Voted, the above said report be accepted and the agreement therein Referd to, be Recorded, which is as follows -
(viz) Memorandum this twelfth Day of March A.D. 1756.
Agreement with Josiah Faxon -Whereas a controversy has aris- en between the Proprietors of the Common Land in the Town of Braintree & M' Josiah Faxon of said Town who Claims a part of the Farm called Houghs Farm with Respect to the Bounds of their Respective Property have now the said Town by their agents Mess" Samuel Niles & James Penniman and the said Faxon for himself together with the assistance of Benja Lincoln Joseph Gooch Esq'. & Mr Ezra Whitmarsh mutually agreed that the bounds be- tween forever hereafter be as followeth, beginning at a stake & Heap of Stones upon the side of a Large Ledge of Rocks, and from thence to run south Eastd fifty Degrees to the River, then begin- ning at the stake, & heap of stones aforesd, and to Run south west. Sixty one Degrees about Fifty Rods to a heap of stones upon the Rocks near the said Faxons old House, from thence North west Eighty six Degrees, one hundred & sixty six Rods and from thence

Warrants. The Freeholders & others Inhabitants of the Town of Braintree Qualifyd. by Law to vote in Town affairs being mett att the Meeting House in the middle Precinct of said Town to Transact affairs the particulars whereof as they were Inserted in the Warrants are as follows, (viz) After a Moderator chosen. First To bring into the assessors a true & perfect list of their Polls Rate- able Estate and Income by Trade & Faculty & gain by money at interest upon oath if required
Secondly, To Raise money to Defrey the charge of said Town the Current year.
[188] Thirdly, To consider what further powers may be necessary or proper to be given to the comttee appointed by the Town to prosecute Trespassers on the Towns Land and act there- on as the Town shall think proper.
Fourthly, To consider and determine whether the Town will allow anything further to the Leasees of the South Commons on acct. of the ways, that have been laid thro' the same.
Fifthly, To hear the report of any Comttees or Committees or choose any Committees that may be necessary.
Moderator. Assembled as aforesaid chose Sam" Niles Esq'. Modr.
Then the act relating to the Valuations was read and the Valua- tions calld for by the Mod".
Money raised £150 Voted One hundred & Fifty Pounds be assessed on the Polls & Rateable Estates within said Town for Defreying the charge of said town the currant year
Comttee To prosecute Trespassers, power enlarged. Voted, That the Comttee appointed some time since by this Town to enquire after & prosecute those Persons who have committed Tres- passes on the Town Land be and hereby are further impowered & directed at the expense of the Town to prosecute in the law those Persons who have been or may be offenders as aforesaid unless they make satisfaction to sd Comttee in behalf of the Town as to . them shall appear reasonable.

We the Subscribers have taken an account of the stuff & labor Dea. Belcher & Nath" Belcher have done to repair the fence between the Town Land & Germantown (so called) and find the whole expense to make the same on the Towns part a good and

The above Report being read before the Town was Voted accepted, and the aforesaid sum of six pounds, Thirteen Shillings & 4ª allowed to the said Messrs Belchers.

The Freeholders & others Inhabitants of the Town of Braintree Qualifyd by Law to vote in Town affairs being Mett at the Meet- ing house in the Middle Precinct of said Town on legall warning to Transact such affairs of said Town as were Inserted in the War- rants which were as follows (viz) After a Modr. chosen.
1st. To see if the Town will order the wood on the Towns land to be sold, and act thereon, as the Town shall think proper.
2dly To Hear the Report of any Comttee or Comttees or choose any Comttees that may be necessary, and to hear and act on any other matter Relating to the Town's Interest that may be laid before the Town.
Assembled as aforesaid chose Josiah Quincy Esq' Modr.
Mr. Joseph Tirrell appeared & declared before said meeting that he would make no objection to the Towns cutting and carrying the wood off the Towns Land, Provided it be done before the first of March next, and putting up the fence they shall pull down.
Towns wood sold Voted, That the wood on the Town's Land lying between Coll Jno. Quincy's Farm & Germantown, also the Towns Wood on Rock Island be sold under the direction of a Committee to be hereafter chosen by the Town.
Voted, That the aforesaid wood be divided in two or more Divi- sions under the direction of a Comttee Time & Place of being sold with the conditions of sale to be posted up in Braintree.
Voted, said Comttee consist of three. Then Sam11. Niles Esqr. Mr. Ebenezer Newcomb & Dea. John Adams were seperately nominated & voted a Committee for that affair.
Voted, The time of sale to be next Monday 2 o'clock P.M. at M' Luke Lamberts House in Germantown.
1758 March 6th. The Anniversary Town Meeting for the choice of Town Officers Anno Dom. 1758.
Warrants The Freeholders and other Inhabitants of the Town of Braintree Qualifyd by Law to vote in Town Affairs being assem- bled at the Meeting House in the Middle Precinct of said Town to Transact the affairs of said Town the particulars whereof as Inserted in the Warrants are as follows, (viz)

