Voted, to take under consideration the Report of the Committee who ware chosen at their Last meeting, to consider of a Late act of the General Court respecting the due observation of the Lords day.


The said Report having had two readings in open Town Meeting, the Town Voted their approbation and acceptance of the same.


The Committees Report is as followeth viz.


That it is the humble opinion of your Committee that a strict and religious observation of the Lords day is one of the greatest caractersticks of a Christian People, that the supreeme monarch of the Universe hath an indisputable Right to ordain Laws binding all his rational beings in an absolute Soverign manner, that this Great Governor of the world, hath revealed to man, that he hath made a special Reservation of one whole natural day out of seven for himself, which (according to the sacred Scriptures and the confesion of the most Learned part of the world) consists of

twenty four hours, wherein all our secular consearns ought in the most desent and devout manner be folded up to give way to the more important service of divine worship and adoration, and all our Laws and conceits of things ought to be regulated by scripture and not according to the Philosophy of the heathen or the super- sticious opinions or traditions of man and when the Laws of any Kingdom or State cooperate with and are agreeable to the Com- mands of the Great Law giver, then and only then may such com- munetees expect to enjoy divine favours and blessings prosperity in this and eternal happiness in a future state of existance, your Committee acknowledge it was surprizeing to them that our hon- ourable Court should at this day when we are just amerging from the horrors of a most barbarous and unparraled war curtail a part of the forth Commandment by tolerating secular concerns or Ser- vile Labour to be carried on six hours of the same to the great disturbance of every sober and Consciencious Person in this State for no other Reasons saith the Honourable Court than that because their a defirant opinions among the sober and Consciencious Per- sons of the same, Concerning the commencement of the sabath and lest they should be thought to lay unnecessary restrictions on the subject [6].


A very slender excuse indeed to whom ought we to hearken to the Great Governor of the world or to the Voice of the sober and consciencious People, a semmilar excuse once was given by a King of Gods antient People for his disobedience of a special com- mand because he feared the People but the inspired Profits In- trogative Answer was hath the Lord as great dilght in burn offerings and sacrifice as in obeying the Voice of the Lord behold to obey is better than sacrifice and to hearken than the fat of Rambs. We cannot conceive that the diference of of opinion or the fear of the People ought to cause an abolition of that sacred command ye fourth Commandment but that it ought to have it due extent at one end or the other, perhaps in some future day this sober and Consciencious party may request an other part of six hours more to be abolished and so on, untill that Great and most Interesting command becomes null and void, not by the traditions of men, but by the Law of the state, to draw to a close in as concise a manner as a thing of so great weight and Importance will admit of your Committee are of opinion that a Remonstrance be preferred to the aforesaid honourable Court when assembled that there may be a revision of and amendment of the above cited Law that their be no part of the fourth Commandment abolished by Law but that it may have its full extent as revealed to us in the Sacred Scrip- tures that thereby the Blessings of him who hath ever held an holy jealousy over his Sabath may decend on this Continent and on every State of the same is the sincere wish of your Committee

Surveyors. to Collect highway Tax. Voted, that the Sur- veyors of highways be impoured to Collect the highway tax Lay the same out in Repairing the highways and account with the Selectmen at the close of the year and that each surveyor have a. Warrant with his List that he may Collect the money from those who refuse or neglect to work out their Taxes. (This vote was. past on the Second day of the March meeting & was overlooked in ye minutes.

Moderator. The Inhabitants of the Town of Braintree being assembled, upon their annual March meeting warrant) by adjourn -- ment from April the seventh, Made choice of Thomas Penniman Esqr. Moderator in the Room of Decon Sam11. Holbrook who was. absent.


Constables dismissed. The Town then Voted, to dismiss all the Constables that they have chosen for this Present year.


to hire Collectors. Voted, to hire Collectors to Collect the Taxes that may be assessed upon the Town the Present year.


Voted that the assessors Lett out the Collecting of the Taxes. this present year at public auction, to be collected by those per- sons that will undertake the same at the lowest price and that all the Taxes that shall be to collect within the year shall be Let out. at one and the same time, and to the same persons upon condition that each collector give Bonds to the Town with good Bondmen to. the acceptance of the assessors, Previous to their receiving the Taxes to discharge themselves in sª office

Hayden's Petition Committee. Voted, to choose a Committee to consider of a petition of Stephen Hayden and report to the Town. Voted, that Capt Peter B. Adams, Moses French & Thomas Penniman for that purpose.


