Pursuant to the precept for the choice of a Representative &c The freeholders and other Inhabitants of the Town of Braintree assembled on Legal Warning for the choice of a Representative the meeting being opened they proceeded and chose Major Joseph Crossbey, Representative, for the present year.

ing Warned to be on the day above sª for the Transacting such other affairs of The Town, the perticulers whereof as they were Inserted in the Warrants, were as follows, After a Moderator Chosen.


First, To Consider of raising money to Defrey the Charges of the Town &c.


Secondly, To Consult & Determine what method may be most for the advantage of the North & Middle precincts Concerning a school or schools in said Precincts for the ensuing year.


Thirdly, To Consider Whether the South precinct shall draw apart of the School Money allowed for Schooling the ensuing year &c.


Fourthly, To Consider & Determine Where the Town Meet- ings shall be held for the year insuing.


Fifthly, To hear & Consider of the request of Capt Jnº Wen- dall concerning the Line betwixt the township of Braintree and Abington.


Sixthly, To Chuse a Constable in the North precinct if occasion be.


Seventhly, To Chuse Man or men in the South precinct if need be.


Eighthly, To Consider of Chusing a Surveyer or Surveyers of ways or fences if need be.


Ninthly, To Considr of Chusing a Comttee to examine into the State of the Treasury, and to report to ye Town as soon as may be.


Tenthly, To consider of the report of the Selectmen in the affair of the Line Run betwixt some part of the Towns Common lands & ye lands of Josiah Faxon


Eleventhly, To Considr of Determining about a method of warning Town Meetings


Twelvthly, To Considr of what sum shall to the Town Treas- urer &c for the time past not yet allowed for.


Thirteenthly, To Considr. & Determine in the affair of all Bonds due to the Town, Both as to the principle, & Interest, and further to Direct the Treasurer, therein, of the mind of the Town.


Moderator. The freeholdrs and other Inhabitants being assem- bled on Legal warning, the meeting being opened they proceeded & Chose Maj' Jos. Crossby Esqr. Modr.


The affair of raising money refered. And then proceeded to that of raising money to Defrey the Town Charges & after some Debate thereon, Concluded to refer the raising money to some farther oppertunity or untill the state of ye Treasury be known vizt. to August (or the next) Town Meeting


Voted one School in ye North precinct & one in ye middle pret And then Voted, that there be one School kept (the ensuing year) in each of the lower precincts, viz. One in the North precinct, and one in the Middle Precinct.


& then Voted, That the South pret Draw a proportionable part of the School Money as usual.

A Comttee chose to examine ye state of ye Treasury. Voted, That any three of the Selectmen with the Town Treasurer be a Comttee to examine the state of the Treasury, & report to ye Town at Augt. (or the next Town) meeting, & then,


A Negative vote on ye altering ye method of warning town meets8 Voted, That the line run betwixt the part of the Towns Common Land and the lands of Josiah Faxon, be accepted, viz. was Voted in the affirmative, as the same is set fourth in therr Return, sd re- turn recorded as follows, see over Leafe.

The Question was put whether some other method should be used to warn Town Meetings than that hether to used, put to vote & it passed in ye Negative.


John Mills released from being surr Voted, that John Mills be released from being Surveyor of Highways for the present year.


Moses Bracket chos" Surveyer of wayes. Voted, That Moses Brackett be one of ye Surveyors of Highways ye present year


ye Town meetings to be held at ye Middle pret Voted, That yo Town Meetings be held at ye Middle precinct Meeting House.


Jos. Pray chose hogreive. Voted, That Joseph Pray be one of ye hogreives for ye present year


ye Town Treasurer allowed &c his Desent & desire also entered Voted, That the Town Treasurer (Richard Faxon) be allowed in Lawfull money equal to twelve pounds old tenor, per year for his services in ye said office for the years past not allowed for, against which the sd Richard Faxon Treasurer of said Town Declared my Desent as a full reward for sd years & Desired that it might be re- fered to some other meeting, that might be more full, &c


The Treasurers & Selectmens ordrs to be allowed &c. Voted, That ye Selectmen's ordrs one Treasurer & the Treasurer's ordre on ye Persons Indebted to ye Treasury by bond for rent, be allowed respecting ye Interest, vizt. ye interest not to goe on after sª Dates, so far as they extend.

A negative Vote on ye raising £100 Lawfull money & then voted £80 Lawfull money for Defreying Town charges And then the Moderator put the Question Whether one hundred pounds Lawfull money shall be raised towards the Defreying the charges of sd Town, this present year, put to vote and it passed in the Negative, and then Voted, That Eighty pounds Lawfull money be assessd Towards the Defreying the Town charges, &c


Voted, ye other perticulars to be refered to March Meeting next And then Voted, That of a further allowance To the Town Treas- urer, and that of a premium to the Constables be refered unto Town Meeting in March next, and then Voted, also, that the request of Benja. Owen one of the late Constables Respecting Hinckley's rates be refered To March Meeting.

