1751 Novemb" 27th.
The Freeholders and others Inhabitants of ye Town of Brain- tree Qualified for voting in Town affairs being Legally assembled For ye Transacting of such of the affairs of ye sd Town ye perticu- lars whereof as they were Inserted in ye were as follows. After a Moderator chose First, To consider of ye affair of Benja. Owen one of ye Late Constables of this Town & of the report of the Comttee Last chose in sd affair, as also to raise money in ye said affair if ye meeting shall then think fit. Secondly, To consider what may be done in ye affair of ye Iron work Bridge
The meeting being opened they proceeded & chose Co" John Quincy Esqr Moderator.
Owens memorial read & Likewise ye Comttees report read The Comttee Desired to try about ye sale of sd Owens real Estate & after money in case &c The meeting adjourned &c And then, after reading ye requists of sd Owen, and the report of ye Comttee Chose in the Last Town Meeting in ye affair of ye sd late Constable Ben- jamin Owen, the Moderator put the Question whether the Comttee Last chose in the affair of sd Benja. Owens be desired to see what price the real Estate of sd Owen will sell for in present payment, and also what it may be sold for if some time may be given for the Payment thereof, and that ye said Comttee inquire & see whether the money wanted may be had, or how or on what condition, in case the said Land Dont at present sell for the money wanted in that affair, put to vote & it passed in ye affirmative, and report to this meeting at the adjournment, and then ye Moderator with the Consent of ye meeting adjournd the meeting unto Monday the Third day of Feb"y next coming at one of ye clock in ye afternoon, (to be at this place)

ye meeting met on ye adjournment Their verbal report. No person appearing to by ye sd real Estate of ye sd Benja. Owen ye Comttees report on ye money, may be had ye sum wanted £66-13 -4 Lawf" money Voted, yt ye Comttee git ye money & pay ye province Treas' & take a Discharge to ye Town, & yt they be re- imbursed both principle & Interest. Vizt untill ye Town Dis- charge ye Debt The freeholders & other Qualified Inhabitants of ye Town of Braintree being assembled by adjournment from ye 27th. day of November last past being assembled as aforesaid, The meeting being opened, Two of The Comttee verbaly then in sd meeting) reported, vizt. to said meeting, that they had given Pub- lick notice by posting up an Intention of the sale of the Real Es- tate of Benja. Owen pursuant to the Last Direction of the Town to them, viz' on their meeting on November 27th. last Past afore sd but that not any person had appeared to purchase the same. And also according to the Direction of the sd meeting aforesaid had proceeded to know where the money wanting might be had, & that

they were satisfied of the obtaining it vizt. about Sixty six pounds, thirteen shillings & four pence ye sª Comttee. signified would yet be wanting for the Gitting a full Discharge From the Province Treas- urer for the sums due to him from the sd Late Constable Benja. Owen &c & then Voted, that the said Comttee that have been Im- ployed from time to time in the affair of the sª Owen, proceed in ye behalf of ye Town to git the said sum yet wanting, vizt What shall be wanting after the Colecting of that due to the sª Owen whether rates or Debts &c and that the said Comttee be reimbursed for the money necessary, and so taken up on Interest with the Interest, they paying to the Province Treasurer the sum or sums due to him from ye sd Benja. Owen as he was Constable of this Town & Taking a full Discharge from ye sd province Treasurer to this Town.
ye sale of ye real estate also refered to March meeting. Voted, That ye sale of the real estate of said Benjamin Owen by Deed to this Town &c, be refered over to the Meeting in March next com- ing for further consideration, also.
John Georges ordr allowed A Committee in ye affair of ye Iron work Bridge also Voted, That the Treasurers acct of the ordrd now exhibited to this meeting on an ordr. from the Selectmen of this Town for the year 1748, To John George be allowed in part of ye sum or sums set to ye sª George in The List or Lists Committed to ye sd Benja. Owen Late Constable To Collect &c. & then Voted, Meas's Ebenezer Newcomb Willm Penniman & Sam11. Niles jun" a Comttee to see that something be done to ye Iron Work Bridge To secure it until March Meeting &c.