[191] Hogreaves. Thompson Baxter, Jonathan Cleverly, Benoni Spear, Matthias Cheesman, Pallitiah Penniman, Benja Allen, Jonathan Wales, Noah Thayer, Thomas Fenton Jr. Daniel Bass. Way thro' Dea. Adams. land Comttee Voted, A Comttee be raised to view the way thro' Dea" John Adams Land & Report to the Town at the adjournment. Then Caleb Hobart, Mr. William Penniman, & Lieut Sam11. Wild were chosen a Comttee for that purpose.
Schools. Voted, The Grammer School be kept the one half the year in the North Precinct, the other half in the Middle Precinct the ensuing year, and that an equal sum as shall be necessary to maintain a Grammer School in each Precinct shall be expended in writting and reading schools, under the direction of the Selectmen, and that the South Precinct draw their proportion of School money as usual.
Voted, That the Leasees of the Nº Comons endeavour an accom- modation with Wm Harman, and if said Refuses to agree to Prose- cute him and Recover possession by Law.
Gore of Land to be sold. Voted, That the Gore of Land above where the Leases were obliged to fence by their last lease belong- ing to the Town be sold to such Persons as may appear to Pur- chase said land.
Committee. Voted, Messrs. James Penniman, Nathaniel Wales & Elisha Niles be a Committee to make sale of said land and that they have full Power to Execute Deeds of the same in the name of the Town.
Leasees of Sº Comons Remitted. Voted, The Leasees, of the South Commons be Remitted Two years Rent, from this time they Compleating on said consideration the whole of the Towns part of wall fence on sd comons and deliver the same at the expiration of their Lease for the use of the Town Mr. William Penniman & M Tho'. Faxon appeared & declared their acceptance of said vote.

Representative The Freeholders & other Inhabitants of the Town of Braintree, Qualifyd by Law to vote in the choice of a Rep- resentative, being assembled pursuant to a Precept Directed to the Selectmen of said Town under the hand of the Sheriff of the County made choice of Sam11. Niles Esqr. for their Representative by a Majority of votes then present.
1758 Augst. 15th.
The Freeholders & other Inhabitants of the Town of Braintree being assembled at the meeting House in the Middle Precinct of said Town To Transact such affairs of said Town the particulars whereof as Inserted in the warrant are as follows (viz)

Voted, Dea". Savels Bridge so called be Repaired with stone under the direction of a Committee. Then Messrs. Ebenezer Adams Sam1. Savel Jun'. & Sam11. Hayward were chosen a Committee for that affair.
[193] Voted, there be a Bridge built with stone over Cram- berry brook under the direction of a Comttee. Then, Caleb Thayer Josh. Ludden Secd. & Elisha Niles were appointed a committee to order said Bridge & Lett it out to the lowest bidder.
The Committee appointed to settle the Treasury made their Report to the Town, which Report as it stands Inserted on the Treasurers book was Voted accepted, vide Treasurers Book Vol 11 Page 85 & 86.
Voted, Majr. Crosbey Dea". Penniman & Elisha Niles be a Com- mittee to Petition the Great & General Court for Relief on the additional tax laid on this Town.
Voted the meeting be adjourned to monday 28th. Instant 4 Clock P.M.
1758 August 28th.
The Freeholders & other Inhabitants being assembled by ad- journment from the 15th. Instant &c Voted mr. Sam11 Hayward be excused serving Constable for this year.

Voted, the Town Treasurer be directed to call on said Norton Quincy for his fine
Constale. Then M' Samuel Bass Jun'. was chosen Constable for the North Precinct.
The Comttee appointed by the Town to settle the Line of the Towns Land offerd. their Report to the Town as follows (viz)
Comttee Report of the Line on the west of the Towns Land near Germantown. We the subscribers some time since being appointed to settle the Line upon the westerly side of the Town Land near Germantown (so called) Did attend that service with the assistance of Mr. Jon. Thayer Surveyor and the most of the owners of the land upon the west of said Line being present upon lawfull no- tice.
We began at a Cedar stake at the corner of Dear. Hobart's meadow (that was) and over Rock Island by Land of Coll John Quincys to salt meadow of Sam" White Esqr. of Taunton then across a Creek to meadow of the Heirs of Dean Sam11. White and then to upland of sd John Quincy and then to salt meadow belong- ing to Benjamin Nash of Weymouth and so to the flats of the Creek that comes up to Capt Bracketts Landing the Line from the stake first mentioned to Collo Quincy's upland Last mentioned and the stake through the Salt meadow was Right but the fence from said meadow southerly to the creek Running to Capt Bracketts Land- ing was about two thirds of a Rod upon the Towns land which we corrected by setting up stakes where said line is & Should be & sd Collo John Quincey hath since Removed his fence almost into sd line, the course of said Line is South 52 Degrees & half west