The Anniversary Town Meeting for the Choice of Town officers for the year Seventeen hundred Fifty & one.


1750 March 4th.


Warrants. The Freeholders and other Inhabitants of the Town of Braintree, Qualified For Voting in Town Affairs being assembled on Legal warning for the Transacting such affairs of the Town the perticulars whereof as They were Inserted in the Warrants were as follows, after a Mod. chosen. First To chuse all such Town offi- cers as the Laws of province, Direct to be annually chosen &c vizt. in the month of March. Secondly, To Consider and Determine as the Town shall judge Convenient on all such Town ways as shall then be offered for their acceptance. Thirdly, To consider wheth- er a premium shall be allowed for birds & Squrrels the Insuing year Fourthly, To considr whether a premium shall be allowed the Insuing year for the keeping of Bulls & boars & if so under what regulations they shall be kept. Fifthly, To know whether ye Town will petition to ye Sessions for help about Building the Iron work Bridge, &c Sixthly, To consider whether ye Town will do any thing towards the Restraining rams the ensuing year.


Moderator The Freeholders &c. Being assembled as above sd after the opening the meeting. The Meeting proceeded and chose L' Col William Hunt moderator.


Town Clerk. Nominated & Voted, Richard Faxon Clerk.


Proposed that three Selectmen be chose & to add two more in case &c Selectmen chose. More Select Men chos And then pro- ceeded to that of Chusing Selectmen, & then after some consider- able Debate &c Voted, That three Selectmen, vizt one in each precinct, and provided that those that shall be chosen will accept

to serve ye Town, In the said office the ensuing year, without pay & So Directly after They shall be chosen Declare in this meeting that they will doe so That then if they Desire that some others be added to their number to serve, that then two more be chose to serve in sª office. They then when chosen allso Declaring their acceptance to serve the Town In said office gratis &c. The Votes being Collected, it appeared that Meas" Richard Brackett, James


Penniman & Samuel Bass were chosen, sd Brackett & Penniman then Declaring to sd meeting that if they shod serve the Town & gratis too, that they shod not incline so to doe unless There should be one in the North, & one in the Middle precincts chosen to serve with them in the sª office ; and in case the meeting should chuse two more that then they would accept & also serve the ensuing year, In the said office gratis, as proposed &c. The meeting then proceeded and the votes being Collected it appeared that Sam" Curtis & Jonathan Baxter were chosen, they then also in sd meeting Declared their acceptance and that they would serve the Town the ensuing year in sª office gratis, and then on a motion made the Moderator with the consent of the meeting, adjourned the meeting to Tuesday the fift of this Instant March at ten of the clock in the morning on sª Day at this place.


March 5th. 1750


ye meeting adjourned ye meeting adjourned again. Some of the vizt. The freeholders & other of the Qualified Inhabitants of the sd Town of Braintree, Being met by adjournment from the fourth of this Instant March &c. Being assembled & the wether being very stormy, after some Considerable Debate the Moderator with the consent of the meeting adjourned the meeting unto Tues- day the Twelve day of this Instant March at ten of the Clock in the morning at this place.

Adjournmient Ens" James Penniman & Dea Sam' Bass, refus- ing to serve as Selectmen three Selectmen sworn Two more Selectmen chose & sworn viz. took ye previous oaths By adjournment from the fifth of this Instant March the free- holders and other Inhabitants of the Town of Braintree Quali- fied for Voting in Town affairs being assembled &c proceeded to that of Selectmens taking the oaths by Law Directed &c. & then (Dea. ) Sam11 Bass & Ens" James Penniman appearing & Declar- ing that they were not Disposed to Take ye sd oath & so not to serve in said Office proceeded (& L' Richard Brackett, Measrs Jonathan Baxter & Sam" Curtis, each of them took ye oath In- joined by Law to be taken by all officers before they enter upon sd office & then proceeded & ye Votes being Collected it appeared that Meas's Ebenez". Hayden & Sam" Pain were chosen to serve as Selectmen each then taking ye sª oath and then proceeded of chus- ing Constables & the votes being Collected, it appeared that Joseph Nightengall, Isaac Newcomb & L' Sam1. ye Moderators oath Inserted. All ye previous Votes of this meeting confirmed The Freeholders & other Qualified Inhabitants being assembled by adjournment from ye 12th. day of this Instant March &c then went and proceeded, the Moderator then having taken ye oath above sd; The Question was then put by the Mod- erator whether all votes that Have been passed by this meeting from the first opening of it on the fourth day of this Instant March & so on all the adjournts. since be all ratified & confirmed, put to vote & it passed in the affirmative


A premium allowed to ye Constables. And then Voted, that thirteen shillings & four pence shall be allowed to each Constable that shall serve the Town in said office for the year, seventeen hundred and Fifty one


Jos Nightengal sworn Joseph Nightengall appearing took ye previous Oath by Law appointed &c March 25th. &c.