The Anniversary Town Meeting for the choice of Town officers for ye year Seventeen Hundred Fifty & two &c.
Warrants. The Freeholders and other Inhabitants of the Town of Braintree, Qualified, for voting in Town affairs being assembled on Legal warning for ye choice of Town officers & such other af- fairs of the said Town the Perticulars whereof as they were In- serted in the warrants were as follows, vizt. after a Modr chose.
First, as above said to Chuse Town Officers.
Secondly, To Here the request of any of ye Late Constables of this Town or of any (other person) of the Inhabitants of this Town in the affairs of their rates &c.
Thirdly To consider of Chusing a Comttee Committees as ye Town shall think fit, also to hear the reporte of any former Com- mittee if any may be offered.

Fourthly, To consider what may be done in ye affair of the Iron work Bridge. Fifthly, To consider what is proper further to be done in ye affair of the sale of ye real Estate of ye Late Con- stable Owen, that has Lately been sett over to the Town.
Moderator chose The Modr & Clerk, both took ye previous Oaths. And the Meeting being opened they proceeded & chose

Maj' Joseph Crossby, Moderator. And then proceeded to chuse a Clerk & then Voted, Richard Faxon Clerk, after which ye Mod- erator and the said Town Clerk each took ye previous oath &c
Selectmen to be chose Two in ye in ye middle & one in ye South pret Chose for Selectmen Lt. Jnº Adams, Lt Richard Brackett, Mr Sam11 Niles Jr (Dea) Sam11 Bass & Ens" Thos Allen And then Voted, That there be two Selectmen chose in the North pret and two in the Middle pret. & one in the South pre- cinct, the Votes bes, collected it appeared that (Dea. ) John Adams, L' Richard Brackett, Mr. Sam11. Niles jun". Ens" Thos. Allen & (Dea) Sam11. Bass, were Chosen, sª Adams, Bass, & Allen, then took ye said previous oath.
Constables chose And then went on that of Chusing Consta- bles & when ye votes were Collected & sorted it appeared that Nathaniel Thayer, Benjamin Cleverly & John Clark were chosen, sd Jnº Clark then Presenting his Brother Sam11 Clark to the Meet- ing For their acceptance to serve as Constable in his room.
Sam" Clark accepted in ye room of his Brother Jnº Clark wt ye provision yt he give Bond to ye Town to Indemnify ye sd Town & giting full discharges from all the Treas's. Voted, that the said Sam11. Clark be accepted to serve in ye office of Constable in ye room of his brother John Clark provided that the sd John Clark become Bound to Indemnify ye Town From any Damage or loss that may be sustained by ye neglect or failure of the said Sam11. Clark's faithfull performance of Discharging His Duty in said Office, and paying in the full sum and sums of all such rates or assessments as shall be committed to him to Collect & pay in unto ye Province, County, Town, and Precinct Treasurer's and each of them as he shall Be Directed by his Warrants Lawfully execu- ted, & taking Full Discharges there of, of each Treasurer respec- tively.
Sª Clark y" took ye previous oath. & then ye sd Sam" Clark took the previous oath as by Law Directed whh I think is no mistak.
The Committee heretofore Imployed in ye affair of ye Late Con- stable Owen Directed & Impowered to make sale of said real estate &c Voted, That ye Committee heretofore Imployed, vizt Some time since In behalf of this Town to Transact the affairs between the sd Town and the Late Constable Benjamin Owen pro- ceed to make sale of the real Estate of the said Late Constable Benja. Owen (by Deed of sale sett over to this Town) as by rela- tion thereto had may at Large appear) vizt that the said Comttee namely Joseph Crossby Esqr. Meas's. Willm. Penniman & Sam" Niles jun". have a Discretionary power to sell & Dispose of the said real Estate, For the payment of the money Borrowed, vizt. ordered to be Borrowed to pay the province Treasurer, (see page 147 back) They accounting withi ye Town as soon as may be of their proceedings and Giting a discharge from ye said province Treasurer, as aforesaid &c.
The meeting adjourned And then the Moderator with ye con- sent of the Meeting adjourned the meeting unto Tuesday the

