The Freeholders & other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being Legally assembled by adjournment from the sixteenth of Septem- ber last, The committee chosen on the said sixteenth of September offerd their report which was read before the Town and is as fol- łows, (viz).

Committee to Lease the Commons their report. The Comittee appointed by the Town at their last Meeting to examine into the state of the Common Lands and to receive Proposals from such persons who might incline to hire said Lands upon Lease for a certain Number of years, Having caused seasonable notifications to be put up in the several precincts, in the Town of their attend- ing the said service this Day at the House of Mr John Hobart's in the Middle precinct did accordingly meet at said place where sundry Persons appeared but finding the Committee not vested with a power of agreeing with them upon any certain terms, They declined making any offers, relating to the same until such time as agents should be appointed & authorized by the Town to accept of such proposals as might be offered & approved of and to execute any Lease or Leases pursuant thereto
And the said Committee having endeavord in the Best manner they could to inform themselves of the present state & circumstan- ces of the said Comon Lands and what measures may be most advisable for the Town to come into respecting the Leasing of the

said Lands pursuant to their late vote are ready to offer their sen- timents thereon if desired.
Edmund Quincy in the Name of ye Committee.
Voted That a Committee be raised to Lease out the Towns Common's under such restrictions & directions as the Town shall now give them respecting said Lease.
Voted, Said Committee to consist of five. Then the following Gent" were seperately nominated & Chosen a Comttee for that affair viz. Edmund Quincy Esqr., Co1. W. Hunt, Mr. James Penniman Capt. Thomas Wales & Mr Samuel Bass.
Comttee to lease Commons. Voted, that Two more be added to the above said Committee Then Lieut Richard Thayer & Mr Samuel Niles were chosen to Join said Committee. Voted, that any four of the above said comttee be a Quorum. Then the Ques- tion was put by the Moderator whether the abovesaid Committee, shall have full power to Execute Leases of the stones & Herbage either of the whole or part of said commons to such as shall appear to Hire the same and for such a Term as said Comttee shall Judge most advantageous To the Town. Voted and passed in the affirm- ative.
[170] Committee Return of Perambulating The line with Ab- ington. We Sam". Bass, James Penniman & Thos Allen being appointed by the Town of Braintree to perambulate the Line between the Town of Braintree, and the Town of Abington viz. The Line called Thaxters and Thompsons Line ; Did meet with Messrs Daniel Reed, Ephraim Spooner & John Noyce Selectmen of the Town of Abington on the eighth Day of October A.D. 1754, and with the assistance of Mr Jonathan Porter Surveyor: Did begin with a saucefax stake and a heap of stones about it at the North west corner between Abington & Braintree and run East- ward about 19 Degrees North and run one hundred Rods and sett up a saucefax stake and stones about it, on the East side of a Large wood plain, and then on the same course one Hundred Rods more and sett up a White oak stake, and stones about it a Great Ledge of Rocks a little to the Northward of it, and then proceeded one Hundred Rods more and sett up a Hemlock stake & stones about it, the stake standing in the crack of a Rock in Swampy Land, and then proceeded to the Dividing line between Braintree & Weymouth and sett up a Hemlock stake & stones about it about 86 Rods from the bound last mentioned all on the same course first mentioned, said stake last mentioned marked with S B &'A. and near a small Hemlock Tree marked on four sides with

Qualified by Law to vote in Town affairs being assembled on Legall warning to Transact such affairs of said Town particulars whereof as they stand Inserted in the warrants are as follows. After a Moderator chosen.
First, To consider off and act upon anything that may be thought proper Respecting any way or ways that may be thought needfull in any part or parts of the Towns Common.
Secondly, To consider off and do what may be thought proper Respecting the Ministerial Land laid out in the Town's Common's.
Thirdly, To hear any claim that may be brought in by any per- son or persons that may claim any part that is now esteemed to be the Towns Common.
Assembled as aforesaid Chose Mr Edmund Quincy Moderator.
Voted, The Meeting be adjourned to Thursday the sixth Day of March next at Eleven o Clock fore noon at this place.
[17]] 1755 March 3ª. The Anniversary Town Meeting for the choice of Town Officers for the year One Thousand, seven hundred & fifty five.
Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being Legally assembled at the Meeting House in the Middle Precinct of said Town for the choice of Town Officers and for Transacting other affairs of said Town the particulars whereof as they were inserted in the Warrants are as follows, viz. After a Moderator chosen
First, To Choose all such Town Officers for the ensuing year, as the Law directs.
Secondly, To consider off and do what may be thought proper to encourage the Fishery in said Town.
Thirdly, To Hear the Report or Reports of any Committee or Committees, and choose any Committee that may be needfull
Fourthly, To consider of the Request of several persons in the South Precinct respecting the opening the way from Cocheco River to the road by Mr. Sam11. Veazie's House, a way formerly laid out.
Fifthly, To consider further and act upon building a House for the Town's Poor.
Moderator. Assembled as aforesaid chose M' Sam" Niles Modr
Then separately nominated & Voted Elisha Niles Clerk & Treas- urer for said Town.
Selectmen Then proceeded to the choice of Selectmen, the votes being Collected & Examined it appeared, Dea. John Adams, Dea. Jona Webb, Capt. Thos. Allen, Mr. Jona. Allen & Dea. Sam1. Bass, were chosen.
Constables Eben'. Spear accepted. Then the Moderator Calld for the votes for Constable which being Collected & Examined it appeared Mess" William Spear, James Thayer Secunds & Joseph Thayer were chosen, the said JJoseph Thayer presenting Ebenez Spear to the Town for their acceptance to serve as Constable in his stead

