Rent to be collected. Voted, that the Treasurer after giveing ten days notice prosecute all persons who shall be Indebted to the Town for Rent.


Deficient Collectors to settle. Voted, that the Treasurer call upon all the Collectors who are in arrears previous to the year 1789, To settle up their Collection be the second monday in August next.


Col : to pay £30 - each. Voted, that each Collector of the last Town Tax pay £30 -into the Treasury within thirty days.


The meeting was then dissolved.

Anno Domini 1790. Braintree Records.


The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled this ninth day of August by adjournment from May 31, a Letter that was directed to the Selectmen from a number of Town in the Westerly part of the County proposing a meeting of the County Towns in the County at Gays in Dedham on 20th. September next being read.


Members to meet at Dedham. Voted, to send three persons to Represent this Town at said meeting provided they will serve with- out any charge to the Town.


Then Capt. Silas Wild, Mr. Joseph White Junr. and Lieut Seth Spear was nominated and chosen


Collectors. Voted, to let out the Collecting of the Taxes for the ensuing year Lieut. Elijah Veazie bid off the North parish Bills at five pence on the pound. The Town then made choice of him as a Collector upon the conditions Recorded in page 84. Mr James Holbrook bid of the Middle parish Bills at six pence on the pound. he was then chosen a Collector upon the same conditions as Veazie was.


Mr John French bid off the South parish Bills at six pence on the pound, he was chosen a Collector upon the same Conditions as the others.


This meeting was then adjourned to the last monday in Novem- ber next at three oClock afternoon.


October 4.


Representative to Congress. The Inhabitants of the Town of Braintree Qualified to vote in the choice of a Representative to the General Court of this Commonwealth being assembled pursuant to Legal Warrants the particulars are as follows. To give in their Votes for a Representative to the Congress of the United States from this District, assembled as aforesaid.


The Selectmen Presided.

The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled this 29th. of November by adjournment.


Capt. Vinton, to meet in County Commee. Voted, that Capt" John Vinton be authorized by this Town to appear in their behalf as a Committee at a meeting or meetings that is or may be proposed by any of the Towns in this County to consult on suitable meas- ures for the division of the same, and also to Petition the General Court for that purpose providing that shall be the Result of the Committees.

Nath1 Glover to have a drawback. Voted, that the assessors be impowered to give a draw back to Nathaniel Glover provided in their oppinion he has been over Tax'd, and to such others as may appear to have been over Tax'd.


The meeting was then Dissolved.


1791 Febry. 7th.


Warrants in the North Preciencts Petition for a seperation. Mod- erator. The Freeholders and other Inhabitants of the Town of Brain- tree qualified by law to vote in Town affairs being assembled this seventh day of Febry. 1791 - pursuant to Legal Warrants the partic- ulars are as follows. After a Moderator chosen, To chuse agents to appear in behalf of this Town before the General Court on Wednesday the 16th. day of Febry. inst. agreeable to Notification from the North Precienct in said Town to shew cause why the prayer of said preciencts petition for a seperation should not be granted & to give instructions to said agents, assembled as afore- said & after a Long dispute fineally, Voted, to chuse the Moderator by Ballot, and Maj' Stephen Penniman was chosen by 93 votes out of 152 - the petition and order of Court being read, then Voted to chuse by Ballot six persons as agents to appear in behalf of the Town before the General Court, the votes being collected and examined, Maj' Stephen Penniman Capt. John Vinton Mr Azariah Faxon, Lieut Nathaniel Niles Mr. Joseph White jun". & Cap". Ichbd. Holbrook was chose.


agents. Instructions to them Instructions to the Represen- tative. Then Voted, that the agents now chosen be author- ized to appear in behalf of this Town before the General Court and prevent if it is in their power the prayer of the petition aforesaid being granted & that they engage at the cost of the Town such Council to assist as they may judge proper. Voted, that the Representative from this Town use his influence in the House of Representatives to prevent a Seperation of said precienct taking place, and that he be desired to assist the agents in any part of their business if they should request it.


