[167] The Committee then chosen were John Quincey Esqr. Mr. Joseph Crosbey and Mr Thomas White.
Voted, that Mr. John Cleverly, and Mr. Benjamin Webb be added to the Three selectmen of the North end of this town, to fix the Place or Places, where the school shall be kept at the south end of the town.
Voted, That Joseph Parmenter have Thirty shillings £1.10- for his service as Town Clerk the year past.
Braintree the 22ª. May 1727.
The Inhabitants of said Town being Lawfully assembled they then chose John Quincey Esq'. Their, Representative for the year ensuing.
They then chose (also) the honourable Edmund Esqr. Mod- erator the Report of the committee chosen to make up accompts with the Town Treasurer, Mr. Benjamin Webb, was then heard Re- ceived accepted by said Town, and he the said Town Treasurer dis- charged for so much by him Payed, as appears under the hands of said committee chosen by the Town to adjust accompts with him, which accompt is now on file.
£90- Then voted that ninety Pounds be raised forthwith for the Defreying the necessary charges of this Present year.
The Committee appointed the last Town meeting to proceed in their work of laying out an 100 acres of the common Lands as mentioned in former votes, having this Day Reported their sur- vey of the same, but it being found imperfect, and Represented to the Town that said committees Projection will not be convenient. Voted, and ordered that the said Committee proceed to perfect their survey, taking care therein to lay out the several Lotts or Parcels of Land in the most suitable Places & the most conveni- ent form, as may be, & lay their doings therein before the Town at their, next meeting for their acceptance & confirmation. Peter Markquand entre'd his dissent.
Then voted that Richard Thayer be excused from being chose Constable this year.

[168] June 12th. 1727.
The Inhabitants of Braintrey Lawfully assembled, They then chose Captain Peter Adams Moderator for that day.
John Thayer, (son of John Thayer) who was chosen Constable with John Niles, May 22d. 1727, Presented to the Town Mr. Ephraim Jones of said Town, who offered before the Town then met to serve in the Room & stead of said Thayer & Niles, as constable for the year ensuing, he the said Jones was then accept- ed by the Town as Constable in the Room & stead of the said John Thayer & John Niles.
£30- Then voted that Thirty Pounds money more be raised & added to the ninety Pounds granted by the Town, last May meeting, for the Defreying the necessary charges of the Town.
The affair of the Return of the Committee about the common Lands was deferred till next, Town meeting.
The Inhabitants of Braintree Lawfully assembled November the 6th. 1727, then chose John Quincey Esqr. their Representative.
They then likewise chose the honourable Edmund Quincey Esqr. Moderator.
Mr. Joseph Neall, Mr Samuel Bass, Mr. Nehemiah Hayden Mr. Benjamin Webb, Mr. Samuel White, and Mr. Joseph Crosbey having been chosen a committee by the Town July the 25th. 1726, to lay out a hundred acres of the Common Land (belonging to the Town) for the use of the ministry, did pursuant thereunto with the assistance of Mr. Maudsley of Dorchester, surveyor, lay out said hundred acres of appropriated Land in four Peices as in Their Report by writing, under all their hands is there expressed & bounded, which Report is now on file and was this Day Read, once and againe to the Town, and voted accepted, and by them was rattified and confirmed.
Then voted that Nathaniel Owen Senior, Deacon Samuel Bass, and Moses Belcher Junior, be a Committee to inspect said Peice of appropriated Lands, and that any Two of them should [169] have Power to prosicute any such persons that do trespass thereon.
The moderator was then Requested by the selectmen to pro- pose to the Town whether they would have Two Gramer Schools kept in it, and ye vote it passed on the negative.
The Report of the committee who laid out a Hundred acres of the common Land belonging to the Town for ye use of the ministry is as followeth.
We the subscribers being a Committee chosen by the Town at their meeting on the 25th. day of July 1726, to lay out a Hundred acres of the common Land belonging to the Town for the use of the ministry &c. Have Pursuant thereunto with the assistance of Mr -- Maudsley of Dorchester Surveyor, Proceeded as follows. First, we laid out one Piece of 25 acres in the small common ad- jacent to the land of the widow Elin' Penniman & Moses Belcher in the following form beginning at the corner of said widow Pen- niman's Land, at the upper end of the Lane that leads into the common, we run southerly by said Land, and the Land of Moses