Fence Viewers, Joseph Nightengal, James Clark Nathaniel Vin- ton, Joseph Arnold, Ens" Nathaniel French, & Abiather French.
Fire Wardens, Daniel White, Clement Crane & Clement Hayden. Sealers of Leather, Jedidiah Bass & Abijah Allen.
Hogg-reaves, Seth Copeland Secunds, Adam Hayward, Nathan- iel Curtis, Ezekiel Thayer, Isaac Tirrell, Wm. Linsfield, Jun". Moses Spear, Josiah Hunt Jonathan Mills & Moses French Jun".
Voted, that for the encouragement of the Bank Cod fishery to be sett up and carried on within this Town that such persons either of the Town or who may come into the Town from other places and shall annually during the proper season of the year employ themselves in their own vessels or those of other in catch- ing and curing of Cod fish are hereby Freed & to be freed from & Released of their Poll tax for the space of three years next ensuing the time of their Commencing in the sd Business and so long as they continue in it within said term, upon the proviso that all such persons who come from other places, shall be approved of by the Selectmen of the Town or a Maj' part of them from time to time and such of them as shall be by the Selectmen Disapproved of shall be still subject to be warned out of Town according to Law.
Then Capt Benja Beal, M' Thomas Faxon, & Dea" Josh Palmer were separately nominated and chosen a Comttee to take care of the wood on the Town's Land and to prosecute all such persons as have or may Trespass on sd Land.
Then the Moderator with the consent of the meeting adjourned to Thursday the Sixth Instant at Ten of the clock forenoon at this place.
1755 March 6th.
The Freeholders and other Inhabitants of the Town of Braintree being Legally assembled by adjournment from the third Instant &c Guilford Field was chosen a Surveyor of Lumber.
Then a proposall from a Comttee at Milton was read before the Town Respecting said Town joining in Building a work House, Voted, the Clerk be desired to inform the Gent" of Milton Comttee their sentiments respecting sd proposal. Then M' James Thayer

The Freeholders and other Inhabitants of the Town of Braintree being Legally assembled by adjournment from the Twenty fifth of February last, The Moderator being absent proceeded and chose Capt Richard Brackett Moderator
Voted, That there be an open way fron M' Eben' Bass' up to the Six hundred acres, Two rods wide.
Voted, That there be an open way from Elijah Veazie & Benja. Baxters, to Ebenezer Bass' corner.
Voted, That there be an open way from Mr Apthorps corner to Mr. Ebenezer Newcombs barrs.
Voted, That there be an open way from the Nine mile stake up to Mr. Marquands one Rod & half wide as it was laid out.
Voted, that M' Moses Pain have an open way from his own yard to the Towns way about Ten Rods one Rod & half wide.
Then the Question was put by the Moderator whether the Town would act anything Respecting the Ministerial Land voted and passed in the Negative.
1755 March 24th.
Warrants. The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assem- bled on Legall warning to Transact such affairs of said Town, the particulars whereof Inserted in the warrants are as follows, viz.
After a Moderator chosen.
First, To consider and Determine upon what may be proposed to Town concerning the Ministerial Land.
Secondly, To know whether the Town concurs with any of those votes passd at the late adjournment, March the sixth Instant, concerning ways on the Towns commons as they were passd when there was but a small number of the Inhabitants by reason of the extraordinary snow, and which vote under the present circum- stances of said comons is thought by may inconsistent.
Thirdly, To consider of and do what may be thought proper to accommodate any of the Inhabitants with convenient ways in any part of said commons, with the consent of those persons that have lately taken leases of said comon and making proper allow- ance to sd Leasees for fencing such ways.
Fourthly, To choose such Committee or Comttees as the Town shall Judge necessary.
Fifthly, To bring in their Votes for a County Treasurer, omitted at the annual meeting.

