[258] The Comtee. to Prepare Instructions for their Repre- sentative offerd their Report to the Town which was voted accepted & ordered to be transmitted to their Representative for his direc- tion


Voted, that Eighty Pounds be assessed on the Polls & Rateable estates within said Town the Present year.


1769 May 15


The Freeholders & other Inhabitants of the Town of Braintree being assembled by adjournment from the sixth of March last.


Constables allowed. Mr Seth Man appeared and urged the necessity of a greater allowance for his service as Constable than usual as there is a great probability of the Taxes being augmented. Voted, that in such case the Town will make said Man such fur- ther allowance as may be reasonable, and in case there should be no Province Tax the year ensuing, sd Man to Relinquish the forty shillings already allowd.

Constables allowed. Voted, That Josiah Vesey who was chosen Constable in March last be allowd. Four Pounds. Then Voted, that Daniel Arnold be accepted to serve in the office of a Constable in the place & stead of the sd Josiah Vesey, said Vesey giving in Bond to indemnify the Town as usual.


Way thro' Mr. Eben". Copelands. Voted, That the Select Men be desired to take care of and effect in the best manner they can the Town engagement the 16th. of May A.D. 1763, Respecting the erecting a stone Wall fence on one side the way laid thro' Mr. Ebenenezer Copelands Land, Provided others make the wall on the other side as Proposd. Voted, that all the Inhabitants that are on sd Way and so to Weymouth Line be excused their Tax on the Highways this Present year and be allowd to work in lieu thereof on sd wall. It is likewise engaged by the Proprietors of the Lands, on sd way that in case the wall be effected thro' sd Copelands land that the Way be laid open to Weymouth Line, according to the Report of the Select men accepted the aforesaid Sixteenth of May A.D. 1763.


Voted, That Enoch Hayden be remitted the interest due on his Bond to the Town for two years last past.

Anno Dom 1770 The Anniversary Town Meeting for the choice of Town Officers, March 5th. 1770.


The Freeholders & other Inhabitants of the Town of Braintree Qualifyd by Law to vote in Town affairs being assembled at the Meeting House in the Middle Precinct of said Town, for the choice of Town Officers and Transacting the other affairs of said town the particulars whereof as Inserted in the Warrants are as follows, (viz) After a Modr. Chosen &c.


First, To choose all such Town Officers for the ensuing year as the Law requires, also a County Treasurer.


Secondly, To direct respecting the repairing the Highways within sd. Town the ensuing year, also to consider the altering the Towns way thro' the Lands of Mr. Sam". Bass Jr & act thereon.


Thirdly, To consider of Building a Work House and act thereon as the Town shall think proper.


Fourthly To see if the Town will remitt to Mr. Joseph Baxter a fine laid on him for the Town for rescuing a Horse from M' Sam1. Ruggles.


Fifthly, To hear the Reports of any Comtees or choose any Com- teen that may be necessary.


Assembled as aforesaid Dean. Joseph Palmer Modr.


Cler & Treas". Then Elisha Niles was nominated & chosen Clerk & also Treasurer.


Wardens. The act relating to the observance of the Lords Day being read, Mess". Jona Rawson, James Brackett Jr. Sam". Niles Esq. John Hayden, Isaac Spear & Simeon Thayer were chosen Wardens.


Constables. Then Ebenezer Adams, Hobart Clark & Jon" Bass were seperately, chosen to serve as Constables.

Mr. Jona Bass Presented Jona. Hayward 2d. to the Town to serve in the office of a Constable in his the Bass' stead. Voted, said Jonathan Hayward, be accepted to serve as Constable Pro- vided sd Bass, Lodge a Bond with the Town Treasurer to secure the Town from any damage that may accru by his default in said office.


Then the meeting was adjourned to the Day the meeting shall be appointed in May next for the choice of Representative and to be opened immediately after the business of sd meeting shall be over.