Belcher Junior, eighty four Rods straight thorow said Penniman's Land, there being a considerable bow in her fence, and extended the line northward from the corner of her Land seven Rods thorow which the lane must be continued the length of the Piece when it comes square being ninety one Rods on that side, the South end being 32 Rods wide, making a right angle against Moses Belchers Land, the north end 57 Rods in width, and the length on the east side about 96 Rods, this containing near an acre above measure to supply the want of that quantity by the crooked line on the west side, next we laid out a Piece of the same quantity between the Lands of Joseph Adams & Josiah Faxson, Divided from the com- mon by a line begining at a corner in said Faxson's Fence & Running eight Rods westward, and from thence we run north four- teen Degrees west till we met the Plain fence so called which encloses the whole Piece.
[170] Nextly we laid out a Piece of Twenty five acres by the Pine Hill adjacent to the lands of Joseph Nightingal Decd. thus, beginning at the wall at the south west corner of said Land we Run Southwest 64 Rods, then making a Right angle we run south east 64 Rods and from thence to said Nightingals fence, the Piece being 64 Rods square, a great flat Rock making the bounds of the south east corner, and lastly we laid out a Piece of the same quantity in the small common by the Lands of Jonathan Hayward Junior, Thomas French and William French. It bounds Eastwardly on said Hayward 40 Rods and Southwardly in said Frenches one hun- dred Rods, the opposite lines being of equal length, all the Pieces being bounded by heaps of stones where there is no fence.

Braintree, November, the 17th. 1727.
The Freeholders and Inhabitants of said Braintree, being law- fully assembled then chose the honourable Edmund Quincey Esqr. Moderator.
Then voted, that no Inhabitant of this Town shall hereafter, Presume to Dig or carry off from the common Lands, any stone or stones whatsoever (for sale or Market) under ye Penalty of Twenty shillings for every cart load, so Dug or carried off, with- out License first had from the town or committee hereafter named, and Paying for the same as the Town or committee and said Per- son shall agree.
Voted that the same committee, or any Two of them shall have Power to Prosicute any Person or Persons not Inhabitants, who shall hereafter presume to Dig and carry off the Towns common, [171] Land any stone or stones whatsoever, without License, first had from the said committee, and Paying for the same as the committee and the Person shall agree. Report of their doings, and accompt with the Town, at their Gen- eral meeting in March, annually, for what money they shall have Received.
The Committee then chosen were Mr. Benjamin Neall Mr. John Ruggles and Mr. William Hunt.
Then voted that the first and the third Pieces of Land laid out and Returned by the Committee, be and ly for the use of the min- istry for the North Precinct, and the second and last pieces of Land mentioned as aforesaid, be and ly for the use of the ministry, for the South Precinct, as the Respective Precincts aforesaid now stand divided.
The Moderator (at the request of the Town) Adjourned the meeting untill monday, the 27th. Day of November instant, at twelve of the clock on said Day.
The Free-holders & Inhabitants of Braintree at an adjournment from November the 17th. to November 27th. 1727, being then met and after some consideration of ; and Debate upon a method about the Dividing or disposing of the six thousand Acres of Land Granted by the honoured General Court to the Town anno. Dom- ini 1666 and confirmed to them anno Domini 17
Voted That for the more Peaceable settlement of the same the said Land be divided as near & conveniently as may be between the Two Precincts, or Districts within this Town as the same now stands Divided and that for quantity & quality, to be hence for- ward managed, improved & farther Divided or Disposed of, as shall be agreed on & ordered by each Precinct Respectively from time to time for ever hereafter.
A motion then being made, and the Question Put whether the Town by the words in the late vote of the Town for Granting or appropriating one hundred Acres of common Land for the use of the ministry it shall be understood or construed to include any other ministry then a Congregational and [172] Presbyterian ministry, the vote then Passed in the negative. at the same time voted, that John Quincey Esqr. be desired to Present the votes of the Town that they passed November the 17th. Instant, Relating to the Prohibiting of Persons Diging or carrying off the Towns common Land any stone or Stones (for sale or market) to the honoured court of Quarter Sessions for Their approbation.
It was then likewise voted that Col. Quincey should have Twen- ty shillings, for the Town having had the service of his Bull.
March 4th. 1727/8.
Moderator. At a Meeting of the Freeholders & other Inhab- itants of the Town of Braintree (qualified) to vote in Town affairs) on Monday the fourth day of March Annoq Domini 1727/8 being thereto Legally warned after the Clerk had read the warrants for calling the said meeting with the returns thereof, They then chose John Quincey Esqr. Moderator for that day.
The said John Quincey accepting and taking his place asked of the Inhabitants so met, to bring in their votes for a Town Clerk, which they did, and

