Then voted that there should be a Petition presented as [109] soon as may bee to ye General Assembly for a confirmation of six thousand acres of Land formerly granted by ye Honoured General Court to this Town.


June 11th. 1711.


Then voted that the present select Men should take care of the above said Petition as to that affair.

Then voted that Co1. Edmund Quinsey & Lt John Baxter be a Committee with ye present Selectmen to answer the Petition of the Town of Milton about the blew hill lands, (by some of them Lately Purchased and by said Town Petitioned to ly within there Township.


January 21st. 1742


Then voted that Co1. Edmund Quinsey and Mr. Nathaniel Hubbard be a Committee to represent the Town at the next ses- sions of the Honoured Court, to obtain an order for the money due from the County for repairing menaticut Bridge.

The Inhabitants of Braintry Regularly Assembled then chose Mr. Nathaniel Hubbard Moderator for that day.


The Selectmen were.

Lt. Joseph Neall. Lt. John Cleverly. Ensign Peter Adams. Sergeant Nehemiah Hayden.


Constables, were Peter Webb and Simon Bryant, but Peter [110] Webb refusing to serve they then chose John Wilde, Constable.


Town Treasurer, was Joseph Crosbye.


Tithing Men, were Samuel Bass, Carpenter, Samuel, Speare Dependence French, Josiah Hobart.


Surveyors were, Deacon Benjamin Savel, Benjamin Neall, John Thayer, Nehemiah Hayden Junior.


Fence Viewers were Benjamin Beall Moses Curtis, Ephraim Thayer, Joseph Allin Junior.


Field Drivers, were Moses Belcher senior, Daniel Legaree Benjamin Hubbard, Ebenezer White.


Then also voted that the Persons who last year entred their Bulls for the use of the Town should each of them have Ten shil- lings a piece.

Braintry May 28th. 1712.


The Inhabitants of Braintry Regularly Assembled, they then chose Mr. Nathaniel Hubbard, moderator.


Then voted, that Edmund Quinsey Esqr. Mr Nathaniel Hub- bard, Lt. Joseph Neall, Ensign William Veasey and Mr. [111] Nehemiah Hayden be a Committee to prefer a Petition to the honoured court, about the lands Petitioned for by Milton to ly in their jurisdiction.


May 28th. 1712.


Then also voted that any person of this Town that takes any sheep from any other person out of the Town to keep for them on the Town's common shall certifie the Town Treasurer thereof, and promise to pay in to him for the use of the Town Twelve pence per head for every such sheep, and if in case he omitt or neglect so to do, and any sheep be found with any such person, they said person shall pay Two Shillings per head for every such sheep.

Samuel Penniman's Bond to the Selectmen.


Know all Men by these Presents, that I, Samuel, Penniman of Braintry in the County of Suffolk in the Province of the Massa- chusetts Bay in New England, am holden & do stand firmly bound unto the present select men for the Town of Braintry aforesaid in ye full & Just sum of one hundred Pounds current money of New England to be paid to the said Selectmen or either of them, their certain Attorney or successors in the said office of Selectmen on the behalf, & for the use of ye sd. Town, To the which payment well & truly to be made I bind myself my heirs Executors & administrators firmly by these presents sealed with my seal this 29th Day of October Anno Domini one thousand seven hundred & eleven, in the tenth year of the Reign of her Majesties Queen Ann.


The Condition of this present obligation is such that whereas the above named Samuel Penniman has received of his Brother John Penniman of Swansy in the County of Bristol in the Province abovesaid, one Deed of a certain tract of land in the Township of Braintry containing about Ten acres of land (as by said deed may more fully appear) and has Received of the Selectmen above named Twelve pounds money by an order on the Town Treasurer, all which is for the keeping & maintaining the aforesaid John Penniman, Now Know all Men to whom these presents shall come, that I ye said Samuel Penniman do covenant Promise grant & agree to & with the said [112] Selectmen and bind and oblige myself my heirs, executors & administrators to find my Brother the above said John Penniman with good and sufficient meat, drink, apparrell, washing & Lodging & with all other things necessary and convenient in sickness & in health during ye time & terme of his the sd John Penniman's natural life. And to save ye Town for ever from any charge therein, upon the true & faithful perform- ance whereof the abovesaid obligation is to be utterly void and of none effect, but if there be failure hereof contrary to the true intent & meaning of these presents, then to abide in full force & virtue, Samuel Penniman.

