Representative. The Selectmen opened the meeting for the choice of Representatives and the Town voted to chuse only one, the votes being Collected Samuel Bass Esqr. was chosen, he had 142 votes out of 271 -


June 15th.


Warrant. The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to Vote in Town affairs being assembled this 15th. day of June pursuant to Legal Warrants the particulars are as follows, first after a moderator chosen to see if the Town will give their assessors or Treasurer any Further direc- tions respecting Gaius Thayer or chuse any committee they may think proper for that purpose.


Secondly - To give any further Instructions they may think proper to their committee which was appointed to make enquirey about the money borrowed of Colo Josiah Quincy in the year 1775.


Thirdly, To chuse any Committee or act on any matter they may think proper, when assembled.


Assembled and made choice of Majr. Penniman moderator.


Voted, to pass by the first article and take up the second.


Voted, that the present Selectmen be directed to make enquiry of what became of the money Received of the Collectors for 1774 Tax & make a final setelment with those that Received it

The Freeholders and other Inhabitants of the Town of Braintree qualified by Law to vote in Town affairs being assembled by adjournment from the 11th. day of May last the Moderator not being present Capt". John Vinton was chosen Moderator.


The meeting was adjourned to the first day of August next at 5 o clock afternoon.


Aug. 1.


The Freeholders and other Inhabitants being assembled pursuant to the above adjournment, did then adjourn to the last monday in November next at two o clock afternoon.


Augst. 1.


Warrants The Freeholders and other Inhabitants of the Town of Braintree qualified by Law to Vote for Representative being assembled pursuant to legal warrants the particulars are as follows, after a moderator chosen.


First To give in their votes for a Register of Deeds for the County.


Secondly To hear the Report of any Committee or chuse any the Town may think proper when assembled.


Assembled as aforesaid and made choice of M' Azariah Faxon Moderator.


The Votes for Register of Deeds being brought in sorted and counted there was for, Joshua Hinshaw Esqr. 15 Votes.

Commee on Colo. Quincy's money. The Committee appointed to enquire of what became of the money Borrow'd of Colo. Josiah Quincy in the year 1775, also of what became of the Tax for 1774, Reported which Report was not accepted the Town added two more to the Committee (viz) Dec". French & Maj Penniman and directed them to Report.

The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote for Representative being assembled pur- suant to Legal Warrants the particulars are as follows.


First after a moderator chosen to give in their Votes, for a dis- creet Suitable Person haveing a Freehold within said County of Suffolk of the annual income of Ten pounds at the least, to be Register of Deeds for said County.


Secondly, To hear the Report of any Committee or chuse any the Town may think proper when assembled.


Assembled as aforesaid and made choice of Peter B. Adams Esqr. Moderator.


Register of Deeds. The Votes for Register of Deeds being brought in sorted & counted there was for Joshua Hinshaw Esqr. 11 Votes and for

Report of the Committee on Money borrow'd of Colo. Quincy. The Committee appointed to enquire of what became of the money borrow'd of Colo. Josiah Quincy in 1775, and what became of the Tax for 1774, Report as follows.


" That after enquiring into the affair of the money borrowed as- " aforesaid from the best information we can git we find that the " Town has had the benefit of all the money borrowed as afore- " said which was one hundred and Fifty pounds, Excepting thirty " pounds in the hands of the Heirs of Colo. Jonathan Bass, and nine " pounds in the hands of the heirs of Dec". James Penniman and " also Ten pounds in the hands of the Heirs of Maj". Edmund Soper, " which has not as yet been accounted for. Moses French, John Hall Stephen Penniman, Caleb Hayward, signed it.


The foregoing Report was Voted & accepted by the Town in Town meeting assembled the 22d. day of Augst. 1791.

Come to call on those who had money borrow'd of Colo. Quincy. Voted, to chuse a Committee to call upon or settle with those who Received the money that was borrow'd of Colo. Quincy in 1775.