Clerk, whether the Town would choose a Moderator by an uplifted hand passed in the Negative, by Polling. Then M' Samuel Niles was chosen Moderator by writting.
Ministerial Lands &c. The Question was put by the Moderator whether the Town would confirm the Grant made of a hundred acres of the com'on land for the use of the Ministry, voted, & passed in the Negative.
Then the Question was put whether the Town concur with any of the votes passed at the adjournment voted & Polld, concurd, 83 non Concurd 91.
The Question was put whether the Town desire the Selectmen to view the way from M' Ebenezer Newcombs to M' Apthorp's corner, and make report, voted and passed in the Negative
Then the Question was put whether the Town would have the way lye open from the nine mile stake to Mr. Marquand voted and passed in the Negative.
The votes being called were Collected & Sealed for a County Treasurer.
1755 May 19th.
Selectmens Report. The Freeholders, and other Inhabitants of the Town of Braintree being Legally assembled by adjournment from the sixth of March, last &c. The Report of the Selectmen Relating to the way from Peter Thayer's to Samuel Veazies house Deferrd to a further opportunity.
Moses Brackett Constable Hogreave. Then Voted, that William Spear be excused from serving as Constable, Moses Brackett was then chosen a Constable for the North Precinct & Jedidiah New- comb a Hog Reave for the present year.
1755 May 19th.
Representative. Pursuant to a Precept for the choice of a Representative the Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in that affair being Legally assembled, the Question was put whether the Town would send one person to Represent them at the Great & General Court the present year, Voted & passd in the affirmative. The votes being Collected & Examined it appeared that the Honorable. John Quincy Esqr. was chosen for that service by a majority of the voters present.
1755, Augst. 18th.
Warrants. The Freeholders and other Inhabitants of the Town of Braintree, Qualified by Law to vote in Town Affairs being as- sembled on Legal warning at the meeting House in the Middle Precinct of said Town to Transact such affairs of said Town the particulars whereof as Inserted in the Warrants are as follows, viz. Money raised, £150, L. mo. Voted That One Hundred and Fifty pounds Lawfull money be assessed on the Polls & Ratable Estates within said Town for Defreying the Town Charge this present year.
Tho8. Faxon Constle. for the North Precinct Voted, That Thomas Faxon be accepted as Constable for the North Precinct in stead of Moses Brackett said Brackett giving Bond to the Town &c.
Comttee to examine the claim on a Gore of the Towns Common's. House for Wm Thompson in the Towns Comons To revert to the Town Voted, Messrs. Josiah Quincy, Samuel Niles & James Penniman be a Comtee to view the Deeds & writing respecting the claims on a Gore of the Towns Commons and Report to the Town. Then the Question was put by the Moderator, If Wm Thompson, obtain a room stond in the Town's Common, where he hath dug, whether the Town will appoint some person to provide materials to finish it and lay the amt. before the Town, voted & passed in the affirmative. Voted, that Elisha Niles have the oversight and take care of said business. said House to Revert to the Town after said Thompson & wife have done with it.
1756 February 2d.
The Freeholders & other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled on Legall warning, to Transact such affairs of said Town the particu- lars whereof inserted in the Warrants are as follows viz -
After a Moderator chosen.
First, To consider of the affair depending between Capt. Faxon . and John Thayer Jun'. one of the Surveyors of Highways for sd Town, to know whether the Town will assist sd Surveyor in paying the charge that hath arisen by reason of a prosecution commenced against him for the execution of his said office, and also advise & direct in the further management of that affair.
Secondly, To hear the Request of Dea". Moses Belcher & Ens". Nath11. Belcher, or others that have leases of the School Lands (so called) To see whether the Town will give up such leases, as may be desired, and also to see whether the Town will make the said Belcher, any allowance for the fence they have put on sd Land.