1770 May 25th.


Warrant The Freeholders & other Inhabitants of the Town of Braintree Qualifyd to vote in the choice of a Representative, also those that were Qualifyd to vote in Town affairs being assembled at the Meeting House in the Middle Precinct of sd Town for the choice of a Representative (Pursuant to a Precept directed to the Select- men of sd Town under the Hand & seal of the Shiriff of the County of Suffolk) likewise for the Transacting other affairs of sd Town the particulars whereof as Inserted in the warrants are as follows (viz) After a Modr. chosen, &c To raise money to defrey the

charge of the Town the currant year. Likewise to hear the re- port of the Town Treasurer, Respecting alterations he has made on the Towns Speciallties and direct sd Treasurer or a Comttee that may be chosen as the Town shall think proper relative to that af- fair.


Representative. Assembled as aforesaid, Eben". Thayer Esq". was chosen by the Town to Represent them in the Great & Gen1. Court or assembly the ensuing year.


Modr. Then Dea". Joseph Palmer was chosen Modr.


Protest against meeting at Cambridge. Voted, Whereas the present precept directing us to choose one or more Representatives requires our sending such person or persons to Cambridge, But the Law positively directs that the Gen11. Court shall meet at the Town House in Boston, We do protest against said requirement for the Gen11. Court to meet at Cambridge, as illegall and an in- fringement of our Rights & Priviledge, and that our compliance with the Precept aforesaid is through necessity and shall not here- after be drawn into precedent.


[261] Money raised £80. - Voted, that Eighty Pounds be assessed on the Polls & rateable estates within sd Town to defrey the charges the current year.


The Treasurer directed Respecting Wm. Hobarts Deed of The Towns Lands. Voted, That Elisha Niles Town Treasurer be directed & impowered in the name & behalf on the Town to make & execute a good & sufficient Deed to William Hobart of the Towns Land lately conveyd to John Curtis Jr. and take from sd Hobart a mortgage Deed for the Towns Security.

Way to Ferry Point Voted, The Selectmen be desired to view the way leading to Ferry point and if they think advisable to Lay out the same and make report to the Town.


Fish Comtee. Voted, Capt John Hayward, Mr. Caleb Hobart & Moses French be a Committee to prevent obstructions to the fish in their passage to & from the pond.


[262] Comtee Report on the Treasury. The Comtee ap- pointed on March 6th. 1769 to settle accompts with the town Treasurer also to examine the Selectmens accts offerd. their Report to the Town. The report respecting the Treasury was accepted & stands in the Treasurer's Book vide voll 11 Fol. 138.

Treasurer allowd. £3-0-0 Voted, The Treasurer be allowed three Pounds for his last years service.


Comtee for settling the Treasury. Voted, Messrs. Edmund Bill- ings, Edmund Soper, & Joseph Porter, be a Comtee. to settle accompts with the Town Treasurer.


The Town Comtee offerd. their report.


We the subscribers being appointed by this Town a comtee to consider the affair respecting the way through Wm Harmons Land and also through James Brackett Jun'. Land Have attended that service and are of the opinion that the Town have nothing to do in that case.


But that those that have occasion to pass thro' sª Land, must agree with sd Harman & Brackett for themselves except the Town choose to purchase to ways, which will be attended with consider- able cost.

The Freeholder & other Inhabitants of the Town of Braintree Qualifyd. by Law to vote in Town affairs being assembled at the meeting House in the middle Precinct of sd Town Pursuant to warrants for that purpose. After a Moderator chosen &c.


The Towns transaction relative to an assessment cominittee to Benja Baxter to Collect & pay to the Province Treasurer. To receive the report of the Selectmen relative to an assessment com- mittee to Benja Baxter late Constable to collect & pay to the Prov- ince Treasurer, and to direct the Selectmen or a Committee for that purpose in that affair, as they shall think proper.


Assembled as aforesaid Deac". Joseph Palmer Modr.


The Selectmen having offerd their report to the Town relative to the assessment abovesaid &c


Voted, The Selectmen be desired to inspect that affair and that they be vested with a Discretionary power to act in that affair and secure any part of sª Baxters estate (that they may judge safe) for the Town.

Secondly, To consider of a request of a Number of the Inhabi- tants of sª Town relative to opening the Way from Mr Borlands Corner to Milton & Dorchester Lines thro' the Farms (so called) and act thereon, also to consider & act upon any thing relative to ways that may be laid before sd meeting.


Thirdly, To see if the Town will Petition the Gen1. Court that the Petit Jurors may be paid in the same manner the Grand Jurors are, or raise the fees.


