Comttee Respecting the way thro Thomas Farm their Report. The Comttee appointed to view the way thro' Thomas Farm so called made an oral Report to the Town to this purpose (viz) That the way laid thro Thomas Farm so called by the Selectmen (which Return of the Selectmen see Recorded at the close of this meeting) be accepted by the Town, Provided the Town should not be charged for a Bridge over the Brook, called Sedar Bridge.
Bridge to be built exclusive of charge to the Town. Then Sam11. Niles Esqr. declared in the meeting in behalf of himself & Neighbours that would be accommodated by said way that he would promise and engage the Town should be at no charge for a Bridge at said Brook but that a good stone Bridge should be built at said place and maintained for twenty years free from any charge to the Town.
Way accepted with conditions. Then Voted the way thro

Thomas Farm be accepted with the conditions offerd with the Return which stand with the Return Provided the Town be ex- empted from charge for the aforesaid Bridge for the Term of Twenty years next, commencing, and said way not to be laid open untill the first of May next.
Comtee to let out the Wall. Then Mr. Caleb Hobart, Mr. John Hayward & Mr Thomas Vinton were chosen a Comtee to Lett out the Wall that was to be made by the Town as Stipulated in the agreement with the Proprietors of said land and Referd to above, to such person or persons as would engage to effect it the cheapest between this & the first of May next.
adjourned. The meeting voted adjourned to Monday the Twen- ty seventh Instant at four o Clock P.M. at this place.
Way thro' Josiah Ruggles Land. The Returns of the Select- men of ways laid out are as follows, (viz) agreable to a Request of sundry of the Inhabitants of the Town of Braintree made to us the subscribers, We proceeded to Lay out a Town way and began at the way that Leads from Bridgwater Road to Mr. Ather- ton Wales in Stoughton bounded by a heap of stones on each side of said way. Thence on the South side of an old Hedge fence to a stump with stones on it standing on the south side of said way. Thence to a black oak tree Blazed on the North side. Thence to a White Oak tree Blazed as above. Thence to the North-East Corner of said Waless feild on which said Wales' Barn Stands, all which way is one Rod & half wide, and by said Wales offered to the Town for their acceptance.

Pursuant to a Request made to us the subscribers by a number of the Inhabitants of the Town of Braintree We Proceeded to Lay out a Town way beginning at Bridgwater Road near the great stone Bridge where the way has been many years used. Thence as the way goes to M' John Hollis® Gate post, standing in his west line. Thence to an old black oak stump. Thence to a Shelving Rock. thence to a Large Shelv- ing Rock (the said bounds being on the North side of the Road) thence to a small black oak tree markd. thence by several stakes said tree & stakes being on the South side of the Intended Road to a small stake standing in the course of the Line between Mr John Ruggles Land & Mr. John Hollis Land. Thence on said Line to said Ruggles Land. Thence half on said Ruggles and half on said Hollis to Mr. John Thomas Land. thence half on said Thomas & half on said Hollis to the Eastermost Line of said Hollis Land. thence thro said Thomas Land straight with the Last mentioned Line near about 77 Paces. Thence to a pair of draw barrs across an old way leading from Hobart Sedar swamp (so called) to said Thomas® House. Thence thro said Thomas Land where the way now is used to M' William Salsbury's Land and thro' said Sals- burys Land where the way now is used to the Iron work Road (so

called) said Road to be one Rod & half wide thro the whole of said way excepting about five Rods near M' William Salsbury' Dwelling House at which place it is agreed to be but one Rod wide by reason of some small apple trees belonging to said Salsbury, all which is Humbly submitted by.

Rods. of stone wall fence on said way thro the said Hollis Land and that the Town make a stone wall fence on one side said way from the Brook to the westward of said Thomas House to sd Salsbury's Line thro said Thomas' Land and that they make Twenty Rods of stone wall fence on said way thro said Salsbury's Land

Warrants. The Freeholders & other Inhabitants of The Town of Braintree being assembled at the new meeting House in the Middle Precinct of said Town on Legall warning to Transact the affairs of said Town the Particulars whereof as Inserted in the Warrants are as follows (viz) After a Moder' chosen.
First, To give in their Valuations to the Selectmen.
Secondly, To Raise money to defrey the charge of the Town the currant year
Thirdly, To see if the Town will allow the South Precinct to draw their proportion of School money as usual.

