The Anniversary Town Meeting for choice of Town Officers for the year, Seventeen Hundred Forty and five


1744 March 4th.


Warrants. The Freeholders and Other Inhabitants of the Town of Braintree Qualified for Voting in Town Affairs being Legaly Assembled for The choice of Town Officers & such other affairs of said Town the Perticulars whereof as they were Inserted in the Warrants were as follows. After a Moderator chosen, First to chuse all such Town Officers as the Laws of this Province Direct To be chosen on the annual meeting in March &c. Secondly, To consider of ye Reporte of ye Select men respecting ye laying out of Ways. Thirdly, To consider of ye Report of any Comttee appointed by ye Town to lay out ways for ye town. Fourthly, To consid' of ye Report of any other Comttee that sd Town have Imployed in any of their affairs. Fifthly, To consider of chusing a Comttee to Lease out ye Town Lands &c. vizt. usualy calld School lands. Sixthly, To consid' whether the Town will come into any other method for Regulating ye Schools. Seventhly, To considr whether the Town will make Any Allowance for the keeping of Bulls and boars (for ye Towns use as some time heretofore, and if so, under what Regulation they shall be &c. Eighthly, To considr whethr any incouragment shall be given for ye killing of crows, black birds & ground Squrrels. Ninethly, To conside of Chusing a County Treasurer.


Moderator The said Freeholdrs &c being assembled proceeded & chose Co" Jnº Quincy Moderator.


Town Clerk And then proceeded and chose Richard Faxon Clerk &c.


ye Constables y" Chose were Sam" White, Jnº Spear & Benja". Porter sd White took ye oath And then proceeded to that of

Constables & after ye votes being Collected & Sorted it appeared that Samuel White jun", John Spear Secdus & Benja" Porter were chosen to said office said White then tooke the Oath to said office, Then on motion made to sd meeting Whethr. more than seven pounds shall be allowed to Each Constable that shall serve in sd office this present year put to vote & it passed in ye Negative, & then ye Question was put whether seven pounds, old tenor shall be allowed to each constable that shall serve The sd Town in sd office of Constable the ensuing year, vizt said sum to be allowed to each of them as aforesd at their making up accts of all assessments that shall be committed unto them, put to vote & it passed in ye affirm- ative.


Vots for a County Treasurer And then proceeded to that of chusing a County Treasurer, and the Votes being Collected were sealed up & Delivered to sd Constable White.


Selectmen And then proceeded to Chuse Selectmen, and after the vote were Collected - and sorted it appeared that those chosen viz. Selectmen were, Maj' Jos. Crosby, Lt. John Adams, Lieut. Richard Thayer, Dear John Holbrook and Ebenezer Copeland


Treasurer. And then proceeded to that of Chusing Town Treas- urer & proceeded by nomination. The Question was then was put whether Richard Faxon, should serve in said office, put to vote, and it passed in ye affirmative.

Surveyors of Highways And then proceeded to that of Survey- ers of high Ways, by nomination & chose as Follows, vizt. Joseph Neal Secdus Jonath Baxter & Gregory Baxter, (Brought over the Rest of the Surveyers of Highways and other Town Officers as in the several colloms Following. Surveyors of Highways William Salsbery, Ephraim Hunt, John Holbrook jun'. Thomas Vinton jun". David Holbrook Jun'. Joseph Ludden Secdus Joseph White and Benjamin Spear.


Tythingmen Chose for Tythingmen Jonathan Webb, William Penniman Jonathan Porter & Ebenezer Hayden.


Surveyors of Plank Timbr &c And then Chose for Surveyors of Plank, Timber Bords &c. Thomas Vinton, Joseph Neal, & John Clark.


Sealers of Leather And then Chose for Sealers of Leather, vizt. Aaron Hayward and Micah Allen.


Fence Viewers And then Chose for fence Viewers, Seth Bass, Ambros Marsh Napthali Thayer, Nehemiah Hayden, Samuel Ar- nold & Joseph Porter, & Thomas French Secdus.


Hogreives. And then chose for Hogreives, John Hayward, David Hunt, Zachariah Thayer Jun". Jonathan Hayward jun". Samuel Clark and Thomas Fenton junT.


And also Chose for the affair of preventing all breaches of the act of this province Lately made for the preservation of Deer, see said act in said province Laws page 15, 16, & 17th. of the Tempo- rary acts. Men Chose to inform in case of ye Breach of ye act re- fering to Deer &c. Joseph Wales, and William Bate.

Now follows Votes as passed in other affairs - & then proceeded to that of the School in the South pret and then the Question was put Whether a part of the School Money shall be allowed to the South Precinct (for the said use) as heretofore & it put to vote passed in ye affirmative


And then ye Comttes Report in ye affair of settling the line between the Towns Land and the Lands of Mr. Ebenezer Thayer on Rock Island was read & voted to be accepted &c.