Treasurer chose. And then proceeded & Voted Richard Faxon, (Town) Treasurer

Benja French accepted, & Voted Constbl. in the Room of Isaac Newcomb. and then Voted, that Benja. French be accepted one of the Constables for this Town for the year 1751 Vizt to sarve in the room of Isaac Newcomb.


L' Samuel Vinton released Voted, That L' Sam11 Vinton be re- leased for serving the town as one of ye Constables this present year (he having paid in that affair before)


John Clarke chose Constbl. Proceeded & the Votes being Col- lected it appeared that John Clarke was chose to ye sª office.


Meeting adjourned to ye 25th March current. The Moderator

Sam" Belcher released & Jno Niles Terus Chosen Proceeded, Voted, Sam" Belcher to be released from serving as Surveyor of Highways, for ye ensuing year, & then John Niles Terus chose to ye said office of Surveyor of Highways. see the Catalogue of names &c


Dea. Jnº Adams request read put to vote & it passed in ye neg- ative And then Dea. John Adam's request read and after some Debate, put to Vote and it passed in ye Negative.


Also a premium for bulls boars, birds, & Squrrels put to vote all passd In ye Negative And then the Moderator put ye Question, whether a premium shall be allowed for bulls, boars, birds or Squr- rels all severally put to vote & all past in the Negative.


Voted that a Comttee. be chose in behalf of ye Town to present a petition to ye Sessions, &c And then Question was put whether the Town will Petition to ye justices of ye Sessions yt Manatiquod Bridge may made a County Bridge Put to Vote & it passed in the affirmative.


ye sd Comttee chose And then Voted to Chuse a Comttee to prefer such a Petition to ye Honble Justices of the Sessions in behalf of the Town of Braintree &c. and then seperately Voted that Lt. Coll. William Hunt, Capt Ebenezer Thayer, & Mr. Sam11 Niles jun" be a Comttee in ye said affair &c.


A negative vote on the restraining Rams And then the Ques- tion was put whether Rams, shall be restrained In any other method than the Law has already ordered, it put to vote & it passed in ye Negative.


Benja Owen to be allowed Eben' Hinkes Town & pro. rate And then Voted, That Benja. Owen a late Constable be allowed Eben- ezer Hinckleys Town & province rate.


1751 May 22d

And then went to that of the Schools, & after some Debate thereon, Voted, That the Schools be as last year, viz in the North & Middle Precincts or- dered by ye Selectmen, and that the South precinct draw a part of ye School Money.

Warrants. The freeholders and other Inhabitants of the Town: of Braintree Qualified for acting in such affairs of the sd Town as: were Inserted in the warrants were as follows. (being assembled; &c) First to bring in their Valuations to the Selectmen, (being assembled as aforesaid, the Selectmen then proceeded & called for the valuations &c Secondly, after a Moderator chosen, To con- sider of chusing one more Selectman, one of those lately chosen failing. Thirdly, To raise money for Defreying the Town charges &c. Fourthly, To hear & Determine on ye report of any of the sd Towns Comttees in any of the affairs of sd Town & to chuse a Comtter or Committes as occasion may be.


Valuations called for. Moderator chose The freeholders &c being assembled as above said the Selectmen Proceeded and called for the valuation &c & then proceeded to that, vizt the meeting proceeded and chose Jos. Crossby Esqr. Moderator.


Curtis' memorial read Sam" Curtis released - Voted to chose one Selectman, Thos Allen chose And then proceeded to that of Chusing one Selectman, on a motion made to said meeting the memorial of Samuel Curtis being then read, Voted, yt the said Sam" Curtis be released from serving the Town in The station of a Selectman &c & then Voted To chuse one more Selectman, Their Votes being called for & sorted it appeared that Ens" Thomas. Allen was chosen.


