The Surveyors to have no allowance for Blowing rocks And then went to that of preventing unnecessary Charges Being expen- ded on the Town ways, the Moderator put the Question whether any of the Surveyers of the Town shall have any allowance for blowing of Rocks, put to vote & it Past in the Negative.
No allowance for Bulls or boars. And then went to that of allowing a premium for bulls & boars, put to vote & it past in ye Negative.
For birds & Squrels. as last year, vizt 9ª for old ones 2ª for young ones 6ª for Ground Squrrels, all old tenor And then went to that of killing Birds & Squrrels, and after some Debate thereon, the Question was put whether the Premium to be allowed for birds & Squrrels shall be as it was Last year, put to vote & it past in the affirmative, viz *. that nine pence per head for grown black birds heads, two pence for young ones heads & six pence for ground Squrrels heads carried in to ye Selectmen from this time until ye fifteenth of October next all in old tenor.
Juror Lists accepted. And then proceeded to that of the Lists of Juriors, and after the reading of them, put to vote whether they should be accepted, and after some Debate thereon Past in the affirmative.
A Committee chose in the affair of the Bridge. And then went to that of accompts, then the meeting on a motion made on the Surveyers accompt in ye affair of the Bridge over the River Into

Eliphalet Sawin, or, report to the meeting, and then nominated & Seperately Voted, Capt Ebenez" Thayer, Ens" Jnº Hunt, Ens" Sam11. Wild, Ebenezer Newcomb & Jnº Curtis, be a Comttee in ye sd affair.
Hayward released from serving Const1. And then on motion made to said meeting to see if Aaron Hayward might Be released from serving the Town as Constable the ensueing year. Put to vote and it past in the affirmative.

French & Others, We the Subscribers have reviewed the Towns way through the land of sd French & others Leading from Nathaniel Blanchers, Westerly towards Sam11. Thayers, & are of the opinion That ye Towns way be continued & Improved through sª lands for the Future as it now is & has been for many years past vizt. one rod and half wide, or more if the Town thinks fit &c.

A Representative. Pursuant to the Precept For the Choice of a Representative &c. The Freeholders & other Inhabitants of the Town of Braintree, being assembled on Legal Warning &c. after the Meeting was opened Proceeded & chose Major William Hunt, Representative &c.
Warrants. Also there being a Meeting warned to be on the day above sª for the Transacting such other affairs of the sd Town, the perticulars whereof as they were Inserted in the Warrants were as follows. First, To Chuse a Constable in the South Part of the Town as usual. Secondly, To Conside of Raising Money necessary for the Defreying the Charges of the sª Town this pres- ent year &c. Thirdly, To Here & consid' of the Reporte of the Selectmen, or any of the Towns Comttees & to Determine there on as they shall think necessary. Fourthly, To Considr & Direct to some agreeable method for the School or Schools in said Town, To the best advantage &c. Fifthly, To Consider of building A New pound, or pounds, that may be convenient For the Inhabi- tants of sª Town, if it shall be thought proper. Sixthly, To Con- sider of the petition of sundry of the Inhabitants of sd Town about a Town way from the Road by Sam" Vesey's to Jonath" Porter's, & the way from said way (along by the House of Ens" Alexander French, Decead. To the Middle swamp way & to Chuse a Comttee to view & report on the same.

Atherton Wales, chose Constable But afterwards was released And then proceeded to that of chusing Constables, & when the Votes were Collected & sorted, it appeared that Atherton Wales was chose to ye sª office, and then on a motion made to the meeting, of some Difficult Surcumstances that he had Lately been under & still was something Dubious of his recovery, moved that he might Released from sd Service, & then Voted that the sd Atherton Wales above sd Be released from serving in the office of Constable this present year.
& then Deering Spear was chose To ye sd office And then again their Votes were called for, for a Constable & the Votes Therefor being Collected & sorted it appeared that Deering Spear was Chose to sd office &c (but he not being there as could be learnd. his mind could not be known.
A Comttee chose To view ye sd Wayes And then went to that about ways And after a representation made by some persons there & the meeting Had, had some Debate on the same, proceeded & chose (Dea.) Jnº Holbrook Ens" Sam" Wild & Will™ Penniman be a Comttee to goe and view the sd ways & to report thereon &c.
The North & Middle Precincts to have but one School The South precinct To draw their proportion And then went to that of the Schools, and after some inquiry & Debate on ye affair of the Schools, & then Voted, that but one School Be kept this present year for the service of the North and Middle precincts of sd Town, also, Voted, that the South precinct draw their proportion of School Money as heretofore for some time &c.