And then proceeded to that of ye Report of the Selectmen Lay- ing out a way in ye South precinct, From ye Meeting-house to Benja" Haywards &c. and after some Debate thereon (& objection made By said Hayward &c) vizt. against laying out sd way throw his land) Voted that ye further consideration thereof be refered over to next May Meeting.


A Comttee to lease out Towns Land And then proceeded to that of Chusing a Comttee to Lease out the Towns Lands alias School Lands, & then nominated and voted, that Co1. John Quincy Majr Josh Crossby, Mr. Richard Thayer Dea" John Holbrook and Mr Moses Belcher, be a Comttee to Lease out the said Town Lands for seven years next coming from the first of this Instant March (viz they not to give Liberty for the Improvement of any part of said Lands by planting or Soeing &c During said term of seven years) at their Discretion.

& a Premium for Birds & Squrrels 4ª per head And then pro- ceeded to that of a Premium for birds & squrrels & Voted, that four Pence per head old tenor be allowed out of the Treasuree of this Town for all ground squrels, Crows and grown black birds.

A Representative Chose - Pursuant to a Warrant to the Select- men for the assembling the town of Braintree, for the choice of a Representative, the freeholders & Other Qualified Inhabitants of ye said Town (of Braintree) being assembled on Legal Warning (the meeting being opened) they proceeded and chose John Quincy Esq. their Representative (viz ye votes being Collected and sorted it appeared that ye said Quincy was chose to ye said trust by the Majr. part of ye voters present, as then Declared by ye Selectmen.


Warrant. Also a Meeting being Warned On the Day above sd for the Transacting some other affairs of said Town of Braintree, the perticulars whereof as they were Inserted in ye Warrant, were as follows, after a Moderator chosen &c. First To Raise Money for the Defreying ye Town Charges this present year &c. Secondly, to chuse two Constables (or as occasion shall be) Thirdly, To consider whether further may be necessary to be done relating to ye passage of Fish up Manatiquod River, and to prevent any un- just or ill method or means (used) or that has or may be used in catching of them at any time to come & that Their passage up said River may not be unreasonably, obstructed &c. Fourthly, To

consider of ye Request of ye South Precinct, respecting their being priviledged with some part of ye Town's Commons to be set to them & to here the petition or request of any other Relating to said Common. Fifthly To considr of & propose & conclude on some method to settle ye affair of ye Bonds in the Treasury, perticularly those at Interest for money let out &c. as far as may be thought proper, that their may be a Determination thereon, as to ye Differ- ence of money, if any be so concluded on, or in any other respect, vizt as to Renewing any of sd bonds, & to Direct of Disposing of the money if any of them shall be paid in, as also if any of them shall be called in. Sixthly, To Chuse one Surveyor of highways for ye North precinct, one failing. Seventhly, To Consider whether there were any Incroachments on any of ye Liberties of ye leases, last expired by those, or any of those, that improved under said leases. Eighthly, To Consider of ye affair of ye Schools &c & that of Ways refered to this meeting, as ye said affairs were refered from our last annual meeting in March last &c.

a Negative vote on ye continuing ye South pret petition And then proceeded to that of the request of ye South precinct & after their Petition Read & Debated, ye Question was put Whether the prayer in said Petition should be continued to ye next town meet- ing put to vote & it passed in ye Negative.


A Comttee chose In ye Affairs of the Bonds &c And then pro- ceeded to that of ye bonds &c. And then Nominated & Sepe- rately Voted Jnº Quincy & Jos Crossby Esqrs. L' Richard Thayer (Dea. Jnº Holbrook and Richard Faxon, be a Comttee to Determine & Settle the affair of the Bonds in the Treasury respecting the Difference of money and the Interest, at their Discretion in ye sd affair in behalf of ye Town &c


A way throw Benja Haywards & ye Crane's Land &c See also page 130 And then proceeded to that of Highways, then the Selectmens return of a Town way Laid out Febry 18th. 1744, and after some Debate thereon, and by the consent of Benja Hayward & Ebenez" Crane &c that yt part of said way going throw their ye sd Haywards & Cranes Lands be accepted as a Town way & to lye open, they then being Present & Declared that they did con- sent to give the Land on which the sd way went of a Rode & a half wide for sd use then Voted, yt sd part of sd way be accepted as aforesd, provided that no Demands be hereafter made on the Town, for pay for the land sd Way goes on, or for fence. Fourthly, To consider of Chusing a Committee to make up accompt with ye Town Treasurer. Fifthly, To Here & consider of ye Reporte or Reports of any of ye Comttees in ye affairs of Ways or any, other of ye Town affairs for which any Comttee has been chose. Sixthly To consider if anything farther shall be done in ye affair of ye Schools, &c.


Moderator. And then the meeting being assembled (on ye sec- ond part of ye Notification or clause in ye Warrants, they proceed- ed, And chose Maj' Jos Crossby Moderat" &c.