ensuing, and forthwith sworn to the true and faithful execution of said office.
Selectmen The Moderator then Demanded of the meeting their votes, for the Choice of Selectmen for the year ensuing their votes were brought in, and by a majority of said votes Mr. Joseph Crosbey, Deacon Peter Adams, Deacon Samuel White, Mr Ben- jamin Allen & Mr. Benjamin Beale, were chosen, but Deacon Adams Refusing to serve, William Hunt who had the next major- ity of votes was accepted.
Constables. Nextly, The votes for Constables being called for, and brought in, Richard Thayer (Smith, so called) Samuel Niles, and Moses Belcher Sent. were chosen to that office, The sd. Moses, Belcher declaring to the meeting his non-acceptance, they pro- ceeded to the Choice of another, and William Field being Chosen, he also declared his non acceptance, after which John Adams, being by a majority of votes chosen, he declared his acceptance.
[173] A motion being then made to the meeting by Samuel Niles and Richard Thayer, whether they would accept of Ephraim Jones, (who offered it) to serve in stead of them two, a vote was asked thereon, and it passed in the affirmative.
Town Treasurer- Votes being then called for for the choice of a Town Treasurer and brought in, Benjamin Webb was by a ma- jority thereof chosen to said office for the year ensuing.

Further upon a motion made by some of the Inhabitants of the new South Precinct in the Town (and manifestation of their desire) that the School Master that shall for the future keep the school in the south part of the Town might be obliged to keep school some part of the year in

the said new-Precinct the voters present were desired by the mod- erator to declare their minds by a vote, which they did, and it passed in the negative.
It was again put to vote by the Moderator, at the desire of the persons aforesaid, whether the Town would abate the said New Precinct their proportion of the charge of all other Schools in the Town provided they will maintain one amoung themselves, It again passed in the negative.
Further, the voters were desired by the moderator to declare their minds by a vote whether they would have any Bulls & Boars kept at the charge of the Town, which they did, and it passed in the affirmative
Bulls & Boars. Then voted, that whosoever of the Inhabitants of this town shall enter with the Town Clerk, a good sufficient Bull of Two years old at least, before the first day of May next, to be kept for the towns use until the Twenty ninth day of September next ensuing, shall receive Twenty shillings out of the Town Treasury, Provided There be not so entered above the number of eight, Two whereof to run at large.
Then voted, that whoever shall enter as abovesaid a good suffi- cient Boar, within the term abovsaid of six months old at least, to run at large for the use of the Town the year ensuing, shall Re- ceive out of the Treasury the sum of Ten shillings, Provided yt there be not above foure so entered.
Black birds - Then also voted, that whosoever shall kill any black-Birds in the Town old or young, shall be paid as they were in the year past, both with respect to the price and season, they bringing their heads, as was voted the last year.
Agreeable to a vote of the Town November 17th. 1727, Mr. Benjamin Neall, one of the Committee chosen to manage the affair of selling the stones in the Towns Comon &c. made report that he had with the consent of John Ruggles, another of said committee agreed with Samuel Savel Junr. for a parcel of Stones before Dugg by sª Savel, being near Three Boat loads, at thirty shillings, to be paid by said Savel therefor, but Savel not having removed them the said Neall had received no money therefor.
further the said Benjamin Neal reported that he had agreed with Benjamin Everden of Dorchester for a Mill-stone he found said Everden carrying away, the said Everden having obliged himself to pay Thirty shillings therefor.
[175] Voted to ye Clark, £3.10-0 Then also voted that Mr. Joseph Parmenter, should bepaid out of the Town Treasury Three Pounds and ten shillings : Thirty shillings whereof for his service the last year as Town Clerk, and forty shillings as a Gra- tuity
the Treasurer £2.10-0. Then also voted that Benjamin Webb should receive Fifty shillings out of the Treasury for his service the last year, as Town Treasurer.