Fourthly, To consider & act upon a request of Sam1. Niles Esqr. a surveyor of Ways respecting laying a Bridge.


Fifthly, To consider of and act upon a request of Enoch Hayden respecting interest money due from him to the Town to see if the Town will remit the same for reasons to be offerd.


Sixthly, To Hear the report of any Comtees or choose any comtees that may be necessary.

Voted, That each Constable be allowd forty shillings afterwards voted the sd Joseph Cleverly 2d. be allowd three Pounds, Provided he serve in sd office or procure a man to the Towns acceptance.

Petition of Dorchester Inhabitants. A Petition of John Billings, William Glover, Eben'. Glover, Josiah Glover, Ezra Glover, & Oliver Billings inhabitants of the Town of Dorchester, setting forth a resolution that they have come into to Petition the Gen11. Court that they & their estates may be sett of to Braintree Pray- ing this Town in case they should be annexed to Braintree that they may in their own persons be excepted from serving in the office of Constable &c.


Voted, The above named Persons shall be exempted from serv- ing in the office of a Constable, Provided they be annexed to Braintree as is above proposed


Votes, for a County Register & County Treasurer were brot. in sealed up & committed to Ebenezer Adams Constable to return.


adjourned Then the Modr. with the consent of the meeting ad- journed to Tuesday the twelfth instant two o'clock P.M at this place.

The Freeholders & other Inhabitants of the Town of Braintree being assembled by adjournment from the 4th. instant, proceeded as follows, (viz)


Voted, That Adam Hobart be excused serving as Surveyor of Highways.


Surveyor of ways. Thomas Faxon & Isaac Niles were chosen Surveyors of Highways.


Deer reaves. Ephraim Hunt, & Seth Man.


Sealers of Leather. Benja. Cleverly Jun". & Abijah Allen.


Hogg-reaves. Adam Hunt, Enoch Hayden, Josiah Hunt, Wil- liam Hobart, Noah, Hayward & Richard Spear.


Voted, That Hoggs run at large the year ensuing.


Voted, The Highways, within sd. Town be repaired by a Tax as usual.


Way from Whites To Haywards accepted Voted, The way as has been fenced out & improvd. from Lieut Joseph Whites to Lieut Joshua Haywards be accepted as a Towns way, Provided it be allowed exclusive of any charge to the Town.


Middle Precinct Constables. Voted, To Choose another Con- stable in the Middle Precinct of sª Town. Then James Faxon was chosen Constable. also voted the two Constables in sd middle Precinct be allowed forty shillings only.


Edmund Soper Presenting Thomas Newcomb to the Town to serve in the office of a constable in his stead voted sª Newcomb be accepted Provided sd Soper give Bond to the Treasurer as has been practised


Constables accepted. James Faxon presenting Stephen Penni- man to the Towns acceptance as Constable Voted, sd Penniman be accepted on condition as above.


Sº Prect. Collector. Voted, Lieut Joseph Hayward be a Col- lector to collect the assessments in the South Precinct for the year 1770, Provided Jonathan Bass, give Bond to the Treasurer for sd Haywards faithfull discharge of sª office

Comtee on Mr Bass' Way. Voted, To raise a Committee to view the way thro' Mr Sam1 Basss Land, and that sd Comtee serve gratis sd Comtee to consist of seven. Then Elisha Niles, Capt. John Hay- ward L' Benja Hayden, Mr Caleb Hobart, Edmund Soper, Ens". Thomas Thayer & Stephen Penniman, were seperately chosen a Comtee to view sª Way to hear the parties relative thereto and make report to the Town.


Inspector of ye River Then Mr. Thomas Vinton was appointed to inspect the river and to be under oath to complain of every breach of Law that may come under his cognizance relative to the fish, in sª river.


Fish Committee. Then Capt. John Hayward, Edward Soper & Moses French were chosen a Comtee. to prevent the obstructions to the Fish in their season of running to & from the ponds.


Petition Jurors fees. Voted, The Selectmen and Clerk of this Town be desired to prefer a Petition to the Gen11. Court at their next sessions that the Petit Jurors fees may be raised.


Enoch Hayden interest remitted. Voted to remit to Enoch Hay- den the interest due on his Bond to the Town for two years past, also the interest that will become due the 30th. of April next.


