Joseph Parmenter Clerk for ye year ensuing The Selectmen then chosen were Lt. John Cleverly.

The Inhabitants of Braintree being by adjournment then assem- bled chose Mr Moses Payne Treasurer for said Town the year ensuing.


40- Then voted, that Mr. Moses Payn should have Forty shil- lings for his service, as Town Treasurer, he continuing in said ser- vice the ensuing year.


Surveyors were Nathan Brackett, Eleazer Vesey Jnº Hunt, Jos. White.

Fence Viewers, were Serjeant Nathaniel Spear, Cornet Jnº Beall, Sam1. Payn Junior, Nathaniel Wales, Richard Faxson.


Then voted, That swine should go at large ye year ensuing Voted, That there be chose Four hog reeves.


There was then chose the four following Persons, Jos. Ruggles Joseph Nightingal, John Thayer wever, and Samuel French


It being desired by some that there should be more hog Reevs chose, It was then Proposed to the Town by the, Moderator, whether they would choose Two more hog reeves, it passed in the affirmative


They then chose Joseph Allin and Moses Belcher.


Jonathan® Newcomb, was hired by Joseph Ruggle, and was accepted, by the Town in his Room.


Sealer of Leather, was Cornet John Beall.


Sealer of Weights and Measures was John Bass.


Tithing men were Samuel Thompson, Ensign Sam1. Baxter Ephraim Jones and Jonathan Hayward.


The question being put by the Moderator whether the Gramer School may be kept at the south end of the Town annually half a year, it passed in the negative.


The Moderator then Proposed, whether the Reading and writing School should be kept the whole year annually at the south end of ye Town for this Town, it passed on the affirmative.


A motion being made by the Moderator, whether the Town would make allowance for Persons, keeping Bulls and Boars for the use of the Town as formerly, it passed on the negative.


[146] March 7th. 1720/21


It was proposed by the moderator, whether the Town would accept of Elkanah Wales, who was hired by Nathaniel Thayer to serve as Constable, in his Room and stead, it passed on the affir- mative

Then voted that said Lands should be Leased out for Ten years (commencing the First Day of this instant March.) by A. Com- mitte chosen for that purpose.


The Town then chose Lt. John Cleverly, Mr. Benjamin Neall and Mr. Joseph Crosby a Committee to Lett & Leass said Lands for said Term.


April 12th. 1721.


The Inhabitants of Braintree Lawfully assembled then chose Mr. Thomas White Moderator for that day.


Whereas there was a grant of 6000 Acres of Land made by the honoured General Court, unto the Inhabitants of this town of Braintree in the year 1666, and since confirmed to said Town Anno Domini , wherefore for the Peaceable settlement and dis- tribution of said Land Voted That all Persons that were (and now are) Inhabitants of this town, that Paid charges in the year 1715, to the laying out of the said 6000 Acres of land to this town They their Heirs or assigns, have a propriety in said Lands.


The Question being propounded by the moderator whether or no They would proceed any further about the Proportioning of the said 6000 Acres of Land, it passed on the affirmative.


Voted. That a Committee be chosen to go and survey Josiah Faxsons Land, and that the select men be ye Committee.


[147] Braintree May ye 24th. 1721.


The Inhabitants of Braintree Lawfully, Assembled, they then chose John Quincy Esqr. their Representative for ye year ensuing.


Braintrey August the 11th. 1721.


The Inhabitants of Braintrey Lawfully assembled, They then chose Captain John Mills their Representative.


They then chose Mr. Benjamin Webb Moderator.


Then voted that Seventy two Pounds money be raised forthwith for the Defreying Town charges.


Braintree August the 24th. 1721.


The Inhabitants of said Braintrey Lawfully convened, to con- sider & Determine whether they would allow of stopping the Fish, at Menattiquod River, by the Iron works.


They then chose Lt. John Cleverly Moderator, and the modera- tor then moved, or put the Question to the said inhabitants, whether they would choose a committee to Proceed in that matter (in the behalf of the Town) as the Law directs, it passed on the affirmative.


Then voted That Lt. Peter Adams Mr. John Marshall & Mr. Nehemiah Hayden, be a Committee for the management of that affair.


The Inhabitants of Braintrey being Lawfully assembled, Octo- ber ye 30th. 1721, they then chose Lt. John Cleverly moderator for that day.

The question being put by ye Moderator whether ye town would take their Part of the Fifty thousand Pounds in Bills of Credit now Lodged in ye hands of ye Province Treasurer for the use of yo town) it passed in the affirmative.


Then voted that there be three Trustees chosen to Receive and dispose of said Bills for ye use of ye Town, Agreable to the Direc- tions of the Law.


Then voted, That John Quincey Esqr. Mr. Joseph Crosbie and Mr. Benjamin Webb, be the said Trustees.


[148] October 30th. 1721.


Then voted, That ye said Bills of Credit shall not be disposed of in Larger Quantitys then twenty five Pounds, nor lesser than Twenty Pounds.


Then voted, that no Person shall Receive any of ye Bills afore- said without Two sufficient sureties : or Land security to wit improved Lands.


