If in case a cure be performed that may prove sound for one whole year, then to give satisfaction for said cure not exceeding Ten Pounds nor to pay said sum untill Twelve months are expired after ye cure & said Twenty shillings to be part of said sum. and

The Selectmen then in being according to a Vote passed by ye Inhabitants of Braintree Regularly assembled May ye 15th. 1699 (refference whereunto had may more fully appear) have allowed unto John Wilson Esqr. Leave and Liberty to set up a shed con- taining Twelve foot front & Ten foot from the fence of Benjamin Webb southerly, as also to Mr. William Rawson Twelve foot front and Ten foot from ye fence aforesaid southerly To Joyne together for to shelter their horses in as it is now staked.

Then voted by ye Inhabitants of Braintree Legally convened, That if Edmund Littlefield would gather all ye Rates yet left ungathered by Thomas Copeland Late constable of said Braintree Deceased, as to Province County, ministers & Towne. it should be accepted as if he himself had personally served (in said Town) as Constable.

Then voted that any person being Inhabitant within this Town shall any time after the 20th. April next, until the 10th. of June fol- lowing kill or destroy any old Black birds within ye bounds of said Town and bring him to any one or more of yt Selectmen who shall take an account of ye number and give order that he shall be paid two pence y head out of ye Town Treasury

Then voted by the freeholders & other Inhabitants of Braintree Lawfully Convened that Fifty pounds money be forthwith raised for ye defraying Town Charges to be paid in silver money at fifteen penny weight or Bills of Credit.

It was then also voted that ye present Selectmen should provide a Gramer school Master for ye year ensueing ye salarry not to exceed Thirty pounds.

The Inhabitants of sd Braintree being Regularly Assembled. Then chose Captain John Wilson Esqr. moderator for that day. The said moderator withdrawing Coll. Edmund Quinsey Esqr. was chosen moderator in his Room.
After ye warrants were read for said meeting which was as fol- lows. To Samuel Allen Constable of ye Town of Braintree, Greeting. you are required in her majesties name to warn & give notice to ye freeholders & other Inhabitants of ye South end of said Town duely quallifyed to vote in Town affairs to meet at ye old meeting house in said Town, on Wednesday next being ye 3ª Day of November at nine of ye clock in ye forenoon then & there to consult & consider about & if possible to fix upon a suitable

& reasonable Line of Division, distinction or Limitation of ye said south end, Assembly & Society, and of ye North end con- gregation. That said Line be loveingly agreed upon & settled (if it may be) and to do any other Town business needfull to be. done on said Day hereof you may not faile makeing return hereof at or before ye aforementioned Day to one or other of the Select- men Dated in Braintree ye 30th. Day of October annoqu - Domini 1708 and the 7th. year of her majesties Reign.
By order of ye Selectmen Joseph Parmenter Town Clerk. A true coppy of ye warrant Attest, Jos. Parmenter Town Clerk. and ye other warrant directed to Constable Moses Curtis of sd Town was of ye same tenor.
There were immediately that did declare against ye dividing of ye Town and that they did refuse to Joyne with said Inhabitants in that affair and requested that it might be entered with their names in ye Town Book.
There then entred their names Lt Jnº Cleverly, Ensign William Veasey, Solomon Veasey, Moses Penniman James Penniman, Samuel Penniman, John Newcomb Junior, James Bracket, Nathan Bracket, John Sanders.

The Inhabitants of Braintree being Lawfully Assembled It was then voted that there should be two distinct precincts or societies, in this Town for ye more regular & convenient uphold- ing of ye worship of God.