Then Cap Hall Maj' Penniman and Capt Sawen was chosen for that purpose

Voted, to chuse a Committee to make a final settlement with those persons who advanced money for the purpose of hireing men in the Years 1775 &c. agreeable to the vote of the Town as Recorded in Libro 2nd. Folo 317 Then Peter B. Adams, Esqr. Ebenezer Thayer jun' Esq. Dec". Moses French, Capt. Eliphalet Sawen & Maj' Stephen, Penniman was chosen a Committee for the above purpose and that they make out a list of the sums due to each person & the Selectmen are authorized to draw on the Treas- urer therefor.

The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled this twenty seventh day of September 1791 pursuant to legal Warrants the particulars are as follows, after a moderator chosen


First to see if the Town will appoint agents to appear In behalf of them before a Committee of the General Court who are ap- pointed to view the situation and Local circumstances of the North precienct, who have hereto fore prayed to be set of from said Town.


Assembled as aforesaid Mr. Azariah Faxon moderator.


Agents to appear in behalf of the Town with the County Come. Voted, to chuse agents to appear in behalf of the Town, before the Committee aforesaid to oppose a seperation takeing place. MThen Maj. Braintree, Anno Domini 1791.


The Freeholders and other Inhabitants of the Town of Braintree Qualified by Law to vote in Town affairs being assembled by ad- journment from August 1st. 1791.


for the division of the County. Commee to give instructions. The Petition from a number of Towns in the County of Suffolk to the General Court praying for a division of said County and the Courts order of Notification thereon being Redd, The Town Voted to chuse a Committee to give instructions to our Representative to use his best endeavors, and Influance in the General Court to have tlie County divided. Voted that sª Committee serve without any pay.


Then Gen1. Thayer, Capt. Vinton, Capt". Hall, Lieut. Baxter Mr. White, Capt. Sawen, and Capt. Wild was chosen.


Moderator. Capt Vinton was excused serving Moderator at his own request, he being engaged in other Business & Majr Penni- man was chosen


Treasurer to prosecute Gaius Thayer Bond. Voted, That the Treasurer be directed to put the Bond in sute which he has against Gaius Thayer Dec". S. Holbrook & Cap Vinton


Treasurer to borrow Money - Voted, that the Treasurer be di- rected and impowered to Borrow-on the Credit of this town a sum not exceeding the sum of Two-hundred pounds and that the same be appropriated & applyed for the purpose of dischargeing such of the Towns debts as are called for.


Collectors chosen & their fees for Collecting. The persons who were chosen Collectors in May last upon conditions did not fulfill those conditions, and the Town made choice of Mess. Elijah Veazie jun Caleb French and Seth Turner jun upon the same condition as the others were chosen, those of them that was present complyd, and procured their bondsman, the Town voted to give them six pence on the pound in each precienct


The Meeting was then adjourned to Monday 12th. December next 3 oclock P.M.

The Town being assembled pursuant the above adjournment They made choice of Capt". John Vinton for their Moderator.


Assessors to give draw backs Voted, that the assessors be au- thorized to give a drawback to Nedebiah Bent for six or seven shillings he being over taxed in year 1790, and to Asaph Faxon such a sum as they shall adjudge him to be over Taxed in said year.

The Freeholders and other Inhabitants of the Town of Braintree qualified by law to vote in Town affairs being Legally Assembled this thirteenth day of March at the Meeting House in that precienct formerly call'd the Middle precienct, but now the first for the pur- pose of chusing Town officers and for transacting other affairs of the Town, particulars are as follows (Viz)


First after a Moderator chosen To chuse all such Town officers as the Law directs for the ensuing year.


Secondly to Raise such sum or sums of money as the Town may think proper for the purpose of discharge. the Towns debts and Defraying the expence of the Town the ensuing year.


thirdly to see if the Town will choose a Committee for the pur- pose of setteling all matters Between this Town & the Town of Quincy.


fourthly to see and determine in what way & manner the Town will repair the High Ways the ensuing year.


fifthly to see if the Town will chuse a Committee for the purpose of takeing care of the fish the ensuing year.


sixthly, To see if the Town will chuse a Committee for the Schooles the ensuing year.


seventhly, To see and determine what money shall be appropri- ated to the support of schools the ensuing year.


