Also the sayd Josiah Chaffin shall have five acers of salt marsh of the towne of Brantrey lying one the south west sid of Speeres land by the sheep Penn, and next to Samuel Belchers Marsh one south east ; ffor which marsh being judged about 5 acers the sayd Josiah Chaffin dos bind himselfe heires executors and assignes to pay or cause to be payed at or before the first of January yearly the just sume of thirty shillings in moneys worth unto the select- men or by their order for the Townes use. [15] About 20th March 69. Propositions made betwene Brantry Towne & Mers Anna Thompson
Ther being propositions made by Elder Baitts Deacon Dyer of waymoth and Capt. ffoster of Dorcester chosen by the County Court held in January 68 : ffor to heare the matter in difference betwene the Towne of Brantry and Mrs. Anna Thompson, and so to make a returne of it onto the next County Court, And these propositions was made after a full debate of matters by both par- tys, wch was that the Towne of Brantry should give Mres Anna Thompson the Just sum of forty pounds in the yeare (69) and this should satisfie upon all demands and the Towne of Brantry should have a full discharge and be acquitted by the sayd Anna Thompson from all after demands whatever ; only what is given in her last six bills she had liberty to get her due of each person wch was in her bills set downe legally by the Deacons.

Their being a Towne meeting called & generally meett together it was voted and concluded their should be a chh rate made to the sum of sixty six pounds, and be disposed as followeth. viz 15€ to Mr. Peter Buckly of Concord : twenty shillings a man for all the ministers that had bine helpfull to the chh and the remainder should goe to Cor Josiah fflintt.

At a publike Towne meeting upon the call of the chh of Bran- try Mr Moses ffiske to be minister to this congregation it was agreed and concluded by the major part that a house and land for an orchard should be bought (or land) and a house built by the whole and it should stand as an accomodation or supply for the ministry from time to time (and allowance for a yearly salyry was 60 pounds to be payed at the countrys set prise for country rates : and five acers of Towne salt marsh the grass therof from yeare to yeare for the ministry :

By the consent or approbation of the Selectmen of Brantry a Towne meeting was called; and persons warned therunto by Robert Stevens and the Towne being meet together it was voted - viz As followeth that the selectmen Deacon Base Capt Richard Brackit Tho : ffaxon Sr Wm Vesy Edm : Quinsey with these three persons chosen the three persons chosen Joseph Crosby Steven Willise to joine with them shall confirme the bargine made with Bro : Samuel Tompson wch is to make an exchange of six acers of salt marsh tenne acers of Rocky common, with fiftenne pounds of [sil- ver] payed by the Towne in way of Rate : this land and money to [be] given to Bro. At the same Towne meeting it was voted that the Towne Bran- try would give to Mr. Moses ffiske the just sum of sixty pounds in money as by a Towne rate and he to make provision for him- selfe as housing and land therunto this was to be tendered vnto him ; - or else to live in a Towne house provided for the ministry. And this house and land bought by the Towne of Brothe Samuel Tompson being about five acers and a halfe or six acers to be fenced and housing set in good repaire :
Dec : 12th. 72. A highway to the Comon.
The Selectmen being meet together to consider about high wayes over the land of John Baxter unto the Comon and we find- ing the side of the hill dangerous, we doe lay out the way to be upon the hill just above the captaines plaine bridge a rod and halfe in the midle within the fenc and to come in and goe out whene the selectmen pulled up the fenc

At a publike training day it was voted, and passed one the affirmitive, that Christopher Web S' should forthwith goe and find out a trackt of land, and by a Sirvaer lay out 6000 acers which was the generall Courts grant vnto the Towne of Brantrey and shall make a returne of it in a plott under the sirvaers hand to be wel bounded by marke trees with B T set one the barke of the trees and heapes of stones or by diging a litle square hole that their maye be markes upon every side within 50 rodes one of another ; the sayd Web and partners being at all the charge ; and this being sufficiently and wel done the Towne dus allow the sayd Web and partners 1500 one thousand five hundred [17] acers for their paines and charge ; in case it be lookt out in a months time, and layed out; the sayd Webb is to give 6 weekes worke to the Towne ; and the plott by the sayd Christo : Webb to be presented to the Hond Generall Court to have it confirmed to be the Townes of Brantry : It is not to be understood that the said 6000 acers shall be layed out within a month from the date specified, but within a twelve month ; Josiah Chaffin and Joseph Crosby are accepted by the sayd Christopher Webb as equall partners they being at equall charge : and these three persons are to have an equal part in quantity and quality out of the 6000 acers ;

