The Free- holders and other Inhabitants of the Town of Braintree being assembled on Legal warning (After a Moderator chosen) To con- sider and Determine upon some effectual Method for the settling the Line betwixt this Town and the Towns of Bridgwater and Abington, and to choose such Committee or Committees as the Town shall think proper to manage that affair, Assembled &c. Chose Co11. John Quincy Moderator, And after considerable de- bate the Question was put, by the Moderator, whether they would act anything on this Warrant, passed in the Negative, and so the meeting Dissolved.

Warrants The Freeholders and other Inhabitants of the Town of Braintree being assembled on Legal warning to Transact some affairs of said Town the particulars thereof Inserted in the war- rants are as follows. After a Moderator Chosen.


First, To reconsider any vote or votes that have passed relat- ing To the Towns Commons.


Secondly, To Consider whether it may not be proper for the Towns committee to make up and settle accompts with those per- sons that have Got stones without their leave

Moderator. Assembled &c. Dear John Adams was chosen Moderator.


Commons. Then the Question put by the Mod' whether the Town would Reconsider any vote or votes that have passed rela- ting to the towns Commons, voted and passed in the Negative.

Price of stones doubled. Voted, the Committee Imployed to take care of the stones &c on the Towns Common's be Impowered to make up accompts with such persons as have carried stones off the Towns Commons without the said Committee's Leave by doubling the price of said stones.


Division of the Common Ratifyd Then the Question was put whether the Town would proceed in any other method than they have hitherto proceeded upon respecting the Division of the Towns commons Voted, and passd in the Negative.


Then Voted, that all the votes that have heretofore passed Re- specting the Division of the Town's commons be Ratifyd & con- firmed -

Warrant. Colony Line. The Freeholders and other Inhabi- tants of the Town of Braintree Qualified to vote in Town affairs being assembled on Legal warning, after a Moderator chosen, To hear the report of the agents of the Selectmen Respecting the controversy subsisting between this Town and the Towns of Bridgwater & Abington, concerning the Colony Line & act there- upon as the Town shall think proper, assembled &c.


M' Josiah Quincy was chosen Moderator


Agents Report. The Agents of the Selectmen producing an agreement, made with the Selectmen of Bridgwater and the Selectmen of Abington Respecting the Colony Line, and the same was Voted, accepted and approved


Committee. Then Voted the Agents aforesd (viz) Jos. Cross- by Esq' M'. Josiah Quincy & William penniman be a Committee to meet the Selectmen of Abington to forward that affair.


The Anniversary Town Meeting for the choice of Town Officers for the year 1754.


1754, March 4th. Warrants.


The Freeholders and other Inhabitants of the Town of Braintree Qualified to vote in Town affairs being assembled on Legal warn- ing at the meeting House in the Middle precinct of said Town for the choice of Town Officers and Transacting other necessary affairs of said Town the particulars thereof as Inserted in the Warrants are as follows. After a Moderator chosen.

1st. To choose all such Town Officers as the Law directs, and consider whether two Surveyors of Highways only shall be Im- proved for the year ensuing and act thereon as the Town shall think best, also to bring in their votes for a County Treasurer.


2dly To consider off and act upon Building a house for the use of the Towns Poor


3dly To consider of mending the ways by a tax and Determine thereon as the Town shall think proper.


4thly To see if the Town will allow anything as a Premium for black birds & Squirrells.


5thly To choose a Committee to inspect the wood on the Towns Land and see that none be cut down.


6thly To consider of and accept of those Town ways that have been laid out of late by the Selectmen or any of them as the Town shall think proper.


Moderator. Being assembled &c Coll. William Hunt was chosen Moderator.


Clerk. Then proceeded and chose Elisha Niles Clerk.


County Treasurer. The Moderator then called for Votes for a County Treasurer which Votes were brought in and sealed as the Law directs.

Selectmen Then, Voted, that the Town would have five Select- men for this present year and the votes being Collected & Exam- ined it appeared, Mesrs. John Adams, Jonathan Webb, Thomas Allen, Samuel Niles jun". and Samuel Bass were chosen Select- men.


Constable Ebenezer Spear accepted. Then the Moderator called for votes for Constables and the votes being Collected and Examined it appeared Mess's Jonathan Rawson, Jonathan Allen & Mathew Pratt were chosen Constables. The said Mathew Pratt presenting Ebenezer Spear to serve as Constable in his stead, the said Spear was accepted as Constable provided the said Mathew Pratt give bond to Indemnify the Town


Thomas Faxon, accepted. The aforesaid Jonathan Allen pre- senting Thomas Faxon to serve as Constable in his stead the sd Faxon was accepted in his room as Constable provided the said Allen give bond to the Town as aforesaid.


