The Freeholders and other Qualified Inhabitants being assem- bled as aforesd. And ye Meeting being opened they then proceeded and Co11. John Quincy Esq. being Nominated Was chose Mode- rator for sd meeting.
Constable Chose. ye Constables allowance. And then pro- ceeded to chuse a Constable ye votes being called For and Collect- ed and examined it appeared that Thomas Fenton was chose to sd office (It being then motioned To said Meeting that the said Con- stable Finton might have an allowance out of ye Treasury for his services in sd office and after some Debate thereon in sd Meeting For ye reason then offered, and for yt so many had been chose, and had paid their fines or become obliged therefor) The Moderator put ye Question Whether Thomas Finton now chose to ye office of a Constable upon his collecting compleating & finishing all such rates assessments as shall be committed to him to collect with ye Town Treasurer (or receiver for ye time being shall be allowed Three pounds out of ye sª Town Treasury for said service & It. passed in ye affirmative.

Voted, That ye sd Old Meeting House in ye North Precinct be still continued During the Towns pleasure and that ye North Pre- cinct use & Repair at their own cost ye sd House, During ye Town's pleasure as aforesd and then ye meet" Dismist.

Warrants. Voted to chuse a Moderator by hand Modr Chose. The Freeholders and other Qualified Inhabitants of the Town being assembled on Legal Warning for the choice of Town officers and Transacting sundry other affairs of ye Town, ye perticulars Whereof as they were Inserted in ye warrants for calling ye sd Meeting being as follows. First To chuse all such Town officers as the law requires &c Secondly, To receive ye Report of y.ª Selectmen Respecting Town ways laid out by them. Thirdly, To consider of an allowance for Bulls, boars, birds and squirrels. Fourthly, To Chuse a County Treasurer. Fifthly To Consider of chusing a Committee or Committees to Settle or adjust accompts with ye Selectmen & Town Treasurer. Sixthly, To consider of some method for regulating of ye School (or Schools) so that It (or they) may be made more useful & beneficial to (ye several parts of) ye sd Town. Seventhly, To consider of an allowance To ye Town Treasurer & Town Clerk per year for his services Therein Eighthly, To consider of petitioning to ye Court to set off to ye Township of Braintree part of Stoughton lands, with ye Inhabitants (thereon) as may be thought proper to Petition for. Ninethly, To Consider of Chusing a Committee To look into & see if there be any Incroachment or Incroachments, on any of ye lands of any Denomination whatsoever, belonging to ye sd Town & to reporte or prosecute as shall be Directed. The Meeting being opened and Capt. Joseph Crossbey being nominated was Voted Modr. for sd Day or Meeting.
Town Clerk. ye meeting proceeded next & voted Richard Faxon Town Clerk.
Selectmen. & then proceeded To chuse Selectmen. It being first Debated what number to chuse Whether five or three. ye Moderator then Put ye Question Whether there should be but three Select Men chosen to Serve ye town in yt Sarvice for this year and It passed in ye affirmative.
Constables March 19th. sd Ebenezer Niles came & Refused and gave his note for £5 - Negative vote on Capt. Baxters applica- tion afterwards gave a note for £5 - His refusal to ye minds of ye other two could. not be known The Votes being Collected & sorted it appeared that Moses Belcher, John Holbrook and Dea. Thomas Wales were chosen Selectmen &c & then Proceeded and Called