warn all the free holders and other Inhabitants belonging to the North Precinct in said Town Qualified to vote in Town affairs, as the law directs, that they meet at the north meeting house in said Town on monday the fourth Day of March next ensuing the day of the Date hereof, at nine of the clock in the forenoon, then and there, First. To chuse a Moderator. Secondly. To chuse Town Officers as the law directs. Thirdly. Whereas there is another Precinct in the south end of this town : To consider whether the Town will do anything as to the Regulating of the School. Fourth- ly To see whether they will allow as usual for Bulls & Boars for the use of the Town, as likewise for the destroying of Black birds, hereof fail not making return of your doings herein to one or more of the Selectmen, upon or before the time above prefixed, dated in Braintree the seventh day of February 1728.

[176] April 3ª a meeting about the 60,000£ loan Pursuant to an act of the Great & General Court, for Raising and setling a Publick Revenue for and Towards defreying the necessary Charges of this Government, by an emission of sixty Thousand Pounds, in Bills of Credit on this Province : wherein the Province Treasurer is ordered and directed to distribute the same to the several Towns within this province &c.
Se ye Law Book Page 395-6 The Selectmen having been noti- fied by the said Treasurer, issued out their warrants to the Consta- bles of the Town for calling a meeting of the Freeholders, to choose Trustees, Qualified as in the act is provided, to take, out their proportion of the said Sixty Thousand Pounds, if the said Free- holders saw meet to take it.
being £552 the towns proportion Moderator. Pursuant wher- unto Having been duly warned they assembled on Wednesday the third day of April Anno Domoni 1728, and being so met after the Clerk had Publickly Read the Treasurer's notification, The War- rants with the Returns and likewise the act aforesaid. They proceeded & chose John Quincey Esqr. Moderator, who accepting & taking his place.
The said Moderator then demanded of the voters present whether they would Receive from thear Treasury their proportion of the said Sixty Thousand Pounds desiring them to show their minds by a hand vote, which they did, it passing in the affirmative
The Moderator, further demanded of the said voters whether they would choose five Trustees to receive & let out the said Bills of Credit agreeable to the said act: which was also voted in the affirmative.
The moderator further asking whether Ten Pounds should be the lowest sum to be let out as aforesaid.
It was voted in the affirmative, and again whether forty Pounds

At the desire of some persons a vote was then asked whether if a number of Persons should appear, to the Towns acceptance They would take a sum of money therefor, It passed in the nega- tive, but some persons being dissatisfied It was asked whether they would Reconsider that thing and it passed in the negative
They then proceeded to chuse Trustees for the receiving and leting out the said Bills of Credit and Mr. Benjamin Neal, Mr. Joseph Crosbey, Mr. Nehemiah Hayden, Mr. John Thayer Jun". & Mr. Samuel Curtiss, being nominated they were voted to be trustees for the receiving and Letting out the said Bills agreeable to the votes abovesaid, Provided they would [177] become Bound Jointly & Severally to the Town Treasurer in behalf of the Town (in & for the whole) for the paying in the interest thereof annu- ally as it shall become due excepting one » cent thereof (a part of the Towns Interest) and the Principal at the respective times, set in the said act, for calling in the same, until the whole of both Interest and principal shall be paid wch said office & charge all the above named persons accepted.

Pursuant to an act of the Great and General Court or assembly of his Majesty's Province of the Massachusetts Bay in New Eng- land &c for the Emitting the sum of sixty Thousand Pounds, in Bills of Credit, To be lodged in the hands of the Province Treas- urer, and to be by him distributed to the several Towns within this Province, Having been notified by the said Treasurer.
These are to order and require you, and you are hereby ordered & required, forthwith to warn all the Freeholders of the North Precinct in the said Town of Braintree that they meet at the north meeting house in said Town, on Wednesday the third day of April next ensuing the date hereof at twelve of the clock at noone then and there, first to chuse a moderator, and then to consider and determine whether they will take their proportion of the said sixty Thousand Pounds, and if they see meet so to do Then to choose Trustees qualified as in the Act is provided to take out the same and dispose thereof agreeable to the said act, and such In- structions as shall then be given them. Hereof fail not, making return of your doings herein to one or more of the Selectmen be- fore the time prefixed. Dated the nineteenth day of March annoq Domini 1727/8.