Ways, by a tax negatived. The Question was put by the Mod- erator whether the Town, would mend the ways by a Tax. Voted and passed in the Negative.


Adjournment Then the Moderator with the consent of the meet- ing adjourned to Tuesday the fifth Instant at one of the clock P.M. to this place.


1754 March 5th

House for ye Poor. Voted, That the Town build a House for the use of the Towns Poor. Voted, the Selectmen are Desired to Look a suitable place to build said House and make report to the Town at the Meeting in May next


Premium on Birds Voted, a Premium be allowed on black birds & squirrels viz. one penny ø head for old ones, and a farthing for young ones to continue from the first of April to the first of Octo- ber.


Committee to inspect the Towns Land. Voted, Capt Ebenezer Thayer, Ensign Nath11 Belcher & Dea. Moses Belcher be a Com- mittee to inspect the wood on the Towns Land &c. and prosecute such as cut down the same.


Then the following Reports of the Selectmen was Read before the Town (viz)


Braintree February 9th 1754.


Selectmen's report of Ways. We the subscribers, being desired by a number of persons of the Town abovesaid to Lay out a Town way in said Town.


Way laid out south side ye River on Mr. Niles Farm. Town way - We proceeded to Lay out said way as followeth (viz) Be- gining at a Town way Running through the Revnd. Mr Samuel Niles Farm to Ensign Nathaniel Belcher's Land from thence the said way is to be Two Rods wide, one Rod on said M' Niles, and one Rod on said Belchers Running on the South side of Mr Niles' Farm so far as said Belchers Land goes, from thence the said way is to be one Rod and half Half wide, all on the Revd Mr Niles Land and also the South side of his farm as aforesaid [164] till we come to Abijah Neal's Land, also a way Two Rods wide be- ginning at a stake and heap of stones by the way above said so running on said Belcher's Land straight to the west side of a heap

Town Way, Leading to Stoughton. We the Subscribers being Desired by a Considerable number of the Inhabitants of the Town aforesaid to Lay out a Town way in said Town, We then pro- ceeded the Day and year abovesaid to Lay out said way Two Rods wide as followeth (viz) Beginning by a way leading to Stoughton, at a stump with stones upon it standing between Crane & Tower so Running straight to a Grey oak Tree with stones about it standing between said Tower & James Clark, from thence running across said Tower to the East side of a Rock with stones on it in David Slone's Land from thence running on said Slone to the South East side of a Great Rock with stones on it in said Sloans land from thence Running on said Sloan's land to the south of a Rock with stones on it a side of a swamp in Sam1 Spears Land, from thence all on said Slone to a great Rock with stones on it in said Sloan's Ground, From thence a straight Line across said Sam1 Spears Feild and so to a Chesnutt stake in said Slones Land by the Fence standing between said Sloan & Benja- min Spear jun' from thence on said Benjamin Spear to the easterly side of a Birch Tree standing by a Little River in said Benja Spears Land from thence on said Benja Spears land to the Easterly side of a Chesnutt stump with stones about it, in said Benja Spears Land, from thence running North East acrost said Benja Spears Land to Coll. Samuel Millers land so acrost said Millers Land running about East to a Rock with stone on it near the Line between said Coll Miller and Micah White from thence half on said Miller and half on said White Running about North till we come to a Town way Leading to Stoughton near said Micah Whites House

Braintree Feb 5th 1753.


Town Way by Capt. Jnº Whites. We the subscribers being Desired by several of the Inhabitants of the South Precinct of Braintree aforesaid to Lay out a Town way in the Easterly part of said Precinct, We then proceeded to Lay out said way one Rod & half wide as followeth (viz) Beginning at the way Leading to Bridgwater at the Northermost corner of Widow Clark's Land then Running Easterly acrost Lieut Joseph Whites Land, Joseph Thayers Land, Joseph Porters Land and Mathew Pratts Land un- til we come to John Whites Land about 190 poles. Then South- erly upon Mathew Pratts Land about 21 poles. Then near the same course partly upon Mathew Pratt, partly on John White Land at the beginning upon John Whites Land 5 feet wide about 32 poles, and at the end of Thirty Two poles one rod wide upon

John Whites Land, and so about the same course upon John Whites Land about 130 poles then Easterly acrost John Whites Land Capt. John Holbrook, & Ebenezer Whites Land, called the Twelfth Lott then across Benja. Thayers Land untill we come to Capt Richard Faxon's Line about a hundred poles.

