It being by the Moderator moved whether the Courts Grant of 6000 acres of land to this Town should be sold it was voted on ye negative


It was then voted that Thirty Pounds money should be raised for ye defraying Town charges. £ 30


Voted, that what the late Committee had done about ye school Land wood was Received & accepted.


Voted that the present selectmen be a Committee to here & receive the accoumpts of ye Constables & Collectors of this town, as to their areers & Deficiencys which have happened in their Rates.


There not being time to accomplish what was this day to be done the moderator adjourned the meeting till Munday the 19th instant at three o'clock.


Munday the 19th. March 1715/16


by adjournment the Inhabitants of Braintree being assembled chose Benjamin Hubbard Constable for the ensuing year.


Then voted That the consideration of disposing or repairing the old School House and the school in gen'ral be refered to the next Town meeting.


Then voted that John Hollis have allowance made him for the use of a way over his land to the Towns land.


It was then also voted that the present selectmen or any three of them be a Committee to agree with John Hollis as to recompenc- ing him for the use of a way through his land to the Towns land

The Inhabitants of Braintry Regularly assembled they then chose Captain John Mills their Representative for ye year ensuing.

They then chose the honourable Edmund Quinsey Esq". Mod- erator for that day.


They then chose Nehemiah Hayden, Junior Constable but he refusing to serve they on the same day chose Benjamin Allin, who hired Samuel Arnold to serve for him, and was by ye Town accepted in said Allins Room & stead.


May ye 14th. 1716


Voted, by ye Inhabitants of Braintry Regularly Assembled that there should be a school kept in the south end of this Town, for one half of the year, each year yearly, beginning the first day of October yearly, for reading & writing (besides the present Gramer school) and that to be at the charge of ye Town.


It was then put to the vote whether the old school house should be repaired, and it passed in the negative.


May ye 14th. 1716.


then voted, that an house be erected for the acomidating of a grammer School in this Town, which shall be in some convenient place as soon as may be, between the north Meeting house & Mr. Benjamin Webbs land, by the committee hereafter named & appointed as they should see meet. against this vote Captain John Mills entre'd his Dissent.


May ye 14th. 1716.


Then also voted, that a convenient School house for writing & reading be built & set up in some conveniant Place in the south end of this Town, near ye meeting house as soon as may be, and as the Committee hereafter named and appointed shall see meet, at the charge of ye town.


The Committee chosen for the service aforesaid

Voted that Fifteen Pounds be paid by the Town Treasurer, out of ye Towns money in his hands, to the Committee chosen to see to the erecting the school houses in said town.

The Inhabitants of Braintry Regularly Assembled then chose Major Jno. Quinsey Moderator for that day.


Then voted that Captain John Mills Mr. William Rawson and Mr. John Wilde be a Committee to inquire into & take an account of the charge of Repairing menaticut Bridge, and to make apply- cation to the Quarter Sessions in order to their allowing a part of said charge.

then voted that the committee chosen ye 14th. of May last to erect Two new school houses in this town, be further impowered to make use of the glass stones & Bricks of the two old school houses about the Two new ones.


September the 17th. 1716.


The Inhabitants of Braintry Regularly assembled then chose the Honourable Co1. Edmund Quinsey Esqr. Moderator for that day.


Then voted that Forty four Pounds & ten shillings money be raised forthwith in addition to the Thirty Pounds granted last March for defraying Town charges.


Upon a motion made by the committee chosen last may to erect a Grammer School house in ye north Precinct whether the town would defend them from any prosicution at Law for so doing it passed on the affirmative


The Moderator moved to the Town whether ye old School house by Deacon Belchers shall be disposed of as the committee hereaf- ter appointed should se meet, it passed on the affirmative


It was then likewise motioned by ye moderator, whether the old school house near Mr. Benjamin Webbs should be also disposed of as the committee hereafter appointed should se meet, it passed in ye affirmative.


[127] September ye 17th. 1716.


It was moved by ye Moderator to ye town whether the Former Committee chosen last may to erect ye two new school houses should be ye committee to dispose of ye two old school houses, and it passed in ye affirmative


Upon a motion of Mr. Benjamin Webb, to the Town whether he might have the use of ye old School house near him (excepting ye stone & brick) for the securing of his hay till ye first of may next, it passed in ye affirmative


September the 17th. 1716.


after which the said old house was sold by the Committee to the said Benjamin Webb for three pounds, paid to ye Treasur".


