at the request of sundry persons of our South Precinct, we laid out a way of two Rods wide to ly open, beginning at the Cochato Line, by Nathaniel Thayer Junior, we laid it as the way then went to Cranberry Brook, from thence at the head of the Lots, that Butt on the Iron Work Land, till we come to the wester- most corner of Samuel Whites Land from thence we laid upon a straight Line, to Mr. Niles house and so through the rest of his Farm, as the way then went, till we came about Thirty Rods beyond a great Rock by the way side where we left the old way, and laid out a new way strait to a black oak Tree, which we marked, from thence upon a strait Line till we got through Mr. Niles Farm to a Rock in Samuel Bass, Juniors Land, near the Line between him & Mr. Niles, thence to the swamp hard by, and so through the swamp, as the way then went, and so strait to a white oak, by the side of John Frenches Field, from thence strait across his Field, Just beyond which we marked a white oak and so on to a pople, thence to another pople which we marked and several other Trees we marked between that and a black oak Tree by Ebenezer Newcombs line, which was the last Tree we marked, the said way to be all along Two Rods wide.

In running the lines between Deacon Savel & Deacon Payn and Joseph Nitingal and the common Lands we began at a heap of stones at the East corner of Nightingals swamp, which is a corner bounds, from thence we run to a black burch Tree by the side of a swamp near norwest from the heap of stones from that we ran to a line near southwest to a great Oak Tree, from thence to a large stump and thence upon a straight line to the six hundred Acre Lots, then we came back to where we began, and Ran a line near south to a great Rock, from that to another Rock and from thence to a third Rock, and from that to the Highway, and the highway, the bounds to the top of the hill, and from thence a strait line to Faxsons Line) where we markt a young sapline, Run by us the subscribers Joseph Crosby Samuel Allen.

[219] Braintree September 4th. 1723.
By ye Selectmen &c.
Whereas there was a Town highway, laid out by ye Selectmen in the year 1690, Feby 16, from ye Country Road leading to Bridgewater, beginning upon ye land of Caleb Hobart, deceased beyond his old Field so called, near ye house of Nehemiah Hayden (now Deceased) & Running to Aldridge Farm near yo coal Pit (a place so called) & so to ye common, as may by yº record thereof more fully appear, and whereas there appears to be several inconveniencies in its lying as it was then laid out at ye desire of several persons in that neighborhood whome it most nearly concerned we the subscribers Selectmen for ye year 1723, in consideration of ye aforesaid inconveniences have ordered that the way aforesaid shall begin about Ten Rods more northward on the country Road, and go thorow ye swampy land as it now goes & is fenced out between ye land of Benjamin Hayden, and ye land belonging to ye Heirs of Benjamin Hobart deceased, till it come to ye land of John Ruggles and from thence straight to a piece of land appertaining to Benjamin Hayden aforesaid near ye Clay Pits, & so thorow ye southernmost side of said Haydens Land by ye line between him & John Ruggles, and then in ye said old way over ye Bridge, as so (as it was before laid out) to the common.

Quincey's Gate, thorow his Land, as the way now goes to the brook & from thence straight up the Hill, & along the Ridge, as it has been lately improved, till it meets with the old way, & from thence as it is now Improved to Mr. Wilsons Land, & so by his house & thorow his land by the swamp straight to the causey, in the land appertaining to the Heirs of Ebenezer Hinckley Deceased & from thence as the way is improved to the way leading from Squantum to Milton.

Application being made to us the subscribers, Selectmen of ye Towne by the inhabitants & Proprietors of ye Lands in & about Bendalls Farm in ye south part of the Town, for a town way to be laid out from the Country Road to the said Lands, and we judging it very necessary to be done, did on the day above said lay out a way One Rod and a half wide to ly open beginning at the country Road near the house of John Niles senior, and so passing thorow ye land of John Niles Junior, between his Dwell- ing house & Barne as the way is now improved, and from thence

thorow ye land of Benjamin Niles on the southernmost side of his house & orchard without his ffence as the way has lately been improved till it be past a little Bridge in his land about three or four Rod; then leaving ye way, we turned off to the left hand thorow said Benjamin Niles Land, and thorow a part of Ebenezer Niles his land, and it being brushy or bushy land we opened it by cutting away the bushes where the way is to go, and from thence thorrow a small corner of John Niles' Land to Bendals Line, then Proceeded on said line till it meets with the old Road, at a noted black oak-Bound Tree. then keeping ye Road thorrow Bears swamp Brook to the parting of ye ways by a black oak Tree, then Proceeded as the ways Divided, one way to the Lands of David Bass, and the other to a cedar swamp belonging to Lievt. Jnº. Cleverly allowing liberty to the Proprietors of ye Lands to alter the way a small matter where it may be made better thereby and not more chargable to the Town, also for their own conveniency of Improvement of their Land, we allowed any particular person to alter a small matter if it may, be without Detriment to the way, they doing it at their own charge.