The meeting was then disolved.


[93] March 7th.


Anno Domini, 1791.


The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being legally assembled at the meeting house in the Middle precienct of said Town, for the choice of Town Officers and for the transacting the other affairs of said Town the particulars whereof are as follows. After a Moder- ator chosen.


Warrants. First, to chuse all such Town officers for the pres- ent year as the Law directs ; also to Receive in the votes for a County Treasurer and the Votes for a Register of Deeds.


Secondly, To Raise such sum or sums of money for the use of said Town as they may think proper when assembled.


Thirdly, To direct in what manner the Highways shall be re- paired the ensuing year, and likewise a number of Bridges.

Fourthly, To determine what shall be done with the old Conti- nental money now in the Treasurers Office.


Fifthly, To see what the Town will do with the land where Enoch Hayden now lives.


Sixthly, To see what allowance the Town will make Lieut. Seth Mann for his land now Improved as a way or County Road.


Seventhly, To see if the Town will allow of a Dam, being erected a crost the Ironwork River so called where the Dam formerly was.


Eighthly, To see if the Town will open a Way through Lieut Wm. Harmon's land to the six hundred acres so called


Ninthly, To see what sum of money shall be appropreated for Schooling the ensuing year.


Tenthly, To see if it be the minds of the Town that all Town Officers that may be chosen this year serve without any pay, from the Town.


Eleventhly, To hear the Report of any Committee or Chuse any the Town may think proper when assembled.


Moderator. Assembled as aforesaid. Voted, to chuse the Mod- erator by written Votes, they being Collected and counted Doct". Ephraim Wales was chosen Moderator. The tenth artical being taken up after a considerable debate whether the Officers should serve without pay, the poll being call for the House divided 98 agst. paying & 99 for paying so it was Voted that the Town officers should be paid.


[94] Then the Votes was Collected for a Clerk and Ebenezer Thayer jun'. was Chosen Clerk.


Clerk & Treasurer & sworn The Votes being Collected for a Treasurer Ebenezer Thayer Jurr. Esqr. was chosen Treasurer and afterwards on the same day was sworn as Clerk and Treasurer, by Hon. Richard Cranch Esqr.


Selectmen Voted to choose three Selectmen the ensuing year. Then Capt". John Hall, Mr. Caleb Hayward and Mr. Joseph White jun' was chosen Selectmen.


No assessors. The Question was put to see if the Town would chuse assessors it passed in the negative.


Voted, to take up and now act on the seventh artical in the war- rant which is to see if the Town will give Liberty for a Dam to be erected acrost the Ironwork River.


Committee on the 7th. artical for a Dam to be erected. Voted, to chuse a Committee of three one in each precienct to consider of the expediency of suffering a Dam to be erected and Report on the adjournment. Then Samuel Bass Esqr. Ebenezer Thayer Junt. Esqr. & Lieut. Seth Spear was chose a Committee for that pur- pose.


County Register. The Votes for a County Register was brought in sorted & counted.


Joshua Hinshaw Esqr. had 116 votes.


Samuel Barrett Esqr. had 40 votes.


Mr Elkanah Hawkes had 4 votes.


Mr. Samuel Ruggles, had 3 votes.

County Treasurer. The Votes for a County Treasurer being Collected, Thomas Crafts Esq. had 63 being the whole.


Constables. Voted, to chuse three Constables in the Town for the ensuing year. Then Lieut. Elijah Veazie, Mr. James Hol- brook & Mr. John French was chosen.


Adjournment. Voted, to adjourn this meeting to to morrow week, twelve oClock at noon, it was accordingly adjourned.