Then voted by ye Inhabitants of Braintry Regularly assembled that menatiqud Bridge should be forthwith effectually Repaired at ye charge of ye Town by the Committee hereafter appointed.


Then also voted that ye Present selectmen be a Committee im- powered to Repair said Bridge.


Braintry March the 4th. 1716/17


The Inhabitants of Braintry, Regularly Assembled then chose y* honoured Col. Edmund Quinsey Esqr. Moderator for that day.


Then voted that a Town Clerk & Town Treasurer should be cho- sen for the time to come by written votes.


Joseph Parmenter was then chosen Town Clerk.


The Constables yt were then chosen was Mr. Peter Webb & Mr Joseph Crosby, Mr. Peter Webb refused to serve, but Mr. Joseph

Crosby hired Mr. Nathaniel Owen to serve in his room, & stead, and said Owen was accepted by the Town, manifested by their usial sign of lifting up the hand and Mr. Ephraim Jones was then chosen Constable.

Deacon Moses Payne was then chosen Town Treasurer.

Then voted that the present select men be a Committee to take the oversight and care of menatiquod Bridge by Deacon Allins until further orders.


Then voted, that no wood nor Timber should be cutt nor carry'd off the Town's common by any Person whomsoever till the Town take further order, and that Ensign Sam1. Baxter, Moses Curtis and Joseph Nightingal be a committee to take care of the same


Then voted that there shall be allowed & paid out of the Towns Treasury Twenty shillings to each person who shall keep a good and sufficient Bull of two years old at least for the use of the town from the Last of March current, to the first of December, next ensuing, and shall sometime in this present month March enter the same with the Town Clerk.


At the same time it was voted that all boares of six months old and upwards running at large for the use of the town, shall be allowed to run without yoaks & Rings.


Then voted that the parents or Masters of all children and servants going to school shall pay in to the present school Master, for the use of the school Three foot of cord wood to be the pro- portion of each child, or servant for the year ensuing.


May the 10th. 1717.


The Inhabitants of Braintry Lawfully assembled, Then chose Major John Quinsey Esqr. their Representative for the year ensuing.


At the same time the Honourable Edmund Quinsey Esqr. was chosen Moderator for that day.


Then voted that Deacon Moses Payne, the Present Town Treasurer, should demand (and if need be sue for) the money remaining in Mr Samuel Marshall's hands (of Boston) which

was given by Mr. Samuel Vesey to the Free school of this Town, in and by his last will & Testament and that according to the Tenour of said will.


[129] Then voted that the Present select men with the honourable Edmund Quinsey Esqr. bee, and are hereby instructed to draw up an order or by-law as near as may be, to the late vote of the Town respecting the management & improvement of the stones in the common, for the use & benefit of the Town, and present it to the next Sessions for their confirmation.


Then voted, that the hereafter mentioned Committee be im- powered to inspect all encroachments (if any be) on common & private highways, belonging to this Town, and the lines & Bound- aries betwixt common Lands and private persons & make report thereof to the Town.


Then voted that the present Select men be a Committee to inquire into, and inspect all such said incroachments, and that Major John Quinsey Esqr., and Mr. Nehemiah Hayden be added to the aforesaid Committee. to Joyn with them in the aforesaid service.


At the same time voted that Mr. Samuel Allin, Mr. Jonathan Hayward, and Mr. Benjamin Neall, be a Committee to take care (as soon as may be) effectually to Repair Menatiquod Bridge (near the Iron works,) by letting of it out to some meet Persons to do said work at the charge of the Town.


Voted, then also, that Lt. Joseph Neall, Ensign Peter Adams Mr. Samuel French, be a Committee to assist the Present Town Treasurer, (Deacon Moses Payn) to Just accounts with Mr. Crosbie, late Treasurer, for the town.


It was then voted that their should be a Reconsideration of the late vote of ye Town, about the new school house frame set up.


May ye 10th. 1717.


Then voted that Col. Edmund Quinsey Esqr. Lt. Joseph Neall and Mr. Nehemiah Hayden be a Committee to make a survey of the common Lands, belonging to ye Town and inquire thereinto and make report to the Town what number of sheep said Lands may keep.

£. 4-0-0 then voted, that Joseph Parmenter should have four Pounds for his service as Town Clerk, from the 21st. of October 1713 till ye first munday of March next ensuing.


£4- Then voted that Mr. Joseph Crosbie should have four Pounds for his services (as Town Treasurer) the years past.