£100 Lawful money Voted &c Voted, That one Hundred pounds

The Committee chose to settle accts wt ye Town Treasurer brought in their report read & accepted The Town Treasurer discharged so far &c One of ye Comttee on ye afair of ye Bridge reported &c Voted a Comttee to put a petition in to ye General Court in ye affair of the sd Bridge &c And then proceeded to that of hearing any (Comttee) report of any of ye said Towns Comttees In the affairs reposed on them : then the Comttee chose last to settle accompts with the Town Treasurer gave in to the sd meeting their report in Writing under their hands, except Capt Jnº Holbrook. ) who said he was prevented attending on the said affair by reason of his being abroad & could not git whom : the said report being then read in said meeting the moderator Then put the Question whether the report now read to them should be [145] accepted & the said Town Treasurer Richard Faxon be Discharged (of the said One hundred eleven pounds three shillings four pence, two farthings & three tenths) according to ye purport of ye said report but now read, put to vote and it passed in ye affirmative, and the Mr. Sam11. Niles jun". one of the Comttee Last chose in ye affair of The Bridge hereto fore called ye Iron work Bridge made a verbal report to sd meeting of the Transactions at ye Sessions, and after some Debate on the affair and curcomstances &c Voted, That a Comttee be chose to petition the Great & General Court that the sd Bridge affore said made a County Bridge & then nominated and Voted, That Majr Moses Belcher, Capt John Holbrook & Mr Sam". Niles Jun'. be a Committee to put forward sd petition to the Gen11. Court in behalf of the sd Town of Braintree to all intents &c.


1751 October 24th.


The Freeholders & other Inhabitants of the Town of Braintree. Qualified for voting in Town affairs being Legaly assembled For ye Transacting such affairs of ye sª Town, the perticulars whereof as they were Inserted in ye warrants were as follows, First, To consider of ye case of ye Late Constable Benja. Owen & what may be done in ye affair of his Constableship in any time past &c. & to hear & consider of any Propos11 yt may be offerred to ye towil by sd Owen and to inquire into ye same, any thing relating &c. Secondly, To consider what may be offered by ye South precinct in ye affair of ye drawing apart of ye School Money. Thirdly To consider whether ye Town will advise to ye making of ye County Rate &c. Fourthly To consider of chusing one hoge Constable in ye North pret.


And then proceeded & Chose Co" Jnº. Quincy, Moderator.


The affair relating to ye Case of the late Constable Benja. Owen Debated upon & a Comttee chose &c And then ye Question was put whether a Comttee of three men be chose to Inquire farther into the affair. Pursuant to ye memorial or petition of the Late Con- stable Benja. Owen (but now read in this meeting and report to this meeting, at the adjournment to be made &c. That ye Town may have the fuller Information for their further consideration &c

Elijah Vesey yt was chose one of ye hoge Constables last March now sworn And then the Moderator with ye consent of the meet- ing adjournª The meeting unto Wednesday ye thirtieth day of this Instant Octobr. at two of ye clock in ye afternoon at this place.


1751, Oct 30th


The Freeholders & other Inhabitants of the Town of Braintree Qualified by Law for voting in Town affairs being assembled by adjournment from the Twenty fourth day of this Instant Octob' The said meeting being opened.


The Comttees report read with an other Declaration then also ex- hibited &c. And the Comttecs report exhibited to ye meeting & read the purport of which sd report was that the said Benja. Owen was willing to fullfill his Declaration exhibited to ye Town at the open- ing of this meeting &c as by Relation had to sd report may more at Large appear we said report is Dated Octobr. 28th. 1751


[146] 1751 Octobre30th.


A report of the Comttee Chosen by ye Town of Braintree on the Twenty fourth day of this Instant October 1751, who were appointed to confer with Benja. Owen one of the Late Constables of said Town, being exhibited & read & meturely con- sidered.


Voted, That ye Comttec hereafter named & Chosen be authorized and Impowered in the name & behalf of the Town to receive the money that is in the said Benja. Owens hands already Collected & also the notes of hand taken in Lieu of rates, and if he the sd Owen shall Ingage to collect the rates remaining uncollected for the year seventeen Hundred & forty nine & of any year or years past if any be giving proper security Therefor to pay the sum or sums, so Collected unto the said Comttee. And Likewise shall give a Legal Conveyance of all his real Estate unmortgaged to the use of the Town, as also of the whole of his personal Estate with Proper accompts of his Debts Drawn out & signed with a power of Attorney To receive the same and so fully and amply perform in all things, according to his Declaration to ye Town & the said Towns Construction thereof, and as soon as may be the said Com- mittee to Improve the produce of the sd real & Personal Estate to pay the same unto the province Treasurer, and to be accountable to ye Town, ye sd Committee, they be and hereby are Impowered to discharge him The sd. Benja. Owen from his present confinement & as soon as may be to make sale of both his real & personal estate Paying the Province Treasurer, the produce There of as foresaid, and then nominated & Seperately Voted Joseph Crosshy