The Inhabitants of Braintry Regularly assembled then chose Co1. Edmund Quinsey Esqr. moderator for the Day.


Then voted that thirty five pounds shall be raised forthwith to defray Town charges.


Then voted that Col. Quinsey with the present Selectmen or any two of them should be a committee to call the Town Treas- urers to an account from the year 1706 about their laying out the Towns money.


Then also voted that captain John Mills, Lt. John Cleverly, Ensign William Veasey Mr Nehemiah Hayden and Serjeant Sam- uel Ffrench be confirmed to be a Committee as before was granted

to inspect & prosicute all encroachment upon highways Private & common's within the Town.


Then also voted that all horses or horse kind that shall be taken damage feasant (after notice first given in any corn ffield or other inclosure being unfettered or otherwise, equivolently [113] restrained from the first of March to the last of November yearly shall forfeit and pay to the use of the poor of the Town three shillings besides answering the law


Then also it was voted, That all swine taken damage feasant after first, notice given, in any corn ffield or other inclosure from the first of March to the last of November yearly not sufficiently yoked and ringed as the law directs shall forfeit & pay to the use of the poor of the Town one shilling a head besides answering the Law.


January ye 12th. 1712/13.


The Inhabitants of Braintry Regularly Assembled, then chose Captain John Mills Moderator, for that day It was then voted thet no person whatsoever shall cut any walnut or oak wood off of the common Lands, under Twelve inches over at the stump, a foot from the ground for the Space of Twelve years comeing, on the penalty of five shillings per Tree and Three shillings of the five to be paid to the Committee which were then chosen to witt Ensign Samuel Baxter, John Marshall & Moses curtis, who were upon information to prosicute the same) and the other Two shillings to ye enformer.


March the 2ª 1712/13


The Inhabitants of Braintry Regularly Assembled then chose Co1. Edmund Quinsey Esqr. Moderator for that day.

Ebenezer Spear and Joseph Ruggles were chose Constables at the same time, but they both presently & positively refused to serve, whereupon the Town proceeded to chuse others, and then chose Thomas White and Joseph Nightingal Constables, but that very day Ebenezer Spear better considered & accepted & was sworn

It was then voted, That the present selectmen be a Committee fully impowered, to stake out the Ancient way (not exceeding a Rod wide) over Rock Island Creek To the towns Lands & meadow with this proviso, that the particular Persons that are interested in the Lands & meadow on Rock Island side and their Heirs forever, do bear their proportionable part, besides their part, as they are inhabitants of the Town, to the making & maintaining of it) against this vote John Hollis and Samuel Penniman entred their dissent.


March 2ª. 1712/13


At the same time it was voted, that the orders made by ye Town about horses and swine november 10th. 1712 are repealed.


May the 15th. 1713.


The Inhabitants of Braintrey Lawfully assembled then chose Co1. Edmund Quinsey Esqr. their Representative for the year en- suing.

The Inhabitants of Braintrey Regularly assembled, they then Chose Co1. Edmund Quinsey Esqr. Moderator for yt day.


It was then voted that Co1. Quinsey, Captain Chapin & Mr. Na- thaniel Hubbard be a Committee to go and search the records, about the courts grant of 6000 acres of land to this town, and if they find the time lapsed for the taking of it up, they are then impowered to Petition ye Honoured court for a confirmation of ye said grant.


June ye 8th. 1713.


Then also voted, on the Negative that neither the persons im- powered in a former vote of the Town (many years since) to find & lay out the 6000 acres of land granted to this Town by ye Court nor their successors should now have what was then granted (the time for doing of it being laps'd) which was fifteen hundred acres, nor go again on that foot.

be a Committee to find & lay out the 6000 acres of land for- merly granted by the Honoured Court to this Town and to do what is needful to be done about the same in ye space of one year and shall have for their so doing Thirty Pounds if the thing be effected, otherwise nothing, and if Captain Chapin should refuse to go then Captain Mills to be joyn'd to ye other two.

The Inhabitants of Braintrey Lawfully assembled then chose Mr. William Rawson moderator for that day


Then voted, that Thirty Pounds money be raised forthwith for the defraying Town charges.