Eliphilet Sawin To be allowed Sixty pounds old tenor The Select to take care to build a pound And then some of ye Com- ttee making a report to ye meeting on ye affair of The Bridges mended Last year by Eliphilet Sawin one of the Surveyers of High Ways, & then Voted that the sd Eliphilet Sawin be al- lowed Sixty pounds old tenor for the mending the Bridges set- tled for by the Comttee as by the reporte by sd Comttee So made (see the sd report below) vizt after the enterry of the following Vote - & then Voted, That the Selectmen take care that a New pound, be built for the use of the Inhabitants of this Town, & as near the Middle precinct Meeting House, as they can find a Con- venient place for the same but Not to carry it further Southward &c. Eliphilet Sawin &c chose March 7th. 1748, see page 130 back &c. Their report is as follows vizt We the subscribers being a Comttee Chosen By the Town to treat with Mr. Eliphilet Sawin for what servis he Hath done in repairing (ye two Bridges, leading into Cochato) and met with him there and considered the affair and are of the mind that he is worthy of Sixty pounds old tenor.

Warrants. The Freeholders & other Inhabitants of the Town of Braintree That were Qualified for voting in Town Affairs being assembled on Legal Warning, for the Transacting such affairs of ye said Town the perticulars whereof as they were Inserted in Warrants were as follows. After a Moderator Chosen, To Con- sider and resolve upon some suitable & effectual method To pre- vent & hinder the carring off wood & Stones from off the Town's Common, & also to prevent & hinder persons fencing in & so Improving any part thereof & to chuse a Comttee Those that have

A restriction Laid on ye cutting wood on ye Common. After a considerable Debate had thereon, the Question was put whether the Town will now consider of any Limitations & Restrictions with respect to the wood & Stones In ye Towns Common, it passed in the affirmative. And then Voted, that none of the Inhab- itants of the Town shall be, Allowed to fell, cut or carry away any Trees, poles, wood or under wood Whatsoever growing or standing on said Common, untill the Town at a meeting for that purpose appointed shall Give Leave therefor.
The Digging or Carrying of Stones off of ye Towns Common restreigned Also, Voted, That none of said Inhabitants of the Town shall be allowed on any account whatsoever to Digg, or Carry off any Stones from the said Common without Leave first obtained from a Committee - for that purpose to be appointed or a major part of them & that upon any person or persons acting Contrary hereunto they shall be Deamed Trespassers.
The Comttee not to Dispose of any Stones but what they sell &c And then, viz' the Question was put whether it shall be in the power of the said Committee (and they are hereby Impowered and Directed) upon application to them made by any Inhabitant or Inhabitants of this Town, To allow or and give them leave to Digg and carry off such Quantity of Stones as they may have occasion for, from the said Common, Provided the said Stones are to be made use of, for fencing or Building within the limits of the Town, put to vote and it passed in the Negative.
The Comttee to sell Stones To account with ye Town Treas' at every six months end & then to pay in the Money by them Re- ceived &c And then Voted, that it shall be in the power of said Comttee or a Major part of them, and they are hereby Impowered and Directed to make sale of any quantity of stones in the said common, as they may judge proper, they setting the price, and that the said Committee shall be obliged to account with the Town Treasurer for the time being, at the end of every six months, for the money by them Received for the Stones So Sold, and to pay it to the said Treasurer, at the same time for the use of the Town.
And then (seperately) Voted, the persons named as follows, to serve as a Comttee (to serve) in the said affair, vizt. Measure Thomas Wales, John Adams, John French, Jonathan Wild and

James Penniman, viz' were chosen a Committee to manage the affairs aforementioned.

& then Voted, that the sd Committee be, and they are hereby fully authorized & Impowered at the charge of the Town to prose- cute in the Law any Person or persons whatsoever, who shall contrary to the true Intent and meaning of the foregoing Votes, cutt or carry a Way any Wood or Digg or carry off, any Stones from the said Common.