Wee the subscribers, hereunto, Selectmen of ye Town of Brain- tree being requested by Nathaniel Littlefield, Joseph, Benjamin & Deering Spear, with several others whose concerns lay that way, to lay out a convenient cart way from ye country Road, in ye south part of Braintree, to Dorchester near Punckapaug, Did on the first Day of June 1721, in answer to their Request, begin at ye Rising ground on ye southern side of ye house of Cornelius Thayer's Jun- ior, and from thence laid out a cart way (to ly open) for ye Towns use, a cross ye land of ye said Cornelius Thayer on ye South side of a stake then set down by ye Road, & several stumps standing on ye edge of the hill, and so round ye hill to a cart way in ye Brook, that Runs thorow ye lands in possession of Daniel Thayer, from thence on ye south side of several Stakes we set down & Trees wee marked near a straight Line to ye cart way, on ye south side of ye said Daniel Thayer his land (the way to be a Rod & a half wide) from thence following ye cart way aforesaid thorow ye Land of Cornelius Thayer senior & Deacon Gregory Belcher's, lott, tak- ing ye middle way where ye way parted into Three, and ye upper way on ye side of ye Hill, marking several Trees on ye north side thereof and so keeping ye old beaten Road to ye Lands of Capt John Hunt, from thence keeping ye way that goes to ye sixth Di- vission of Lotts and so with yo way to Dorchester Line.

[223] The committee chosen the 10th. Day of May 1717, to Inquire into and Inspect all encroachments on Common Lands and private highways, belonging to the Town and the lines and Bound- aries betwixt common Lands and Private Persons made the under written Report the 12th May 1718 at a publick Town Meeting.
At Captains Plaine we find the wall on the west side not straight, and suppose it too far in, at one end, of Faxsons Farme we saw an ancient imperfect Platt, we know not but ye Draught might be true, but incompleat and uninteligible having no meridian Line, nor north Point, nor any bound marks described, supposing the Platt true. William Thayer has encroached on the common land and mr. Faxson has Land lying out by Deacon Bass's we found the fence removed at Nathaniel Owens, we suppose on to the common, and at Benjamin Neal's a small matter, we find ye way to straight at Mr. Crosbey's sloe bushes, and at Lt Cleverly's & other Places in ye North Precinct, at the south end the way is to straight from Elder Wales Barne to John Copeland's, againe on south Road between samuel Payn & Samuel Curtis, and again

We the subscribers hereunto, Selectmen, being met together at the desire of Joseph Nightingal to settle the line between his land on the south side of ye Captain's plaine (so called) formerly be- longing to Dea. Samuel Bass Deceased, and the comon ajacent, did together with the said Joseph Nitingall agreeable to a copy of an ancient Record, taken from the Town Records by the Clerk as near as we could settle the said Line as follows viz. to Run straight from the end of the old wall on the Rocks at the southwest corner of said Land, Eastward to an old wall on the top of the hill beyond the round meadow in said Plain and so down the hill to meet with Joseph Adams, Fence on the south side of his Barne which heretofore, belonged to John Bass, and we marked several Trees all along in the said line for bound Trees.

we the Selectmen of Braintree have laid out the way that leads to ye Purchase land over menatticut River, the East corner of ye little Pond & so from the Country way as Mr. Jones Fence stands & so round as ye fence stands & so to ye River by Marked Trees and at the River by two Maple Trees, on the Right liand, the one on this side, and on the further side, the other Tree, & from thenice in ye old cart way till it comes to William Richards Ffence on the right hand & from thence through Nathaniel Thayers Land, Junior & through John Wilds Land till we come to the Purchase land with marked Trees & Rocks on the right hand all to be one Rod & an half wide

There being complaint made by Thomas Thayer Junior that the way from his Dwelling house, over the Dam into ye country Road was fenced up in Two places, & several of ye neighbours desiring to have that way laid out further than it had formerly been for an out lett into the vacant lands & for their convenience in coming to meeting & mill, we the Selectmen of Braintry this 21st. of May 1690 went to ye Place & opened ye way & continued the way for- merly laid out till we came near Richard Thayers (Juniors) house & from thence till we come to ye cart way at ye corner of John Staples land within fence & we marked it out a Rod & half wide by Stakes & Marked Trees.

[226] Know all Men by these Presents that I Samuel Penni- man of Braintry in the County of Suffolk, in the Province of the Massachusetts Bay in New England, am holden and do stand firmly bound unto the present select men, for the Town of Braintry aforesaid, in the full & Just sum of one hundred Pounds, current money of New England, to be paid to the said Selectmen, or either of them, their certaine Attorney or successors in ye said office of Selectmen, on the behalf & for the use of the said town, To which payment well and truly to be made I bind myself my heirs execu- tors & Administrators firmly by these presents. sealed with my seal this 29th. day of October Anno Domini one thousand seven hundred and eleven, in the Tenth year of the Reign of Her Majesty Queen Ann.
The condition of this present obligation is such that whereas the above named Samuel Penniman has received of his Brother John Penniman of Swansey in the County of Bristoll in the Prov- ince abovesaid, one deed of a certain Tract of land in the Town- ship of Braintry, containing about ten acres of Land (as by said Deed may more fully appear) and have Received of the Selectmen

above named Twelve pounds money, by an order on the Town Treasurer, all which is for the keeping and maintaining the afore- said, John Penniman. Now know all Men to whom these Presents shall come, that I the said Samuel Penniman Do covenant Promise grant & agree to & with the said selectmen and bind & oblige my- self, my Heirs, executors, & administrators to find my Brother the abovesaid John Penniman with good & sufficient, meat drink apparrel, washing & Lodging and with all other things, necessary and conveniant in sickness and in health, during the time & terme of his, the said John Pennimans natural life, and to save the town for ever, from any charge therein, upon ye true and faithfull per- formance whereof, the above said obligation is to be utterly void & of none effect, but if there be failure hereof contrary to ye true intent & meaning of these presents, then to abide in full force and virtue.