Com. to draw Wrighting The Committee appointed to consider of the expediency of suf- fering a Dam to be built across the Ironwork River, Report as their opinion That a Dam may be errected a Crost said River for the purpose of setting up a Forge and other Buildings (Excepting a Grist Mill) without injuring the Town provided proper sluice ways be keept open for the Fish the Town accepted the Report and chose Peter Boylston Adams Esqr. Ebenezer Thayer jun". Esqr. & Samuel Bass Esqr. a Committee to draught writeings of agreement to be entered into between the persons who shall erect the dam aforesaid & the Town and Report.


Old money. Voted, that the Treasurer be desired to see how the old Continental money can be disposed of and report.


land where Enoch Hayden lives. Voted, That the Selectmen be directed to take possession of the land where Enoch Hayden now lives and conduct the same in the best manner they can for the Towns interest.


The way from Sº. Parish meet& House to Milton Line. Voted, that the Selectmen be directed to view the Road from the South Parish meeting House by Lieut. Seth Manns to Milton line and Report to the Town their opinion what advantage or disadvantage it is to those person who formerly own'd the land now improved for said way


[97] Money for Schooling. Voted, that there shall be the sum of One hundred and Fifty pounds appropreated for Schooling the ensuing year.


Come to divide the money. Voted, to chuse a Committee of Fifteen to proportion and divide the money voted for Schooling between the three preciencts.

1791 April 4th.


The Freeholders and other Inhabitants of the Town of Braintree being assembled by adjournment from the 15th. of March last, to transact the Business of the Town.


on Lieut. Mann way by his House. The Selectmen Reported as their opinion that it was advantagus to those persons who own'd the land on each side the Road leading from the South parish meeting House to Milton to have said Road. The Town then Voted that they would not allow Lieut. Seth Mann any thing for his land improved for said way nor neither would they purchas a drift way for him thro' his neighbors land to the northerly part his land.


Report of the Committee on Receipts for Money advancd. for soldiers. The Committee appointed by the Town Dec. 21st. 1789, on the Subject of Receipts for money advanced to hire men for a Reinforcement for the army and for Guards Reported the Copy of a Number of Receipts signed by Colo. Jonathan Bass, Capt. Ed- mund Billings, & Capt. Daniel Arnold, for money Received from sundry persons, for the purpose aforesaid as therein is expressed in said Receipts.


New Committee on the same subject. The Town where upon Voted, to chuse a Committee to consider of what sum shall be allowed to those persons who advanced money for a Reinforce- ment and for Guards agreeable to a Former vote and Report to the Town. Then Ebenezer Thayer Jun'. Esqr. Colo. Edmund Billings and Samuel Bass Esqr. was chosen for said Committee.


[98] Liberty to erect a Dam a Crost the Ironwork River upon Conditions


Committee on Dam report as follows.


The Committee appointed by the Town of Braintree to draught writeings of agreement to be entered into between the said Town on the one part and a number of persons who are desirous of building a Dam a crost the Ironwork River so called on the other part : are of opinion that the following being voted by the Town will be sufficient for the purpose intended, the same being consented to and signed by the person to whom the Grant shall be made (viz) Voted, that this Town do Relinquish to Mess Caleb Hunt, Eli Hayden Josiah Vinton, Benjamin Hayden jur Sam. ler Thayer, Jonathan Bowditch & Atherton Thayer, their Heirs and Assigns, forever all the Right the Town has to the priviledge to that part of the Ironwork River aforesaid where a Dam formerly stood which priviledge the Town purchased of Mr. Thomas Vinton decd. upon the following conditions, that the said Caleb Hunt & his associates above named do errect a Dam a Crost the said River at or nigh the place where the said Thomas Vintons Dam formerly was and that they set up a Forge or some other water works on the same within the Term of Two Years from this time : Excepting only such mill or works as is herein expressly prohibited and that they be at the whole expense of said Dam and works and pay all the Damage it may be to the land of any person or persons own- ing on said River which may be flowed or otherwise enjured In consequence of said Dam and that they and their Heirs and as- signs shall open and cause to be keept open proper and sufficient Sluce or Passage way for the Fish to pass thro. said Dam (from the last day of April to the first day of June) yearly and every year forever after so that the fish shall not in any manner be the least hindered or impeded in their Running or passing to the Ponds (in the whole of the month of May) In consequence of said Dam or any obstruction occasioned thereby :