Voted, that two Hundred pounds to be assessed &c £200 - And then proceeded to that of Raising money for Defreying Town charges, & then Voted that two Hundred pounds old tenor be assessed on ye Poles & Estats of the Inhabitants of said Town for Defreying charges &c.


Voted, that a Petition in ye affair of ye fish be prefered to ye Gen1. Court &c & a Comttee chose And then proceeded to that of prefering a Petition to the General Court By ye Representative of this Town, in the affair of the Fish, that there, may be such an Act passed as may prevent all Devices that have or may be used to the obstruction of any sort of Fish in their passage up Manati- quod River at any season of ye year for ye future, and then chose L'. Richard Thayer, John Curtis & John Hayward, in The affair to see that such a Petition be prefered as aforesd.

The Comttees Report read and accepted in ye affair of je Bonds at Interest &c And then passt to that of the Comttee Report in ye affairs of ye bonds, vizt. the Bonds, at Interest, the sª Reporte being Read in said Meeting & the Moderator put the Question whether the Reporte Now Read shall be so accepted, (vizt. said Report Dated Febry, Twenty Seventh Seventeen Hundred Forty & five) and that the Treasurer Conform thereto accordingly, put to vote & it passt In ye affirmative.


The affair of ye Bridge Left with the Selectmen And then pro- ceeded to that of Petitioning that Manatiquod Bridge May be Made a County Bridge & after Some Debate thereon Voted, That ye Selectmen take Care thereof.

A Representative. & then on ye Day a bove said Moderator. and then ye mod- erator adjourned ye meeting viz. their consent, to four o'clock on ye afternoon Voted, yt mr Joseph marsh Be released &c. And Nath" Spear chose & after some Debate ye meeting proceeded To a new choice & then Josiah Ruggles was chose to said office Benja" Owen accepted in ye room of Josiah Ruggles & took the oath Owens allowance Voted also Thayers The freeholdrs and other Qualified Inhabitants of ye Town of Braintree assembled on Legal warning, on ye Day & year above sd & pursuant to ye The Business set forth in ye Warrants as afore sd, proceeded and chose Maj' Joseph Crossbey, Moderator & then proceeded to that of chusing a Constable (in ye North precinct) of said Town) viz after ye meeting being again assembled by adjournment as noted in ye margin - at which time (a Petition or) memorial From Mr. Joseph Marsh to ye sd Town, on that of his ye sd Marsh's Being chose Constable (vizt. to said office on ye annual meeting in March Last past & after sd memorial being Read & Some Debate thereon, ye Moderator Put ye Question whether ye sd Jos' Marsh should be Re- leased & Discharged from serving ye sª Town in sd office of Consta- ble ye present year & that an other Be chose &c put to vote & it past in ye affirmative, and then the Votes being Collected & sorted it appeared that Nathan Spear was chose to serve in sª office, but in consideration that ye sª Spear was chose one of the Surveyers of Highways for ye present year, & after some Debate thereon ye said meeting proceeded to a new choice & after The Votes were Collected & Sorted, it appeared that Josiah Ruggles was chosen to ye sd office of Constbl and then at ye motion of sd Ruggles to the

Owen might be accepted in his room, ye mod- erator put ye Question whether That ye sd Benja" Owen should serve in sd office in ye room and stead of sd Josiah Ruggles put to vote & it past in ye affirmative, (sd Owen being there & consent") and then sd owen made a motion to sd meeting that he might be allowed By ye sd town a premium as had been a late practice in that case, also, Benjamin Thayer Chosen to the sd office of Con- stable on March last past made motion To this meeting for an al- lowance to him in like (manner) sort, and then ye Moderator put the Question whether Benja" Owen & likewise Benja" Thayer, vizt. each of them shall be allowed seven pounds old tenor for their Ser- vices in said office, (under ye proviso heretofore annexed to sd allowance) put to vote & it passed In ye affirmative (See ye pro- viso annexed to said allowance on page 108 Back)

1746, Augt. 25th.


The Freeholders & other Inhabitants of the Town of Braintree Qualified For Voting in Town affairs Being Legaly assembled for ye Transacting such Affairs of ye sd Town The perticulars whereof as they were Inserted in ye Warrants were as follows.


First To bring in their valuations to ye Selectmen of their Poles & other Ratable Estats. Secondly, After a Moderator chosen, To consider of raising money to Defrey the Necessary Charg's of ye Town this present year &c. Thirdly, To consider of any affair Relating to any of ye Bridges within this Town. Fourthly, To consider what is necessary to be done for ye Securing ye sd Town's Stock of powder. Fifthly, To consider of any affair relating to ye Schools, & of allowing any part of the School Money to ye School in ye South precinct or to any other of ye precincts of said Town. Moderator-300£ Tax, £300-Proceeded to ye second & chose Majr. Joseph Crossby Moderator. & then proceeded to that of raising money to Defrey ye necessary charg's &c & then Voted, That three Hundred pounds old tenor be assessed &c to Defrey ye necessary charges of sª Town as far as it will goe.
