The Question was then put whether it be the opinion of the Town that it is absolutely necessary that the Town make some order or orders to prevent the unressonable Digging up, breaking or carrying off the stones from the Towns Common, and also to prevent the Cutting & carrying off, the wood, it passed in the affirmative.
Then voted That no Person be allowed from henceforth, to take stones for his own use from off the comons for building, fencing or the like, without first Giving notice to a Committee (by the Town appointed) of his so doing and rendering a true accompt of their Quantity, and how he disposed of them.

Representative May 20th. 1730. Pursuant to the Precept to the Selectmen For the choice of a Representative : The Free- holders and other Inhabitants of the Town duly Qualified, assem- bled (having had legal) warning) on the day above sd and after the Reading of [195] the Precept, and warrants for calling the meeting they proceeded to the Choice of a Representative and their votes being brought in and examined, It appeared that Major Quincey was chosen Representative, by all the voters present.
Particulars in ye warrants On the same day the Freeholders and other Inhabitants Qualified to vote in Town affairs, assem- bled to transact some other affairs of the Town Inserted in the warrants. The particulars whereof were. First. To chuse a Moderator. 2 To Grant money for the defreying of the necessary Charges of the Town 3. To chuse a Committee or Committees to Run lines between the Towns Comons, and the lands of Particular persons. 4. To chuse a Constable in the Room of Joseph Spear, who being chosen at March meeting Refused to take the oath. 5. To consider and Determine whether they will allow to the. South or new Precinct, either to have the Priviledg of the school in that Precinct a part of the year, or Remit to them so much of the Rates to the Schools as their part thereof is. lastly, whether each Precinct shall have the benefit of the money paid by such therein, as refuse to serve in the office of Constables when chosen thereto, as by the warrants on file may more at large appear.

Memorial. Samuel Payn Jun'. Nathaniel Littlefield and John French as a Committee for that Precinct and in their behalf, Pre- sented a Memorial to the meeting setting forth the desire of the Precinct either to have the Priviledg of the School there some part of the year or els that their part of the charge of maintaining the schools should be Remitted to them.
The matters ye in Refer'd &c. Then voted that the matter in- serted in the memorial should be referred to the next meeting.

Secondly To chose a Constable to serve in the room of Wil- liam Linsfield who being chosen at a Town meeting on May 20th. last past Refused to serve and paid the penalty for not serving. 3d.ly to consider and do what may be thought needfull & proper about laying out highways in the Middle & South Precincts of the Town, which affair some persons there have desired may be laid before the Town. lastly, to bring in to the Selectmen or as- sessors a true account of all their Polls & Ratable estates in order to their being assessed to the publick Taxes of this present year, as may by the warrants on file more at large appear.
Moderator And being so assembled they then First chose Mr. Joseph Crosby Moderator.
Nextly, the Selectmen offered to the Town a Petition of sundry person to them being as follows vizt.
Braintree, July 27th. 1730.
To the Selectmen of the Town of Braintree, wee the subscribers, being Inhabitants of the Town of Braintree and obliged to do duty we think it reasonable that wee should have the like Priviledg with others to have a way to pass in, which we are debarred of to our great Damage, there fore we desire the Town to be called together to consider about opening the way already laid out, and to lay out. what more ways may be of necessity to be laid out in Cochato, which may be of great benefit to the Inhabitants that live that way and all others, which may have occasion to use it.

Whereas sundry persons belonging to the South precincts of the. Town have presented a Petition to the Selectmen that the Town

might be called together to consider about opening a way hereto- fore laid out beginning at Cochato line & Running to the land of David Eames (which said way was laid out by the Selectmen May 19th. 1724, at the desire of sundry persons of our south Precinct.
[198] The question was put whether the Town will take the matter into consideration in order to passing any act there about & It passed in the negative.
a Constable chosen. Next they went upon the Choice of a con- stable and the votes being brought in & examined it appeared that Jonathan Hayward Junr. was chosen Constable.
Vote of 8£ a annum towards a schoole in new Precinct. A memorial of the new South Precinct was then laid before the Town, which was presented at the last Town meeting (the hearing where- of was referd. to this meeting) concerning a School there : and the Question being put whether the new South Precinct shall have eight Pounds paid out of the Towns Treasury towards supporting a school in that Precinct, yearly untill the Town take further order, the first year to be understood to commence from March last past. It passed in the affirmative.
January 26th. 173g
Representative. Pursuant to a Precept to the Selectmen for the choice of a Representative (his excellency having dissolved the House of Representatives) The Freeholders and other Inhabitants of the Town duly Qualifyed assembled upon legal warning on the day abovesaid and after the Reading the Precept, & warrants for calling said meeting they proceeded to the Choice of a Representa- tive, and their votes being brought in and examined It appeared that Major John Quincey was chosen by a majority of the votes.
The Anniversary Town Meeting 173º
March 1st. 1732
The Freeholders and other Inhabitants of the Town duly quali fyed, and having had Legal warning, assembled for the choice of Town Officers for the year ensuing, and for other Business inserted in the warrants the particulars [199] whereof are as follows, vizt.
Particulars of ye warrant. First, To chuse a Moderator. Sec- ondly, to chuse Town officers &c. Thirdly, To chuse a Committee to let the Town Lands &c
Fourthly, To consider and Determine whether they will allow as heretofore for Bulls & Boars &c. and for killing Black Birds.
Moderator. Fifthly, To chuse a Register for the County &c wch. particulars are more at large in the warrants on file, and being so assembled and the meeting opened, They proceeded to the choice of a Moderator, and Capt. Peter Adams being nominated, was chosen by hand votes and accepted.
Town Clark. They then proceeded to chuse a Town Clark, and Benjamin Webb being nominated was chosen by hand vote Clark for the year ensuing.
Constables. They then proceeded to ye choice of Constables and the votes being brought in & examined it appeared that David