[178] May 15th. 1728
Pursuant to the Precept to the Selectmen of the Town of Brain- tree, to assemble the free Holders and other Inhabitants of the Town duly Qualified for the choice of a Representative &c
Representative. The Freeholders and other Inhabitants Quali- fied as by Law required (Having been by vertue of warrants from the Selectmen duly warned) assembled on Wednesday, the fifteenth day of may anno Domini 1728, and being so assem- bled, after the warrants were publickly Read with the Returns thereof, the meeting proceeded to bring in their votes for a Representative, which being examined, it appeared that John Quincey Esqr. was chosen Representative by a major part of the whole votes, after which.
Moderator. The Freeholders and other Inhabitants of the Town qualified to vote in Town affairs being assembled by vertue of the warrants abovesaid proceeded as by the warrant directed, first, to chuse a Moderator and Capt. Peter Adams being first nominated was voted Moderator, who accepting and taking his place
Committee to just accompts with the Selectmen & Treasurer. A motion was made for the choice of a Committee to take an account of the Selectmen of their disposal of the Towns money, heretofore Granted for defreying the Towns Charges, and to ad- just accompts with the Town Treasurer, upon which Mr. Benjamin Neal, Mr. John Adams & Mr. John Hollbrook, being nominated were chosen a Committee for that affair.
Grant of £100 - to defrey Town charges - Then also voted that the Town should be assessed the sum of One hundred Pounds for defraying the necessary charges of the Town this present year. £100-
The moderator then put the Question to the Town whether the Middle Precinct in the Town should have libertie to move the school now kept in that Precinct to Two other places, to be kept at each place a third part of the year, (or half a year at each if the said Precinct see cause) Provided the said Precinct will be at the whole charge of such removal; the places nominated being, one at the south east corner of the little Pond where the ways part, and the other near the house of Nathaniel Wales, and it was voted in the affirmative
[179] Surveyors of Shingles &c. The meeting then pro- ceeded to chuse Surveyours of Clapboards & Shingles ; and Thomas White Ebenezer Field, Joseph Neall Secundus and Joshua Hay- ward, being nominated were separately voted Surveyors as above- said.
The Brand - It was then also voted that the Brands of the Town for Shingles & Clapboards should be a small [B] and that each of

the surveyors should have one, being all made alike & at the Towns charge.
Warrants - The Warrants for calling the said meeting, Returned by the Constables were as follows vizt.
Suffolk ss. To John Adams Constable of the Town of Braintree within the County of Suffolk, Greeting.
In his Majestys name you are Required forthwith to warn all the freeholders and other Inhabitants of the north Precincts in the Town of Braintree aforesaid, that have an estate of Free-hold in Lands within this Province or Teritory of forty shillings y annum at the least ; or other estate to the value of fifty Pounds Sterling. To assemble at the North Meeting house in said Town, on Wednesday the fifteenth day, of this Instant May, at Twelve of the Clock at noone : Then & there to elect & depute one or more persons (being free holders & Resident in the same Town accord- ing to the number Set & limited by an act of the General Assem- bly, to serve for & Represent them in a Great and General Court or assembly, appointed to be conven'd held and kept for his maj- esty's service at the Court house in Boston, upon Wednesday the twenty ninth Day of May Instant, and further you are hereby re- quired timely to notifie & Sumon the Person or Persons so elected and Deputed by the Major part of the electors present at such Election, to attend his majesty's Service in the said Great & Gen- eral Court or Assembly on the day above prefixed by nine in the morning and so De Die in Diem during their Session & Sessions. And you are alike Required to warn all the Freeholders & other Inhabitants of the said Town of Braintree duly qualified to vote in Town affairs to assemble at the place abovesaid and on the day set as abovesaid, at Two of the clock in the afternoone, then & there first to chuse a Moderator, Secondly to grant such sum or sums of money as are necessary for defreying the necessary charges of the Town this Present year Thirdly To consider and determine whether the Midle Precinct in the said Town shall have liberty to move the schoole kept in the said Precinct and lastly to choose a fit person or Persons to Survey Clapboards, & Shingles as the laws of the Province require, hereof fail not and make Return of your doings hierein to one or more of the Selectmen sometime before the said day Dated at Braintree the second day of May in the first year of his Majesty's Reign King George the Second &c annoq Domini 1728.