Edmund Quinsey Esqr. & Serjeant Nehemiah Hayden be a Com- mittee in ye name of ye whole Town To Adress ye Great & General Court or Assembly now siting, for their Approveing & confirming the Line by them agreed upon, between ye said societies.
November ye 3ª. 1708.
The Inhabitants of Braintree being Lawfully assembled then voted that the line for ye distinction of Precincts between ye North & ye South Societies should run as followeth, That said Line begin at ye head of ye ship coave by John Newcomb senior (tak- ing in his living to ye South end) And so to run from ye head of said cove to ye common & to run from ye common by said John Newcombs to ye line between John Penniman Junior & Samuel Veasey, and then running upon ye line between Theophilus Curtis and Mr. Frances Legaree, as also running upon ye line between Serjeant Samuel Paynes & James Pennimans Land to ye common, and from thence to ye northwest corner of Faxon's Farm, and so to ye northwest corner of Alldriges Farm and so to run from said corner of said Farm from markt Trees to ye mouth of blew hill river where it comes into More's river & so by said blew hill river To Dorchester upon ye blew hill line.

There was then read the General Courts order for two Pre- cincts in this Town, which was as followeth.
At a session of ye Great & General Court held at Boston upon Wednesday the 20th. of October, 1708.
Friday November 5th. 1708 In Council.
A petition of Coll. Edmund Quinsey and Nehemiah Hayden on behalf of ye town of Braintree. Praying this Courts Approba- tion & confirmation of ye vote & Agreement of the said Town, That there should be two Distinct Precincts in the said Town for ye more regular & convenient Upholding of ye worship of God, and that the Divisional [102] Line, betwixt ye north and south precinct begin at the head of the ship cove by John Newcomb senior (taking in his living to ye south end) And so to run from ye head of sd cove to ye Common and so to run from ye common to the Line between John Penniman Junior and Samuel Veasey and then running upon ye line between Theophilus Curtis and Frances Legaree. As also running upon ye line between Serjeant Samuel Paynes & James Penniman's land to the common and from thence to the north- west Corner of Faxons Farm, and to ye northwest corner of Aldriches Farm, and so to run from ye said Corner of said Farm, from markt Trees to the mouth of blew hill river where it comes into Mores River and so by said blew hill river to Dorchester upon the blew hill Line) with the order passed thereon in ye house of Representatives were read and concurred with, vizt. Ordered, That the Prayer of this Petition be Granted, and that two Pre- cinets be setled and confirmed according to the vote of the Town of Braintree annexed.

[104] Then also Nehemiah Hayden & Samuel French who were chosen (some time since) by the towne with Lt John Cleverly as a Committee to Run the line, between Braintry & Weymouth made their Report to the Towne : that they went over to Weymouth and proposed to them (viz. to their committee chosen for that pur- pose) to be at half the charge of a Surveyor (as being so instructed of the Towne) in Running the aforesd. line : but they refused to Run the line with a Surveyor.
then also was voted, That Mr. Nathaniel Hubbard and Mr. William Rawson Sen'. Should be a Committee, to see to the repair- ing of Monaticut Bridg, and to agree with fitt persons that should undertake the Reparation thereof.

October 24th. 1709.
The Inhabitants of this Town of Braintree Lawfully convened upon due warning, Chose Capt. John Wilson Moderator.
A town tax. Then voted on the affirmative, That a Rate of Forty Pounds shall be levyed on the Towne, by the Selectmen for the Defraying the necessary Town Charges of this present year 1709.
Comons to be Proportioned. Then voted also that something shall be done for the more equall proportioning or Regulating, the Improvements of all the comons in the Towne.
Also That a Committee be chosen to consider more deliberately about the premises and to draw up some Proposals thereabout, to offer to the Towne at the next annual Towne Meeting.
& Comitte. Then also Voted, That Ensign William Vesey, Lt John Cleverly and Serg Nehemiah Hayden, should be a committee for the aforesaid business.
[105] Braintree Octobr. 8th. 1709. A private way on Mr Rawson Farme
The Selectmen of Braintree being mett upon Mr Rawsons Farm in sd Towne the Day & yeare above sd. layd out a Private Drift way not to be layd open as follows viz to begin at the corner of the Farm called old Mr Willsons Farme, where a stubb & stones is the bounds and be two Rodd wide till it comes to a stubb & stones in the line between Mr. Willson & Mr. Rawson, from thence on each side the center trees in the said Line a Rodd wide unto a Walnut Center Tree, at the Topp of the Hill newly Dugg Downe, from thence to the Savin bound Tree, a Rodd wide on the south & a Rodd & half wide on the North side of the line, from thence, that is to say from the Savin Tree to a forked Stump upon the plaine, a Rod & half wide, & from thence to Dorchester line where the new causey is made, the same breadth. It must be understood the said Mr. William Rawson freely gives the way to the Town of Braintry as above mentioned & agrees to repair the said Causey near the Townes Line forever so farr as it lies in Braintry.