July 22ª. 1717.


The Inhabitants of Braintree Lawfully assembled Then chose Col. Edmund Quinsey Esqr. Moderator for yt day.


Then voted that Deacon Moses Payn the Present Town Treas- urer Take of Mr. Samuel Marshall of Boston Four Pounds in Bills of Credit in lieu of the six Pounds yet remaining in his

hands, that is due to the Town of a Legacy given to said Town, by Mr. Samuel Vesey, in and by his last will & Testament & give said Marshall, in the name of ye Town, a full discharge for said Legacy.


Then voted that one hundred & Twenty Pounds be raised forth- with for the defreying of the charges that have arisen & shall arise for this present year.


July 22, 1717


Upon a motion made concerning Hannah Walseby voted, that ye present Select men shall forthwith take care to agree (if they se cause) with the executors to the will of Joseph Bass, Deceased, as to a legacy given by him said Bass, to said Walesby in said will, and if not make report to ye Town at the next Town meeting.

upon a Publick Town meeting (by adjournment from July the 22d. 1717.) The Moderator being absent. the Inhabitants then assembled, chose Mr. Samuel French, Moderator for at Present meeting and said meeting was adjourned until ye first munday in September following, at Four of the clock in the afternoon.

Public Town meeting by adjournment from August the 5th. 1717, It was then voted, that the Petition then presented & read to the Town should be presented to the Great and General Court at their next sessions for their consideration, by our present Rep- resentative, in the name and behalf of the Town.

Then voted that Twenty Pounds more in money be forthwith raised for the defreying Town charges and relief of Thomas Wells.

Then voted that the said Memorial be referred to be considred next March meeting.

They then chose Mr. Ebenezer Hinkley and Nathaniel Blanchard Constables, but upon their request to be spared this year they were both released, and they then chose Samuel Tompson and Joseph Allin junior Constables, but on Samuel Tompsons Request he was likewise released, and upon Joseph Allin's Request Mr. Jones the then Constable (being hired by him) was accepted in said Allins Rome, and Mr. John Marsh, was chose constable, and

Then voted that there be abated to the widow & children of Mr. Peter Webb, Deceased, Three Pounds Ten shillings of his five Pound Bond, in ye Present Town Treasurers hands.


The question being put by the Moderator whether or no they would agree upon a Rule of Proportion or Divission of the six thousand Acres of Land granted by the Court to this Town, it passed on ye negative.


£2.0-0 Then voted, that Deacon Moses Payn, the Present Town Treasurer, be allowed to take Forty shillings out of the money of the Towns Treasury in his hands for his service as Town Treasurer for the year past, and this present year ensuing.


Voted, that Ebenezer Thayer should have another year allowed him for the taking off the wood on the Towns land which he was to have of the Town.


Voted, that the disposing of the Towns Land be referred, untill next May meeting.


Then voted that the Memorial of the Honourable Edmund Quinsey Esqr. and Mr. Joseph Crosby be referr'd until next May meeting.


Then voted, that the request of Josiah Faxson about settling the bounds between his and the Towns Land be (also) referr'd to the above said May meeting.

coming, and all such Bulls to be entre'd by the last of March yearly and every year during said five years, and to be kept to the first of November following yearly.


Voted, That a Committee be chosen to lett ye Town's Lands and that there should be of that committee Three persons chosen.


The committee to Lett the Towns Lands, then chosen were Capt. John Mills, Lt. John Cleverly and Mr. Benjamin Neall.


Then voted, that the Towns Lands & meadows should be Lett for 12 years.


Voted, at the same time that the heither part of the Towns Lands joyning to the Land of William Savel, Deceased should ly to be improved only for pausture, the said twelve years.


Then voted that about the middle of the said term of 12 years, that three crops of grain may be took off of the remainder of the Towns land.


Voted, that the rents of the Towns Lands be paid in to the Towns Treasurer for the support of ye Grammer School.


Then voted that their should be a committee chosen to settle the bounds between the Towns Lands and Josiah Faxsons Lands.


Voted, that a committee be chosen to make a final settlement of ye Lines & Boundaries betwixt common Lands and Private Persons, and to make Report thereof to the Town.

The Moderator then moved it whether the Memorial of Col. Quinsey and Mr. Joseph Crosbie referr'd till this may meeting would be now considered on, it passed in ye negative.