The Anniversary Town Meeting for the Choice of Town officers, for the year, Seventeen Hundred Fifty.
The freeholders and other Inhabitants (Qualified for voting in Town Affairs) of the Town of Braintree Being asembled on Legal Warning for the Transacting such affairs of the Town the perticu- lars whereof as they were inserted in the Warrants were as follows, After a Moderator chosen.
First, To Chuse all such Town officers for the ensuing year as by Law Directed. Secondly, To here the reports of the Select- men, & also such reports as may be then made by the said Towns Committees or any of concerning Town ways, or any other affairs of said Town, and to act on any such reports as the town at said Meeting shall then think fit. Thirdly, To Consider what method shall be proceeded upon for warning Town Meetings for the future (or year ensuing). Fourthly, To Considr of Chusing a Comttee to examine into the State of the Treasury, and to report thereon to the Town at their next Town meeting. Fifthly, To Consid' & resolve on some such method as may be satisfactory To the Town in the affair of Regulating the School (or Schools) In the said Town. Sixthly, To Consid' what sum may be allowed per year to the Town Treasurer for the time past not yet Determined. Seventhly, To Consider if it may be necessary to Chuse a Comttee to take proper methods to prevent any unreasonable to, or Destruc- tion of ye Fish in their passage up the Iron work or manatiquod River so called, and to pursue any prudent method in all respects whatsoever to effect the same, in all such measures, & in all that relates thereto. Eighthly, To Consid' Whether there shall be a premium allowed for Bulls & Boars the ensuing year. Ninethly, To Consid' whether there shall be a premium allowed for killing Birds and squrrels the ensuing year. Tenthly, To Conside of a request that Dea. Jnº Adams may then offer to the Town about altering a way, or the Town way through his Land in the South precinct.

Crossby, Esqrs & Capt Jnº Holbrook And then proceeded to that of hearing the Selectmens and Comttees reports - then the Comttee Last appointed to settle accompts with the Town Treasurer made their Report, which was then read in the sd Town Meeting, and the Question was put whether the said Treasurer Richard. A Comttee chose in ye affair of the fish And then went to that of Chusing a Comttee to see that no unreasonable methods be practised to the hinderance of the Fish in their passage up the Iron work, alias Manatiquod River & then Seperately, Voted, that Jonathan Allen, William Penniman & Amos Stetson Be a Comttee in the affair aforesaid.
No allowance for keeping Bulls or boars. And then the Ques- tion was put whether a premium shall be allowed To any person or persons for an Incouriagment for the keeping of Bulls or boars the ensuing year, put to vote and it passed in the Negative.

This report read put to vote to see if it should be accepted & It passed in the Negative The report or return of one of the Towns Comttees under their hands is as follows - Whereas we the sub- scribers, were chosen at a General Town Meeting upon ye 22ª day of May 1749, To view the Town's way Leading from ye way by David Eames's Through the Lands of Ephraim Thayer, Sam11 Hay- den & others, To the Country road in ye South precinct, Leading To ye Meeting House in sª precinct. Laid out by Sam11. Baxter, Richard Thayer & William Hunt, Selectmen in the year 1732, as by ye town record In that affair may more fully & at Large appear, and to report to ye town Thereon, pursuant to that order of ye Town. Wee have carefully Viewed ye said way, & are of the opinion that ye Town relinquish & Discontinue the said way as an open way, but that it be used & Improved as a Drift way for ye passing to meeting & mill if ye Town shall think fit &c.

Braintree June 24th. 1748. at ye request of several of the Inhabitants of said Town, We the subscribers as ye Law Directs Layed out a Town way, one rod & half wide, and bounded it as followeth.
This report read In the sd Town meeting on ye day above sd & was accepted with a proviso vizt, That there be no demmands made on ye Town either for ye Lands on which ye sd way goes or for Fencing it Begining at North west corner of Jonathan Porter's Land runing unto a Cedar post in Peter Thayer's fence near ye South East corner of said Thayer's orchard. Thence runing to a pine stake in said Thayers Land. Thence runing to a White Oak post in said fence, both posts being marked and standing on the west side of ye way, thence as ye way now is used To John French's land & thro' sª French's land, To & thro' ye River on the North West side of a Large rock which lyeth near ye South side of said River, from thence as ye way is now used, To a large black oak stump with a stone thereon, sd stump standing on ye Topp of ye hill ; thence To a black oak tree where ye way is now used, To & thro' Alexander French's land where it has been many years Im- proved, to & on the Saw Mill Dam, on condition yt one side of ye way thro' sª Alexanders Land be fenced with a Lawfull fence, by the Neighbors or others, and from said Dam to & thro' a shere of Land belonging To the Heirs of Dependence French Deceased as the way is now used, To an open way so given and used by the Proprietors there adjoyning.