Eighthly to see if the Town will give a premium on Crowsheads.


Ninthly to hear the Report of any Committee or Choose any the Town may think proper.


tenthly to see if the Town will choose a Come. to lease Town Lands.

The Committee that was appointed to settle with the Treasurer made their Report which was read and accepted as it is Recorded in the Treasurers Book Folº. 424 & 425.

Voted a Committee to settle with the Treasurer at the end of the year. Then Maj. Stephen Penniman Cap Nehemiah Holbrook and Samuel Bass Esq. was chosen.


Voted to raise the sum of five hundred pounds for the purpose of defraying the Charges of the Town the Ensuing year and pay- ing the Towns Debts, and that the same be Assessed on the Polls and Estates lying within the same.


Voted to adopt the same Rules and Regulations for the collect- ing Taxes as was adopted the last year the particulars are Re- corded in Folº. 84.


Money advanced to hire soldiers. Voted that the Committee who was chosen Augst. 22d. 1791, to make allowance to those who advanced money be authorized to meet again and make such fur- ther allowance as they may think proper.


Drawbacks and over Taxes. Voted that all matters Respecting over Taxes &c be submitted to the Committee who are authorized to settle with the Town of Quincy.


Voted that the May meeting be held at this place this year by a Majority, 69 Voteing for it 39 Voteing against it.


Voted to adjourn this meeting to the same day the May meeting shall be on at one oclock afternoon at this place.

The Freeholders and other Inhabitants of the Town of Braintree being Assembled by adjournment from April 2d.


Voted to adopt the same Rules & Regulations for Collecting the Taxes as was voted the last year and the year before as Recorded in page 84.


Benjamin White bid of the North precienct bill at nine pence on the pound for Collecting


Seth Turner junt. bid of the South precienct bill at eight pence on the pound he was then Chosen a Collector on the Conditions as Recorded in page 84.


Voted that the Committee prosecute all person who have catchi'd alewives contrary to Law.


The School Committee Report that the Sum of One hundred and Thirty pounds will be sufficient for to be laid out in Schooling and in fuel for the fires for said Schools. The Town Voted to Accept the above Report.


Voted to adjourn this meeting to the last monday in November next 2, oclock afternoon.

The Freeholders and other Inhabitants of the Town of Braintree qualified by the Constitution to Vote for Representatives being as- sembled pursuant to legal Warrants for that purpose, the Select- men opened the meeting it was Voted to send one Representative to the General Court the Ensuing year.


The votes being Collected and Sorted, Ebenezer Thayer jun". Esq. was chosen.


[114] The Freeholders and other Inhabitants of the Town of Braintree qualified to Vote in Town affairs being Assembled pur- suant to legal Warrants the particulars are as follows after a Mod- erator Chosen to see if the Town will hear and grant the Request of Mr. Ebenezer Newcomb which is that the Town will consent that Nights Neck so called may be set of from this Town otherwise that the Town will consent to lay out a way from said Newcombs to the head of Hayward Crick so called.


Secondly to see if the Town will choose an agent or agents or do anything towards incourageing a Seperation of the County of Suffolk.


Assembled and Made Choice of Maj Stephen Penniman for Moderator.


Voted to chuse a Committee to view the land where Mr. New- comb proposes the way shoud be & Report. Then Lieut. William Hobart Capt". James Faxon & Capt". Isaac Thayer was chosen for that purpose.