The Anniversary Town Meeting for the choice of Town officers March 3ª. 1760.
Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualifyd by Law for voting in Town affairs being assem- bled at the meeting House in the Middle Precinct of said Town on Legall warning to Transact the affairs of sd Town the Particulars whereof as Inserted in the Warrants are as follows (viz) After a Modr chosen
First, To choose all such Town officers for the ensuing year as the Law directs, also a County Treasurer.
Secondly, To consider & Determine upon Petitioning the Gena Court for the Division of the County of Suffolk.
Thirdly, To consider & Determine upon Removing the School House in the North Precinct & better Regulating the Schools in said Precinct.
Fourthly, To consider and Determine upon building a House for the Town to meet in to manage business of a secular concern in.
Fifthly, To Choose a Committee to settle with Elisha Niles Town Treasurer, as to the State of the Treasury, and also to con- sider what allowance he ought to have for his said service.
Sixthly, To make answer to a Petition of the Town of Dorches- ter now in the Gen11. Court Praying the Bridge over Neponset River (so called) should be a County Bridge.
Seventhly, To appoint some meet Person to Inspect & shift the Towns stock of Powder and do what the Town shall think proper concerning the House where it is now reposited
[200] Eighthly, To choose a Committee to take care of the wood on the Land called the Town's Commons, or direct the Com- mittee appointed for that purpose in that affair and also to consider whether it will be advantageous for the Town with the consent of the Leasees to lease out all the wood on said Lands.

Voted, the Selectmen be directed to Exchange the Towns stock of Powder, & take care of the same.
Powder to be directed by the Selectmen. Luke Lambert, ac- cepted Constable. Mr Thomas Vinton Constable Elect Presenting Mr Luke Lambert, to the Town to serve in said office in his stead, Voted, the said Lambert be accepted, Provided the said Vinton give bond, to the Town for his the said Lamberts faithfull dis- charge of said Trust.

The Freeholders & other Inhabitants of the Town of Braintree, Qualifyd. by Law to vote in Town affairs being assembled by ad- journment from the 3ª of March last &c After a Debate Respect- ing Mr. Thomas Vintons not fulfilling his obligation to the Town by giving Bond for Lambert® faithfull discharge of the office of a Constable, Voted, That the Town proceed to the choice of a Constable for the middle Precinct of said Town. The votes being Collected for a Constable Mr. Thoº Vinton was chosen. Then Daniel Baxter was nominated & Chosen a Surveyor of Highways.
Constable Accepted. Voted, William Spear be excused serving constable this present year. Then Elijah Vesey was chosen a Constable for the North Precinct & Jonathan Wild was Nominated & Chosen a Surveyor of Highways. William Linsfield Presenting Jonathan Bass to serve as Constable in his stead, Voted, said Bass be accepted, Provided the said Linsfield give Bond for his the said Bass faithfull discharge of said trust.
Then John Bowditch was chosen a Hoggreave & refused serving. Then Thomas White, Elijah Thayer, Sam11. French 3rd & Jesse Wild were chosen Hogreaves
School House removed Voted, That the School House in the North Precinct be removed nigh the ten mile stake to be placed in the Road as convenient as may, Provided it be Removed clear of any charge to the Town.
Comttee to Inspect the Comons Voted, Capt. Benja Beal, Mr Peter Markquand & Mr. Caleb Hobart or either two of them be a Committee to Inspect & prosecute all Persons that have or shall tresspass, on the Lands called the Town's Comons by cutting wood on said land.

[202] Voted, That there be a premium paid out of the Towns Treasury on the Heads of black Birds & Red or Ground Squir- rells, that may be killed within said Town from the 20th. of May Inst to the 20th. of Sept". next (viz) Two pence for old ones & a penny for young.
Voted, That the widow Elizabeth Arnold be allowed a draw back from the Selectmen for two years Taxes.
Voted This Meeting be adjourned to this day seventh 4 o'clock P.M. at this Place.

Voted, Moses Adams be excused serving Constable this present year.
Voted, John Holbrook Jun' be excused serving Constale this present year.
Voted, That the vote passd on the 26th. of May last Respecting Mr. Thomas Vinton being excused serving Constable this present year be Reconsidered and null.
Then the Votes being calld. for Constables, James Clark & Thomas Vinton were chosen.
Then the Meeting was adjourned to the day & Place the meeting should be appointed in august next, and to be before the sd meet- ing.

