Warrants. The Freeholders & other Inhabitants of the Town of Braintree Qualifyd. by Law to vote in Town affairs being assem- bled at the meeting House in the Middle Precinct of said Town to Transact the affairs of said Town the particulars whereof Inserted in the Warrants are as follows, (viz)
First, To choose any Town Officers that may be necessary. Secondly, To bring in Valuations to the Selectmen.
Thirdly, To raise money to Defrey the contingent charges of the Town for the current year.
Fourthly, To consider and Determine upon some effectual meth- od to Prevent the great difficulty that attends the Bridge called Fox Bridge.
Fifthly, To consider whether the Town will allow anything as an Encouragement to a Person that will engage to sett up & main- . tain a Horse Mill for the grinding of Grain.
Sixthly, To Hear the Report of any comttees or choose any com- ttees that may be necessary.

Moderator. Assembled as aforesaid, Sam11. Niles Esqr. was chosen Moderator.
The Comttee appointed for the sale of the South Comons made their Report to the Town agreeable to the Report offerrd to the Town 17th. of May last & exhibited therewith a particular acct. of said sale which was voted accepted.
Then Elijah Vesey was chosen Constable for the Present year
Money raised £130 - Voted, One Hundred & Thirty Pounds be assessed on the Polls & Rateable Estates within said Town to De- frey the charges of the Town the Currant year.
Comttee for ye Bridge. Voted, That Mr. Caleb Hobart, Capt John Hayward & Dea" Sam" Bass, be a Comttee to Inspect the Stone Bridge aforesaid & consider and Determine what they shall think necessary for effecting the Difficulty now subsisting and upon their Resolve thereon to Lett the same out to Labourers that shall ap- pear to effect the same at the lowest rate.
Voted, that the Town Proceed at this time Respecting a Horse Mill.
Vote for a Horse Mill. Voted, Mr. Jonathan Thayer be allowd to draw Forty Pounds Lawfull money, From the Town Treasury as an encouragement to him for the setting up and maintaining a Horse mill for the grinding of Grain, Provided the sd. Jonº Thayer with good sureties Lodge or Bond with the Town's Treasurer thereby oblidging Himself & Heirs for the space of Twenty years next succeeding to sett up & maintain a Horse mill nigh his the sª Jonathan's new Dwelling House for the Grinding of Grain so that any of the Inhabitants of the Town may be supplyd with Grinding in times of Drought or scarcity of water for Grinding at the water mills he Demanding & taking no more than the Lawfull toll and in his the sd Jonathans Projection for the setting up & maintaining sª mill, shall not prove effectual then the said Jonathan Thayer or his Heirs &c to pay the sd Forty Pounds with the Lawfull Interest for the same from the time lie Recd. said sum into the Town Treas- ury for the use of sd Town.

Comttee to settle with Treasurer. Voted, Dean. James Penniman, Capt. John Hayward & M' Azariah Faxon be a Comtee to settle accts with the Towns Treasurer & make Report to the Town.
1762, Sept 30th.
Warrants. The Freeholders and other Inhabitants of the Town, of Braintree Qualifyd. by Law to vote in Town affairs being as- sembled at the Meeting House in the Middle Precinct of said Town to Transact the affairs of said Town the Particulars whereof In- serted in the warrants are as follows (viz) after a Modr. chosen.
First, To see if the Town will reconsider their vote respecting a Horse mill to be sett up by Mr. Jonathan Thayer, and to act upon that affair respecting said Horse mill as the Town shall think proper.

Moderator. Assembled as aforesaid, Mr. Jonathan Rawson, was chosen Moderator.
Horse Mill Negatived. After Large Debate respecting the Forty Pounds allowd Mr Jonathan Thayer on 23ª of August Last as an encouragement for the setting up & maintaining a Horse Mill for the Grinding of Grain.
Voted, That the Town Treasurer be directed to withhold said sum & not Pay the same to the said Jona. for the purpose aforesaid the Town's vote above referd to notwithstanding.
Mr. Elijah Vesey Presenting Mr. Benja Bass, to the Town to serve as Constable in his stead. Voted, the sd Benjamin Bass be accepted, to serve in the office of a Constable the ensuing year in the stead of the sd Elijah Vesey, Provided the said Vesey Lodge good & sufficient Bond with the Town's Treasurer for the sd Bass faithfull discharge of said office.
Voted, the sd Benjamin Bass be allowed Forty shillings out of the Towns Treasury for his services as Constable the ensuing year.

The Freeholders & other Inhabitants of the Town of Braintree Qualifyd by Law to vote in Town affairs being assembled at the Meeting House, in the middle Precinct of said Town for the choice of Town officers & Transacting other affairs of said Town the Particulars whereof as Inserted in the Warrants are as follows (viz)
After a Moderator chosen.
First, To choose all such Town officers for the ensuing year as the Law directs, also a County Treasurer.
Secondly, To consider & Determine what the Town may think proper Relative to Schools & School Housen within said Town.
Thirdly, To consider and Determine Respecting building a Work House within said Town.
Fourthly, To Determine whether the Town Meetings for the future be warned by Posting up a copy of the Warrant in one or more Publick places within each Precinct of sd Town.