Then voted by ye Inhabitants of Braintry Lawfully assembled that there should be in each Precinct a Constable annually chosen.
Constables, were John Bass, and John Hollis, But John Bass, refuseing to serve Paid his five pounds money, and James Puffer was chosen (in his room) Constable.
Tithingmen. Deacon Benjamin Savel, Deacon Moses Payne, Deacon Joseph Allin Deacon, Samuel Bass,
were then chosen Tithingmen.
Surveyors. Then were chosen Ebenezer Spear & Moses Curtis Surveyers.
Fence Viewers the Fence Viewers were Nathaniel Spear Samuel Belcher & Ephraim Thayer, Josiah Hobart.
Field Drivers. then were chosen, Samuel Penniman & John Wilde Field Drivers. A Committee. At the same time it was voted That Peter Webb & Joseph Crosbye be a Committee to go and search the records at Boston with reference to the grant of the 6000 Acres of Land by ye General Court, To ye Town of Braintry, and make report of it unto the said Town.
It was then also voted that Joseph Bass should have Twenty shillings allowed him for his service the Two years last past for serving the Town, as Town Treasurer.
May the 19th. 1710.
The Inhabitants of this Town Lawfully convened, chose Cap- tain John Mills their Representative for the year ensuing.

At the same time they chose John Beall a Sealer of Leather for the year ensuing.

At a Town meeting Lawfully convened, Mr. Nathaniel Hub- bard was chosen moderator for that Day.
Then voted, that a sume of Thirty Pounds money be forthwith raised for ye defreying Town Charges.

Then voted that the Town should alow six pounds for & tow- ards the keeping of Bulls, from the first of March next, to the first of March [107] following which shall be in the year of our Lord 1712, to be paid at the end of said year, every Bull to be a good sufficient Bull of two years old at least to be entred with ye Town Clerk on the first munday of March next, the six pounds to be paid in proportion to the Bulls entred, and if it shall happen that less than six Bulls be entred no man to be allowed more than Twenty shillings for, one Bull.

[108] Town Treasurer. Mr. Joseph Crosbye, was chosen Town Treasurer for this present year 1711.
Constables, were then chosen Moses Penniman & Peter Hobart, but Peter Hobart agreeing with Jonathan Hayward & presenting him before ye Town was accepted then by them and voted Consta- ble in his Room.
Tithingmen were
Peter Newcomb, John Bass Drumer. Serjeant Sam1. Payne & John Copeland Senior.
Surveyors were
Capt. John Mills. Lt. John Cleverly. Serjeant Sam1. French. & John Thayer.

BRAINTREE RECORDS, 1711-2.
March 5th. 1710/11
Then voted that no person freeholder or other Inhabitants shall hence forward carry any wood or stones off of ye common out of ye Town to make merchandise thereof but what is allowed by. ye Committee hereafter chosen, under the penalty of forfeiting Twenty shillings for every cart load so taken & carryed away to ye poor of ye Town.
Then also it was voted that Capt. John Mills Lt. John Cleverly, Ensign William Veasey, Mr. Nehemiah Hayden & Serjeant Samuel French be ye Committee as above said, as also to inspect & prosicute all incroachments upon the highe wayes, private Town wayes & commons within this Town.