Bass Samuel Arnold and Thomas Wales were chosen, but David Bass declaring his refusal they proceeded to the choice of another, and the votes being brought in & collected, it appeared that Eben- ezer Crosbey was chosen.
Selectmen. Next, they proceeded to the choice of Selectmen and the votes being brought in and examined, it appeared That Joseph Crosby, William Hunt, Richard Thayer Jun'. Deacon Sam- uel White, and John Hollbrook were chosen Selectmen.
Treasurer. They then proceed to chuse a Town Treasurer and Benjamin Webb, being nominated was chosen by hand votes Town Treasurer.
The meeting then proceed to the choice of other Town officers, and the following Persons being nominated were chosen by hand vote to the respective offices following vizt.
[200] Surveyors of Highways. To the office of Surveyor of Highway® were chosen, Eleazer Veasey, David Bass, Josiah Hobart, Jonathan Wild, Samuel Vinton and Alexander French.
Tithingmen To the Office of Tithingmen ; were chosen, Samuel Belcher, John Bass, Ephraim Jones, Samuel Wild William Cope- land.
Fence Viewers. To the Office of Fence Viewers were chosen, Seth Bass, Samuel Ruggles, Thomas Bolter, Joshua Hayward & Willm. Linsfield.
Hogreaves. To that of Hogreves were chosen, Seth Guliver, Ebenezer Adams, William French, Richard Thayer Sent. and Elia- kim Thayer.
Sealer of Leather Sealer of Leather, John Beale.
Surveyors of Clapboards & Shingles. To Survey Clapboards & Shingles were chosen Samuel Belcher, Ebenezer Field, Ephraim Arnold & Thomas Vinton.
Committee to let the Town Lands. They then went upon the choice of a Committee to let the Town Lands, and Capt. Peter Adams, Deacon Samuel White Joseph Crosby, Ephraim Thayer, and Benjamin Webb, being Separately nominated, were separately voted to be a Committee to let the said Town Lands, and any three of them to be quorum to act in that affair.
Term seven years. Then voted that the said Land should be leased for seven years, and no more, by that Committee.
The question was then put whether it should be left to the said Committee to let the lands abovesaid at their discretion, and it passed in the affirmative.
[201] Bulls. Then voted that whosoever of the Inhabitants of this Town, shall enter with the Town Clerk, a good sufficient Bull of Two years old at least before the first day of May next en- suing to be kept for the Towns use until the 29th. day of Septem- ber next following shall be paid out of the Town Treasury Twenty shillings, Provided there be not above Twelve so entered six whereof to be in the North Precinct, Four of the said Twelve to run at large, Two of which foure to be in the North Precinct.
Boars. Then also voted, that whosoever of the Inhabitants of this Town shall enter as abovesaid a good sufficient Boar, of six

months old at least before the said first day of May to be kept for the Towns use the year ensuing & to run at large shall be paid out of the Town Treasury fifteen shillings, Provided there be not above six so entered. Three whereof to be in the north Precinct.
Birds. Then also voted, that whosoever shall kill any grown Black-birds within this Town before the last day of May next ensuing shall be paid out of the Treasury Three pence a head, and for all young ones within that time a half penny a head and from the said last day of May to the last day of November next one penny y head for all so killed, they bringing the heads of all to any of the Selectmen or constables.
Next the Choice of a Register was considered : but the day being Spent, the people mostly gone, and another meeting ap- pointed to be on the fifteenth Instant, It was Defer'd 'till that meeting, and the meeting Dismiss'd. [202]
Contents of ye warrant. Moderator-And being so assembled they first chose Coll. Edmund Quincy Moderator.
Ebenezer Niles voted Constable in ye stead of T. Wales. Next Thomas Wales, who was chosen a Constable at the annual . meeting March 1st. presented Ebenezer Niles to the Town's ac- ceptance, to serve in his Roome, and the question being put whether the Town would accept of Ebenezer Niles to serve as a Constable in the stead of Thomas Wales, it passed in the affirma- tive.
Votes for Register. They then went upon the choice of a Register and the votes being brought in were sealed up and de- livered to Ebenezer Crosby Constable by him to be kept & Re- turned to the next Quarter Sessions as by Law directed.
Ministry Land continues in the Towns Regulation. The ques- tion was then put, whether it were the minds of the Town to pro- ceed any farther in the affair specified in the warrant concerning the appropriated Lands to the use of the ministry and it passed in the negative.
Then the Moderator by a vote of the Town adjourned the Town-meeting to monday ye. 29th. of March next at one of the clock, and the Reports of the Selectmen concerning Townways was left to be then Received

But before the meeting was adjourned Major Leonard Vassal desired of the Town the liberty of altering the road against his

House for his conveniency, and the Question being put whether the Town would give him the liberty of such an alteration he not damnifying the Road, it passed in the affirmative.
It was then also voted that Mr. Joseph Crosby (one of the Selectmen) with one or Two more of the neighbours should be present and assist therein Mr. Benjamin Neal and Mr Samuel Baxter being nominated, &c.

James Orbitant, Entered the mark's of his neat cattle & sheep &c. the sd. mark is a crop off of, a split in and noch, all in the right ear, the said noch cut in ye side of y' ear next the heads.