Votes being called for Constables Joseph Field was chosen & then excused for this year. Then Benja Savil, was chosen & then likewise excused for this year. Christopher Thayer was chosen Constable who Presenting, to the Town Moses French Jr. to serve in sd office in his The said Christopher stead.
Voted that Moses French Jr be accepted in the place or stead of Christopher Thayer to serve in the office of a Constable, Pro- vided the sd Christopher Lodge a sufficient Bond with the Town Treasurer to indemnify the Town from any damage that may arise by any default of the sª Moses in said office.
Also Voted, The said Moses French Jr. be allowed Forty shil- lings for his sd Service. Micah White & James Clark were chosen Constables.
Voted, Micah White be allowed Forty shillings out of the Town Treasury for his sd Service.

School Housen &c Voted, that there be a School House built in each Precinct of the sd Town at the Towns expense.
Voted, that the School House in the Northi Precinct be erected opposite to the Ten mile stake, Provided Mr. John Beal, will allow, a peice of Land in exchange for the Land where the old Pound stood.
Voted, The South Precinct have Liberty to provide a Place for to erect a School House.
Voted, That the school House in the middle Precinct be erected on the South east corner of Benja Hayden's Land at the Lane lead- ing to Mr. Lem11. Thayers
Voted, That a Comttee be raised in each Precinct to Plan the Bigness of sd Houses, & the manner in which they shall be built and let the same out to any of the Inhabitants of sd Town that appear & engage to Effect the same and the lowest Rate and that the offers for effecting sd buildings be delivered to the Respective Comtee of each Precinct sealed & that sd Committees shall declare the undertakers those that are Lowest in their bid or offer.

Voted, The Comttee in the North Precinct for Conducting the affair of the School House have full Power to contract with the aforesaid Jolin Beal Respecting the exchange of Lands as before provided and that they give & take security in the Name & behalf of the Town.
Voted, That the Town will not act on the Article respecting the work House, at this time
Warrants to be posted up. Voted, That the Constable in each Precinct be directed for the future to Post up a Copy of the War- rant for the Town meetings with a Notification of sd meeting Ten days before the meeting at Two Publick Taverns within each Precinct if such there be.
Voted, That the Selectmen be desired to view the way Referd to in the fifth article of the warrant & make Report to the Town on their adjournment of this meeting.
Voted, Mr Thomas Faxon be allowd one Pound four shillings pursuant to his Request
Voted, Dean. Palmer, Doct. Savel & Mr. James Brackett be a Comttee to treat with Collo John Quincy Respecting a way to accom- modate the Inhabitants of the Town to and from Haugh's Neck & make report at the adjournment of this meeting.
Comttee Report for settling the Treasury. The Comttee appointed 23d of August Last to settle accts, with the Towns Treasurer offerd. their Report thereon which was voted by the Town accepted which

The Honble Peter Oliver Esq Petition granted. On Reading the Petition of the Honble. Peter Oliver Esq' & others for a Highway near the blue Hills, &c
Voted That no objection be made to Granting the Prayer of the Pet". of the Honble. Peter Oliver Esq & oth"" for a Publick Road thro' the Blew Hills, Provided those Inhabitants of Milton who are Pro- prietors of Land in Braintree thro' which sd Road is Proposd to be laid out freely Give their Land as the Proprs. who live in Braintree do freely offer to give theirs.

Townways. We the Selectmen of the Town of Braintree being directed by this Town to view sundry ways, First the way through Mr. Eben'. Copeland's Land & a number of other Persons Land &