It being brought vpon a secund consideration by Samuel Tomp- son and some of the Towne accounting it to hard upon Samuel Tompson it was then granted by the Towne of Brantrey being meet together that it sheuld be neere about twelve acers which first rote was but about tenne acers.
Also voted and assented by the Towne then meet together that Rich. Brackit Samuel Base Thomas ffaxon Wm Vesy Edmond Quinsey being selectmen in the yeare : 72 : shall signe a deed in the Townes behalf to Samuel Tompson and John Mills Jur. :

These may certifie whom it may concerne that I Moses ffiske doe herby acquitt and discharge the Towne of Brantrey respecting their ingagmts to me by rates allowed by them for my salary for my four first yeares of my labours with ye in ye ministry : vid : from part seventy one seventy two to yeares past seventy foure Seventy five ; But in case any person or p sons be indebted, it is tobe un- derstood of any such persons or persons, capeable to satisfie that they shall be lyable to pay theire arreires by distress, their names being returned to the Deacons : December 4th : 1676 : y Mr. Moses ffiske

Their being a highway layed out formerly by the Selectmen of Brantrey a way into the Towne land and so into the neckes and Towne meadows ; which way by Peter Georges land and through the land of Henry Neals (by their request) to the Selectment it was layed under the hill ; along by Peter Georges orchard and at the end of Henry Neals meadow their being left about two rods from the meadow ; and so also through the Towne land 2 rods and through Mr. Thomas Sheapards land which is in the occupation of George Speere, and so to Mr. Haughes necke as formerly called and so through the Towne land in the ancient way over the ridge hill to Edmond Quinseys necke which way their being some obstruc- tion as to repairing of this way in diverse places we the selectmen of the Towne as Wm Vesy Joseph Adams Samuel Tompson Josias Chaffin and Edmond Quinsey doe also agree to and confirme the same way to remaine for the Townes use ; wheras the way is straightened at Peter Georges corner the wall being vp already we doe judge the way at Henry Neals corner at the black stump to be so wide that one cart may pass well by another

A true Copie of the Selectmens of Boston given vnder their hands to the Selectmen of Brantrey in giving up all their lands unto the Township of Brantrey accepting Mr. John Wilsones farme Pastour of Boston first chh 20th (8) 1647.
This writing wittnesseth : - That it is agreed betwixt the Se- lectmen for the Towne of Boston on ye 1st and Martin Saunders Samuel Bass and Mathew Barnes for and in the behalfe of the Towne of Brantrey one the other party : - That wheras Boston hath certaine lands lying betwene the bounds of Dorchester and ye bounds of waymoth as by the grant of the Court as will appear ; It is now agreed, by and betwixt the partys aforsaid; in the

behalfe of the Towne aforesaide (as followeth) to witt the Select- men of Boston for and in the behalfe of the Towne doe graunt that all such lands of theirs within the Precinct aforsaid (being hertofore comonly called and known by ye the nam of Mount Willis- ton shall be accounted wthin the Township of Brantrey, and lyable to bear all comon charges in yt Towne when they are layed out and improved. The Towne of Boston still retaining the right and power of allotting and disposing of all these lands to ytickler persons yt are yet vnlotted out ; The Towne of Brantry paying the sum of fifty pounds in manner as followeth vnto the use of the Towne of Boston) viz tenne pounds the 10th. of January next ensuing the date herof and ten pounds each first month ensuing (the next first month excepted) for foure yeares successively vntill the whole be payed all ye said Payments to be made in mer- chantable corne as wheat Rye peas & Indian at fifty shillings in each of them, wch sayd sum of fifty pounds being payed the inhabitants of the Towne of Brantrey are not only to enjoy for a comon the 1500 acers formerly layd out for a comon, but also the above liberty and power uth all their inhabitants as other townes to bring in att improved lands to bear comon charges uth them. Provided that Mr. John Wilson Pastour of the chh of Boston shall not be ratted unto Brantrey for his farme at Brantrey only that his [farm] shall be still lyable as hertofore : Finilly it is agreed and prmised by ye said three men of Brantrey, to make the A for said Payments.
[22] Att the meeting house of Boston to the Selectmen ther- of, wch shall be successivly chosen ye severall yeare. In witness whereof, the Selectmen of the Towne of Boston for the time being on the one Part and Martin Saunders Samuel Base and Mathew Barnes one the other part in the behalfe of the Towne of Brantrey interchangably have set to their hands this 20th (8) 1647

At a Country Court held at Boston 30th April 1662 Thomas ffaxon Sent Peter Brackit and Moses Paine in the behalfe of the Towne of Brantrey Plaintiff, against Thomas Gatliffe of the sd Towne Defendant in an action of the case by Treaspassing vpon the Townes right in lands that is or hath bine flowed by the mill pond by mowing grass and chalenging it as his owne propriety as alsa trespassing vpon the Townes common in fencing in part of it and vpon the townes highway by his building fencing and digging holes according to attachment dat: 23. 2 mo : 62.