May ye 12th. 1718.


voted, that Major John Quinsey Esqr. should have liberty to make half a ditch fence upon the Towns Land in the line Between the Towns Land and said Quinseys he allowing the same liberty for the town if they shall se cause.

Then voted that Eliezer Isgate have liberty for getting stones off of the common (with his own hands) what he pleases, and that without paying for them.


August the 4th. 1718.


The Inhabitants of Braintree Lawfully assembled then chose the honourable Edmund Quinsey Esq Moderator for yt Day.


Then voted that the Interest money of the Towns that now is or may be in the hands of the Town Treasurer shall be paid out for the defreying the Towns charges at the order of the Select men.

The Constables then chosen were Mr. Ebenezer Hinckley, and Mr. David Rawson, but said Rawson refused to serve & paid Five Pounds to Deacon Pain Town Treasurer, and said Hinckley hired Nathaniel Owen, who was accepted by the Town in his Room.

They chose Deacon Moses Payne, Town Treasurer for ye ensu- ing year. Then voted that he should have Thirty shillings for his. service, in case lie continued in said service ye year ensuing.

Then voted that Joseph Parmenter should have for his service the year past as clerk and for writing of leases &c for ye Town Twenty six shillings


Then voted That there be Thirty shillings allowed out of yo Towns Treasury, to every Person who shall keep a good sufficient Bull of Two years old at the least, in a good pasture for ye use of ye Town, ye year ensuing, and every such Bull to be entred by ye Town Clerk, sometime in March.


Then voted, likewise that there be Twenty shillings allowed out of the Towns Treasury, to every Person who shall keep a good sufficient Bull Running at large, approved of by any one or more of the Selectmen, said Bull to be for the use of ye Town, and entre'd by ye clerk as aforesaid.


Then voted that there be Five shillings allowed out of ye Towns Treasury, to every person, that shall keep a good sufficient

it was Then moved by the Moderator, whether or no the Town would stand by the Select men, in their Laying out a way through Col. Quinseys and some others Lands (at their consent) where the way was before, and it passed in the affirmative.

at the same time it was then propounded by the Moderator whether the Town would choose a committee to treat or agree with Edmund Quinsey Esqr. as to any recompense for the way lately laid out by the selectmen, over his & some others Lands, it passed on the negative.


Then moved by the Moderator, whether or no the 6000 acres of Land, granted and lately confirmed by the honoured, Court, should be sold, it passed in ye negative.


March 23ª. 1718/19


The Moderator then propounded whether the Town would choose a Committee to consider who are or ought to be proprie- tors of said land, and to make report thereof at the next Town meeting, it passed in the affirmative.


Then voted that seven persons should be chosen for a Commit- tee to attend said service.


The Committee then chosen were


Lt. Joseph Neall Deacon Samuel Bass. Lt John Cleverly. Mr. Joseph Adams. Mr. Samuel White Mr. Joseph Crosbie. Mr. Peter Hobart.


March 23d. 1718/19.


Then voted that the present select men, doe, goe & view that way that is laid out in the South Precinct, from the country road by John Thayers and so by the meeting house through that street till they come to the Country Road againe by John Copelands Barn, and to doe what they shall then think necessary to be done [137] The warrant for the aforesaid meeting was as followeth. Freeholders and other Inhabitants of said Town, Qualified ac- cording to law, to vote in Town affairs, That they meet at ye old meeting house in said Town on Monday the 23ª. Day of this instant March, by nine of ye clock in ye Forenoon. Then and there to consider of Debate upon and agree about, an answer to ye petition of Edmund Quincy Esqr. and Mr. Joseph Crosbie Relating to a Private Drift way through their land &c. As also about managing, Improving Dividing or Disposing of ye six thou- sand Acres of undivided or common Land : lately laid out & con- firmed to ye Town by order of the honoured General Court. As likewise to consider further about any other Town ways, hereof fail not, making returne of your doings herein, to one or more of the select men, on or before said Day dated in Braintree the 16th. Day of March in the year of our Lord 1718/19 and in the Fifth year of his majesties Reign.

Deacon Samuel Bass one of ye Committee chosen by ye Town last march meeting, did on ye behalf of said Committee make this Returne, that it was ye opinion of said Committee, That ye 6000 Acres of Land which was formerly granted, & lately confirmed by ye honoured Court to this Town belonged to the Persons that were then Freeholders & to their Posterity.


It was then moved by ye moderator, whether or no the matter Relating to said lands should be deferred to the next Town meet- ing, it passed on the affirmative