The Selectmen of the Town for the time being shall be the sole judges of what shall [99] be proper and sufficient Sluce or pas- sage ways, and the said Caleb Hunt, Eli Hayden, Josiah Vinton, Benjamin Hayden jr. Samuel M. Thayer, Jonathan Bowditch and Atherton Thayer their Heirs or Assigns shall not errect or suffer to be errected at the place aforesaid any mill for the purpose of grinding grain of any kind. and they further engage for them- selves and their Heirs and assigns to Comply with all the aforego- ing conditions, and if at any Time they shall neglect or not fully and compleatly comply with every condition aforesaid then the aforegoing Grant shall be null and void and every priviledge that the Town now has in the River or stream aforesaid, or that may be annexed thereto in consequence of the afore going vote at the time of failure or neglect, shall revert back and be the property of said Town of Braintree until they shall see fitt at a legal town meeting called for that purpose grant or dispose of the same to the said Caleb Hunt and his associates before named or their Heirs or assigns or some other person to whom the Town may see fit when assembled.

Dam a Crost the Ironwork River. The Town voted to accept of the aforegoing Report with this alteration and addition. That the time for the sluces to be opened and Kept open be struck out and that the Selectmen be the judges of what time the Sluces.

Come to settle wh Treasurer. Voted, To chuse a Committee to settle with the Treasurer at the end of the year. Then Maj". Stephen Penniman, Peter B. Adams Esqr. and Samuel Bass Esqr. was chosen.


Capt. Vinton. information concerning of Gaius Thayer. Capt". John Vinton who is one of M' Gaius Thayers Bondsmen as a Col- lector, comes forward and informs the Town that said Gaius Thayer who has been a Collector of Public Taxes for several years past is likely to fall short of the sums due to the several Treasurers and he is now in the hands of an officer on two Executions thus issued, from the town Treasurer, and he requests that the Town would direct the Assessors to demand of said Gaius his several Bills according to a Law pass, Febry. 15th. 1786, which Law being Read from the 14th Sec" to the end.

direction to the assessors. The Town Voted that the assessors be directed to consult any Gentleman learned in the Law Respect- ing the aforesaid difficulty with the Collector and to do what the law will justify them in doing without injuring the Town in any Respect whatever.


The meeting was adjourned for half an houer.


They assembled again after they had carried in their votes for Governor &c and then adjourned to the day the annual meeting in May next shall be on, at one oclock afternoon.

The Freeholders and other Inhabitants of the Town of Braintree, Qualified by Law to vote in Town affairs being assembled by ad- journment from the 4th. day of April last.


Continental Money - Voted, That the Town will sell the Con- tinental money that is now in the Treasury and the Treasurer be directed to sell it for the most it will fetch.


£1000, Raised. Voted, to raise the sum of One thousand pounds for defreying the charges of the Town the ensuing year and for paying the Debts of said Town and that the same be as- sessed on the Polls and Estates.


For Collecting of Town Taxes. Voted, to adopt the same Rules and Regulations with regard to the Collection of Taxes &c. as was adopted the last year which stands Recorded in Folº. 84.


Collectors on Conditions Seth Thayer bid of the North Parish bill a /6ª on £

Voted, to dismiss all Committees that have been chosen on the account of money borrowed of Col. Quincy.


Committee to settle with Colo. Quincy's Heirs. Voted, That the Selectmen be a Committee to enquire into the expenditure of the money borrowed of Colº. Josh Quincy in year 1775, and settle with those who have demands.

The Freeholders and other Inhabitants of the Town of Braintree Qualified by the Constitution to vote for Representatives being assembled the eleventh day of May pursuant to Legal Warrants for the choice of a Representative and to give in their Votes for a Register of Deeds for the County of Suffolk.