Whereas a p cell of land about twenty yeares Sinc was granted vnto Richard Wright by the Towne of boston for the encorigment and furtheranc of a water mill at Brantrey wch said mill and pond together with other estate hath been sold by the said Wright vnto major Gibbins and by him vnto Symon Lynde and by the said Lynd assigned to Thomas Gatleiffe [23] who now dwelleth [on] and possesseth the same and wheras sundry differences are arisen concerning the mill pond and flowing therof by reason of divers apprehensions how and for what end the sd pond was granted therfore so it is that I, Thomas Gatliffe of Brantrey, miller doe herby owne and declare that I doe fully apreehend and adjudge that the sayd mill and pond and flowing therof was at first granted for such an end and purpose as that the Towne of Brantrey might be served and accommodated therby and as it hath ben hitherto so improved and at this time is so ; I declare and promise by gods assistance that I my heires and assignes shall so improved the said pond & noe wayes seeke to cast down, or demolish the same to the frustrating of the Townes accomoda- tion as wel as my owne particuler profit by grinding, and we Thomas ffaxon Sr., Peter Brackitt and Moses Paine part of the Selectmen of Brantrey and as chosen and apointed by the Towne of Brantrey to end and setle the differences about the said pond doe a also herby in or owne name and in the namof the Towne of Brantrey declare and owne that we also doe apprehend and Judge that the formentioned mill pond was granted as aforsaid for and to such an end and purpose as is above exprest and doe herby for us and o' successors of the Towne of Brantrey declare and promise that neither wee nor they shall or will seek to interrupt hinder or molest the said Thomas Gatleife his heires or assignes for or touching the said mill pond, or flowing therof or any wayes seeke to demolish the same but on the contrary gladly cherish and countenance the maintening and upholding the same for the ends and purposes afformentioned for wch it was granted. In wittness wherof the [parties ] aformentioned have subscribed hervnto ther hands this 30th April 1662 Thomas Gatlife Peter Brackit Tho : ffaxon Moses Painc. Att a Country Court 30th April 1662. Capt Rich : Brackit Levt. Rich. Cooke appeared before the Gover and deposed that having subscribed their names as wittnesses to this paper were present and did both see and heare Tho : Gatleife in behalfe of himselfe and Peter Brackit Tho : ffaxon and Moses Paine in behalfe of the Towne of Brantrey signe and publish the writing contained in this [paper] to be their agreement. We whose names are under written being chosen a committee at a legall towne meeting to conferre uth Leut John Holbrooke of waymoth and Christopher Webb of Brantrey about the rebuilding of the Corne mill being demolished by fier, and we finding a record of an agreement formerly made by a Committee chosen by the Towne of Brantrey as Peter Brackit Tho : ffaxon S'. and Moses Paine ; made with Thomas Gatliffe who was posessor of the said mill ; Therfor we who have subscribed being meet together and heard considered what has. bine proposed and what we find recorded as a former agreement we adjudge that in case any inhabitant of the Towne shall build any other mill, so long as this mill dus make a sufficient supply vnto the Towne for grinding we judge to be contrary to what was agreed upon and we also agree that the custome of the Towne is ingagded to this mill, while wel supplyed ; and vsed. Therefore we account him an offender that doe make vse of any River that is not perticular propriety to grind for the inhabitants : As Wittness o' hands this 22th January 1674.