for the Votes for Constables, the Votes being Collected, examed & sorted, it appeared that Capt Sam1 Baxter, Thomas Copeland, & Ebenezer Niles were chosen, none of them, [48] but Capt Baxter, (Brought up) Baxter being there. Capt Baxter applyed To ye meeting to be releast from ye said choice, and after some debate thereon in ye meeting the Moderator Put ye Question whether Capt Sam" Baxter for ye reason (By him now) offered should be released from the sd Service of Constable to whh he hath been now chose & It past in ye negative. He then Declard his refusal - The other two not being there, their minds could not be known.
Treasurer. ye Meeting then proceeded to chuse a Treasurer Voted Richard Faxon Town Treasurer. (he being Nomd.)
March 6th. owen Released from ye Surveyors office Surveyer of Highways See also Page 51 And then proceeded to that of Surveyers of Highways Nomminated and chose Joseph Owen, David Bass, Christopher Webb & John Spear, (in ye North pre- cinct) Moses French, Thomas French, Jonathan Allen & Benja Clark in ye Middle part, Jonathan Clark Jonathan Hayden & Wm. Linsfield, in ye South part.
John Hains chosen Constable, March 6th refused to serve paid 5 Pounds. Proceeded to that of Constable next, the votes being called for viz. For another Constable & ye votes being Collected & examined and sorted it appeared that John Hains was chosen, but he not being there his mind could not be known.
Tythingmen And then proceeded to chuse Tything men nommi- nated & Voted (in ye North part) Sam" Cleverly, & Thomas Baxter, In ye Middle part) Wm Penniman & James Penniman (In ye South part) Sam11 Vinton & Joseph White Jun".
Fence-viewers. And then Went upon that of Fence-viewers & voted, (For ye North part) Joseph Neal & Nathaniel Belcher. (For ye Middle part) Sert John Thayer & Josiah French (For ye South part) Cornelius Thayer & John Clark
Hogreives. And then went upon that of hogreives & Voted (for ye North part) Wm Veasey & Moses Penniman (For ye Middle part) Caleb Hobart & Thomas Allen, (For the South part) John French Jun' & Sam" Pain Tertius.
And then proceeded to that of Surveyers of Timber & Voted, Capt. Wm. Hunt (in ye Middle part) & Ebenezer Field (in ye North part) :
To ye office of Sealer of Leather Were chose Mr John Beal (in ye North part) and John Capen (in ye Middle part.
A certain number of Bulls & boars To be allowed for Bulls How to be approved & entered The Moderator then put the question whether there should be any Bulls & boars allowed for the service of the Town this year, and it passed in ye affirmative & Voted that thirty shillings shall be allowed for each bull that shall kept in pasture for ye use of ye Town & voted that twenty Shillings shall be allowed For each Bull, running at large, pro- vided they be all allowed [49] or approved of by the Selectmen & entered with the Town Clerk by their order.

Highways excepted And then proceeded to that of Highways ye First being as follows. Upon viewing a piece of ye Town Way that leads from Ebenezer Crossbey's land throw ye farm formerly belonging to Doct". Wilson : We find that by altering sd way & laying it across a small corner of swamp; it was, easily made a much better way besids ye Shorting ye way, more than one half : in consideration of which, We have laid out ye way a Cross ye sd corner of a Swamp till it meets ye old way again, Whh is submitted To ye exceptance of ye Town Meeting in March :

Judg Quincys Heires & so over a little brook to a black oak tree marked on ye East side of ye way, thence to a little hill - thence to a white oak marked on ye West side of ye Way & thence over a Little Slow, to a black oak tree on ye East side of ye way, marked, & thence to two black oak trees marked standing Closs to-gether on ye West side of ye Way & an other tree stand- ing opposite on ye other side of ye way & thence to a black oak tree marked on ye West side of ye Way & thence to a little Brook Wherein is standing a White oak tree, In ye middle of said way thence to a black oak tree on ye Southeast side of sd way thence to a White oak tree on ye West side of sd way & thence to two white oak trees standing neer together & so thence to Bridg- water line as the way Is now Improved all ye above sd way to ly open & to be Two rods Wid, Voted excepted &c.

Boars. The Meeting adjourned Then went upon that of boars. Voted, that six boars (viz*) two in each precinct shall be allowed

for the service of ye Town this year & then Voted, that fifteen shillings shall be allowed (out of ye Town Treasury) For each boar that shall be entered with ye Town Clerk. By ye Select mens ordr as in ye case of bulls aforeesd. The Modr. with ye con- sent of ye Meeting adjourned the Meeting to To-morrow at nine of ye Clock in ye forenoon.
1738 March 6th.
Birds and Squirrels The Freeholders & other Qualified Inhab- itants mett, By adjournment &c. The Moderat put ye Question whether they would proceed & act on what remains in the War- rant & it past in ye affirmative & then went upon that of birds & Squirrels. ye Question was then put whether there should be an allowance for birds & Squirrels, and It past in ye affirmative, and then, Voted, that four pence per head (shall be allowed out of ye Town Treasury) for old black-birds heads brought In to ye Selectmen from hence untill the last of June, & from thence as last year, both as to time & price. Voted, That ye Incouriagment for young birds & Squirrels be the same as was allowed ye last year, So also ye time of Bringing them in
Crows. Copelands request to be released granted And then on a motion made in said Meeting Voted that Sixpence per head be allowed (out of ye Town Treasury for Crows (vizt) all ye year, if brought in to the Selectmen, as in ye case of black birds (viz for heads, and then John Webb one of ye Constables of sd Town, Representing to ye Meeting ye request of Thomas Copeland to be released for this year, from serving In ye office of Constable to whh he was chose on ye First of this Instant, and on ye sª request & for ye Reasons offered, the Question was put to ye meeting. Voted, That ye sª Copeland be released from serving &c.
Hains denied ye request. Constables Eph™. Thayer & Joseph Owen. John Hains also requesting to be released from serving as Constable & also ye same request tryed by a Vote, but passed in ye Negative, and then he declared his non acceptance, & paid his fine (See page 48 margan) and then ye meeting proceeded to chuse two more Constables. ye votes being brought in & exam- ined & sorted it appeared that Ephraim Thayer Jun. and Joseph Owen were chosen. - Joseph Owen (after a little consideration Declared his acceptance, But sª Ephraim Thayer not being there his mind could not be known. [51] Votes for a County Treasurer The Meeting then went upon that of a County Treasurer, ye votes being Collected were sealed up in ordr &c (viz) To send to ye Sessions.
But one School. A Committee to be Chosen. A Comttee for ye ordering ye School And then proceeded to that of ye Schools - and after some debate in sª meeting, ye Moderator put ye Question whether there should but one School be kept In this Town (at ye Town's charge) & it passed in ye affirmative. And then ye Ques- tion was put Whether a Committee, shall be chosen, to order the Time (and place) when the School shall be kept in each precinct viz the North & Middle precincts & Voted in ye affirmative, and