Then voted that ye Bills aforesaid be lett at six per cent.


Then voted, That the Bonds for said Bills be made to the Town Treasurer for ye use of the Town.


Voted, that ye Trustees have a Reasonable allowance made them for their Pains and Trouble about that affair.


Whereas the General Court at their Session begun & held at Boston upon Wednesday the thirteenth Day of July 1720, passed an Act for the emitting of the sum of fifty Thousand Pounds in Bills of Credit on the Province to be Lodged in the hands of the Province Treasurer and by him distributed to the several Towns in the Province as by said Act is directed.


The Inhabitants of the Town of Braintree qualified as in the said act is Provided and Regularly Assembled on the Thirteenth Day of November, 1721, to consider & determine whither they would, Receive from the Treasury their part of the said fifty thou- sand Pounds & They then chose the honoured Edmund Quincy Esqr. Moderator for y'. day.


The question being put by the moderator it passed in the affirmative.


The question being Put by the Moderator whether the Town would lett said money to Five Persons who should find good & sufficient security to the satisfaction of the Town, it passed in the affirmative


The Moderator moved to the Town whether they would have a certain sum Paid down by the Persons that they should Lett said money too, for ye Towns use it Passed in ye affirmative.


Then ye moderator adjourned the meeting till monday the Twen- ticth day of November at one of ye clock in afternoon.

The Inhabitants of Braintree being Regularly assembled.


The moderator then Put the Question, whether if three persons should appear to pay down one hundred Pounds for the use of the Town, They should have the Priviledge of the 548 Pounds of the

There then appeared, the honoured Edmund Quincey Esqr. John Quincey Esqr., and Joseph Crosbie which three persons, were accepted & voted for by ye Town, to have their Part of Bills in ye Province Treasury lett too, They paying said sum of one hundred Pounds down for ye Towns use, and giving good security for the whole.


Then voted that the Bonds Payable for the said sum for Bills of Credit be made to ye Town Treasurer.


Then voted, that Mr. Benjamin Webb Mr. William Vesey, and Mr. Benjamin Neall, be Trustees in the Towns behalf and for their use to receive & lett the said Bills of Credit from ye Province Treasurer and pass Receipts for the same in the Towns stead.


Voted, that the hundred Pounds Paid down (for the use of the Town) out of said Province Bills of Credit be put into the hands of ye Town Treasurer.


Then voted that the Town Treasurer shall have Power to lett out said Bills of Credit for the Towns use he taking good & sufficient security.


Then voted that ye Present Town Treasurer take better security (if he se cause) for Bonds of ye Towns money now in his hands.


March ye 5th. 173}.

It was then moved by the moderator whether the Town would allow - anything for Bulls & Boars for ye use of ye town the year ensuing, it passed on ye negative.


The Moderator then also moved to the Town whether they would prolong ye lease of their Land Lett to Moses Belcher, it passed on ye negative.


The Town then voted Twenty shillings to Joseph Parmenter, for his service for serving ye Town as Town Clerk, the year past.


Braintree May the 14th. 1722.


The Inhabitants of Braintree Lawfully assembled, then chose John Quincey Esqr. their Representative for the year ensuing.


They then chose John Quincey Esq'. Moderator for that Day.


[151] They then chose Mr. Benjamin Webb, Mr. Joseph Crosby and Mr. Samuel Allen a Committee to make up accoumpts with Mr. Moses Payne late Treasurer for said Town, said Com- mittee to Render a true account to ye Town of the present state of ye Treasury, at ye next Town meeting.


Then voted that Mr. Peter Hobart ye Present Town Treasurer, shall upon his Receipt of ye Towns moneys & Bonds from Mr. Moses Payn late Town Treasurer give & Pass unto him a full receipt thereof.


Then Elkanah Wales was accepted by ye Town as Constable in the Room of his brother Nathaniel Wales who had agreed with him to take his Place and that service for ye year ensuing.


August 13th. 1722


the Inhabitants of of Braintree Lawfully assembled they then chose Mr. Benjamin Webb Moderator for that Day.


Then voted that one hundred and twelve Pounds be raised forth with for defreying Town Charges.


August, 13th. 1722.


The Moderator put ye Question whether the Town would Act any further in ye matter relating to the Dam at the Forge as to ye Recovering our Priviledge, as to ye passage of ye fish it passed on the affirmative.


Then voted that there should be a Committee chosen to Act in that affair


Then voted that it shall be in ye Power of ye said committee to Present the matter to the next sessions or to Petition ye General Court for ye Reobtainment of said Priviledge


The committee then chosen were Mr. Samuel Payn Mr. Benja- min Neall, Mr. John Hunt.


Then voted, that Joseph Parmenter should have for his services as town clerk, Thirty shillings for this present year, he continuing in said service till next march.

the Moderator then put the Question to the Town whether they would chose a Committee to Treat and agree with the Proprietors of the Dam at menattiquod River, it passed on the affirmative.


They then chose Lt Samuel Allin Mr. Samuel Payne Ensign Samuel Baxter, Mr Benjamin Webb, and Deacon Samuel White a Committee for that affair.