Report whether it is proper to have a way thro' sª Land. We are unanimous of opinion that it is necessary to have a way laid out thro' sª Lands Beginning at the Road leading from the Iron works in a corner of sª Copeland's Land and straight thro' his Land to the South side of a large Rock near the Barr's, by Mr. Matthias Cheesman's Land & then thro' sd Chessman's Land South of a Large Rock & old cellar, so along a Ridge & on the South side of his Barn & South of an old pine stump, then to a pair of Bars in Mr. Daniel Pratts Land, then thro' a Corner of sd Pratts Land to a way formerly used, then keeping the oldest way till it strikes the N. E. Corner of Mr. Daniel White's Land, then Running to the S. W. corner of Justice Dyer's Land then keeping along by Capt John Whites fence till it strikes the aforesaid old way then keeping sª way till it strkes the N. E. Corner of Simeon Thayers Land being the 13th Lott then across Zachariah Thayers Lott to the line between said Thayer & Capt Faxons lott and on that line till it strikes the aforesaid old way then keeping said old way till it strikes a lane on the south side of Mr. Ebenezer Whites House, then running Easterly till it strikes Weymouth line this Town not to be at any expense for sª way and said Way to be one Rod & half wide.
[223] Also to view the way leading from Mr. Eben'. Newcombs to Mr. Benja. Cleverlys We think it proper to have said way laid out as follows (viz) Beginning at great Rock near Mr. Eben". Newcombs & running about 52 Rods in the way formerly used till it comes to a heap of Stones then Running Easterly about 28 Rods till it comes into the Way laid out some years agoe then keeping sd Way about 28 Rods then keeping along between the Hill & the fence lately made by Mr. Eben". Newcomb Jr till it comes to the Brook, being about 36 Rods, then over the Brook to the way laid out some years agoe by Mr Joseph Pray's Door being about 8 Rods then keeping said Way as it is now fenced to Mrs Apthorps house the Town to be at no expense for sd ways, and Mr. Eben Newcomb jr. to have the land in the old way in lieu of this now taken, for a way and sd Newcomb to procure a Deed from Mr. Thomas Newcomb to M' John Ruggles of a piece of land lately taken off sd Thom® Newcombs Land to accommodate sd Ruggles with a Way & sd Way to be one Rod & half wide.
Eben' Miller & order of the Selectmen. The foregoing is a true Copy of the Selectmens report

Voted, the Report Respecting the way leading thro' Mr. Cope- lands Land and so on to Weymouth Line be accepted. Likewise
Voted, the Town be at the expense of erecting a stone wall on one side of the Way proposd thro' sd Mr. Copelands land, provided those that are benefitted by sd way make a stone wall on the other side sd way thro' sª Copelands Land.

Firstly, To bring in Valuations to the Selectmen.

excused. Then Oliver Gay was chosen & excused by Law, then Benja. Baxter was chosen & excused for this present year. Then Joseph Field, was chosen & excused for this present year
Then David Linsfield was chosen.
Voted, James Thayer be allowed Forty shillings he serving in sd office or providing a Man to the Towns acceptance. James Thayer Presenting Moses French jr to the Town to serve in the office of a Constable in his the sd James stead.
Voted, That the sª Moses be accepted to serve in the office of a Constable in the place or stead of the sd James this Present year, Provided the sd James Thayer Lodge a Bond with the Town Treas- urer thereby oblidging himself to save the Town from Sustaining any damage by reason of any default of the sd Moses in sd office.
[225] Voted to have three Selectmen only the Present year.
Then Mr. Jonathan Rawson, Capt". Ebenezer Thayer Jr & M' Benjamin Porter, were chosen Selectmen.
Thompson Baxter was then chosen Constable.
Then the Modr. with the Consent of the Meeting adjourned to Monday the 19th. Instant nine o'clock A.M.

Voted, To Proceed to the article Respecting mending the ways by a Tax, after considerable debate thereon.
Repairing the Highways by a Tax. Voted, to mend the High- ways within this Town the Present year, by a Tax. Voted, That a Comtee be raised to take sd affair under consideration & Report at the Meeting in May next, in what manner they judge it will be most expedient for the Town to proceed in that affair.
Then Mr. John Adams, Sam11. Niles Esqr. & Mr. Joshua Hayward were chosen a Committee for that purpose.

The Selectmen made their Report of a High Way laid out as follows (viz)
Braintree March 16th 1764.
Upon application made to the Select Men of this Town by sun- dry of the Inhabitants of the Town &c.
Way from the sd meeting House to Middle swamp. We the subscribers have on the Day above mentioned laid out a way as followeth (viz) Beginning at the County Road (so called) opposite against the South Meeting House as the way is fenced out between Sam" French & Baruck Jordans Lands to the de- scent of a Hill against the Easterly corner of said Jordan's land and thence one Rod & half wide as the way is improved by sd Frenchs House and so along by John Kings House till it comes to the North Easterly corner of Thomas French's field by a small brook thence straight a little south of a bend in the way as it is now improved till it comes to Lieut Joshua Haywards land, thence through said Haywards & ens" Joseph Wales land as the way is

now fenced & improved over dirty Bridge to Joseph Waless, JE House and thence crossing a corner of sd Wales® pasture on the east side of a White oak tree Blazd, thence on the east side of a Black oak tree Blazd. to Ephraim Thayer Jrs. fence thence by sd fence along by his House on the Easterly side of it thence on the Easterly side of a small Pine tree, Blazd, thence on the east side of a large pine stump with stones upon it, thence straight the same course to the line between Nath1. French's & Capt. Peter Thayers Land thence turning Easterly upon sª Line bearing an equal part upon each of their lands untill it comes to the way now improved thence on the west side of a white oak tree Blazd. thence as the way is improved on the East side of a Rock in a corner of Zachens Thayers fence thence by the West of another Rock at the Southwest Corner of sd fence, thence on the east side of a black. oak tree Blazd. also on the east of a small white oak saplin Blazd. and thence as the way is now improved through William Linsfield's land & over a causeway that crosses middle swamp to Jonathan Thayers land.