We the subscribers being Desired by several persons of the Town abovesaid to Lay out a Town Way in said Town, then we proceeded to Lay out said way one rod and a half wide as followeth, Namely beginning at a gate at the South west end of a Cansey leading to Popes Island, From thence a straight Line running to the North side of Ens". David Bass barn, from thence to a gate standing between sd Ensn Bass and Mr Samuel Bass and from thence as the way is Improved up to a Town way near M' Simon Crossbeys house the said way is to be with Gates & Barrs

Representatives. Pursuant to a Precept for the choice of Rep- resentative the Freeholders and other Inhabitants of the Town, Qualified to vote in that affair being Legally assembled and the Meeting being opened the Question was put whether the Town would send two Representatives provided the Town be at no Addi- tional expense thereby voted and passed in ye affirmative, and then the following Gent". were chosen viz. Mess" Josiah Quincy, Samuel Niles.


1754 May, 20th.

After a Moderator Chosen. 1st To hear the report of the Com- mittees chosen & Impowered to Divide the Towns Common's and take care of the wood & stones on said Common and act thereon, as be thought proper.


2dly To consider of and do what may be thought proper respect- ing that part of said common voted for the use of the Ministry, viz. To take a part thereof for the use of the church and South Pre- cinct societies or to vote them according to their proportion of the

remainder of said common to the use of the ministry for cach of them.


Common &c 3dly To consider of and do what may be most for the good & peace of the Town Respecting said commons either in Dividing them by Polls, or Taxes, or by leasing them out or by any other way or Method that the Town may think proper to do with said common and make such preparatories on either of the aforesaid Heads as may be necessary, and to choose such Com- mittee or Committees as the Town may have occasion, to manage on the affairs of said Common.


Being assembled &c Chose M' Samuel Niles Moderat".


Then The Report of the Committee Impowered to make sale of the stone was Read, and after considerable Debate the warrant voted Dismissed.


May 20th. 1754.


The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled on Legal warning to Transact such affairs of said Town, the particulars whereof as Inserted in the warrants are as follows viz. after a Mod- erator Chosen, First To raise money to Defrey the charge of the Town the currant year.


Secondly, To consider of and Determine upon some speedy & Effectual method to Rail the Iron work or stone Bridge.


Thirdly, To here and Determine upon the Demands Mr. Peter Adams hath on the Town.


Fourthly, To choose such Town Officers as may be necessary for the present year.


[166] Fifthly, To Consider of and confirm or Disannull a vote passed in March last allowing a premium on black birds & Squirrels.


Sixthly, To choose a Committee or Committees as the Town shall think proper assembled &c Capt Richard Faxon, was chosen Moderator.


Town Officers. First proceeded to the choice of Town Officers and the following persons were separately chosen (viz) Ezekiel Crane, Surveyor of Highways. Hogg-Reives John Stone James Orberton.


Fence Viewers Jonathan Wild Jr. Joseph Wales Jr.


Fire Wardens Daniel White Clement Crane.


Committee to Rail the Iron Work Bridge. Then Voted, a Committee be chosen to rail the Iron work Bridge and Mess". James Penniman, John Curtis, & Capt Ebenezer Thayer, were chosen a Committee for that affair.


Mr Peter Adams allowance. Then Voted, Mr Peter Adams be allowed Three pounds Lawfull money of the Towns he giving a full Discharge to the Town Respecting his own and his Father's Demand on said Town, and deliver up what of the Towns stock he hath in his hands.

After a Moderator chosen, First, To consider of and Determine whether the Town will accept of or comply with the agreement of the Selectmen of this Town and the Selectmen of Abing- ton, relating to the settling the Line between said Towns on the Line that was Run by Coll Thaxter & Capt Thompson anno Dom' 1713 Secondly, To choose a Committee to make up accompts with Elisha Niles the present Town Treasurer.


Thirdly, To see if the Town at this time will put a stop for the paying for birds & Squirrells.


Being assembled &c Edmund Quincy Esq. was chosen Moder- ator.


The Selectmens agreement respecting the Line Negative. The aforesaid agreement of the Selectmen being Read & Debated the Question was put by the Moderator whether the Town would accept the same voted and passed in the Negative.


Committee to settle ye Treasurer. Then M William Penniman. Capt Ebenezer Thayer & Mr. Josiah Quincy were seperately nom- inated and chosen a Committee to settle with the Treasurer.

Warrants. The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assem- bled on Legal warning to Transact such affairs of said Town the particulars whereof as Inserted in the warrants are as follows viz.


After a Moderator Chosen &c


First, To consider & Determine upon that part of the excise act Relating to private Consumption of wine & Distilled Liquors.


Secondly, To raise money to Defrey the Charge of the Town this Present year.


Thirdly; For any of the Inhabitants of the Town to bring in their valuations to the Selectmen.


Fourthly, To choose a Committee if the Town Think best to petition the General Court for some help for building the Iron work or Stone Bridge.


Fifthly, To consider of the Request of Ens". Nath11. Belcher respecting an abatement on a lease which he hath of the Towns Land, and also an allowance for fencing on the same.


Sixthly, To consider what to do in the affair between this Town and Abington.