Comtee for settling accts. with Town Treas'. Voted, to raise a Committee to settle accts. with the Town Treasurer Then Mr. James Clark, Mr. Azariah Faxon, & M". Joshua Hayward Jun". were seperately chosen a Comtee for that purpose.


The Comtee for settling the Treasury their report choose for Do James Clark Azariah Faxon & Joshua Hayward Jr. The Com- mittee for settling the Treasury offerd. their report which was voted accepted and stands recorded in the Treasurers Book vide voll. 2, foll.


Then the meeting was adjourned to the day the meeting may be appointed in May next and to be after said meeting.

The Freeholders & other Inhabitants of the Town of Braintree Qualifyª. by Law to vote in the choice of a Representative, also those Qualifyd. to vote in Town affairs being assembled at the Meeting House in the Middle Precinct of said Town Pursuant to warrant the particulars whereof are as follows (viz) To Elect or Depute one or more Persons to serve for and represent them in the Great & Gen" Court or assembly appointed to be convend held & kept for his Majestys service at Harvard College in Cam- bridge upon Wednesday the Twenty ninth Day Instant and so Die in Diem during their session or sessions. Then after a Modr. Chosen.


Warrants. First, To raise money to defrey the Charge of the Town the present year.


Secondly, To direct the Town Treasurer respecting some of the Town Specialties under his care.


Thirdly, To see if the Town will excuse the Dorchester Petitionrs. from serving in the office of Constable in case they should be sett off to Braintree.

Money raised £100- Voted, That one Hundred Pounds be assessed on the Polls and rateable estates within said Town to de- frey the charge the current year.


Treasurer directed respecting Mr Wales & Mr. Bracketts Bonds. to ye Town. Voted, The Treasurer be directed to discharge Twenty six Pounds, thirteen shillings & four pence of Mr. Nath1 Wales Bond to the Town and releive Mr Moses French's Bond together with sd Nath1. Wales & Benja Vesey for said sum payable to the Town.


Voted, The Treasurer be directed to discharge Mr James Brackett Jun'. his Bond to the Town for Lands purchased, and receive a Bond payable to the Town from Moses Adams, Ebene- zer Adams & Christopher Thayer Jr. of the same sum.

adjournmt The adjournment of the Town meeting from the Twelfth of March last was attended.


Voted, That L' Nath1. Belcher Jr be excused serving as Tything man the present year and Mr. Mathew Pratt was chosen to sd office.


[267] The Selectmen offerd their report to the Town respect- ing a way laid out as follows (viz). We the subscribers being de- sired by some of the Inhabitants of this town to lay out a way from M' Ephraim Thayers to Mr. Shadrack Thayers, we accord- ingly attended said business and are of opinion that it is necessary a way should be laid out as the Lane is fenced out between said Ephraim Thayers Land and the Land of Mr Eben'. Clark as far as sd lane goes, then from the Westerly corner of sd Clark's Wall to a heap of stones near the line which divides said Clarks other Land from the Land belonging to the Heirs of Daniel Bass decesd. and to run on that Line till it comes to the Land of Mr. Shadrack Thayer said way to extend one rod & half south from sd line. Then from sd Division Line through the Land of sd Shadrack Thayer running to the Southward of a walnut Tree Blazd. Then as the old cart way goes till it come to the Lands of Nath1. Thayer decd. said way to be one rod & half wide then through said Nath1 Thayer's Heirs land as the old cart way goes till it comes to a Post in the corner of a Fence on the top of a Hill southward of the House where said Nath1. widow lives then as the fence runs till it comes to the sd House one rod & half wide then as the lane now goes.

BRAINTREE RECORDS, 1772.


The above Report being read before the Town was voted ac- cepted Provided the Proprietors of the Lands thro which said way is laid out make no demand on the Town for the Land or fencing the same. also Voted, Elisha Niles be directed to pay out of the Towns Treasury Four Pounds to the Proprietors of said lands when and as soon as he shall obtain a Receipt from cach & every Proprietor of the Lands thro which sd way goes (in behalf of the Town) that they allow sd way to lye open for the use of sd Town, and that they make no further Demand on the Town for sd way.