then the Question was put whether the committee hereafter named shall be Impowered to provide a School Master (vizt) a Gramer School Master) For the Town and it past also in ye affirmative. And then went upon that of chusing a Committee and Voted, That Co" John Quincy Capt. Joseph Crossbey, M' Moses Belcher, Richard Faxon & M' Ebenezer Thayer Bee a Committee In the affaire of ye School (as above sd) being all seperatly Voted :
The Town Clerk and Treasures Allowance his dissent as to ac- ceptance in full &c. and then went upon that of an Allowance to ye Town Clerk & Town Treasurer for his service for the two years past, and then the Moderator put the Question if twenty pounds should be allowed to Richd Faxon for his Service in sª offices of Clerk & Treasurer, which sd sum of twenty pounds was then voted in ye affirmative (and y" the sd Faxon Declined the acceptance, of as a full Reward for sd services &c
Doct". Stedman Chosen Surveyor of Highways And then pro- ceeded to chuse a Surveyor of Highway, Doctr. Benja Stedman being nominated was chosen a Surveyor of Highways by vote &c
Owen released from being a Surveyor of Highways Joseph Owen who Before was chosen Constable, Declared his acceptance, and applyed to ye Meeting to be released from Serving In that of Survey of highways, they then voted him to be released from the service of surveyor of highways.
Petitioning to ye Court referd to May meeting And then upon that of petitioning ye Court for a part of Stoughton lands &c Whh was refered to May Meeting.
And then prceeded to chuse ye Comtees as follows.
Committees Chosen two of them Voted, that (Mr) Benja Neal, M' John Beal, & Ensign John Thayer be a Comttee to settle & ad- just accompts with the Selectmen & Town Treasurer.

Nightingalls Provee & Town rates remitted to ye widow. On a Motion then in the Meeting Made & for the Reasons there then offered, Respecting the Town & Province, Rate (or rates) Due from Ebenezer Nightingall, Deceased, & that were to be collected by Ebenezer Adams late Constable, Voted, That the sd Province & Town rates, and the sums of them as set in sd late Constable Adam's list or lists be remitted to his ye sd Nightingall's relect or wido.

Peirces : Thirdly, To see if ye Town will give ord' for ye Comttee (authorized by this Town to prosecute Trespassers on ye Towns Commons) to Draw Money out of ye Towns Treasury to prosecute those who have Trespassed upon ye Towns &c Fourthly, To consider of puting in a Petition to ye General Court to prevent Damages To this Town respecting ye great Damage (that has or) that is like to be by seting saines for ye catching of Fish in (or) across any of ye salt or fresh Rivers &c.
Moderator. The Meeting being opened & Co" John Quincy be- ing nominated was Voted, Moderator, &c