It was then voted that Joseph Parmenter should have Twenty shillings for serving the Town as Town Clerk for the year past.


December 28th. 1713.


The Inhabitants of Braintrey Regularly assembled Then chose Edmund Quinsey Esqr. Moderator for yt Day. Then voted that the Parents or Masters of all children or servants, that go to school shall forthwith that is to say upon their first, or next appearance at the school and so from this day until the first of April next coming deliver in to the [116] Present school master for the use of the school, at the schoolhouse, Three foot of cord wood, to be the proportion of each child or servant for this year.


December 28th. 1713.


Then voted that Lt. John Cleverly, Ensign William Veasey and Benjamin Neall be a committee to look after the towns wood till the Towns meeting next march and then to make report of their opin- yon to ye Town.

Then voted that the present selectmen for the year ensuing should in some convenient time as soon as may be, go and stake out a way from Pens Hill (so called) to Nightingals according to the Report made by the Committe who have viewed the same.

then also it was voted that the present selectmen shall go and stake out a private Townway from Joseph Whites to Benjamin Clarks as ye way now runs.


Braintry May the 17th. 1714.


The Free holders and other Inhabitants of said Town Regularly assembled, they then chose Captain Mills, Moderator for that day.


And Co1 Quinsey was then chosen their Representative for ye year ensuing


Ephraim Thayer, was then chose Constable for the year ensuing


May ye 17th. 1714)


it was then voted by the Inhabitants aforesaid that the wood of the Towns Land should be cut down, all that is fit for cutting into wood, and the Committee then chosen for to make sale of the wood and Timber on said Land and to doe for the Town (on that behalf) as they would for themselves were. Co1 Quinsey, Lt. John Clev- erly and Mr Nehemiah Hayden


Then also voted, that the Grant of the 6000 Acres of Land by the Honoured Court to this Town should be sold


Then also voted that Col. Quinsey, Capt. Mills and Mr. Joseph Crosbye should be a Committee appointed and impowered to sell the aforesaid Granted Land except they do discover any Method more beneficial for the good of the Town.


It was voted at the same time, that the present Selectmen or any Three of them shall let Mr. Benjamin Webb the old school house for some time, as they and he shall agree.


At a Second session of the General Court held at Boston the 11th. October, 1666.


In answer to the Petition of the Inhabitants of Braintrey The Court in Considerations of the Reasons therein expressed, [118] Judge meet to Grant unto them six thousand acres of Land in some place Limitted to one Place, not prejudiceing any Plantation or particular Grant.

The Inhabitants of Braintrey Regularly Assembled they then chose Co1. Edmund Quinsey Moderator for that day.


Then voted that a Town way over the River by Ephraim Jones to cochato is nt thought necessary to be done.


Then also voted, that the present selectmen draw up a by-law for the prevention of Dogs coming into the Meeting-houses, in the time of Publick worship, and that annexed, with a penalty as they should see meet on the owners thereof, and that some meet per- sons be procured by them to se after them.


[120] April the 11th. 1715.


Then voted that Col. Quinsey be joyned to the present Selectmen in setling and adjusting the accounts of ye Town with the present Treasurer and others as there may be need.


Then also voted that the Publishments of Marriages for the fu- ture to be set up upon the foreside of the most Publick Doors of the meeting houses in said Town.

June the 24th. 1715.


At a meeting of the Inhabitants of the Town of Braintree Regu- larly assembled, Lievt. Jolın Baxter was voted Moderator,


Then voted that Mr. Joseph Neall, Mr. Joseph Allin and Mr. Samuel French, be a Committee impowered in the name & behalf of the Town, to shew cause why the present Selectmen refused to run the line between said Town and Weymouth, and further to defend ye said Town of Braintry in answering to the information filed against the Selectmen thereof at the next Inferior Court and in case their should be ocation to Prefer a Petition to the next session of the General Assembly relating to y. premises.


Then also voted, whereas the Select men of Weymouth have filed an Information in the clarks office of the Inferior Court at Boston, setting forth, that the Selectmen of this Town, have re- fused to run the line, betwixt the Two Towns, And thereupon obtained a summons to the said Selectmen of this Town, for their appearance to answer to the said Information.