Committee of Safety. Voted, to add six persons to the Com- mittee of safety two in each Precenct the Town then made choice

June 2ª.


The Inhabitants assembled by adjournment from May 16th. and made choice of Decon Samuel Holbrook Moderator in the Room of Thomas Penniman Esqr. who was absent. Mr. Samuel Bass secd was chosen Selectman in the room of Ensign Isaac Spear who refused to serve.


Voted, to choose a Committee to Petition the General Court for a releas of the fines Laid on this Town for their deficiency on ac- count of three years men and also of three and five months men.


The Town then made choice of Capt. Peter B. Adams, Decon Samuel Holbrook, Colo". Jonathan Bass, Capt. Joseph Baxter, Maj Stephen Penniman and Mr. Joseph White for said Com- mittee.


The Town then mad Choice of David Linsfield Jun". Thomas Wales, & Lt. Jacob Spear to serve as Surveyors in the. South Precenct in addition to those already chose.


Voted, to reconsider the vote Respecting the Surveyors Collect ing the Highway tax.


Voted, That the several Surveyors within this Town work or cause to be worked out upon the Highways the whole of the Taxes Committed to them, and that the Surveyors, return to ye assessors of all deficiencies by the first of November next and that the Sur- veyors be paid as usual.

Hogreaves. The Town Voted to excuse Thomas Belcher from serving in the office of Hogreave this Present year, and the made choice of Ebenezer Pratt to serve in his Room.


Nath" Holbrook, Collector. Voted, to except Nathaniel Hol- brook as a Collector in the Room of Capt. John Vinton he giving Bonds To the acceptance of the Selectmen in manner and form as was required of Capt Vinton.


Voted to adjourn this meeting to the sixteenth day of this In- stant June at four O'Clock P.M. at this place.


We the subscribers a Committee Chosen by the Town to exam- ine The former Selectmens accounts and also to settle with them for the money they Borrowed and Received for the Town have met several times for that purpose and upon examination the Selectmens Book, and other Papers we find that the money they Borrowed and Received in the year 1780 amounts to Twenty five Thousand three hundred and eighty five Pounds Sixteen Shillings the money

they account for amounts Twenty three Thousand and Twenty six Pounds sixteen shillings, Including the milage paid the three and six months men the Balance unaccounted for amounts to Two Thousand three hundred and fifty nine Pounds Old Currency their is also a Ballance of Eleven Pounds four shillings in hard money Borrowed in the year 1781 not accounted for the money they Rec'd for milage they supposed the Town had the benifit of

Before the adjournment Voted to except the above Report Voted to Choose a Committee to enquire after the money not accounted for in the above Report and also what has become of the money Borrowed of Colo11. Josiah Quincy which was Received in hard money by the Selectmen. Capt Joseph Baxter Capt Silas Wild and L' Nath11. Niles ware chosen for said Committee.


The meeting stands adjourned to the 16th. Instant 4 o'clock P.M.

Anno Domini 1783. Anniversary March meeting Continued by adjournment.


The Inhabitants being assembled by adjournment from June the second Made Choice of Mr Azariah Faxon, Moderator in the Room of Decon Sam11. Holbrook absent.


Treasurers directions. Voted, That the Treasurer issue Execu- tions against all the Collectors for town Taxes that are delinquent and that have not settled their Collections with the Treasurer by the first day of September next those for the year 1782 and those for the year 1783 excepted.


Voted, to excuse Thomas Wales from serving as a Surveyor of Highways this present year.


Then made choice of Edward Faxon to serve as a Surveyor of highways in said Belcher's Room.


Fence Viewers. Fence viewers were chosen on the 10th. of March but was overlooked in Recording that days work.

May 16th.


The Inhabitants of the Town assembled by a legal Warrant for the purpose of electing one or more sutable persons to Represent them in the Great and General Court or Assembly of this Com- monwealth this Present year.

Anno Domini 1783.


The Inhabitants of the Town of Braintree assembled at the meet- ing House in the middle Precenct, in said Town by a Legal war- rant the particulars whereof are as follows.


First Article. First, After a Moderator chosen To consider of and determine what sum or sums of money may be necessary for the Town to raise for their use this present year to discharge debts necessary charges &c.