Ministry Lands The Freeholders & other Inhabitants of the Town of Braintree being assembled at the Meeting House in the middle Precinct of said Town to know the minds of the Town Respecting the Lands sequestered to the use of the ministry wheth- er the Town now concur with or dissent from those acts of the Town Respecting that affair, the Articles of said Warrants being Long & nothing acted thereon they are not carried into the Book, but lodgd. in the Clerk's office.
The seventh Article in said Warrant, To Hear and act upon a List for Jurymen prepared by the Selectmen and to be laid before the Town Pursuant to an act of the Gen". Court.

Voted, James Clark be excused serving Constable this present year. Then William Savel was chosen Constable and afterwards excused this year
Then, Joseph Field & David Holbrook, Jun'. were chosen Con- stables.
Comttee Report respecting the Treasury. The Committee for setling the Treasury made their Report, to the Town Respecting the state of the Treasury which Report as it stands Inserted on the Treasurer's Book was voted accepted vide Treasurers Book Voll 11 Page 92, 93.
The aforesaid Comttee made Report to the Town Respecting an affair of Capt. Clark.
Braintree Augst. 21st. 1760.
Respecting Capt. Clark. We being appointed to examine into & consider a difficulty subsisting between Capt. Sam11. Clark & the Town Treasurer having enquired into that affair it appears that Capt Clark by a mistake was charged to the present Treasurer £2 =3 = 7 more than he ought to have been and that it is our opin- ion on the present circumstances that the Town allow said sum to be discounted with said Clerk by the Treasurer.
Joseph Crosbey, Comttee Thomas Wales.
Treasurers allowance. Voted, the said Report be accepted and the Treasurer be directed to discount the said sum of £2 == 3 == 7 with said Clark.
£2 = Then the aforesaid Comttee offerd. a verbal Report respect- ing the Treasurer's allowance, (viz) that they had considered the said service and that they judged him worthy of Forty Shillings + year for the same, which was voted accepted and the Treasurer allowd forty shillings a year for his past service.
Adjourned. Then the meeting was adjourned to monday the 1st. of Sept. next 4 o Clock P.M. at this place.
1760 Augst. 25th.
Meeting Dismistd. . The Freeholders & other Inhabitants of the Town of Braintree being assembled to Transact some affairs of said Town made choice of Coll. Josiah Quincy for Modr. but disputing the legallity of Luke Lambert's service of the warrant for assem-

Warrant. The Freeholders & others Inhabitants, of the Town of Braintree Qualifyd by Law to vote in Town affairs being assem- bled at the Meeting House in the Middle Precinct of said Town on Legal warning to Transact affairs of said Town, the particulars whereof Inserted in the Warrant for calling said meeting are as follows viz. After a Moderator chosen, &c.
First, To raise money to defrey the charge of the Town the currant year.
Secondly, To hear the request of Mr. William Penniman Jun'. respecting an allowance for making wall on the new way thro' Thomas® Farm (so called) and act thereon.
Thirdly, To consider off and Determine upon some more ef- fectual method to remove the obstructions in the Rivers which pre- vent the fish at the proper seasons going into the Ponds.
Fourthly, To choose one or more Collectors of Taxes as the Town shall think proper.
Moderator. Being assembled as aforesaid choose Capt Thomas Allen Modr.
Money raised. £60 - Voted, Sixty Pounds be assessed on the Polls & Rateable Estates within said Town the present year.

John Hayward, James Thayer & Jonathan Thayer be a Committee to Remove the obstructions that prevent the fish going into the Ponds, also voted said comttee be allowed six pounds out of the Town Treasury to be improved for that purpose where they shall judge it most beneficial and that they make report to The town of their proceedings in that affair at their meeting in March next.

Benja Baxter excused. Voted, Benjamin Baxter be excused serving Constable this present year.
Jedidiah Bass, Constable. Constables allowance. Then Jed- idiah Bass, & Samuel Arnold be allowed forty shillings, each out of the Towns Treasury for serving in the office of Constable.

Then Elisha Niles was Nominated & Chosen Clerk.
Then the Town proceeded to the choice of Constables, as fol- lows, (viz) Moses Adams & David Holbrook Jun'. were separ- ately chosen. The said Holbrook appearing and asking the Town excuse for this year, with a Promise of serving another year if he should live, and the Town should choose him, he was excused serving this year.
Then Thomas Vinton was chosen who paid his fine.
Then Ephraim Jones, was chosen who made the return to the

Then Noah Whitcomb was chosen who presenting Jonathan Bass to serve in said office in his stead, voted, said Bass be ac- cepted provided said Whitcomb give Bond to the Town for his the said Bass faithfull discharge of said Trust and the said Whitcomb gave Bond accordingly.