Voted, that the honourable Edmund Quinsey Esqr., Captain John Mills Levt. Joseph Neall and Mr. William Rawson be Com- mittee fully impowered to treat with the said Selectmen of Wey- mouth respecting the said line and to settle the same, in the name and behalf of this Town as to them shall seem reasonable. Pursu- ant to the Records of the General Court.

[121] August the 16th. 1715.


The Inhabitants of Braintry Regularly assembled they then chose Co1. Quinsey Moderator for that day.


Then voted that the Report of the Committee (chosen in April Last past for the settling & adjusting the accounts of the Town with the Town Treasurer &c (should be accepted, about what was now due to the Town (being about 28 Pounds) and that the Present Town Treasurer should sue for & recover ye same for ye use of ye Town.


August ye 16th. 1715.


For the better & more effectual management & improvement of the stones of the common or undivided lands of the Town it was then Voted, That no person shall dig nor carry off any stones on the said common or undivided lands upon any account what- soever, without license from the Committee hereafter named upon penalty of the forfeiture of ten shillings for each & every cart load so dug and carry'd away, one quarter part to be to said Com- mittee in full satisfaction for their care & pains and the other three quarters for the use of the Town.


Instructions to the Committee were.


First. That the Committee shall give no license to any Person to dig or carry off any stones from said Lands, to make sale or merchandise thereof without the Town's Direction.


Secondly. That the Committee may & shall give license to any & every Person in this town for such a quantity of stones as he or they shall stand in need of for their own proper use in this town.


Thirdly That the Committee shall or may seize all stones that they shall find dug or carted on & off said common Lands, the digger or carter whereof is not known, and the same dispose of to the best advantage for the Town, by sale, or otherwise, deducting one quarter part thereof to themselves in full satisfaction as above said.


The Committee then Chosen were Captain John Mills Lt. Jnº Cleverly, Ensign Peter Adams. Then voted yt any two of said Committee shall have power to give License for getting stones


Voted at the same time that the Committee chosen last June, to answer the information fiel'd agst. them by Weymouth inen at the court last past, that their power be revived to answer it at next October Court.


[122] August the 16th. 1715.


Then voted that Col. Quinsey if he se cause and have opper- tunity, should prefer a Petition to the next, General sessions, in order to a settling of the line between Braintry & Weymouth.


September 26th. 1715.


The Inhabitants of Braintry Regularly assembled they then chose Co1. Edmund Quinsey Esqr. Moderator.


Then voted that Co1. Edmund Quinsey, Esq. Captain John Mills, Lt. John Cleverly & Deacon Gregory Belcher be added to the

Then voted that the said Committee be impoured to prefer a Petition (if they shall se occasion) to the court, Relating to the. premises.


Then also voted that the said Committee procure a Surveyor (at the Towns charge) to try ye line in contriversey between Wey- mouth & Braintree men.


Whereas there was a Committee formerly chosen to sell the 6000 Acres of Land granted by ye Court to this Town.


Voted that any Two of them be a Committee impowered to sell said lands.


September 26th. 1715


the Present Selectmen agreed with Lt. John Cleverly for his son Johns keeping school, this present year, for thirty four pounds, to be paid him out of the rent of ye school Lands, And ye remainder to be made up out of ye towns stock.

The Inhabitants of Braintry Regularly assembled they then chose Co1. Quinsey Esqr. Moderator that day.


Then voted that forty eight Pounds money be forthwith raised for the defraying Town Charges


Whereas the Committee lately appointed & impowered to lay out & get the confirmation of the 6000 Acres Grant) have this day made a Report to the Town thereof about the laying out of the same it was voted that the same was accepted according to said report.


Then voted that the charges raised for the laying out of the 6000 acres of land granted as aforesaid be proportioned as other Town charges be raised. And also then voted that the Town Treasurer, Mr Joseph Crosbye should receive it.


Then voted, that the Parents, or masters of all children or ser- vants going to schools shall, that is to say upon their first or next appearance at the school, from this day deliver into the present Schoolmaster, for the use of the schoolhouse three foot of cord wood to be the proportion of each child or servant for this year.


Then also voted that the moneys Received for the wood of the Town, be let out for the use of said town.


March the 5th. 1715/16