2ªly, To hear the Report of any Committee or choose any that the Town shall think Proper when assembled.


3dly, To act upon any other matter or thing that the Town may think proper when assembled.


Assembled as aforesaid.


Moderator Made Choice of Majr Seth Turner for a Moderator.


£1000- Voted, to Raise one Thousand Pounds for the Towns use and that the sum be immediately assessed.


Committee to settle with Gen11. Palmer. Voted, that Messr. Capt Peter B. Adams, Decon Benjamin Bass and Colo11 Ebenezer Thayer Jun'. be a Committee to to settle Accounts & all other matters of dispute between Gen11. Joseph Palmer and the Town and report to the Town as soon as may be.


Committee to settle with Vinton & Linfield Voted, To choose a Committee to settle with Capt John Vinton & Lt. David Linsfield upon the affairs that they the said Vinton & Linfield are now dis- puting in Law with the Town and that said Committee be impow- ered to make a final settlement provided that they can settle upon terms that shall appear to them to be best for the Town, which if they fail in then in that case for them to report to the former Com- mittee that they may for the Town defend said dispute in Law.


The Town then made choice of James Brackett, Elisha French Joseph White Jur. Moses French & Silas Wild for said Committee.


Allowances to French Voted, to allow Moses French for one four & one six dolar Bills which he took of the Collector of this town certificate money, counterfit.


To Capt. Adams. Voted to pay Capt. Peter B. Adams for 22 dollars Counterfit which he received as Collector for taxes to be consolidated from the time of his discharge from the Treasurer


To Capt. Isaac Thayer. Voted to pay Capt Isaac Thayer for one forty Dollar Bill Counterfit Rec'd for taxes to be consolidated from the time of his discharge from the Treasury.

any meathod for settling with those of the Towns Creditors who call themselves sufferers by shifting their securities with the Town upon the request of the Selectmen that the Town may advise there- on and act as they shall think proper.


Secondly, To hear the Report of any Committee or Choose any Committee as the Town shall think best.


3ªly, To act upon any other matter or thing that the Town shall proper when assembled. Assembled as aforesaid.


Moderator. made choice of decon Sam11. Holbrook, Moderator.


The Town then Voted to Choose a Committee to settle with those of their Creditors who shifted their securities with the Town and to make up to them their Loos in such a manner as they shall agree upon Colo11 Ebenezer Thayer Jur. Ensign Samuel Bass, and Maj' Seth Turner ware then chosen a committee for that purpose.


Voted, That said Committee Settle with Capt Moses Brackett in the same manner as they settle with the other Creditors.


Voted, that said Committee shall have right to draw upon the Treasurer for the payment of those persons that they shall agree with and that the Treasurer pay the orders of said Committee.


Committees Report accepted. Voted, to accept the Report of the Committee that settle with Capt John Vinton and Lt. David Linfield which report is fil'd with the Town Bond.


[14] March 1st.


Anno Domini 1784. The anniversary Town Meeting for the choice of Town Officers.


The Freeholders and other Inhabitants of the Town of Braintree being assembled at the meeting house in the Middle Precenct in said Town persuant to a Legal Warrant the purticulars whereof are as followeth (viz).


First After a Moderator Chosen, To choose all such Town Offi- cers for the year ensuing as the law requires also a Committee of safety.


2ªly, To Consider of and determine what meathod shall be persued for repairing the highways this Present year and also to see if the Town will adopt Some suitable plan for Repairing the Bridges, within This Town which have been much damaged by the late Flood.


3ª.ly, To Consider of and determine what sum of money it is best for the Town to rais for discharging of Debts and Defreying the necessary charges of the Town this present year.


4th, To see if the Town will choose a Committee to confer with the Inhabitants of Dorchester Farms and Squantum Respecting their gitting of from the Town of Dorchester and being added to the Town of Braintree and to assist them therein as the Town shall think Proper.


5thly, To see if the Town will make an allowance unto Majr Seth Turner for a debt that he received of the Town in depreciated money.


6thly, To see if the Town will pay Thomas Brackett and others

Then the Town Voted to act upon the fourth article.


Voted to choose A Committee of three persons to consult with the Inhabitants of Dorchester Farms & Squantum Respecting their gitting of from the Town of Dorchester, being added to the Town of Braintree, and to assist them.