The Question was put by the Moderator whether the Town would pay Capt. Faxon's charge and move the Fence back, from whence it was Removed, voted and passed in the Negative.
Then Voted That the Town would assist the Surveyor, in De- fending the action brot. against him by, Capt. Faxon, and pay the cost that should arise thereon.
[176] 1756 February 2ª.
Then the Question was put by the Moderator whether the Town would release Dea". Moses & Ens". Nath" Belcher from their Leases of the School Lands, voted & passed in the Negative.
Then the following proposalls made by Capt Faxon were read before the Town, viz. I the subscriber do hereby propose, con- sent & agree to put a stop to and final issue of the controversy, Subsisting in the Law, between myself & Mr. John Thayer Jun". upon the following consideration & condition viz.
That the said John Thayer or the Town on his behalf shall pay or cause to be paid to me or my order on Demand the necessary cost, & charge, I have hitherto expended in commencing & carry- ing on said controversy or suit against said Thayer in the Law, as, Witness my hand. Richard Faxon.
A true copy of sd proposalls Attest, Elisha Niles Town Cler
The above proposall being read To the Town the Question was put by the Modr. whether the Town would accept the same, voted & passd in the affirmative
Then voted that vote Respecting the Defending the sd action be reconsidered & disannulled
And then voted that the said John Thayer be allowed a Draught on the Town Treasurer sufficient to discharge Capt Fax- ons cost against him, and likewise Reimburse him such necessary charges as he hath expended in defending said action.

James Penniman, from the way leading to Aldrige' Farm along by the House where his son Thomas lived, and so into the way that goeth by the said M. Penniman's Dwelling house as the people now pass, and deter- mine the way to be as here described, if the Town think proper.

Eighthly, To hear the Report of the Selectmen Respecting ways laid out last year and act thereon.

Moderator. Assembled as aforesaid chose Coll. Wm. Hunt Moderator.
Clerk & Treasurer -Then Elisha Niles was chosen Clerk and also Treasurer for said Town.
Selectmen. The Votes being called for Selectmen & Collected it appeared by examining the same that, Capt Richard Brackett, Mr. Jonathan Rawson, Lieut Ebenez" Thayer, Mr. Jonathan Allen Mr. Benjamin Porter, were chosen.
Division of the Town. Voted to postpone the further choice of Town Officers and proceed to the second article in the warrant, Respecting the Division of the Town into two Townships, and then a Memorial of the North precinct by their Comttee was read before the Town and after considerable debate thereupon the Question was put by the Moderator, whether the Town would Choose a Committee to consider of said Memo1 and Report to the Town at May meeting voted & passed in the Negative.
Constables. Then William Savel, Nathaniel Blancher, Samuel Blancher were chosen Constables.
sd Samuel Blancher presenting, Ebenezer Spear to the Town for their acceptance to serve as Constable, in his stead, Voted said Spear be accepted provided said Blancher give for his faith- full discharge of said trust. Nathaniel Blancher presenting Moses French Jr. said French was accepted by the Town on the condi- tions abovesaid.
Mending ways by a rate Then proceeded to the fourth article Respecting the mending the ways by a Rate, and large Debate being had thereon the Modr put the Question whether the Town would mend their ways by a Rate the year ensuing Voted & dis- puted Polld and determined in the affirmative.
Adjournment. Then the Moderr. with the consent of the meeting adjourned to Monday the fifteenth Instant ten of the clock A.M. to this place.

Surveyors of Ways. The Freeholders & other Inhabitants of the Town of Braintree being Legally assembled by adjournment from the first of March Inst. A motion being made to reconsider the vote passd for the mending the ways in said Town by a Rate, the Question was put by the Modr whether the Town would reconsider said vote passd in the affirmative, and then voted to mend the way in said Town in the usual method by surveyors. Then the follow- ing persons were separately surveyors of ways, for the year ensuing viz. Maj'r. Eben". Miller, Joseph Neal, Ens" Nath11 Belcher, Josiah Capen, Luke Lambert, Benjamin Thayer, Ens™ Thomas Thayer, Peter Markquand, Caleb Hobart, Sam11 Holbrook, Shad- rack Thayer, Eliphalet Sawin, Naphtali Thayer Josiah Thayer.

Voted, Mr John Borland a Constable for the North Precinct having first released William Savel from that office upon his re- quest.
Adjournment. And then proceeded on the request of Dea". Moses Belcher and his Brother, the Question being put whether the town would throw up the lease with said Belcher. voted and passed in the Negative. Then whether the Town would make said Belcher any consideration on sª leases voted & contested. Polld & Determined in the affirmative, and after a great debate what consideration to make said Belcher's it was thought proper to refer it to the adjournment of said meeting, and then the Moderator with the consent of the meeting adjourned to monday the twenty second Instant, at ten in the morning to this place.