mett on ye adjournment. Voted ye rest of ye Town be chose by hand votes A Negative vote on ye Chusing but one Surveyor of Ways - & then Voted, two in each precinct. The Freeholders and other Inhabitants being assembled by adjournment from the 2ª. vizt second day of this Instant March, & then mett, Proceeded & Voted that the remaining officers be chosen by hand vote & then on a Motion made unto sd meeting that but one Surveyor be chosen for the present year after some Debate put to vote, & it past in ye Negative, & then voted that two Surveyors be chose in each precinct.

To the meeting for their accept- ance, The sd Nathaniel Thayer Giving in his Bond pursuant to the proviso Voted, to be as afore sd. (See page 148) back, and then Voted, That the .sª Ebenezer Thayer Jun be accepted to serve In ye office of Constable this present year in the room of ye said Nath1. Thayer : John Clark also appearing & giving in his bonds also to the Town, his brother Sam11. being accepted on the sd proviso (see sd p 148) Benjamin Cleverly, also, appearing, chosen on ye second of This Instant March, (see also sª p. 148) all vizt Cleverly, Clark, and Thayer jun' all took their oaths to ye office of Constables for ye present year, vizt sª Ebenezer Thayer jun. Voted, That Joseph Hayward a late Constable of this Town be allowed one pound one shilling & four pence Lawfull money in the rates to Him due from his Brother Benja. Hayward since Deceasd.
also Aaron Hayward allowed. also Deering Spear allowed &c - Voted, That Aaron Hayward be allowed three shillings, seven pence L. M. due to him on ye rates by him to be collected of ye Benja. Hayward jun.
Voted, also, that Deering Spear a late Constable be allowed Eighteen shillings & sixpence, three farthings 7 tenths Lawf" money due to him on Rates from the said Benja. Jun &c. also
Voted, that the said Deering Spear be allowed of the rates due to him from one John Prat, nine shillings, eleven pence one eight tenths farthings, Lawful Money.

Voted, That the Leases now to made on the Town's Lands, be for seven years term, and then nominated & Seperately. Voted, Meas's Jos. Crossby, Ebenezer Thayer, Benja. Beal jn' John Ruggles & William Pennimau be a Committee Impowered to Lease out the Town Lands for ye sd term of seven years To come commencing from ye first day of this In- stant March, & as To fencing or planting any part yt to be left to their Discretion viz They Determining about ye fence & Lim- iting ye affair of planting, viz. the above said Comttee &c

A Committee in ye affair of ye Iron work Bridge Heretofore so called Voted, vizt. a Comttee in ye affair of ye Iron work Bridge (who were by a Script of their names returned to me) as follows vizt. Measrs. John Quincy, Joseph Crossby, Ebenezer Thayer Richard Thayer, Ebenezer Newcomb Jonathan Allen, Samuel Niles jun William Penniman & Richard Faxon, that ye above sd Comttee be Directed to goe and view said Bridge see whether it be best to Build with stone or timber & when & where & report to ye Town their Judgment thereon.
' 1752 May 18th.
A Representative being chose by Votes, but, Decling to take ye oath appointed by law &c The meeting proceeded to another choice. & then John Ruggles, chose Representative, & took ye sd oath Pursuant to a precept Directed to ye Selectmen of this Town of Braintree, and their Warrants to ye Constables : The Freeholders & other Inhabitants of the sd Town, Duely Qualified having had Legal warning) and being (legaly) assembled, pro- ceeded. The Select Men called for their Votes for a Representa- tive which when Collected & Sorted it appeared that Sam11 Niles jun". was chose, who some Debate in said meeting, was called on to take ye oath injoyned By Law, Respecting the Bills of Credit of Conneticute New Hamshire & Roade Island, vizt the law made