The Honle. Richard Cranch, Capt. Peter Boylston Adams, Royal Tyler Esq. ware chosen a Committee for that purpose.


Then again proceeded to the choice of Town Officers.


Messrs. Gaius Thayer, Ichabod Holbrook and Daniel French ware chosen Constables.


Lt. Elijah Veazie, John Field, Caleb Hunt, Elisha French, Capt. Elisha Wales & Capt Thomas French were chosen Wardens.


Joseph Field, Jonathan Marsh, Capt. Lemuel Clark, Decon Samuel Holbrook, Majr. Seth Turner & Lt. Joseph Spear, ware assisers of Bread.

Voted, To Repair the highways this Present year by a tax, and that the price allow'd for a days work done and performed on the Highways shall be three shillings, Teems and utentials in propor- tion.


Voted, That each single Poll be Taxed three Shillings towards Repairing the Highways this present year and the estates in proportion


Voted, to Adopt the following meathod for mending the high- ways This present year (viz) The Surveyors in the first place to be sworn to the faithfull discharge of their duty and in case of Default to be prosecuted for their fines.


Secondly, That the Selectmen make seperate Districts To Each

Surveyor and hand them to the Assessors, and they to annex a tax to each District and commit them to the Surveyors that the Surveyor call on each Individual to do his duty, and in case of delinquency, To work out the whole tax on the ways, and make return of the delinquents to the assessors by the first of Oct" next, and to take a certificate from the Assessors, of the sum Total of delinquency for which each Surveyor is to have an order from the Selectmen upon the Town Treasurer for his pay.


This last vote was past upon the adjournment March 15th.

Alewive Committee Solomon Thayer William Allen, Adam Hobart, Jacob Allen Nehemiah Holbrook & Nathaniel French ware chosen a Committee to see that the fish called alewives were not obstructed in their passing up & down the Rivers in this Town & further to conduct that matter as the law directs.


Committee for the Channell. Lt. David P. Hayward, L' Ebenez". White, & L' William Hobart ware chosen a Committee to see that fish ware not caught in the Channel between Braintree & Wey- mouth contrary to law.


Voted, to choose a Committee to Look into the Circumstances of the Town's Lands, Fences, &c and to consider in what manner it may be best to improve the same in future & Report to the Town at our annual meeting in April next.

Committee to settle with Selectmen. Voted, To Choose a Com- mittee to settle with the Selectmen & report to the Town of the Selectmens Accounts for three years past


Mess8. Capt. Thompson Baxter, Capt. John Vinton and Maj Seth Turner ware Chosen a Committee for that purpose.


[18] Committee to settle with sundry persons, for money. Voted, to choose a Committee to settle with these Persons who now hold money in their hands that was borrowed by the Town of Colo1. Josiah Quincy.

Allowance to Capt. Newcomb. Voted, to allow Capt Thomas Newcomb to draw pay from the Treasurer for six, eight dollar Bills which he received for taxes which proved to be counterfit


Town Way. Voted, That the Cross Road from Colo11. Ebenz'. Thayer, to Isaiah Thayers be considered and Recorded to be a Town way.


Adjournment. Voted to adjourn this meeting unto the first monday in April next at nine of the Clock in the forenoon at this place.

Voted, to choose a Commit- tee of three persons to hear the request of Thomas Brackett & others who say they have not had the full Bounty promised them by the Town for their Inlisting into the Continental army for three years, Capt Peter B. Adams, Mr. Joseph White Jur. & Decon Samuel Holbrook, ware chosen a Committee to consider of the above request & to report to the Town.


Towns Land Committee. Voted, to Lease the Towns Lands for the Terme of three years, Capt Peter B. Adams, Thomas Penniman and Moses French ware chosen a Committee for that purpose.


Selectmen Committee. Voted, that the present Selectmen con- duct in the affair of those suits brorought against the Town by Capt. Joseph Baxter, & Ensign Thomas French as they shall Think best.


Royal Tyler Esqr. & Thomas Penniman Esqr. was chosen deli- gates for the Town to meet in County Convention at the House of Timothy Gay in Dedham, on the Twenty second day of April Inst. at Ten O'Clock A.M.


[19] Settlement with Gen11. Palmer. Voted, to accept the report of the Committee that settled with The Honle. Joseph Palmer Esqr. which is as followeth, (viz)