Fourthly, To see if the Town will allow Ens". Thos. Thayer an equivalent in Land for that which is taken off by the Town way thro' the Land he purchased of Mr. Moses Pain.
Fifthly, To see if the Town will allow swine to go at Large.
Sixthly, To see if the Town will accept that way thro' Dear John Adams' Land in the South Precinct as he hath before Requested.
Seventhly, To hear the Request of any late Constables Respect- ing Rates, they have not been able to collect and act thereon.
Eighthly, To hear and Receive any Reports or Returns of the Selectmen or Comttee and act thereon and choose any Committees that may be necessary

Adams, Capt. Ebenezer Thayer Jun'. & Capt. Richard Brackett were seperately Nominated & chosen a Comttee to Lett & Lease out the School Land for the term of seven years.
Voted, that the Land between Collo John Quincy's Gate & Wm Savels be Tilled Two years only and that by planting one year & sowing the next and that it be done the Two first years of the Lease.
Constable accepted. Then Mr. Moses French Jun'. was ac- cepted by the Town a Constable in the stead of Mr. Ephraim Jones he producing bonds for the Towns security.
Adjourned Voted, the Meeting be adjourned to may next the Day the meeting shall be appointed for the choice of a Represen- tative at nine o'Clock forenoon.
1759 May 21st.
The Freeholders & other Inhabitants of the Town of Braintree being assembled by adjournment from the fifth of March Last &c &c.
Constables French excused. Voted Mr. Moses French Junr. be excused serving Constable this year.
Ebenezer Spear accepted. Voted, Mr. Ebenezer Spear be ac- cepted to serve as a Constable in the stead of Mr. Joseph Porter sd Porter giving bond to the Town for the said Spears faithfull dis- charge of said trust.
Constables Chosen. Then Mr. Norton Quincy & M' Ephraim Jones were chosen Constables.
Ebr. Spear late Constable allowed - Voted, M' Ebenezer Spear late Constable be allowed a draught on the Town Treasurer, for the sum of one Pound, Two shillings & eleven pence, and Mr. .Seth Porter for the sum of sixteen Shillings & six pence.
Then Mr Gregory Baxter & Mr. Joseph Field were chosen Sur- veyors of Highways
Then a Report of the Selectmen of a way Laid thro' Mr. Josiah Ruggles Land was Read before the Town & Voted accepted & Recorded Page 197.
[196] The Committee to view the way thro' Dean Adams Land & Thomas' Farm & Report. Then the Report of the Select men of Town way laid thro' Thomas' Farm, so called was laid before the Town and then Voted, That Capt. Benja Beal M' Samuel Bass & M' Caleb Hobart be a committee to view said way and the way thoro' Dea". Adams Land and Report whether it be proper for the Town to accept said Ways.
Voted, the Meeting be adjourned to the second Monday in August next at two of the Clock afternoon.
1759 May 21st.
Representative. The Vote for a Constable for the North Precinct being calld for by the Modr. Mr. Jedidiah Bass was chosen, said Bass Refused serving as being under oath in previous office.
Constable chosen & excused. Then Mr. William Spear was chosen, & then excused for this year. Then Mr. James Brackett was chosen Constable. Mr. Thomas Vinton chosen Constable & excused for this year. Then Mr. Peter Dyer was chosen, Consta- ble.
Comttees Report on the way thro Dea". Adams land. The Comttes appointed to View the way thro' Dea" Adams Land Reported to the Town as follows (viz) The Committee having been upon the spot on Dean. John Adams Land do find that one part of the old Road on his land will be much to his Damage to Establish the same, and whereas it was his Property and he was not notifyd when laid out and hath never been Satisfyd. for the same, doth at this Day offer to the Town a more strate Road on which he hath bestowed much Labour as we see and offers still to bestow more, and it is to be Remembered the Town is at no charge in fencing of sd way so that upon the Whole we think that any Person mak- ing it his own case would think it much not to be heard & favora- bly answered by the Town, so we say it may be well for the Town to give up the old Road so far as to make the Road more strait