Voted to chuse one agent to join with those Towns in the County of Suffolk who have petitioned the Gen1. Court to have the County divided then Eben'. Thayer jun. Esq. was chosen who is hereby authorized to appear in behalf of this Town before the General

The Freeholders and other Inhabitants of the Town of Braintree qualified to vote in Town affairs being assembled this 28th. day of May pursuant to Legal warrants the particulars are as follows for the purpose of Chooseing an agent or agents to shew cause why the prayers of the Petitions of the South Precienct made to the General Court the last session should not be granted. Assembled and made choice of Dec". Moses French as Moderator. it was Voted that Capt. John Vinton Dec". Moses French Mr Caleb Hay- ward Capt. Eliphalet Sawen Capt. Ichabod Holbrook Doct. Daniel Fogg and Capt. Thomas French be chosen as agents to shew cause why the Prayer of the South Precienct made to the General Court at their last Session (viz) that the said South Precienct be set off as a seperate Town should not be granted. Voted that General Ebenezer Thayer be desired to use his influence for the same Pur- pose.


Voted that said Committee or agents procure Council if need be and that they Conduct the matter as think best.


Voted that this meeting be adjourned to Monday next five oclock

The Freeholders and other Inhabitants of the Town of Braintree being assembled pursuant to the above adjournment.


Voted that the Town meetings in future shall be held in the North Precienct one year and in the South the next; and as the meetings have been held in the North this year they shall be con- tinued to be held there untill the first of next March and from that time they shall be held in the South precienct for one year and so shifting alternately from year to year so long as the Town Re- mains connected as they now are.

The Freeholders and other Inhabitants of the Town of Braintree qualified by Law to Vote in Town affairs being assembled the third day of September pursuant to legal Warrants the particulars are as follows, after a Moderator chosen


First to see if the Town will give their consent to have a Hospi- tal or horspitals opened in some Convenient place in said Town for the purpose of Inoculating for the small pox.


Secondly to see if the Town will adopt any Measuers for the Regulation of said Hospitals.

Voted that there be Liberty given for Inoculating for the small pox within the Town provided that there can be suitable places provided for Hospitals.


Voted to chuse a Committee who shall be Authorized and Impow- ered to approve or disapprove of such places as shall be proposed for Hospitals and no person shall presume to Inoculate at any other place than such as shall be approved off by said Committee under the penalty of the Law in that case made and provided. Then Dec". Moses French Capt. Jonathan Thayer Mr. Caleb Hayward Mr. D. P. Hayward Ebenezer Thayer jun. Esq' was chosen for the North Precienct Samuel Bass Esq. Lieut. Nathaniel Niles Capt. Eliphalet Sawen Cap. Barnabas Clark & Mr. Joseph White Jun". was chosen for the South Precienct and that the Committee in each Precienct have power to conduct the Business seperately but in case of a disagreement they are to call on the other Committee to assist them in setteling any dispute that may arise with Regard to the place or the limits or bounds allowed the patience to walk or Recreate themselves, and that the whol Committee limit the time for Inoculation.

The Freeholders and other Inhabitants of the Town of Braintree qualified by the Constitution to Vote for Representatives to the Gen1. Court of this Commonwealth being assembled this second day of November for the purpose of givein their Votes for five Repre- sentatives to the next Congress of the United States, one of whom must be an Inhabitant of the County of Suffolk, one of the County of Essex & one of the County of Middlesex, one other may be an Inhabitant of either of the Counties aforesaid, and the other may be an Inhabitant of any part of the Commonwealth, excepting that part formerly call'd the Province of Maine ; And also for givein their Votes for five Persons as Electors of President and Vice Pres- ident of the United States, agreeable to Warrants signed by the Selectmen.

The Freeholders and other Inhabitants of the Town of Brain- tree being assembled pursuant to Legal Warrants this second day of November the particulars are as follows after a moderator chosen


To see if the Town will addopt any measures in order to put a stop to the Inoculation of the small pox in this Town.


Assembled as aforesaid Dec". Holbrook Moderator.


Voted, that this Town will not consent that there be any more persons Inoculated in it for the small pox.


Voted to chuse a Committee of three who shall inform the Doc- tors of this vote and to apply to the Sessions to discontinue the Licence granted to the Doctors in this Town for inoculating Hos- pitals to be opened for the small pox. Then Mr. Caleb Hayward Eben". Thayer jun. Esq. and Majr. Stephen Penniman was chosen for said Committee.