Meeting, Voted, that six pounds be allowed out of the Treasury of this Town, & to be equally Divided betwixt the three Constables, That shall serve in sd office for this year, provided they Collect & pay in ye whole of the assessments, rates or taxes Committed to them to collect (without any other or further Demand therefor)
A, Committee to answer at Court &c & then proceeded to chuse a comttee &c ye Question was then put whether a Committee shall Chose to answer ye Petition at Court concerning a way across from More's Farm &c, & that they in ye Towns [53] behalf to oppose the laying out an open way a Cross from More's farm in Braintree To Capt Peirces in Milton as set forth in sª petition. Put to vote and it passed in ye affirmative, and then nominated & separately voted Moses Belcher & John Holbrook Two of ye Select- men of sd Town & with them Cor' Ebenezer Thayer a Comttee for ye affairs aforesaid
ye Comttee about Stones not allowed &c Draw money out of ye Treasury. And then proceeded to that of an allowance to ye Comttee In ye affair of Stones To Draw Money out of ye Treasury, To prosecute Trespassers, on the Towns Interest in ye Commons, and after some Debate (it being offered that as the Treasury was not at this time in prepared capacity, and as the sd Comttee might provably supply themselves) The question was put whether ye sd Comttee should Draw Money out of ye Treasury as above sd & it passed in the Negative.

Jno. Quincy Esq. Desired as he is ye Town's Representative, to take care of ye petition. & then proceeded to that of puting in a Petition to ye General Court on their next Sessions to prevent all persons whomsoever seting, or catching of any sort or sorts of Fish, either with Sa'enes or Dragnets in any season of ye year) at any time hereafter, when they come up to Spawn, that is to say to prevent all Persons whomsoever either seting of Sa'ens or Drag netts, In any of ye salt or fresh, rivers in which they come up to spawn, as aforesaid, either in theire passing up or down to or from any part of this Town, in any season of the year, put to vote, and it passed in ye affirmative, (& it is to be understood that the Honble John Quincy Esq". ye Representative of this town, is (authorised & Desired in behalf of ye Town to prefer the sd Peti- tion to sª Court & as speedily as may be to pray the consideration of sª Court thereon to prevent all devices of that nature & ye fur- ther Damage that is speedily Like to accrew, to us thereby if not prevented, and that the Honble. Court would be pleased to gaurd, us against all Devices of ye like nature by which the Fish of all sorts may be hindered (and the privilege spoiled) either in passing up or Down in their season of spawning, for ye future.
Marquand's allowee And then Peter Marquand applyd. to the meeting for an allowance for the service of his bull the year past. Voted, that Peter Marquand be allowed Twenty shillings out of ye Treasury for the reasons offered, on ye acct aforesd.

[54] 1739 May 14. Representative Chosen. Pursuant to a precept for ye choice of a Representative the Freeholders and other Qualified Inhabitants of ye Town of Braintree being assem- bled, on Legal Warning, The Meeting Being opened they pro- ceeded to ye choice of a Representative, and the votes being Col- lected and examined and sorted it appeared that Co" John Quincy Esq. was chosen by a majority of ye voters &c.
Warrants. And on ye Day above said the Freeholders and other Qualified Inhabitants of sª Town, being assembled to Transact some other affaires of ye Town, ye perticulars whereof as they were Inserted in ye warrants were as, follows.
First, To consider of ye Request of sundry persons respecting a free Passage or course for ye Fish up Manatiquod River. Sec- ondly, To hear ye Reports of any of ye Town's Committees that may have any thing to offer to ye Town & to Determine thereon as may be thought proper. Thirdly, To consider of Raising of Money to Defrey ye necessary charges of said Town this present year, as well as. what may be behind of ye last year past &c Fourthly, To consider whether any vote or votes that were past in our Last March Meeting respecting ye Schools, shall be recon- sidered & whether anything further shall be added in any respect. Fifthly, To Consider of ye request of sundry persons about a way (throw the Reved Mr. Niles' farm leading to ye Iron works, & Middle swamp. Sixthly. To consider of what may be offered

farther about a way from The Road neer Mores' farm Bridge in sd Town across to ye Road by M' Beal's on Crains plain &c vizt (instead of Coming out to ye Road by said Beal's to save Contro- vercie & cost of Land &c (To come out neer ye mile post by Mr Neals, seeing also it there May be accomodable to some of ye Inhabitants of that part of ye Town. Seventhly, To consider of that clause in ye warrant, for our last March meeting Respecting a Petitioning for some of Stoughton Lands &c Eighthly, To consider of building a New pound or pounds & where they shall be set. Ninthly, To consider of ye further allowance to ye Treasur & Clerk, it also being at ye last anniversary meeting likewise refered to this meeting
[55] The meeting being opened, they proceeded, and nomi- nated & chose Co" John Quincy Esq. Moderator for sd meeting, and then ye Moderator with ye consent of ye Meeting, adjourned ye meeting for half an hour, and then meet and proceeded.