Seventhly, To consider and resolve on some Method of Repair- ing or rebuilding the Cart Bridge near Mr. Peter Diers


Eighthly, To choose such Commttees as shall appear necessary and to hear the Reports of any already chosen.


Ninthly, To consider and determine on the Jury list.

Voted, to Raise a Comttee to Treat with the Selectmen of Abington. re- specting the controversy subsisting about the Line and Report to the Town on their adjournment of this meeting and then the follow- ing Gent". were separately nominated and chosen a Comttee. for that purpose viz. Mr Josiah Quincy, Capt. Thos. Allen & Mr. James Penniman


Money raised £200 L. Mo. Voted, Two Hundred Pounds Law- full Money be assessed on the Polls & rateable Estates within this Town to Defrey the charge of said Town this present year.


Comttee to petition ye Gen11 Court. Voted Capt Richard Faxon, Edmund Quincy Esq. & Capt Thomas Wales, be a Comttee. to Petition the Gen1. Court for some relief for building the stone Bridge.


Ens" Nath1 Belcher allowd. Voted, Mr. Nath11. Belcher be allowed eight shillings Lawfull money per annum as an abatement on his and his Bro8. Lease to the Town, being an error.


Also, Voted, sd. Nath11. Belcher be allowed Twelve shillings in his part of the Lease in consideration of the Loss he sustains in Fencing.


Committee to let out the Cart Bridge to be rebuilt of Stone Voted, the Cart Bridge nigh Mr. Peter Diers be rebuilt with stone and then Mr. Caleb Hobart, Mr. Shadrack Thayer & Dea". Sam11. Bass, were separately nominated & chosen a comttee. to Let out said Bridge to the lowest bidder.


The report of the Committee to settle with Treasurer Then the Committee appointed on the 24th June last to settle acct", with Elisha Niles Town Treasurer produced their report on that affair which said report with the list of outstanding Debts as they stand Inserted in the Treasurer's book Vol. 2 pages, 70, 71, 72 was Read & Voted accepted.


Benja. & Nath1 Owen's debts remitted. Then the town Voted that Benjo. Owen & Nath11 Owens Heirs be remitted the demands the Town hath on them as Inserted in said list.


Meeting adjourned Then the Moderator with the consent of the meeting adjourned to monday the sixteenth Day of September next at two of the Clock P.M. at this place.


1754, August 19th.


The Freeholders and other Inhabitants of the Town of Braintree Qualified by law to vote in Town affairs being assembled on Legall warning to Transact such affairs of said Town the particulars whereof as Inserted in the warrants are as follows, viz. After a . Moderator chosen, &c. First To consider whether the Committee chosen and Impowered to sell Stones on the Towns Common in August 1749, shall yet have Liberty to sell stones on said com- mon's, and also to make up with such persons as have gotten stones off said Commons, at such prices as they think proper. Secondly, To accept or refuse the report offered to the Town in June 1753

The Freeholders, and other Inhabitants of the Town of Braintree Qualified by law to Transact Town Affairs being legally assembled by adjournment from the nineteenth of August Last.


List read. Voted, the Comttee chosen in 1749 be still Impowered to make up with such persons as have gotten stones off the Towns Comons.


Then the List offerd. to the Town in June 1753, was again Read before the Town.


Voted, to pass by the second article in the Warrant for the present.


Voted, to Lease out the Towns Commons.


Comttee. to consult Respecting leasing out the Com. Voted, that a Comttee be Raised to consider of a suitable Term to Lease out the Towns Commons and to consult with & Receive proposals from such as may appear to Hire said Common exclusive of cutting wood on said commons, and make report to the town on the ad- journment. Then the following Gent". were separately nominated & chosen a Comttee for that purpose viz. Edmund Quincy Esq", Co11. Willm. Hunt, Joseph Crosbey Esqr. Capt. Thomas Wales & Lieut. Richard Thayer.


Comttee Impowered. meeting adjourned. Voted, The Com- mittee chosen in August 1749, be still continued a Committe to Inspect the wood and stones on the Towns com". Then Moderator with consent of the meeting adjourned to the First Monday in November next at Ten of the Clock forenoon at this place. A.T.8 :

Excise act, reconsidered. Voted, To reconsider the vote passd. the nineteenth of August Last respecting the excise act, also Voted the excise bill, now under consideration is inconsistent with our Rights & privileges as Englishmen is contrary to the nature & spirit of our happy Constitution ; and that our Repre- sentatives be desired to prevent as far as in them lies this bill or

The Comttee appointed on the nineteenth of august last to treat with the Selectmen of Abing- ton &c offerd their Report to the Town which was as follows, (viz) That the Town perambulate the Line called Thompson & Thaxters Line and pay the charge of Abington execution they remitting the fines in said execution