in Seventeen Hundred & Forty & eight &c. But when ye oath was urged, the said Niles, Declared to sd meeting that he should not take the said oath as it stood in ye act or Law &c the said meeting proceeded to an other choice, ye Votes being called for and Collected & sorted it appeared that John Ruggles was chose representative, who appearing to the said oath.
1752 May 18th.
The freeholders and other Inhabitants of ye Town of Braintree, Qualified For Voting in Town affairs being Legally assembled for ye Transacting of such affairs of sd Town, the perticulars whereof as they were contained in the warrants were as follows. (After a Moderator chosen) First To consider of raising money to Defrey the Necessary charges of this Town &c
Secondly, To consider of some proper method to order ye School or Schools more to ye advantage of ye Town in General if it may be.
Thirdly, To consider whether there may be any occasion of any- thing further to be done in ye affair of the Iron work Bridge (so called) and to chuse a Comttee in that affair if need be.
Fourthly, To consider of granting Liberty to move the Town way up ye stream by Whare The old Forge Stood on John French's Land, for ye convenience of building a Bridge on less Charge &c
Fifthly, To Consider of Supplying any vacancies in any of ye Town Offices if any of Those chosen at ye Town Meeting in March last, fail.
Moderator chose -The freeholders &c assembled as aforesd proceeded and chose L' Col Wm Hunt Moderator.
& then Voted, That ye article of raising money to Defrey Town Charges &c be refered over to August meeting.
The Grammar School To be in ye North pret a Comttee to ord' ye School in ye Middle pret ye South pret to draw their part. also Voted That the Grammar School he ordered by the Selectmen & be in The North precinct ; & that the school in ye Middle precinct be ordered By a Comttee to be chose in said Mid- dle precinct ; and that ye South precinct Draw a proportionable part of the School money & then (Seperately) Voted, That Meas's. Sam" Niles jun'. Willm. Penniman & Jnº Hayward be a Comttee to order ye school in ye Middle precinct, and then Voted That the remaining affairs in the warrants, be referred to ye adjournment of this meeting : and then the Moderator with ye consent of ye meet- ing adjourned ye said meeting unto Fryday the Twenty second day of May currant, at two of ye Clock in the afternoon at this place.

For the Transacting the remaining affairs in the Warrants for calling the meeting held on ye Eighteenth day of this Instant May afore said vizt the two per- ticulars concerning Bridge &c. & then proceeded & Voted, That the Town way over the River in John French's Land, by where the Forge Lately stood, be moved up the streem There as may be convenient for the building a Bridge on less Charge said John French being then in ye meeting consented thereto.
The Comttees report accepted with ye amendment. entered on ye same. Voted, That the Committees report (of their judgments in ye affair of Building a Bridge over the River (Called) the Iron work river be accepted with the amendment entered under on ye same reporte
The Comttee Directed to see sd Bridge Built &c Voted, That a Comttee be chose to see said Bridge usually called the Iron work Bridge) built and well Done & at the Cheepest Lay or price that it cann be Done for by any that shall appear, after Publick & Sea- sonable Notice given to any (or all) Persons whatsoever, they doing it as & in place where the sd Comttees Reporte (Brought into & read & accepted by this meeting) Directs, with respect had to ye amendment, thereon entered under sª reporte.
The said Report being as follows.
The Comttees report, as it was returned to ye Town meeting assembled on sd May 22d. 1752. Whereas, we ye subscribers were appointed a Comttee by ye Town at their meeting upon adjournment March ye tenth seventeen Hundred Fifty & two, To view ye Iron work Bridge & to Reporte to ye Town our judgment there upon, accordingly we have carefully viewed the same, and are of opinion that ye town build a New Bridge as soon as may be, and that ye old Bridge be kept up till ye New one be built, and that ye New one be built in ye manner Following, vizt That ye said Bridge be built all with stone. That is to say begining on ye South east side butment or Headwork partly, upon or with the slate Rock joyning The old Bridge & partly upon ye wharfage of ye old Bridge & so across ye River North west over ye highest part of ye falls or Slate Rock at ye bottom of ye River with a middle pillar upon ye same six Feets wide or more, & Twenty feet Long, To be built all with Large flat quine stones & so sharp Like a wedge upon ye upper end or South west end of the same, & that ye two passages for ye carrying off The water be 7 feet wide if stones can be gotton, Large enough for The Covering if not then) six feet wide & seven in Height And that ye front and sides of ye abutments be built all with Large Choice Stones, & that ye middle be filled with a smaller and that ye abutments, be as wide at bottom as shall be thought proper, & that ye top of said Bridge When compleated as above be fifteen feet wide, & such a Height as shall be thought best & that this affair be under the Direction & Inspection of a Comttee that ye Town shall think proper to appoint for that purpose &c.

Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualified for voting in Town affairs being assembled on Legal warning for ye Transacting such affairs of ye sd Town the perticulars whereof as they were Inserted in the warrants were as follows.
First, To bring in their valuations of all their Pols & other Ratable Estate To the Selectmen.
Secondly, After a moderator chosen To consider of raising money To Defrey ye Necessary Charges of ye sd Town, (also respecting the charge of ye Iron work Bridge &c).
Thirdly, To consider of Disposing of the Town Cows if it may be more For ye advantage of ye serving ye end Designed &c
Fourthly, To consider of chusing a Comttee or Comttees in any of the affairs that may concern the Town, also to here the report of any Comttee heretofore Chosen by the said Town (if any be) to be offered by them.
Moderator chose. Firstly, Being Legaly assembled as above said & the valuations called for. Secondly, the meeting pro- ceeded & Chose L' Co" Wm Hunt Moderator.
Two hundred & sixty six pounds, thirteen shillings & 4 pence £260=13-4 Thirdly, Voted, That (Two Thousand Pounds old tenor that is to say) two Hundred sixty & six pounds thirteen shillings & four pence Lawfull Money, be assessed on the Pols & other Estates of the Inhabitants of this Town to Defrey Town Charges &c
Voted a Committee be chosen to petition in ye affair of ye Bridge. Fourthly, Voted, That a Committee be chose to Petition the General Court that Bridge (called Iron work Bridge be made a County Bridge.

1753 Feby 26th.
The Freeholders & other Inhabitants of the Town of Braintree That are Qualified for voting in Town affairs being assembled on Legal warning for the Transacting such affairs of the sd Town, the perticulars whereof as they were Inserted in the Warrants were as follows. After a Moderator chose First, To receive ye report of ye Comttee whh was Chose and Impowered by sd Town To Dis- pose of Stones from (& to inspect & prosecute Trespassers on ye Lands) Towns Commons.
Secondly, To make such addition to sd Commttee as may be thought necessary or proper
Thirdly, To Impower sd Comttee to use & Improve so much of ye Towns as is or may be in their hands (& necessary) to prosecute in ye Law such as have or may Trespass on sª Common, or that may neglect timely to pay ye duty laid on said stones sold by sd Comttee, or that have neglected to pay said Duty to ye above sª Comttee .
Fourthly, To consider of and resolve upon ye price of stones) if ye Town shall think proper, as also to grant ye Comttee as much power in all respects, with respect to the management of sd Com- mons, as was Granted to them at ye Town meeting Augt 14th. 1749, (unless the Town shall see fit to set ye price on ye stones to be sold.
Fifthly, To chuse & authorize a Comttee to establish ye lines round each common, with the proprietors thereto adjoining.

Moderator chose. The Freeholders & other Inhabitants being assembled on Legal warning they proceeded & chose L' Co11 Wm Hunt Moderator.
Firstly Voted, That ye report now read be accepted vizt put to vote and it past in the affirmative, Secondly - and then the Moder- ator Put the Question whether there shall be an addition made to the Comttee put to vote & it past in the Negative.
Thirdly And then the question was put whether the sd Comttee shall be Impowered to use and Improve so much of ye Towns money as is or may be in their (necessary to prosecute in ye Law, such as have or may Trespass on sª Common, or that may neglect timely to pay the Duty Laid on sd stones sold by sª Comttee, or that have neglected to pay said Duty to ye above said Comttee put to vote & it past in ye affirmative.
Fourthly-And then the question was put whether the Comttee shall set the price on the stones in the Common that they shall sell &c. put to vote and it passed in tlie negative.