At a publike Towne meeting it was voted [by] the Towne that Samuel Base Sr. Capt. Rich : Brackit Sam : Tompson Christo : Web and Edm Quinsey should be a comittee for to treat with the heires of Mr. John Wilson formerly pastour of the old chh in Boston or whom they shall impower about the difference between the Towne of Brantrey & the Tenents of the farme (lying within the Towne- ship of Brantrey)
It was voted & passed one the affirmative that Edmond Quinsey & Christo : Web Caleb Hubart should let out the Towne land for harvest the three yeares not exceeding

According to this vote of the Towne Edmund Quinsey Caleb Hubart Christo : Webb Sr. have let & set vnto John Baxter the hither towne land being about 40 acers to improve in pasturing for the tearme of three yeares next Insuing from the Date herof he fencing of it; (& prohibited taking of any wood but to fenc)

The said Baxter or his heires paying to the Towne of Brantrey foure pounds per annum forty shillings in money and forty shillings in good Indian or Maulte at prise current yearly ; or in case Mr. Benjamin Thompson will have two cowes summared the said Jo : Baxter shall sumer them ; & be allowed twenty shilling a yeare out of the corne pay : that is to be vnderstood, while he sumer the 2 cowes he is obliged to pay 40$ in money & 208 in corne per anum : as Wittness or hands

Their being meet at Caleb Hubarts house the Selectmen as Ed- mund Quinsey Caleb Hubert Edmund Sheiffeild Henry Neal, ther was severall of the Inbabitants that dwel in the eastward part of monotocat as Joseph Arnold Larance Copland Thomas Holbrook they desired that the Selectmen would goe and lay out a highway for them to goe to their houses, and it was agreed by the Select- men there present that John ffrench Sr. & Samuel Howard should have a sufficient cartway betwene them both as halfe the way upon Samuel Howards land and halfe the way to ly upon John ffrench land vntill it comes to the Towne's Common of forty acers, & John french willingly assented to it that gates should be set up at both ends of the way ; & the way is to be 20 foote wide
[26] 4th March 1677/8. About Mr. Wilsons farme
At a Publike Towne meeting it was voted one the affirmative that Christopher Web Sr. & Joseph Crosby should have full power to act in behalfe of the Towne of Brantrey in making a full agre- ment & sshure of all differences now depending at Court betwene the heires of the Late Revd Mr. John Wilson pastour of the first ch in Boston & the Towne concerning the payment of all rates & dues to the towne & Country or by a furder prosecution at the general Courte :
3d March 1678/9 Mr. Benj Tompson 30£ Salary
At a Publike Towne meeting it was voted one the affirmative that Mr. Benjamin Thompson Schoole Master shall have this yeare for his salary the rent of the Towne land made vp thirty pounds & that the Towne give him a peice of land to set a house on vpon the Common to be set out by Joseph Crosby & Christopher Web not exceeding an acer & halfe or ther abouts & in case he leave the Towne the land to returne to the towne they paying for his building & fencing as it is then worth, but if he dye in the Towne servis as school master the land to be his heires for ever. -
It was also agreed that every child should carry into the school master halfe cord of wood beside the quarter money every yeare.

At a publike Towne meeting voted-wheras the inhabitants of the Towne of Brantrey having purchased of Wampa-tuck aliis Josiah a Indian Sachem all his rights title & interest to all the lands within the Towneship of Brantrey as apeares by a deed vnder the hand & seals of the sd Josiah Sachem & divers of his wisemen & wheras the greatest part of the inhabitants have en- joyed their particuler alotments and parcels of land they are pos- essed off by vertue of former grants & purchases made befor the obtaining the sd deed & which of right each person ought to injoy therfor for the avoiding future differences & troubles may arise about or concerning the premises it is herby ordered consented to & agreed vpon by all the inhabitants aforsaid, what so ever land any person or persons or sd inhabitants have or doe injoy by vertue of such grant or purchase they shall for ever injoy the same as the owne proper right to them thr heires executors administre and assignes for everi any thing in the sd deed to the contrary notwistanding.

At a generall Towne meeting the Towne made choise of Joseph Crosby Caleb Hubart & Christopher Web Sr. to prosecute their interest to the lands purchassed of Josiah Sachem by a treatey uth Boston Selectmen & in case they cannot comply to bring the matter to a faire trial as sorne as they can with conven- iency : But capt Rich Brackitt & Edmund Quinsey assented not vnto the vote.

It was agreed & voted that no person or persons whatsoever shall fall cutt or carry away any wood timber fencing stuffe from the common lands purchased of Josiah by the Towne of Brantrey vpon penalty of paying ten Shillings for eng load so carried of (the fifteene hundred acers of old common not herin included this to stand in forc vntile the Towne take further order That the committee apointed for to judge of dammage done vpon the Townes common as by the records appeareth are herby inpowered to send the counstable & fetch the penaltys by distress or in any other legal way to obtaine the same.
